Background:
Education codes 44256(b), 44258.2, and 44263 expand the authorization for holders of MultipleSubject and Single Subject credentials, referred to as Board Authorizations. Board Authorizationsare assignment options provided to employing districts and counties. School districts may expandsubject authorizations only to teachers who hold a full credential (i.e., non-emergency, waiver,provisional internship, short term staff permit or intern).
To teach in a subject area other than designated by the credential, a teacher must complete 12semester units in the additional subject to be authorized for middle school. Teachers must complete18 semester units in the additional subject to be authorized for high school.

APPROVE SINGLE PLAN FOR STUDENT ACHIEVEMENT 2013-2014 Approve the Single Plan for Student Achievement (SPSA) for Edison, Emerson, Gant, Lincoln and Longfellow Elementary Schools; Gompers and Newcomb K-8 Schools; and Stephens Middle School. Each of the plans has been reviewed by Equity, Access, and College & Career Readiness staff for compliance. Each plan contains the components of effective planning based on student needs, assessment data, use of staff, parent involvement, and allocation of resources. Each schools’ approved SPSA for the 2013-2014 school year will also serve as an interim plan until the following school year’s SPSA is revised and approved. The funding for all programs and personnel outlined in these SPSAs is reflective of the current fiscal year only. 2. APPROVE APPLICATION FOR 2014-15 WORKFORCE INVESTMENT ACT, TITLE II
PROGRAM Approve Long Beach School for Adult’s application for the Workforce Investment Act, Title II: Adult Education and Family Literacy Act. The grant provides supplemental funds for Adult Basic Education (ABE), high school subjects, English as a Second Language, citizenship, and English Literacy and Civics Education, thereby enabling adults to become employable, productive, and responsible citizens, workers, and family members. The proposal seeks $293,220 in funding. 3. APPROVE PARTICIPATION IN USC’S SEA GRANT PROGRAM Approve the participation of Cabrillo High School in USC’s Sea Grant Program, Taking Action: Reducing Chemicals of Emerging Concern. The program provides resources for teachers to facilitate their students’ learning and promotes behavioral change beneficial to the environment. It also promotes environmental stewardship through community projects at each participant school. One Cabrillo teacher and his students have been invited to participate. LBUSD is not the fiscal agent for this program. 4. APPROVE PARTICIPATION IN THE LONG BEACH ADULT EDUCATION
CONSORTIUM: AB86 PLANNING GRANT Authorize the district’s participation in the Long Beach Adult Education Consortium Planning Grant in collaboration with Long Beach City College. The intent of the planning grant, supported by AB 86 funding, is to collaboratively develop a plan for expanding and improving adult education services by creating linkages between the two educational systems through a regional consortium. This regional collaboration provides capacity for the school district and the community college to find common ground and cross historical and cultural boundaries to provide seamless services for adult students. The adult services to be defined will address the

following priorities established in AB 86: (1) Elementary and secondary basic skills, including classes required for a high school diploma or high school equivalency certificate; (2) Classes and courses for immigrants eligible for educational services in citizenship and English as a second language, and workforce preparation classes in basic skills; (3) Education programs for adults with disabilities; (4) Short-term career technical education programs with high employment potential; and (5) Program apprentices. The planning grant budget of $300,390 will support the design work to be conducted between March 5, 2014 through June 30, 2015. SUBJECT: Service Learning Graduation Requirement Exemption CATEGORY: Business Items Reason for Board Instruction Consideration: Action Date: March 4, 2014 BACKGROUND: Under Education Code 51225.3 (a)(2), governing boards of local school districts may adopt additional coursework requirements for graduation. LBUSD Board Policy 6146.1 High School Graduation Requirements states that students must complete 40 hours of Service Learning to meet graduation requirements. Governing boards may grant a student an exemption from requirements if there are no alternative modes for completing the requirements. Students on the following list are not able to complete the 40 hour Service Learning requirement as a result of severe medical conditions and are requesting an exemption from the requirement.

The District has also reached a tentative agreement with the California School Employees Association, Long Beach Chapter #2, Unit A and Unit B, regarding the 2014-2015 Traditional and Track B work calendars. RECOMMENDATION: It is recommended that the 2014-2015 Traditional and Track B calendars be adopted for the upcoming school year. Selection and Evaluation of Instructional Materials
The Governing Board desires that district instructional materials, as a whole, present a broad spectrum of knowledge and viewpoints, reflect society’s diversity, and enhance the use of multiple teaching strategies and technologies. The Board shall adopt instructional materials based on a determination that such materials are an effective learning resource to help students achieve grade-level competency and that the materials meet criteria specified in law. Textbooks, technology-based materials, and other educational materials shall be aligned with academic content standards and the district’s curriculum to ensure that they effectively support the district’s adopted course of study. (cf.0440 – District Technology Plan) (cf. 6141 – Curriculum Development and Evaluation) (cf. 6143 – Course of Study) (cf. 6146.1 – High School Graduation Requirements) (6161.11 – Supplementary Instructional Materials) The Board shall select instructional materials for use in grades K-8 that have been approved by the State Board of Education (SBE) or have otherwise been determined to be aligned with the state academic content standards adopted pursuant to Education Code 60605 or the Common Core Standards adopted pursuant to Education Code 60605.8 (Education Code 60200, 60210) The Board shall adopt instructional materials for grades 9-12 upon determining that the materials meet the criteria specified in law and administrative regulation. (Education Code 60400) The Board’s priority in the selection of instructional materials is to ensure that all students are provided with standards-aligned instructional materials in the core curriculum areas of English/language arts, mathematics, science and history-social science. Review Process The Superintendent or designee shall establish a process by which instructional materials shall be reviewed for recommendation to the Board. Toward that end, he/she may establish an instructional materials review committee to evaluate and recommend instructional materials. The review process shall involve teachers in a substantial manner and shall encourage the participation of parents/guardians and community members. (Education Code 60002) In addition, the instructional materials review committee may include administrators, other staff who have subject-matter expertise, and students as appropriate.

BP 6161.1 If the district chooses to use instructional materials for grades K-8 that have not been adopted by the SBE, the Superintendent or designee shall ensure that a majority of the participants in the district’s review process are classroom teachers who are assigned to the subject area or grade level of the materials. (Education Code 60210) Individuals who participate in the selection or review of instructional materials shall not have a conflict of interest, as defined in administrative regulation, in the materials being reviewed. The committee shall review instructional materials using criteria provided in law and administrative regulation, and shall provide the Board with documentation supporting its recommendations. All recommended instructional materials shall be available for public inspection at the district office. Public Hearing on Sufficiency of Instructional Materials The Board shall annually conduct one or more public hearings on the sufficiency of the district’s textbooks and other instructional materials. (Education Code 60119) The hearing shall be held on or before the end of the eighth week from the first day students attend school for that year. (Education Code 60119) The Board encourages participation by parents/guardians, teachers, interested community members, and bargaining unit leaders at the hearing. Ten days prior to the hearing, the Superintendent or designee shall post a notice in three public places within the district containing the time, place and purpose of the hearing. The hearing shall not take place during or immediately following school hours. (Education Code 60119) At the hearing(s), the Board shall determine, through a resolution, whether each student in each school, including each English learner, has sufficient textbooks or instructional materials which are aligned to the state content standards adopted pursuant to Education Code 60605 or the Common Core Standards adopted pursuant to Education Code 60605.8 and which are consistent with the content and cycles of the state’s curriculum frameworks. Sufficiency of instructional materials shall be determined in each of the following subjects: (Education Code 60119)
1. Mathematics
2. Science
3. History-social science
4. English/language arts, including the English language development component of an adopted program
5. World languages
6. Health

BP 6161.1 The Board shall also determine the availability of science laboratory equipment, as applicable to science laboratory courses offered in grades 9-12. (Education Code 60119) In making these determinations, the Board shall consider whether each student has sufficient textbooks and/or instructional materials to use in class and to take home. However, this does not require that each student have two sets of materials. The materials may be in a digital format as long as each student, at a minimum, has and can access the same materials in the class and to take home as other students in the same class or course in the district and has the ability to use and access them at home. However, the materials shall not be considered sufficient if they are photocopied sheets from only a portion of a textbook or instructional materials copied to address a shortage. (Education Code 60119) The Board shall make a determination that all students within the district who are enrolled in the same course have “identical” standards-aligned textbooks or instructional materials from the same adoption cycle, as defined in Education Code 1240.3 and 60119. (Education Code 1240.3, 42605) However, the district may purchase the newest adopted instructional materials for students in district schools ranked in deciles1-3 of the base Academic Performance Index in any one of the past three school years without necessarily purchasing these materials for use in other district schools. (Education Code 1240.3) If the Board determines that there are insufficient textbooks or instructional materials, it shall provide information to classroom teachers and to the public setting forth, for each school in which an insufficiency exists, the percentage of students who lack sufficient standards-aligned textbooks or instructional materials in each subject area and the reasons that each student does not have sufficient textbooks or instructional materials. The Board shall take any action, except an action that would require reimbursement by the Commission of State Mandates, to ensure that each student has sufficient materials within two months of the beginning of the school year in which the determination is made. INSTRUCTION BP 6164.6 Identification and Education Under Section 504 The Governing Board believes that all children, including children with disabilities, should have an opportunity to learn in a safe and nurturing environment. The district shall work to identify children with disabilities who reside within its jurisdiction in order to ensure that they receive education and related services required by law. The Superintendent or designee shall provide identified students with disabilities with a free appropriate public education, as defined under Section 504 of the federal Rehabilitation Act of 1973. Such students shall receive regular or special education and related aids and services designed to meet their individual education needs as adequately as the needs of nondisabled students are met. In addition, qualified students with disabilities shall be provided an equal opportunity to participate in programs and activities that are integral components of the district’s basic education program, including, but not limited to, extracurricular athletics, interscholastic sports, and/or other nonacademic activities. In providing services to students with disabilities under Section 504, the Superintendent or designee shall ensure district compliance with law, including providing the students and their parents/guardians with applicable procedural safeguards and required notifications. Any dispute as to the identification evaluation, or placement of any student with a disability shall be resolved in accordance with the processes specified in the “Procedural Safeguard” section of the accompanying Administrative Regulations. The superintendent or designee shall maintain a list of impartial hearing officers who are qualified and willing to conduct Section 504 hearings. To ensure impartiality, such officers shall not be employed by or under contract with the district in any other capacity except as hearing officer and shall not have any professional or personal involvement that would affect their impartiality or objectivity in the matter. For the purpose of implementing Section 504 of the Rehabilitation Act of 1973, the following terms and phrases shall have only the meanings specified below: Free appropriate publication (FAPE) means the provision of regular or special education and related aids and services designed to meet the individual educational needs of a student with disabilities as adequately as the needs of nondisabled students are met, without cost to the student or his/her parent/guardian, except when a fee is imposed on nondisabled students (34 CFR104.33) Student with a disability means a student who has a physical or mental impairment which substantially limits one or more major life activities and a student who has a record of an impairment or is regarded as having such an impairment.

BP 6164.6 Physical impairment means any physiological disorder or condition, cosmetic disfigurement, or anatomical loss affecting one or more of the following body systems: neurological; musculoskeletal, special sense organs; respiratory, including speech organs; cardiovascular; reproductive, digestive, genito-urinary; hemic and lymphatic; skin; and endocrine. Mental impairment means any mental or psychological disorder such as mental retardation, organic brain syndrome, emotional or mental illness, and specific learning disabilities (34 CFR 104.3) Substantially limits major life activities means limiting a person’s ability to perform functions such as caring for himself/herself, performing manual tasks, seeing, hearing, eating, sleeping, walking, standing, lifting, bending, speaking, breathing, learning, reading, concentrating, thinking, communicating and working. Major life activities also includes major bodily functions such as functions of the immune system, normal cell growth, digestive, bowel, bladder, neurological, brain, respiratory, circulatory, endocrine, and reproductive functions. Substantially limits shall be determined without regard to the ameliorative effects of mitigating measures other than ordinary eyeglasses or contact lenses. Mitigating measures include, but are not limited to, medications, prosthetic devices, assistive devices, learned behavioral, or adaptive neurological modifications which an individual may use to eliminate or reduce the effects of an impairment. Any action or decision to be taken by the district involving the referral, identification, or evaluation of a student with disabilities shall be in accordance with the following procedures:
1. A parent/guardian, teacher, or other school employee, student success team, or community agency may refer a student to the principal or 504 Coordinator for identification as a student with a disability under Section 504.
2. Upon receipt of any such referral, the principal, 504 Coordinator, or other qualified
individual with expertise in the area of the student’s suspected disability shall consider the referral and determine whether an evaluation is appropriate. This determination shall be based on a review of the students school records, including those in academic and nonacademic areas of the school program; consultation with the student’s teacher(s), other professionals, and the parent/guardian, as appropriate; and analysis of the student’s needs.
3. If it is determined that the student needs or is believed to need special education or
related services under Section 504, the district shall conduct an evaluation of the student prior to his/her initial placement. Prior to conducting an initial evaluation of a student for eligibility under Section 504, the district shall obtain written parent/guardian consent.

BP 6164.6 The district’s evaluation procedures shall ensure that the tests and other evaluation materials: (34 CFR 104.35)
a. Have been validated and are administered by trained personnel in conformance with the instruction provided by the test publishers
b. Are tailored to assess specific areas of educational need and are not merely
designed to provide a single general intelligence quotient
c. Reflect the student’s aptitude or achievement or whatever else the tests purport to measure rather than his/her impaired sensory, manual, speaking skills, except where those skills are the factors that the tests purport to measure
Section 504 Services Plan and Placement Services and placement decisions for student with disabilities shall be determined as follows:
1. A multi-disciplinary 504 team shall be convened to review the evaluation data in order to make placement decisions.
The 504 team shall consist of a group of persons knowledgeable about the student, the meaning of the evaluation data, and the placement options. In interpreting evaluation data and making placement decisions, the team shall draw upon information from a variety of sources, including aptitude and achievement tests, teacher recommendations, physical condition, social or cultural background, and adaptive behavior. The team shall also ensure that information obtained from all such sources is documented and carefully considered and that the placement decision is made in conformity with 34 CFR 104.34 934 CFR 104.35.
2. If, upon evaluation, a student is determined to be eligible for services under Section 504, the team shall meet to develop a written 504 services plan which shall specify the types of regular or special education services, accommodations, and supplementary aides and services necessary to ensure that the student receives FAPE.
The parents/guardians shall be invited to participate in the meeting and shall be given an opportunity to examine all relevant records.
3. If the 504 team determines that no services are necessary for the student, the record of the team’s meeting shall reflect whether or not the student has been identified as a disabled person under Section 504 and shall state the basis for the determination that no special services are presently needed. The student’s parent/guardian shall be informed in writing of his/her rights and procedural safeguards, as described in the “Procedural Safeguards” section below.

4. The student shall be placed in the regular educational environment, unless the district can demonstrate that the education of the student in the regular environment with the use of supplementary aids and services cannot be achieved satisfactorily. The student shall be educated with those who are not disabled to the maximum extent appropriate to his/her individual needs.
5. The district shall complete the identification, evaluation, and placement process
within a reasonable time frame.
6. A copy of the student’s Section 504 services plan shall be kept in his/her student record. The student’s teachers(s) and any other staff who provide services to the student shall be informed of the plan’s requirements.
If a student transfers to another school within the district, the principal or designee at the school from which the student is transferring shall ensure that the principal or designee at the new school receives a copy of the plan prior to the student’s enrollment in the new school. Review and Reevaluation The 504 team shall monitor the progress of the student and, periodically, shall review the effectiveness of the student’s Section 504 services plan to determine whether the services are appropriate and necessary and whether the student’s needs are being met as adequately as the needs of nondisabled student. In addition, each student with a disability under Section 04 shall be reevaluated at least once every three years. A re-evaluation of the student’s needs shall be conducted before any subsequent significant change in placement. Procedural Safeguards The Superintendent or designee shall notify the parents/guardians of students with disabilities of all actions and decisions by the district regarding the identification, evaluation, or education placement of their children. He/she also shall notify the parents/guardians of all the procedural safeguards available to them if they disagree with the district’s action or decision, including an opportunity to examine all relevant records and an impartial hearing in which they shall have the right to participate. If a parent/guardian disagrees with any district action or decision regarding the identification, evaluation, or education placement of his/her child under Section 504, he/she may request a Section 504 due process hearing within 30 days of that action or decision. Prior to requesting a Section 504 due process hearing, the parent/guardian may, at his/her discretion, but within 30 days of the district’s action or decision request an administrative review of the action or decision. The Coordinator shall designate an appropriate

BP 6164.6 administrator to meet with the parent/guardian to attempt to resolve the issue and the administrative review shall be held within 13 days of receiving the parent/guardian’s request. If the parent/guardian is not satisfied with the resolution of the issue, he/she may request a Section 504 due process hearing. Section 504 due process hearing shall be conducted in accordance with the following procedures:
1. The parent/guardian shall submit a written request to the Coordinator within 30 days of receiving the district’s decision or, if an administrative review is held, within 14 days of the completion of the review. The request for the due process hearing shall include:
a. The specific nature of the decision with which he/she disagrees b. The specific relief he/she seeks c. Any other information he/she believes is pertinent to resolving the
disagreement
2. Within 30 days of receiving the parent/guardian’s request the Superintendent or designee and 504 Coordinator shall select an impartial hearing officer. This 30-day deadline may be extended for good cause or by mutual agreement of the parties.
3. Within 45 days of the selection of the hearing officer, the Section 504 due process
hearing shall be conducted and a written decision mailed to all parties. This 45-day deadline may be extended for good cause or by mutual agreement of the parties.
4. The parties to the hearing shall be afforded the right to:
a. Be accompanied and advised by counsel and by individuals with special knowledge or training related to the problems of students with disabilities under Section 504
b. Present written and oral evidence c. Question and cross-examine witnesses d. Receive written findings by the hearing officer stating the decision and
explaining the reasons for the decision If desired, either party may seek a review of the hearing officer’s decision by a federal court of competent jurisdiction. Notifications The Superintendent or designee shall ensure that the district has taken appropriate steps to notify students and parents/guardians of the district’s duty under Section 504. (34 CFR 104.32).

RESOLUTION OF THE BOARD OF EDUCATION OF THE LONG BEACH UNIFIED SCHOOL DISTRICT
IN SUPPORT OF THE WEEK OF THE SCHOOL ADMINISTRATOR
WHEREAS, Leadership Matters for California’s public education system and the more than 6 million students it serves;
WHEREAS, school administrators are passionate, lifelong learners who believe in the value of quality public education, and
WHEREAS, the title “school administrator” is a broad term used to define many education leadership posts. Superintendents, assistant superintendents, principals, assistant principals, special education and adult education leaders, curriculum and assessment leaders, school business officials, classified educational leaders, and other school district employees are considered administrators; and
WHEREAS, providing quality service for student success is paramount for the profession; and
WHEREAS, most school administrators began their careers as teachers. The average administrator has served in public education for more than a decade. Most of California’s superintendents have served in education for more than 20 years. Such experience is beneficial in their work to effectively and efficiently lead public education and improve student achievement; and
WHEREAS, public schools operate with lean management systems. Across the nation, public schools employ fewer managers and supervisors than most public and private sector industries including transportation, food service, manufacturing, utilities, construction, publishing and public administration; and
WHEREAS, school leaders depend on a network of support from school communities – fellow administrators, teachers, parents, students, businesses, community members, board trustees, colleges and universities, community and faith-based organizations, elected officials and district and county staff and resources – to promote ongoing student achievement and school success; and
WHEREAS, research shows great schools are led by great principals, and great districts are led by great superintendents. These site leaders are supported by extensive administrative networks throughout the state; and
WHEREAS, the State of California has declared the first full week of March as the “Week of the School Administrator” in Education Code 44015.1; and
WHEREAS, the future of California’s public education system depends upon the quality of its leadership;
NOW, THEREFORE BE IT RESOLVED, that the Board of Education of the Long Beach Unified School District that all school leaders be commended for the contributions they make to successful student achievement.

CATEGORY: New Business Reason for Board Consideration: Action Business Department - Financial Services Date: March 4, 2014 Background
Education Code Sections 35053(g), 42130, and 42131 require school districts to prepare two reports regarding the financial and budgetary status of the district. The first report covers the period ending October 31, and the second report covers the period ending January 31. The District is required to prepare these interim reports in a format prescribed by the state and in accordance with the state’s Criteria and Standards. In addition, the Governing Board of each school district is required to certify to the district’s ability to meet its financial obligations for the remainder of that fiscal year and for the subsequent two fiscal years.
Recommendation
Approve a positive certification of the Second Interim Financial Report for 2013-2014 indicating that the Long Beach Unified School District will be able to meet its financial obligations for the remainder of the 2013-2014 fiscal year and the following two fiscal years, and authorize filing of this report with the Los Angeles County Superintendent of Schools, in accordance with Education Code Section 35035(g).
