The meeting started in the Cantonment Board office with the PCB welcoming all themembers present. With the permission of thc President, following agenda were introduced anddecided upon in that order: .

Agenda No.1: BUILDING APPLICATION

To consider application of Sh. Mohammad Maqbool Bhat and Sh. Altaf Hussain Ss/o Sh.Abdul Aziz Bhat RIo l lousc No. 186, Sonwar, Ward 5 for regularisation of construction on landbearing Kh. No. 632 at Sonwar. The applicant was found constructing the building without permissionof this Board. Thc offender was then asked to stop unauthorised construction vide notice undersection 239 dated 31 $1 Dec, 2016. The offender then applied for regularisation of the unauthorisedconstruction. The 0130. Srinagar has certified that thc land involved in the construction is private videtheir letter No. DEO-B P/SO W A RI 104/1716 dated 29 May, 20 17.

The case was placed before the Board which vide CBR No. 250) dated 10.10.2017 resolvedthat building committee Bel shall visit the site and submit its recommendations to the Board. Thereport of BC I is placed before the Board according to which the applicant has not left any fire gapfrom north east and north west side. The site was inspected by the CEO and it was observed that thebuilding plans earlier submitted by the applicant did not match \\ ith the already constructed buildingwhich was brought before the Board in its meeting dated 27.02.2018. Thus, the building plans werereturned to the applicant ide letter 0. CI3IBP/32/Sonwar/5141 dated 03 March, 2018. The applicanthas resubmitted the building plan on 01) March, 2018. The drawings were found as per theconstruction already made. However. the applicant has not left. any setback on two sides. Further, theFSI is 2.047. If approved, the applicant is liable to pay construction fee as under:

Resolution No.1:

The Board approved to rcgularise the construction and to compound the offence u/s 247 of theCantonments Act, 2006. The Board proposed a sum of Rs. 86,544/- as building sanction charges asdetailed on agenda side including an amount of Rs. 64,060/- as compounding fee under first provisoof section 248 of the Cantonments Act, 2006.

Further, the Board approved to send a proposal to the GOC-in-C, Northern Command undersecond proviso to Section 248 of the Cantonments Act, 2006, for his concurrence to accept the sum byway of composition as the building. is on private land which is not under the management of theBoard.

Agenda No.2: REVISION OF PAY OF CANTONMENT BOARD EMPLOYEES ANDPENSION OF P}~NSIONERS/FAMJLY PENSIONERS (SEVENTHPAY COMMISSION)

The Finance Department, Go t. of J&K has notified the Jammu and Kashmir Civil Services(Revised) Pay Rules, 2018 vide SRO 193. SRO 194 dated 24.04.2018. The rules shall be deemed tohave come into force on the 1'1day of" January, 2016. These rules shall apply to persons appointed tocivil services and posts in connection with the affairs of the State including whole time contingentpaid workers/work charged employees drawing pay in graded scales whose pay is debited toconsolidated fund of the State.

The pay and allowances of the Cantonment Board employees have been equated with that ofvarious posts under the Govt. of J&K to which the said rules apply. Thus, the pay and allowances ofthe Cantonment Board employees may he revised in accordance with the said rules and amendmentsthereto, if any, w.e. f. 0 1.01.2016.·

Further, the Govt of J&K vide G.O. 0.220-F of 20 18 dated 24.04.2018 has ordered that thearrears of all the employees including those appointed on or after 01.01.20 I0 governed under NewPension Scheme on account of revision 'of pay of State Government employees for the period01.0 1.2016 to 31.03.20 18 shall be drav n and credited to their G.P Fund accounts.

Since the employees 01 the Cantonment Board who were appointed after 01.01.2004 aregoverned by National Pension Scheme, they do not have any GPF account. The arrears on account ofpay revision may be released to these employees. For other employees, the arrears may be credited totheir GP Fund account.

Further, the Finance Department, Govt. 01 J&K issued G. O. No. 222-F 01 2018 dated24.04.2018 vide wh ich pension structure lor pre 01.01.2016 pensioner / farni Iy pensioners have beenrationalised. The same may be implemented in respect of the Cantonment Board pensioners.

Also, the Govt. ol.l&K issued G. O. No. 223-F of 2018 dated 24.04.2018 vide which theschedule of payment 01 arrears 01 pension on account 01 revision of pension of State Governmentpensioners has been noti fied. Since tile provision for payment of arrears of pension on account ofrevision of pension 01 Cantonment Board pensioners has already been made in Budget 20 18~19 (0)and sanctioned by the GOC-in-Chief: C, the arrears may be released to the pensioners immediately.

The Board may approve to send a proposal to this effect to the GOC-in-Chief, NC through thePO, DE, NC under Rule 45, 46 and 47 of the Cantonment Account Code, 1924 and to incurexpenditure under Rule 19(b) of the Cantonment Account Code, 1924

Resolution No.2:

The Board considered and approved to send a proposal as mentioned on the agenda side forrevision of pay of Cantonment Board employees and pension of pensioners/family pensioners witheffect from 01.01.2016 to the GOC-in-Chief, NC through the PO, DE, NC under Rule 45, 46 and 47of the Cantonment Account Code. 1924 and to incur expenditure under Rule 19(b) of the CantonmentAccount Code, 1924.

Agenda No.3: GRANT OF EIGHT ADVANCE INCREMENTS TO SHRI TARIQAHMAD KllANDEY, JUNIOR ENGINEER

Refer PCB approval dated 15.10.2005, CBR No. 170 dated 30.04.2007, CBR No.7 dated06.07.2015

Shri Tariq Ahmad Khanday was appointed as Junior Engineer on 26.1 1.200 I in BadarnibaghCantonment Board. l le is a degree holder (B. L) in civil engineering from Bangalore University. ShriKhanday requested to grant him R ad ancc increments admissible to degree holders in Engineeringemployed by the Govt. of J&K.

A proposal was sent to the Pl)DI~, Con 19.10.2005 for grant of 8 advance increments afterobtaining PCB approval dated 15.10.2005. The proposal was returned with observations. After aseries of correspondences on the matter, the PDDE, NC, vide letter dated I 1.08.2014, advised forsubmitting a fresh proposal de-novo duly approved by the Board.

The matter was placed before the Hoard which vide CBR No.7 dated 06.07.2015 constituteda three member Committee of elected members to verify/peruse all connected documents along withgenuineness of degree certificate of Shri Tariq Ahmad Khanday, .I.E. and the direction of the Hon'bleHigh Court in SWP 0.208/2015. The genuineness of his degree certificate bearing No. No. M33-£-B I-GH-2540 (Registration o. 92IIA036) has been verified from Bangalore University. TheCommittee has also submitted its recommendation that the degree certificate of Shri Tariq AhmadKhanday, J. E. is genu inc.

All appointments to services under Badarnibagh Cantonment Board are governed by theCantonment Fund Servant Rules. 11)17 (CFS R, 1937). Further, the pay and allowances of Cantonment

Fund servants have been equated with that to various departments of the Govt. of J&K throughMemorandum of Settlement (MoS) arrived at between the Cantonment Boards and Employee Uniondated 13.05.1969.

The Govt. of J&K notilied the J&K Civil Services (Revised Pay) Rules. 1998 vide SRO 18dated 19.01.1998 which were made effective from 01.01.1996. Rule 15(g) of the said Rules providedspecial treatment for the post or-Junior l.nginccrs and stipulates that-

"All the Junior Engineers. present in the pay scale of Rs. I 76()-3200 will beplaced in the revised pay scale of Rs. 5700-/0/00. The fresh recruitments to the postsof Junior Engineers (both Diploma & Degree Holders) will be made in the pay scaleof Rs . .J500-7000 and they will be placed in the revised pay scale a] Rs. 5700-/0/00after putting ill H years of service in the former scale. 711e Degree l lolders will beentitled to 8 advance increments on their initial appointment in the pay scale of Rs.4500-7000"

Since Shri Tariq Ahmad Khanday was appointed on 26.1 1.200 I, he was given pay scale ofRs. 4500-125-7000. Being a degree holder. 8 advance increments on his initial appointment in the payscale of Rs. 4500-125-7000 should have also been given to him. Ilowever. this was not given to him.

The estimated total financial implications on account of arrears in the event of grant of thesaid eight advance increments for the period from 26.1 1.200 I to 3 I .03.20 18 corne to Rs. 7,30,0001-.

The Board may consider and appro e to send a proposal to the competent authority i.e. theGOC-in-C, C through the PD. DI·:. C for sanctioning grant of eight advance increments to ShriTariq Aharnd Khandey. Junior l.nginccr w.e.f. his date of appointment i.e. 26.11.2001 under Rule 5 ofthe CFSR, 1937 and Rules 45. 46 and 47 and to incur expenditure under Rule 19(b) of theCantonment Account Code. 1924.

Resolution No.3:

Considered and approved to send a proposal as mentioned on the agenda side for grant ofeight advance increments to Shri Tariq Ahmad Khandey, Junior Engineer with effect from his date ofappointment i.e. 26.11.200 I to the (jOC-in-Chief, C through the PO, 0[, C under Rule 5 of theCantonment Fund Servants Rules. 1937 and Rules 45, 46 and 47 of the Cantonment Account Code,1924 and to incur expend iturc under Rule 19(b) of the Cantonment Account Code, 1924.

Agenda No.4: OI'ENINC OF BIDS UNDER RULE 173(xx) OF GENERALFINANCIAL RULES, 2017

Refer CBR 0.7 dated 25.04.2017

The Board vide CI3R under reference constituted a Committee to suggest modifications, ifany, required to be made in procedure adopted by the Board In public procurement. However, thesuggestions from the Committee arc still awaited.

Rule 173(xix) of GFR, 2017 says-Rejection of all Bids is just ified when:

(a) effective competition is lacking.(b) all Bids and Proposals IIr£' not substautiallv responsive fa the requirements of the

Procurement Documents.(c) the Bids iProposqls' prices (Ire substantially higher that the updated cost estimate or

available budget: or(d) none of the technical Proposals meets the minimum technical qualifying score.

Further, Rule 173( xx ) of' C; I·K 20 I 7 says-Lack of competition in rille 173(xix) shall 1101 be determined solely on the basis of the number ofBidders. Even when 011(1' one Hid is submitted, the process may be considered valid providedfollowing condit ions are .1'01 isfied:

(a) the procurement wltS satisfactorily advertised and sufficient lime was given for submission ofbids.

The Board has approved procurement through its various CI3R ICBR No. IOdated10.10.2017, CBR No. 16 dated 10.10.2017, CBR No.9 dated 20.11.2017, CBR No. II dated20.11.2017, CBR No. 13 dated 20.11.2017, CRR No. 15 dated 20.11.2017, CBR No. 26 dated27.02.2018] when only single bid \ as found technically valid as the bid was found to satisfy theconditions imposed by Rule 173(xx) or GFR. 2017. The technical bids for these procurements wereopened by the Technical l.valuation Committee (TEC) constituted by the Board.

To bring in more transparency. competition, fairness and elimination of arbitrariness in theprocurement process (Rule 173 or G FR, 2017), in case of open tender enquiry, the Board mayapprove that if only single bid is received or i I' technical evaluation of bids result in single technicallyqualified bid in the first call, the financial bid shall be opened if the estimated value of procurement isup to Rs. 5 lakhs; otherwise the bides) shall be rejected and tenders will be recalled. Further, iftechnical evaluation of bidis) result in single technically qualified bid-

(a) in the second call. the Board shall decide whether to open the financial bid or not.(b) in the third and subsequent calls, the financial bid shall be opened.

Resolution No.4:

The Board considered and approved to continue to open single bid received or singlequalified bid after technical evaluation under Rule I73(xx) of the General Financial Rules, 2017 if allthe conditions listed therein arc mel. lhc acceptance or lowest bid shall be based on reasonability orrates quoted by the bidder.

Agenda No.5: SUOP NO.4 SITUATED IN SONWAR, MANDLl~ GALl

Refer CBR No. 19 dated 22.06.2016.

The shop No.4 located in Mandir Gali, Sonwar was put to auction on 18.06.2016 and thehighest bid @ Rs 475/- per sf! WilS offered by Shri Ali Mohammad Dar S/o Shri Ghulam MohammadDar RIo Batwara (the licensee). lhc shop was allotted to the licensee under a contract agreementw.e.f. 12.09.2016 for a period or 4 years and 364 days.

The licensee reported that a huge amount of electric bill is outstanding against the shopbecause of which he is not able to gel electric connection for the shop. It was found that the earlierallottees of the shop i.e. Shri Manvoor Ahmad Rcshi (19.07.2007 to 18.07.20 I0) and Shri Mohd RafiqRather (16.04.2014 to 09.06.20 I 5) hav c not cleared their electricity dues for the shop wh ieh stands atRs. 43,852/- till the end or Feb. 1018. 130th the cx-allottccs were asked to clear the outstanding duesbut it has not been done till date. lhc AEE, Sub-division Sheikhbagh has informed that electricconnection to the shop shall not be provided until the dues are cleared.

The licensee has submitted an application that due to outstanding electric bill, he could notstart his business since the allotment or the shop. ow, the applicant has requested for termination oflicense and refund of rent deposited along with the security deposit.

The Board considered that due to non-provision of electric connection by the electricitydeptt., the shop has become unuvahlc which is resulting in loss of revenue to the Board. Online tenders were invited through c-procurcmcnt portal by the Board for repair of Roadsfor the year 2018-19.

In response to the tender notice. seven firms were found to have uploaded their bids.Technical bids were opened on 25.04.20 I!) and after scrutiny of documents, financial bids in respectof only three firms were opened as the other four firms did not submit all the requisite documents. The re-drafted bye-laws have already been circulated to all the members and were also placed before the Board in itsmeeting dated 17.01.2018.

The Board may approve the buildings bye-laws placed before it so as to forward them tocompetent authority for publishing in the Gazette. The connected documents are placed on the table.

The maximum I:AI{ prescribed by tile Srinagar Municipal Corporation (Building) Bye-Laws,2011 for residential buildings in high dense areas i.e. 200 was adopted by the Board for theCantonment. for such cases, the Srinagar Municipal Corporation (Building) Bye-Laws, 2011prescribes maximum ground coverage of 50% with no restriction on number 0(' storeys. Since thedraft building bye-laws (Bye law 2.4.3) for Badarnibagh Cantonment propose restriction on thenumber of storeys to G 12, the Hoard resolved to provide maximum ground coverage of up to 70% forresidential buildings.

Further, the Board resolved to adopt the setbacks for buildings as prescribed by the SrinagarMunicipal Corporation (Building) nyc-Laws, 20 II for Badarnibagh Cantonment. However, since40% increase (from 50% by Srinagar Municipal Corporation to 70% by the Board) in the groundcoverage is proposed lor residential buildings in Badarnibagh Cantonment, the Board resolved todecrease the setbacks by 40% for residential buildings in Cantonment area 'in comparison to thatprescribed by the Srinagar Municipal Corporation (Building) Bye-Laws, 2011.
