I. Jose can ask Juan to perform the obligation which is the payment of P20,000.00. Failure of Juan to pay the P20,000.00 does not make juanito liable to Jose, because even if Juanito wrote a letter to Jose, stating that he shall settle Juan’s obligation; it is subject to a suspensive condition which did not happen making Juanito not liable for the payment of P20,000.00. since the obligation is a generic thing, Jose can ask for damages resulting from breach of contract II. In application of payment the debtor has the right to choose to which obligation or debt, the payment should be applied unless it is expressly given to the creditor. However, in that case PGMA, the debtor had not specified the debts to which the payment should be applied and some with Normita, the creditor. So the partial payment must be applied to the most onerous obligation. It must first be applied to a debt in which the debtor is solidarily liable because it is more onerous in the sense that the debtor can be compelled to pay the entire amount. Next, it should be applied to a debt secured with a mortgage of debts property since failure to pay such debt will result to foreclosure of the mortgaged property. Next is that if should be applied to debt bearing interest since failure to pay such debt will result to additional liability because of the accrual of interest until it is paid. And lastly is should be applied to unsecured debt since it is not secured by any motgage and it bears no interest. III.
