ILLEGAL RECRUITMENT:
- Considering the dismal conviction of illegal recruiters despite the stiffer penalties provided for by our existing laws, we will focus on
improving the implementation of all preventive illegal recruitment measures.
- We will increase protection for OFWs before their departure and also while they are abroad, through provisions of free legal and social
services.
- Through the POEA, together with POEA and OWWA, we will also intensify public information programs on migration and distribute
comprehensive, easy-to-use guidebooks that outline migrant workers' rights and a detailed step-by-step procedure on how to assert these
rights.
- We will further pursue the prosecution of those involved in illegal recruitment. Through the Task Force Against Illegal Recruitment
(TFAIR) [see EO 759 series of 2008] under the Office of the Vice President; we will post and publish photographs of top illegal recruiters in
government offices and other strategic places. We will also push for the creation of special courts to speed up the hearing and resolution of
illegal recruitment cases.

HIGH PLACEMENT FEE:
- We will study and pursue possibilities to standardize the "placement fees" charged by the recruitment agencies to prevent
overchanging and solicitation of other unnecessary fees from the applicant.
- There should be a strict monitoring and feedback system made available to the OFWs to report cases of abuse or overchanging by
recruitment agencies. The resolution of the cases files should be swift and definitive, with no opportunity for corruption.
INABILITY TO SAVE MONEY:
- We will promote the financial wellness of out OFWs. We shall proactively encourage support, and incentivize domestic investment
decisions of OFWs, especially in real estate, capital market, insurance investments, and other asset-building initiatives.

RISK OF MASS LAY-OFF IN CASE OF ECONOMIC TURMOIL:
- We will protect the rights of OFWs to security of tenure with their employers and to claim rightful separation benefits. We will provide legal
support and labour liaisons through POLO-OWWA arm to ensure agreements with foreign employers are kept and honoured.
- We will establish a Roadmap on Workforce Engagement focusing on two tracks: (1) local employment and (2) local enterprise
building. This roadmap shall become a reintegration plan for OFWs who wish to return to the country. This will be in support of the
enhanced reintegration services by DOLE, accessible through the regional offices.
- This should start with intensive capacity building and awareness campaigns for better personal financial management .
- The government shall also build upon S.B. 1421 or the Act Establishing a Credit Asssistance Program for Overseas Filipino Workers,
and design programs to widely distribute the benefits of similar policies.
EMPLOYER ABUSE:
- We shall enhance personnel and service availability in foreign jurisdictions, provide mobile consular services as often as possible,
and survey jurisdictions with additional need for POLO-OWWA officers.
- We shall strategically map out the presence of OFWs abroad, especially in cities distant from capitals, where embassies or consular
offices are located.
- In case of difficulty in establishing consular offices, in port cities in particular where many Filipino seafarers dock, we shall tap Honorary
Consular Officers , or such upstanding Filipino Community (FilCom) members with a heart for service. All foreign posts shall also make
24-hour hotlines available and ensure that embassy officers are accessible to OFWs at all times.
-We shall make the Assistance to National Fund (ATN) and Legal Assistance Fund (LAF) fully accessible to distressed Filipinos,
especially in emergency cases.
CORRUPT AIRPORT OFFICIALS AND STAFF:
- We will suspend erring officials and, if after due process they are proven to have illegally engaged in extension schemes, then we will
immediately terminate them and enforce necessary legal punishments.
- We will also create a reporting hotline specifically for OFWs and their kin which should be their first and main go-to system if they know
they are engaging with or have encountered corrupt airport officials and staff.
- We will intensify surveillance and monitoring systems, and create third-party councils to objectively and swiftly litigate cases raised
against corrupt officials.
IMPOSITION OF TAXES AND CUSTOM DUTIES ON BALIKBAYAN BOXES:
- We stand by two positions on Balikbayan boxes: (1) BoC or any agency will not 'physically open' the Balikbayan Boxes for inspection, and
(2) There will be no additional taxes and duties imposed.
- We will observe the existing legal parameters set in Section 105 of the Tariff and Customs Code of the Philippines, which states
Balikbayans/OFWs are entitled to Duty and Tax Free Privileges.
- We will support passage of the current bill filed by Senator Ralph Recto, Senate Bill No. 2913 or the Balikbayan Box Law, proposing to
raise the non-taxable value of contents for Balikbayan Boxes to P150,000.
- To resolve revenue losses form smuggling, we will refocus the efforts of BoC to big smugglers and not on intrusive "selective opening" of
boxes. We will invest more on technological maintenance and upgrading of X-ray scanners which should eliminate manual inspection -
from small boxes to 40-by-20 feet shipping containers.

BROKEN FAMILIES/CHILDREN INABILITY TO FINISH STUDIES:
- Ultimately, we should to build an economy where Filipinos will not have to leave their families in for better opportunities. But we should
continue to support the families of OFWs in the meantime.
- We will create a streamlined system of government support services for OFWs. These should be available through the Social
Development and Welfare Assistance Centers for OFW families proposed through House Bill 2466.
- We will expand the educational scholarships for OFW dependents (or the OFWDSP), through DepEd and OWWA. We will also include
the children of OFWs in the beneficiary-targeting system of the new UNIFAST Law.
- We recognize that the government cannot do this alone - therefore we will engage the private sector and civil society to address
challenges brought about by familial separation for economic betterment.
TERRITORIAL CLAIM OVER WEST PHILIPPINE SEA:
- We will stand by our territorial claims and pursue fair arbitration of our case in the international court.
- While it is important to establish our territories, we will continue to build economic, cultural, and diplomatic ties to preserve and promote
the welfare of our nationals in labor-receiving countries.
- We will also adhere with the labour policies promulgated through the ASEAN integration, promoting a 'freer' flow of skilled labour,
establishing a highly competitive single market.
ESTABLISHMENT OF AND PROVIDING BUDGET FOR MIGRANT AND OVERSEAS RESOURCE CENTER:
- We support the establishment of more resource centers for our OFWs. This is aligned with our thrust to bring services closer to Filipinos
abroad.
- We will invest on establishing more resource centers for both our land-based and sea-based OFWs.
- We will ensure that our OFWs are fully aware of and engaged with services available to them. We will intensify information campaign by
working closely with OFW communities and empowering our Labour Attaches to better understand the needs of the Filipinos abroad.

ILLEGAL RECRUITMENT:
I voted to approve R.A. No. 10022 which continues to penalize illegal recruitment by a syndicate or when committed in large scale with life
imprisonment. It is committed by a syndicate when it is committed by three or more persons and it is committed in large scale when it is
committed against three or more individuals.
Illegal recruitment can further be curbed by streamlining government processes which our OFWs are required to undergo to be legally
employed overseas. At times, bureaucratic difficulties push our workers to engage the services of illegal recruiters who tempt them with
faster deployment.
I authored Senate Bill No. 63 proposing a National Land Use Plan/Policy Act which requires the establishment of a national full
development plan that is in essence and in effect, a National Full Employment Plan. It envisions every Filipino to have gainful employment
in our homeland.

HIGH PLACEMENT FEE:
The placement fee for our OFWs should not be more than the equivalent of one month's salary of the employee. Although presently, no
placement fees are allowed to be collected from domestic helpers, caregivers, and seafarers, and those to be deployed in countries such
as Canada, United Kingdom, US (Temporary Non-Agricultural Workers), Ireland, and the Netherlands, the Philippines should aim for what
is provided in the Convention 181 of the International Labour Organization which does not allow recruitment agencies to charge any fees or
costs to workers.
The POEA and the DOLE should strictly suspend or revoke the licenses of recruitment agencies that charge excessive placement fees.

The government must timely and accurately anticipate global conditions which may lead to economic turmoil. Mechanisms must be in
place for mass repatriation of our workers should it become necessary. But before such conditions occur, our OFWs must be made to
realise to begin saving money as early as possible. As stated above, government must provide our OFWs and their families more financial
literacy and management seminars so that they can have safety nets should they suddenly be repatriated. A savings equivalent to six to
twelve months worth of salary should be aimed for as early as possible.
INABILITY TO SAVE MONEY:
The Philippine Overseas Employment Administration, The Department of Labor and Employment, the Overseas Workers and Welfare
Administration, and the Philippine Overseas Labor Offices abroad should conduct more financial literacy and management seminars for our
OFWs before they are deployed and also for those already abroad. They should be guided to the proper investment opportunities and also
be made aware of options such as forced savings to be deducted from their salaries if they so choose. More families of OFWs should be
invited to attend financial literacy and management seminars as well.
EMPLOYER ABUSE:
The government must ensure that OFWs are properly informed of the laws and cultures of their host countries before they are deployed,
particularly of their rights against abuses committed by employers. The Philippine Overseas Labor Offices should spare no resource in
periodically monitoring the conditions of our OFWs, especially our women who are domestically employed and are very vulnerable to
abuse. Employers must be screened thoroughly to ensure that they do not have prior records of abusing their workers before workers are
deployed to them. Government must ensure that assistance in case an OFW is subjected to abuse.
CORRUPT AIRPORT OFFICIALS AND STAFF:
The penalty of reclusion perpetua must be imposed on airport officials who plant ammunition in the belongings or the person of any
innocent individual as provided in Section 38 of Republic Act No. 10591 or the Comprehensive Firearms and Ammunition Regulation Act.
After the arrest, where the evidence of guilt is strong, he shall not be allowed to post bail and remain in detention during trial. Any form of
extortion should be punished with the full force of the law.
IMPOSITION OF TAXES AND CUSTOM DUTIES ON BALIKBAYAN BOXES:
The government should not impose taxes and customs duties on balikbayan boxes containing personal and household effects which do
not exceed One Hundred Fifty Thousand Pesos three times a year. The Senate is poised to approve the Customs Modernisation and Tariff
Act on third reading which provides for such exemption provided that the contents of the balikbayan boxes are neither in commercial
quantities nor intended for barter, sale or hire.
BROKEN FAMILIES/CHILDREN INABILITY TO FINISH STUDIES:
The government must provide more counselling services to the families of our OFWs. It has been reported in a study of the impact on
OFW's family separation by the National Association of Colleges that one in every four OFW families end up broken and two in every five
children of OFWs do not finish college because of lack of parental guidance. Our families must be kept together.

TERRITORIAL CLAIM OVER WEST PHILIPPINE SEA:
Utmost care must be exercised by the government in pursuing our claim in the West Philippine Sea as our actions and statements affect
our OFWs especially those working in other claimant countries. All efforts must be exerted towards a peaceful settlement of the dispute in
the West Philippine Sea. Channels of the communication must be kept open between contending parties. Often, public interest is best
served when negotiations of this nature are kept confidential between property authorised officials of the parties.
Moreover, we should audit all our existing treaties and agreements with other countries in relation to National Security.
ESTABLISHMENT OF AND PROVIDING BUDGET FOR MIGRANT AND OVERSEAS RESOURCE CENTER:
Due to recent reported abuses committed by government officials abroad against our OFWs, the government must strictly implement the
recently issued Joint Manual of Operation for Migrant Workers Resource Centers. It provides that "The wards shall be prohibited from
engaging in any work inside or outside the Center, whether full time or part time, whether with or without remuneration, while under the
custody of the Center. Likewise, they shall not be allowed to work in the households of the Embassy/Consulate, and POLO officers and
other staff, or do personal errands for any of them, or for the Center Coordinator."
I voted to approve R.A. No. 10022 which provides that it is imperative that an effective mechanism be instituted to ensure that the rights
and interest of distressed overseas Filipinos and Filipino migrant workers are protected and safeguarded. It further established a Legal
Assistance Fund for Migrant Workers in the amount ot P100,000,000 which should be replenished yearly by the GAA.

- It is tantamount to economic and betrayal of public trust --- and should be meted stiffer fines to deter the nefarious practice
- Has filed SenateResolution NO. 1352 which is calling for the review of Republic Act 10364 or the Expanded Anti-Trafficking Act of 2012

- Look for ways to arrive at standardized placement fees with subsidy;
- The economy is benefiting much from the dollar remittancesof our OFWs. They are considered as our modern-day heroes. It is just and
proper that the government should provide subsidy to the placement fees of OFW.The subsidy should be applied for by the applicant OFW
before making any payment to the recruitment agency. The program will serve two purposes: (1) It will ease the burden at high placement
fee to our OFW; (2) The government, through the POEA, can monitor the activities of recruitment agencies as the application for subsidy
will reveal the applicant's recruitment agency.

- Consulates and embassies need to be fitted with sanctuaries/halfway homes for OFWs;
- Full implementation and strengthening of the Migrant and Overseas Resource Center to assist OFWs in distress and help them in their re-
integration in the Philippines;
- The fight rules ofthe Commission on Audit restricts the government from helping OFW in distress abroad who needs financial assistance.
COA should liberalize its rules to remove clogs that prevent the timely release of funds for assistance to OFWs who are in need for various
reasons.
The overseas employment program was a creation under the administration of President Marcos. But the original program was only a stop-
gap measure to provide employment for our people while we developed our industries and modernized our agriculture. However, it became
a major economic policy and we are now highly dependent on OFW remittances. The government should give utmost priority to the
creation of jobs in the country to provide alternatives for our OFWs. Thus, I filed in the senate SB No. 1862, An Act Establishing the inter-
Agency Council for the Creation of Jobs, Defining its Power and Functions, Appropriating Funds. Therefore and for Other Purposes."
INABILITY TO SAVE MONEY:
- According to a Bangko Sentral ng Pilipinas (second quarter 2015) survey, only 49.7 percent of the households surveyed revealed that
their remittances are put in savings and only 6 percent put it in investments.
- Being so, there should be a program that will encourage OFWs to save through higher interest rates and faster rate of returns. This
includes giving OFWs with enough know-how to engage in investment initiatives through seminars and conferences here and abroad;
- Setting up a comprehensive plan including skills training and business matching to encourage OFWs and their families to set up their own
business in the Philippines to augment family income, provide a stable alternative and put their money into better use;
EMPLOYER ABUSE:
- Strengthen Standard Employment Contracts with each host country that will provide sufficient protection to Filipino workers;
- Setting up of a legal fund to assist OFWs in distress;
- Strengthen legal arm of employers and consulates to help OFWs, ensure that they will not surrender their passports and such documents
to employers who are not to exploit and abuse them.
- As most of the abuses happens to OFWs with no proper documentation, agencies like the Department of Foreign Affairs (DFA) and the
Department of Labor and Employment (DOLE), the Overseas Workers Welfare Administration (OWWA) should come up with a more
stringent process to ensure that no Filipinos will leave the country with incomplete documents.
- Test and evaluation of prospective OFWs on the Comprehensive Pre-Departure Education Program to determine if they really understand
the unique culture language, customs including laws of their host country;
CORRUPT AIRPORT OFFICIALS AND STAFF:
- PAO lawyers booths should be permanent fixtures in our airports to assist OFWs;
- Strict implementation of security in our airports;
- One strike rule on erring officials and staff, immediate suspension of personnel pending investigation of any corruption charge, strict

- High resolution CCTV to be installed to cover all areas in the airport;

IMPOSITION OF TAXES AND CUSTOM DUTIES ON BALIKBAYAN BOXES:
- The origin of the balikbayan boxes can be traced to the time of President Ferdinand Marcos when section 105 of the Tariff and Customs
Code of the Philippines was amended to provide duty and tax-free privileges to OFWs so they can send personal effect to their families.
Our OFWs have sacrificed and risked so much, and continue to do so for the benefit not only of their families but of the entire country as
well. Hence, they most certainly deserve special tax and customs treatment from the government. Balikbayan box is equivalent to a love
letter of an OFW to his/her spouse and the rest of the family and every item in the box is bought with endearing and loving purpose.
Balikbayan box is not so much its contents, but rather the sacrifice that it embodies andthe sentimentalities that is expresses.
- Welcomes the increase in the tax exempt value of balikbayan boxes. Continuous evaluation on further increasing the tax exemption to
cope with inflamation.

- Setting-up of psychological/guidance center in OWWA tasked to assist families undergoing separation anxiety asaresult of one or both
parents working abroad;

ILLEGAL RECRUITMENT:
In the Senate, Senator Trillanes is the principal author of RA 10364 or the Expanded Anti-Trafficking in Persons Act. This law seeks to
address the loopholes of RA 9208 and the human trafficking in the country particularly in disaster areas where women and children are
easy preys for unscrupulous groups. The law (1) strikes out the confidentiality provision that protects those who are charges of human
trafficking; (2) creates a permanent secretariat for the Inter-Agency Council against Trafficking (IACAT); (3) provides direct funding for the
IACAT's Secretariat.

Senator Trillanes has filed Senate Bill No. 1147, which creates a character for the Overseas Workers Welfare Administration (OWWA).
OWWA is the lead agency tasked to promote and protect the welfare of our OFWs and their dependents. OWWA is in charge of making
sure that the placement fees collected among out OFWs are reasonable.

RISK OF MASS LAY-OFF IN CASE OF ECONOMIC TURMOIL:
Displaces OFWs can have access to livelihood loans to provide alternative source of income. In the interim, displacement subsidies can be
shouldered by the government.
INABILITY TO SAVE MONEY:
Senator Trillanes is proposing a pension fund for OFWs as well as access to livelihood loans. He is pushing for financial management
programs that could teach our OFWs the value of saving and growing their hard earned money.
EMPLOYER ABUSE:
Strengthen the capacities of the OWWA, Department of Labor and Employment (DOLE) and Department of Foreign Affairs (DFA) in
pursuing charges against those responsible for the abuses of our OFWs. Additional funds should also be allocated to
consulates/embassies for legal services.
CORRUPT AIRPORT OFFICIALS AND STAFF:
Support avenues or help desks where the OFWs can file their complaints against erring airport officials and staff; install more CCTVs. As
regards the "tanim-bala" cases, as a policy, bullets found should be confiscated but the passengers should be allowed to depart.
IMPOSITION OF TAXES AND CUSTOM DUTIES ON BALIKBAYAN BOXES:
The previous rates should be retained while a comprehensive study is being made.
BROKEN FAMILIES/CHILDREN INABILITY TO FINISH STUDIES:
Though the local government units, Department of Education, Commission on Higher Education, as well as seeking support of the private
and non-government organizations, widen the dissemination of information on government and non-government sponsored scholarships
and how to avail them.
TERRITORIAL CLAIM OVER WEST PHILIPPINE SEA:
Senator Trillanes is full supportive of the government's foreign policy of pursuing a peaceful resolution of the territorial disputes through the
arbitration case filed at the Arbitral Tribunal at The Hague. At the same time, the government should fast track the modernization of the
AFP.
ESTABLISHMENT OF AND PROVIDING BUDGET FOR MIGRANT AND OVERSEAS RESOURCE CENTER:
Section 19 of RA 8042 mandates the establishment of Migrant Workers and Other Resource Overseas Filipino Resource Center. In case
there is a need to augment its budget, government must provide for it.
