Fertilizer Distribution Regulations

Chapter I> General Provisions

Article 1. Fertilizer referred to in Article 1, paragraph1 of the Fertilizer Distribution Kodan Ordinanceand in the present Regulations shall'.be ammoniumsulphate, calcium cyanamide, superphosphate, syn-thetic fertilizer, imported kali salt, imported am-monium nitrate and Thomas phosphate.

Article 2. Any manufacturer or importer of fertilizershall sell fertilizer manufactured or imported by

[ "ji 'him to the Fertilizer JDlstribution Kodan*.Article 3." Farmers referred to in the present Regula-

tions shall be those who engage in farming.

Chapter II. Authorized Fertilizer Dealers

'Article 4. Those who, can be authorized as fertilizerde'alers (hereinafter named as authorized dealers)shall be the -corporations organizedgander law byfarmers (hereinafter 'named as agricultural corpora-tions) or (hose who sell fertilizer as their businessto*' farmers (hereinafter named as merchants).-Merchants, however,, shall be those who have ac-

- ' cepted ' the preparatory 'purchase registration offertilizer ,fro'm not less than one hundred: farmers,who live in the sales "districts of merchants prescribedin Article 5. >,

Article 5. ' The Prefectural Branch Offices of the Per-; ' tilizer Distribution Kodan, taking into consideration

the local distribution of farmers, the transportationsituation, etc., shall designate the sales districts of'fertilizer forHhe merchants authorized as dealers.

The FrefecturaJ Branch Offices of the FertilizerDistribution Kodan, when' they deenrit fit andproper, that the sales districts of merchants extendover the neighbouring prefectures of the prefectures'where the officer are located, may enlarge the sales

districts after conferring with the neighbouringPrefectural Branch Offices of the Fertilizer Distribu-tion Kodan and receiving approval thereof.

Article 6. The persons who have been authorized asdealers (hereinafter named as authorized dealers)shall sell the fertilizer transferred from the FertilizerDistribution Kodan directly to the farmers whohave made purchase registration with mem.

The authorized dealers can not conduct, in anyname, wholesale business of fertilizer.

Article 7. A person who wants to be designated as theauthorized dealej, shall submit to the FertilizerDistribution Kodan an application for dealer desig-nation stating his name and address (further, in thecase of a merchant, the location of his place ofbusiness), the location of his fertilizer 'storehouse,and the names and addresses of farmers who havemade preparatory purchase registration to him, to-gether with ¥50\for each of them as security.

Article 8. The Fertilizer Distribution Kodan, in givingdealer designation according to the provisions^ofArticle 15 of the Fertilizer Distribution KodanOrdinance, shall submit to the Minister of Agri-culture and Forestry an application for approval ofdealer designation, "stating the names and addresses •E ^of agricultural corporations or merchants concerned(further, in the case of merchants, the location of

1 their places of business), and the number 6f farmerslisted in the preparatory purchase registration.

Article 9. The dealer designation shall be made by theFertilizer Distribution Kotfan delivering the au-thorized dealer cards, (Form No. 1) to the authorized ""^.dealers. i

Article 10. The time when authorized dealers will starjt^sellingof fertilizei shall be designated by the Fer- -^tilizer Distribution Kodan. ,

Chapter III. Purchase Registration

Article ll. The agricultural corporations or merchants,shall prepare purchase registration books (Form

_Ko- 2), which shall be submitted to the PrefecturalBranches of the Fertilizer Distribution Kodan to _jki.get tally-impression of the Kodan on each page ofthe books..

The authorized *dealers shall use in later pur-chase registration the purchase registration bookswhich they have used in preparatory purchase regis-tration. ' ^ ^

Article 12. Preparatory purchase registration ©r pur- ^%cr^ase registration shall Ipe effective when farmersrecord' dates of registration, and their names andaddresses, and stamp: theij; seals on the, purchaseregistration books as prescribed in the precedingArticle. ' " '

Cancellation of purchase registration shall be* effectivewhen farmers or* in the case of paragraph

'Article 13. Farmers shall not vary the dealers of th'elfpreparatory purchase registration or -purchase regis-tration as to the kind of fertilizer or'crop forfertilization.

Article 14. Farmers shall be able to alter the dealersof their purchase registration at their option. Butthe 'alteration ^all be made within the last threedays of a month., > _ -iL

Article 15. If a farmer wants to alter the dealer of hispurchase registration to any other agricultural cor-poration or merchant who is newly to be authorizedas a dealer? he shall report to his former dealer ofregistration to that effect, and then make prepar-atory purchase registration with the said agricultural ^

corporation or merchant.The Fertilizer Distribution Kodan, on au-

thorizing the agricultural corporations or merchantsas authorized dealers, shall regard their preparatorypurchase registration as purchase registration^ and ^shall order the erasure of purchase registration tothe former dealer of the farmer's registration.

The erasure in the preceding paragraph shalltake effect when the newly authorized dealer beginsthe selling, of fertilizer. iv ;

Article 16. If a farmer alters his dealer of purchase

registration, he shall cancel the former purchaseregistration, and then make a new purchase regisptration.

Those who have accepted an erasure or anewpurchase registration in the preceding paragraphshall report to the County Branch of the FertilizerDistribution Kodan to that effect.

The erasure and purchase registration in para-graph 1 shall take effect as from the last day ofthe next month.

Article 17. If the number of farmers registered withany authorized dealer becomes less than one hundredby alteration of purchase registration, the FertilizerDistribution Kodan shall cancel the authorizationby thelast day of the next month, and shall notifyto that effect to the farmers registered.

Any farmer who has received the notification, in the preceding paragraph, shall register anew

with any other authorized (Jealer Within three daysafter receiving such notification, regardless of7 theprovisions of the proviso of Article 14.

The purchase registration in the preceding.paragraph shall take effect as from the day on which

the cancellation of designation becomes effective.

Chapter IV. Allotment and Distribution ofFertilizers

Article 18. The Minister of Agriculture and Forestryshall determine the amount of fertilizer allotted for

/ distribution to each prefecture or consumer, accord-ing to the basis decided by the Director-Generalof the Economic Stabilization Board.

The prefectural governor shall effect the allot-ment of distribution of fertilizer to each city, townor village, or to each consumer, according to the

; fi, *-direction of the Minister of Agriculture and For-estry. The mayor of a city, or the headman of atown or village shall effect the allotment of distribu-

% tion to each farrier, according to the direction ofthe prefectural governor.

Article 19., Tlie mayor of a city, orithe headman of atown' ox a village shall issue, fertilizer purchasechit-books to farmers, after he determined the allot-ment of distribution to farmers according to theprovisions of the preceding Article.

The prefectural governor shall allot the pur-chasable amount of;authorized dealers on the basisof the requested purchase amount by farmers, andshall issue dealers' fertilizer purchase chit-books.

Th^e Minister of Agriculture and Forestry ora prefectural governor, on determining allotmentof distribution to consumers, shall issue to themcertificates of fertilizer purchase allotment.

The form of a fertilizer purchase chit-book,(including dealer's fertilizer purchase chit-book),and certificate of fertilizer purchase allotment (here-inafter named as allotment documents) shall bedetermined by the Minister p£ Agriculture andForestry.

Article 20. The Minister of Agriculture and Forestry,a prefectural governor, or the mayor of a city orthe headman of a town or village shall publish theallotted amount of fertilizer to each prefecture, orcity, town or village, or consumer or farmer, incase the allotment is effected.

Article 21. The Fertilizer Distribution Kodan, au-

thorized dealers, consumers or farmers shall not beable to sell or buy fertilizer without the presenta-tion of allotment documents,(with necessary record ;the same shall apply hereinafter as the same ex-pression arises). But, this shall not apply in casefertilizer is sold by the procurement demand issuedby the Supreme Commander for the Allied Powers,or in case allotment documents are unable to bepresented owing to any unavoidable accident suchas calamity.

The allotment documents shall not be trans-ferred to or obtained by transfer from others.

Article 22. A farmer, consumer, or designated dealershall return the used allotment documents, to theissuing office, according to the notice cited on theallotment documents.

Article 23. Prefectural governors, or the heads of a*city, ward, town or village may, when deemednecessary in order to secure the equitable distribu-tion of fertilizer, give to authorized dealers neces-sary instructions as to the sale method of fertilizer.

Article 24. Authorized dealers cannot refuse the saleof fertilizer to those who present a chit-book, ex-

, cept for the case where there is no stodk or toosmall amount in stock to reach the minimum dis-tribution unit or in other similar cases.

Authorized dealers shall act in compliance withthe instructions as provided for in the precedingArticle and shall sell fertilizer at controlled pricesas well as on just and fair conditions.

Article 25, Authorized dealers shall keep fertilizer pur-chase registration books and certificates issued bythe Fertilizer Distribution Kodan, and shall postup, in their stores or some other noticeable places,the number of authorization and other matters asinstructed by the Minister of Agriculture and For-estry or the competent prefecture! governor^

Article 26. Authorized dealers shall post up the amountof fertilizer possible to be sold on each sale-day attheir ships 'ot some other noticeable places, andshall keep the books to be filled up with the true;and correct records of the following matters:1. The monthly or daily delivery as classified^by

the kind of fertilizer as well as the amount oftheir stock, andount at the end of'a month;

2. The amount sold of fertilizer as classified byregistered farmers as well as by the kind of fer-tilizer.

Chapter V. Miscellaneous Rules

Article 27. Authorized dealers shall, in accordance withthe instructions by the Minister of Agriculture andForestry, return or transfer to the Fertilizer Distri-bution Kodan the containers of fertilizer whichthey have handled (straw-bags, gunny sacks, orKraft paper bags as instructed by the Minister ofAgriculture and Forestry).

Article 28. The Minister of Agriculture and Forestryof prefectural governors may, when deemed neces-

^ sary, order authorized dealers to submit reports onthe following matters :1. The amount of stock as classified by the kind

of fertilizer on the day as appointed by theMinister of Agriculture and Forestry or prefec-tural governors ;

2. The amount transacted during the period as

appointed by the Minister of Agriculture andForestry or prefectural governors.

Article 29. The Minister of Agriculture and Forestry,a prefectural governor or the head of a city, ward,town or village may take such necessary measurestoward violators of the present Regulations assuspension of issue of allotment documents, curtail-ment of allotted amount, or others.

The Minister of Agriculture and Forestry mayorder the Fertilizer Distribution Kodan to cancelthe designation of authorized dealers in case wherethey violate the present Regulations.

In case where the Fertilizer Distribution Kodanhas cancelled the designation of- authorized dealers,the provisions of Article 17 shall apply with thenecessary modifications.

Article 30* When the designation of authorized dealershas been cancelled under Article 17 and the pre.ceding Article and such cancellation has becomeeffective, they shall return their fertilizer purchasechit-books to the prefectural governors, and returnor transfer to the, Fertilizer Distribution Kodantheir designations cards and the fertilizer then ins' lock. ,

Supplementary Provisions: ^ ,

Article 31. The present Ordinance shall come intoforce as from the day of its promulgation. However,the provisions of Article 6, paragraph 1, Articles 19and21 shallbeput in force as from the day to bedesignated separately by the Minister of Agricultureand Forestry.

^rticle 32* The provisions of Article 14 shall be en-forced as from October 1, 1947.

Article 33. The agricultural associations of cities, townsand villages established under the Agricultural Or-ganizations Law shall be, till July 31, 1947, regardedas authorized dealers of the Fertilizer Distribution

- Kodan.Article 34. The sale districts provided for in Article

5 shall be, till the establishment of the FertilizerDistribution Kodan, determined by the prefecturalgovernors. ' /f~N

Article 35. The purchase registration books providedfor in Article ll shall be, till the establishment ofthe Fertilizer Distribution Kodan, submitted toprefectural governors and checked by them.

Article 36. Applications for authorized dealers providedfor in Article 7 shall be, till the establishment ofthe Fertilizer Distribution Kodan, attested by pre-fectural governors, and, through them, be submittedto the Minister of Agriculture and Forestry.

Article 37. Farmers shall make preparatory purchaseregistration with agricultural corporations or mer-chants within the period as designated by theMinister of "Agriculture and Forestry, in order toselect those who are to be the first authorizeddealers after August 1, 1947.

The following partial amendments were made tothe Regulations for Bureaus and Sections of the Min-istry of Justice and came into force as from May 3,1947:
