1.0 INTRODUCTION

This Community Relations Plan (CRP) describes issues that are ofinterest or concern to local community members regarding theHalby chemical Superfund Site in Hew Castle County, Delaware.The plan also recommends community relations activities to beconducted by the U.S. Environmental Protection Agency Region III(EPA) during the Superfund remedial activities at the site. Thecommunity relations program outlined in this plan focuses onactivities designed to establish and maintain open communicationamong interested parties and involved agencies. It alsosuggests methods to ensure that information about site-relateddevelopments and activities is provided to the public in atimely manner.This plan is divided into the following sections:

o Site Background and Key Issues;o objectives of the Community Relations Program at the

Halby Chemical Site;o Community Relations Activities; ando Preliminary Schedule and staffing Plan.

The first three sections of the plan are based on:o Previous investigations;o Results of current Superfund studies and assessments;

and

o Information obtained during interviews conducted onMarch 13 and 14, 1991 with local officials, residents,and adjacent business and property owners.

The schedule and staffing plan coincides with technical mile-stones scheduled for the site from the completion of theRemedial Investigation/Feasibility Study (RI/PS) throughimplementation of the remedial action.A mailing list of local, State, and Federal officials; membersof the community; and media representatives is included inAppendix A. Individuals consulted during the preparation ofthis plan are indicated on this list. Appendix B suggestspossible locations for information repositories and forconducting public meetings during remedial activities at theHalby Chemical Site.

2.1 SITE DESCRIPTION

The Halby Chemical Site consists of approximately 14 acres ofland in Wilmington, New Castle County, Delaware*'. The siteis located in a highly industrialized area near the Port ofHilmington. To the northeast, northwest, and south, the ConrailRailroad, Interstate 495, and Terminal Avenue, respectively,comprise the bordering properties. Figure l-l shows thelocation and approximate property boundaries of the Halbychemical Site. Major site features are shown on Figure 1-2 andinclude:

o The former Halby Chemical plant, which includes a waste-water/runoff treatment system, two buildings, tanks tostore bulk chemicals,, drums, machinery, and a railroadspur. The buildings include a large three story steelstructure that housed the chemical plant and a threestory brick building containing office space, a machineshop, a motor storage room, and a warehouse for chemicaldrums.

o A lagoon is located at the northern part of the site.The lagoon was used to receive wastewater/runoff fromthe plant. The lagoon is breached along the northwestbank causing a direct hydraulic connection with thedrainage ditch which parallels 1-495. Prior tobreaching of the lagoon bank, the lagoon drained via anelongated 36-inch diameter pipe beneath the railroadtracks into the tidal marsh on the opposite side of thetracks. This pipe had reportedly been partially crushedand filled during repairs to the railroad tracks.

o A tidal marsh area is located adjacent to the site. Thetidal marsh is connected to the Christina River via theLobdell Canal. The marsh fluctuates 2-3 feet over eachtidal cycle.

o The 1-495 runoff ditch directs surface runoff from I-49Sto the Christina River, Because of the direct hydraulicconnection with the Christina River, both the ditch andlagoon are under tidal influence. Hater levelsfluctuate 2 to 3 feet with each tidal cycle.

o Two active large warehouses are located northwest of thechemical plant, One warehouse is used primarily tohouse an auto repair business, and the other warehouseis used to store steel,

o h residential area consisting of three trailer houses islocated northwest of the chemical plant along TerminalAvenue,

o Off-site areas consist of miscellaneous businesses, coaland petroleum coke piles, and storage facilities.

2.2 SITE HISTORY

From 1948 to 1977, sulfur compounds were produced at the HalbyChemical Site. During this period, the three principal productsproduced were ammonium thiocyanate, ammonium thioglycolate, andisooctyl thioglycolate.

From 1948 to 1964, all liquids, cooling water, surface water,and acid production wastewater from the Halby Chemical plantwere discharged to a drainage ditch, and subsequently into theunlined lagoon. The lagoon drained into the Lobdell canalthrough the marsh, and from there into the Christina River.

Between 1964 and 1972, only cooling water was reported to haveentered the lagoon, while the acid production wastewater wasdischarged into the sewer lines.

In 1972, Halby Chemical Company merged with and became part ofthe Argus Chemical Company, a wholly-owned subsidiary of theHitco Corporation. By 1975, Hitco periodically diverted theacid wastewater flow from the county sewer system to a pilotplant designed to treat wastewater from the plant. The treatedwastewater was discharged to the lagoon. The plant closed inAugust 1977 and the property was sold to Brandywine ChemicalCompany. At some time between May 1977 and June 1983, thenorthwest bank of the lagoon was breached and the lagoon nowdrains through the runoff ditch along I-49S to the ChristinaRiver during tidal fluctuations.According to property title records, a portion of the site(until 1969) and the adjacent properties (until 1974) were ownedby the Pyrites Company. Reportedly, the Pyrites Company mayhave used the property to store raw pyrite materials, whichcontained arsenic as an impurity,USEPA has also found from interviews with previous employeesthat arsenic was used on-site for Halby operations. Distearylthiodipropionate (DSTDP), a plasticizer and stabilizer used inplastics, was produced at the site for 10 years. DSTDPspecifications include arsenic and lead. Alkobane, a corrosioninhibitor, was also produced at Halby, which has a specificationthat Includes arsenic and sulfur. Halby was capable ofsupplying Alkobane in 100,000 pound lots by railroad tank car.

2,3 PREVIOUS INVESTIGATIONS Q

The Halby Chemical Site and the surrounding area have beenstudied by EPA, the State of Delaware's Department of NaturalResources and Environmental Control (DNREC), and the city ofWilmington. The off-site studies by DNREC (1985) and the cityof Wilmington (1986) concluded that the local groundwater vascontaminated at least in part from the bulk storage of petroleumcoke and salt. The on-site studies at the Halby Chemical Sitewere initiated in 1983 by DNREC. The DNREC Preliminary Assess-ment (PA) reported that nearby residents complained about lagoonoverflow, hydrogen sulfide-like odors in the vicinity of thesite, and numerous spills. In March 1984, EPA performed a SiteInspection (SI) of the site. Analytical results showed highlevels of organic and inorganic compounds. The SI signalled thebeginning of Superfund activities at the Halby Chemical Site.

In 1984 and 1985, EPA reviewed the site through the HazardRanking System (HRS). If a site scores 28.5 or higher, the siteis added to EPA's National Priorities List. In 1985, EPAassigned an HRS score of 30.90. The site was subsequentlyproposed for the National Priorities List in September 1985 andwas included on the final list in June 1986.The Remedial Investigation for Operable Unit No. 1 (OU-1) wascompleted in September 1990 and involved sampling soil, surface ,•water, groundwater, and sediment. Groundwater monitoring wells •were also installed to determine the nature and extent of thecontamination at or near the site and to study the geology andhydrogeology of the site.Contamination at the site is a result of the previous wastewaterdischarges and plant operations. Soil contamination wasdetected at the process plant outfall and within the chemicalplant area. Contaminants included heavy metals (arsenic, lead,and zinc), polynuclear aromatic hydrocarbons (PAHs), volatileorganic compounds (VOCs), and carbon disulfide. Contaminationof sediment was detected within the drainage ditch next to theprocess plant and evident throughout the lagoon and marshareas. Sediment samples collected from the marsh, lagoon,Lobdell Canal, and Christina river were found to be toxic tosome bioorganisms. Surface water did not pose a risk to humanhealth. However, surface water samples from the Christina Riverand marsh area were found to be acutely toxic to aquaticspecies. Site contaminants were also detected in the shallowgroundwater and were generally confined to within a few hundredfeet of the site.

EPA also completed a Risk Assessment in September 1990 todetermine the nature and extent of the threat to public healthand the environment.

"^ The main concern at the Halby Chemical Site is the chemicalexposures through a number of present and future pathways thatnay result in potential adverse health effects. The exposurepathways of concern for on-site workers and residents includedirect dermal contact and ingestion of surface soil from thechemical plant area, inhalation of suspended soil particulates,denial contact and ingestion of sediment from the lagoon and themarsh, and inhalation of volatiles in the atmosphere and thosereleased from groundwater.A Feasibility Study (FS) for Operable Unit No. 1 (OU-1) wascompleted in April 1991 using the information obtained from theRemedial investigation and the Risk Assessment. The FS for OU-levaluated and developed remedial alternatives for an appropriateRemedial Action for the soil at the chemical plant area and thesediment in the lagoon, drainage ditch, and plant outfall area.A FS for Operable Unit No. 2 will be performed for the ground-water and the sediment in the marsh area.

2.4 HISTORY OF COMMUNITY INVOLVEMENT

Interviews with State and local officials, longtime residents ofthe area (over 30 years), and business and property ownersreveals no evidence of individual or organized communityinvolvement over the past ten years pertaining to the HalbyChemical Site. This lack of involvement can be partiallyattributed to increased isolation of the site from the communityafter construction of a nearby 1-495 section of roadway.

Besides the present isolation of the site from the community,the site location among other industrial facilities in the areamay contribute to the relative lack of community interest.Other contributing factors may be that chemical production atthe site ceased in 1977 and activities now occurring at the siteare limited to the warehousing of chemicals.

According to the DNREC Preliminary Assessment written in 1983,there had been site-related complaints prior to the past tenyears from nearby residents about lagoon overflow, hydrogensulfide-like odors in the vicinity of the site, and numerousspills. The recent interviews with residents and business owners in the ,'immediate vicinity confirmed that the H&lby Chemical Site hadbeen a cause for concern when chemicals were produced. Severalproperty owners mentioned that the chemical fumes caused paintto peel from buildings and the noxious odors were intolerable onoccasion. None of the interviewees currently perceived a publichealth risk associated with the site, nor had local officialswith the city of Wilmington and Hew Castle Council receivedcomplaints or inquiries about the Halby site.2.5 COMMUNITV CONCERNS

Although there appears to be no present community concern aboutthe Halby Chemical Site based on the community interviews ofMarch 13 and 14, 1991, it is believed that site contaminationproblems have the potential to arouse community concern giventhe findings of the Remedial Investigation and Risk Assessment.The problems include soil, groundwater, surface water, andsediment contamination. The issue is compounded by the factthat other sources of potential contamination are present in theproject area. Contamination from contact with on-sitecontainers, tanks, drums, pipes, and buildings also could arousecommunity concern. A fence erected around the chemical plantsite prevents access to these materials and they are adequatelycontained to prevent off-site migration. However, the lagoonand affected tidal marsh area are not fenced. ( * \Consequently, issues that might eventually cause concern amonglocal residents include the potential contamination of ground-water currently used for drinking water purposes; impairment offuture groundwater use; the potential contamination of localaquatic life, including blue crab and various fish species; ordirect contact with hazardous substances in the contaminatedsurface water, sediments, and soil. The economic effect of sitecleanup is also of concern to on-site and adjacent businessowners who may be affected (i.e., displaced temporarily orpermanently) during or after site cleanup.3.0 OBJECTIVES OF THE COMMUNITY RELATIONS PROGRAM AT THE HALBY

CHEMICAL SITE

A primary objective of the community relations program at theHalby Chemical Site is to provide the community with anopportunity to learn about and participate in the superfundremedial process. Another important objective is to provideavenues of communication among local citizens and local, State,and Federal officials. Community relations efforts should focuson providing accurate and timely information about findings anddevelopments at the site and ensuring effective coordinationamong local, State, and Federal officials. Maintaining closecontact with the community and following any media coverage ofthe site throughout the RI/FS will help ensure that EPA

nunity relations staff are aware of any shifts in communityconcerns regarding the site. Recommended approaches forcommunity relations activities at the Halby Chemical Site arediscussed in detail below:1. Ensure active coordination of activities among Federal.

State. and local agencies. Since the Halby Chemical Sitecomes under the jurisdiction of several different regulatoryprograms monitored by different agencies, it is importantthat State and local officials be kept apprised of EPA'sactivities and findings at the site. This effort will allowthese officials to respond more effectively to citizen'sinquiries and to make appropriate referrals as necessary.By coordinating information and activities among theconcerned agencies, the EPA will help citizens to betterunderstand the role and authority of each of the agenciesinvolved at the site.

2. Provide accurate and timely information about the remedialactivities to the community and to State and local officialsand other interested parties. To keep citizens and respon-sible officials informed of site activities, concise andeasily-understood information should be made availableregarding the schedule, purpose, and outcome of technicalactivities. Where information cannot be released to thepublic, a clear and simple explanation of why the informa-tion must be withheld should be provided. By identifyingspecial situations where more detailed information may berequired or where certain types of information are requestedby individuals or groups, EPA community relations staff willbe able to address citizen concerns or inquiries morequickly and efficiently. For example, owners of propertieswhere samples are taken should be provided with follow-upexplanations of what tests were performed and what sampleanalyses revealed, site-related information nay bedisseminated through public and informal meetings, newsreleases, fact sheets, and the information repositories.

3. Identify a central contact at EPA. The EPA Region IIISuperfund Community Relations Coordinator can provide timelyand consistent responses to any questions raised by arearesidents, local officials, or the press concerning theHalby Chemical Site. The Community Relations Coordinatornamed in Appendix A is the EPA's primary contact person forthe community at the Halby Chemical Site.

4. Inform area residents and local officials about the proce-dures. policies, and requirements of the Superfund program.By circulating basic information about the Superfundprocess, EPA community relations staff will be able to avoidany confusion about EPA's purpose or responsibilities at thesite. This information should be distributed to interested

citizens and local officials and to the news media. It ("should also be placed in the information repositories. Some 'suggested topics to address include the different roles andresponsibilities of the EPA and the State, and EPA'sSuperfund remedial action process, and general informationabout the enforcement process.

4.0 COMMUNITY RELATIONS ACTIVITIES

The following is a list of community relations activities whichmay be conducted during remedial activities at the Halbychemical site in order to encourage communication between EPAstaff and area residents, ensure that the community is providedwith accurate and timely information, and enable interestedcitizens to participate in the remedial program. This list ofactivities serves as a starting point for the communityrelations program at the site and may be subject to change assite work progresses.

1. Establish and maintain information repositories and anadministrative record.purpose; TO ensure that site-related information isavailable to interested citizens.

Contents; Fact sheets, technical summaries, site reports .....(including the Work Plan, Community Relations Plan, RI v,.,1Reports, FS Reports, and Proposed Plan), general informationon the Superfund program, and any other relevant documents.Location! New Castle County Council Office and theHilmington Institute Library. (See Appendix B foraddresses, phone numbers, and contact persons.)

2. Designate an EPA contact person.

Purpose; To provide accurate and timely responses toquestions from citizens, local officials, the press, andother news media, and to ensure that information provided tothese groups is consistent.Responsibilities; To respond directly to public inquiriesregarding site activities and to maintain the informationrepositories.

3. conduct briefings for state and local officials.Purpose ; To inform key State and local officials of theschedule of activities and any major findings that occurduring the completion of remedial activities at the HalbyChemical Site.
