MINIMUM FEES CHARGEABLE BY QUANTITY SURVEYORS FOR PROFESSIONAL SERVICES
In terms of subsection (6) of section 7 of the Architects' and Quantity Surveyors' Act, 1979 (Act 13 of 1979), it is hereby made known that the AdministratorGeneral has, under subsection (3) of the said section 7 prescribed the minimum fees, set out in the Schedule hereto, which shall be chargeable by a quantity surveyor for his professional services.

MINIMUM GELDE WAT BOUREKENAARS VIR PROFESSIONELE DIENSTE KAN VRA
Ingevolge subartikel (6) van artikel 7 van die Wet op Argitekte en Bourekenaars, 1979 (Wet 13 van 1979), word hierby bekend gemaak dat die Administrateurgeneraal, kragtens subartikel (3) van genoemde artikel 7, die minimum gelde voorgeskryf bet, soos in die Bylae uiteengesit, wat 'n bourekenaar vir sy professionele dienste moet vra.

SCHEDULE
General
1. (1) A quantity surveyor shall not charge professional fees less than the fees prescribed in this Notice without the prior approval of the South West African Council for Architects and Quantity Surveyors.
(2) The fees to be charged shall be the sum of the fees stated in columns 2 and 3 of the fee scale referred to in paragraph 2 and, unless otherwise stated, be calculated on the total final value of the works in a contract, which value shall include -
(a) all labour and materials whether supplied free of charge or not;
(b) all specialist services and installations which form an integral part of the works;
(c) any portion of the works carried out under a subcontract or separate contract and executed concurrently with the building contract, but excluding the installation of machinery or equipment related to the specific use of the building such as those required for production, manufacturing, treatment or processing, carried out by a separate contractor and in connection with which the quantity surveyor is not required to perform a service; and
(d) any amount of adjustment evaluated or verified under any applicable contract price adjustment provisions.
Building works
2. ( 1) For services in respect of building works the fees shall be as set out in the following scale.
(2) The services referred,to in subparagraph (1) and the apportionment of fees to such services are set out in the Annexure.
BYLAE
Algemeen
1. ( 1) 'n Bourekenaar mag nie gelde wat minder is as die gelde in hierdie Kennisgewing voorgeskryf word vir professionele dienste vorder nie, sonder die voorafverkree goedkering van die Suidwes-Afrikaanse Raad vir Argitekte en Bourekenaars.
(2) Die gelde wat gevorder moet word, is die totaal van die gelde wat in kolomme 2 en 3 van die geldeskaal in paragraaf 2 bedoel, aangegee word en wat, tensy anders vermeld, op die totale finale waarde van die werke by 'n kontrak bereken word en wat die volgende moet insluit -
(a) aile arbeid en materiaal ongeag of dit gratis verskaf is of nie;
(b) aile spesialisdienste en -installasies wat 'n integrerende deel van die werke vorm; ·
(c) enige gedeelte van die werk wat gelyktydig met die boukontrak deur 'n sub-kontrak of aparte kontrak uitgevoer word, maar uitgesonderd die installering van masjinerie of toerusting wat spesifiek betrekking het op die doel waarvoor die gebou opgerig word, soos byvoorbeeld produksie, vervaardiging, behandeling of verwerking wat deur 'n afsonderlike kontrakteur uitgevoer word en waarvoor die bourekenaar nie 'n diens hoef te lewer nie; en
(d) enige aanpassingsbedrag wat bereken of nagegaan is ooreenkomstig toepaslike kontrakprysaanpassingsbepalings.
Bouwerke
2. ( 1) Vir dienste ten opsigte van bouwerke sal gelde wees soos in die volgende skaal uiteengesit.
(2) Die dienste waa~·na in subparagraaf (1) verwys word en die toedeling van gelde aan dienste word in die Aanhangsel uiteengesit.

Industrialised buildings works
3. (1) For services in respect of works designed to be carried out by industrialised or unorthodox system building methods and documented in accordance with the relevant portion of the Guide to the System of Measurement for Performance-based Tender Enquiry Documentation issued by the Association of South African Quantity Surveyors, the fees shall be 50 per cent of the fees calculated in terms of paragraph 2.
(2) The services referred to in subparagraph (1) and the apportionment of fees to such services are set out in the Annexure.
(3) Where a single contract includes works covered by the provisions of both paragraphs 2 and 3, the full value of the works shall be calculated in terms of paragraph 2.
Engineering works
4. (1) For services in respect of contracts comprising structural engineering works such as cooling, water or other towers, reservoirs, caissons, culverts, bridges, canals, aqueducts, storage and treatment tanks, grain elevators, silos and structures comprising encasements and supports for housing heavy industrial and public utility plant, machinery and equipment, the fees shall be 75 per cent of the fees set out in paragraph 2.
(2) For services in respect of contracts comprising civil engineering works such as quays, wharves, jetties,

Geindustrialiseerde bouwerk
3. (1) Vir dienste ten opsigte van werke wat ontwerp is om volgens geindustrialiseerde- of ongewone boustelmetodes uitgevoer te word en wat gedokumenteer is ooreenkomstig die toepaslike gedeelte van die Handleiding vir die Opstel van Tenderdokumente gebaseer op Prestasiegrondslag uitgereik deur die Vereniging van Suid-Afrikaanse Bourekenaars, moet die gelde 50% wees van die gelde soos in paragraaf 2 uiteengesit.
(2) Die dienste waarna in subparagraaf (1) verwys word en die toedeling van gelde aan dienste word in die Aanhangsel uiteengesit.
(3) Waar 'n enkele kontrak werke insluit wat deur die bepalings van beide paragrawe 2 en 3 gedek word, moet die volle waarde van die werke ooreenkomstig paragraaf 2 bereken word.
lngenieurswerk
4. (1) Vir dienste ten opsigte van kontrakte bestaande uit struktuuringenieurswerk soos verkoelings-, water- en ander torings,. reservoirs, caissons, duikers, briie, kanale, waterleidings, opgaar- en behandelingstenks, graansuiers, silo's en strukture bestaande uit omhulsels en stutte vir swaar nywerheids- en openbarenutsinstallasies, -masjinerie en -toerusting moet die gelde 75% wees van die gelde soos in paragraaf 2 uiteengesit.
(2) Vir dienste ten opsigte van kontrakte wat siviele ingenieurswerk behels soos kaaie, dokke, hawehoofde,

dams, shafts, tunnels, airport runways and aprons, roads, railways, sewers, pipelines, sportsfields and major earthworks, the fees shall be 50 per cent of the fees set out in paragraph 2.
(3) The services referred to in subparagraphs (1) and (2) and the apportionment of fees to such services are set out in the Annexure.
(4) Where a single contract includes works falling within both categories as defined in subparagraphs ( 1) and (2), the fees shall be separately calculated on the basis of the total value within each category, except where the total value within the one category or the other is not more than I 0 per cent of the whole.
(5) The fees laid down in subparagraphs (1) and (2) shall apply only where the work is measured in accordance with the Standard System of Measurement of Civil Engineering Quantities for South Africa and South· West Africa.
Negotiation of rates
5. For pre-contact negotiation of rates with a contractor, where required, irrespective of the type of contract envisaged, an additional fee on the time charge basis as laid down in paragraph 21 shall apply.
Alteration of work
6. For work to existing buildings comprising alterations, minor additions and redecoration, 1 per cent of the value of such work shall be added to the fee calculated in accordance with paragraph 2.
Works originally included in contract but subsequently omitted
7. The appropriate fee in accordance with the apportionment set out in the Annexure in respect of works or a portion thereof originally included in the documentation for a contract but subsequently omitted, shall apply in addition.
Excessive variation
8. Should the works under a contract incorporating bills of quantities be varied to an extent where the value of measured work omitted in the adjustment of variations (excluding any work originally measured as provisional) exceeds 15 per cent of the value of measured work in the total final value of the works, then an additional fee shall be charged on the amount of such excess (excluding adjustments involving the substitution of materials without additional measurement) calculated at 60 per cent of the marginal rate in column 3 of the appropriate fee scale ..

(3) Die dienste waarna in subparagrawe (1) en (2) verwys word en die toedeling van gelde aan dienste word in die Aanhangsel uiteengesit.
(4) Waar 'n enkele kontrak werke insluit wat deur die bepalings van beide subparagrawe (1) en (2) gedek word, moet die gelde apart bereken word volgens die totale waarde van elke deel, behalwe waar een deel minder as 10% van die totaal is.
(5) Die gelde wat in subparagrawe (1) en (2) bepaal word is slegs van toepassing waar die werk volgens die Standaardstelsel vir die Opmeting van Siviele Inge- ~ nieurswerk in Suid-Afrika en Suidwes-Afrika gemeet word.
Onderhandelinge in verband met tariewe
5. Vir onderhandelinge waar nodig met 'n kontrakteur voor die aangaan van 'n kontrak in verband met tariewe, ongeag watter tipe kontrak beoog word, is addisionele gelde op die tydvorderingsbasis soos in paragraaf 21 bepaal, van toepassing.
Werk verbonde aan veranderings
6. Vir werk aan bestaande geboue wat veranderings, kleiner aanbousels en herversiering omvat, moet 1 persent van die waarde van sodanige werk by die gelde ooreenkomstig paragraaf 2 bereken, gevoeg word.
Werke wat oorspronklik by die kontrak ingesluit maar later weggelaat is.
7. Die toepaslike gel de ooreenkomstig die toedeling soos in die Aanhangsel uiteengesit, ten opsigte van werke of 'n dee! daarvan wat oorspronklik by die dokumentasie vir 'n kontrak ingesluit maar later weggelaat is, is boonop van toepassing.
Oormatige wysiging
8. Indien die werke, kragtens 'n kontrak wat hoeveelheidslyste behels, in so 'n mate gewysig word dat die waarde van gemete werk wat weggelaat is met die aanpassing van wysigings (uitgesonderd enige werk oorspronklik as voorlopig gemeet) meer is as 15 persent van die waarde van gemete werk by die totale finale waarde van die werke, word ekstra gelde op die bedrag van sodanige oorskot gevorder (uitgesonderd aanpassings wat die vervanging van materiaal sonder bykomende meetwerk behels) welke ekstra gelde bereken word teen 60 persent van die marginate koers in kolom 3 van die toepaslike geldeskaal.

Repetition work
9. (1) For each replication of an entire complex or the replication of individual distinct buildings or structures within a single contract or from a previous contract, the fee shall be 5 per cent of the total fee set out in paragraphs 2, 3 or 4, as the case may be, in respect of the prototype.
(2) For fee calculation purposes, the value of the prototype and each replication thereof shall include a pro rata allowance in respect of preliminary and general items.
(3) For the services detailed in A, C and D of the Annexure in respect of replications, the appropriate full fees as set out in column 1 of the Annexure, irrespective of the type of contract which actually applies, shall apply in addition.
(4) For any modification of the design within a prottype involving work detailed under B of the Annexure, the appropriate fee, or, alternatively, a time charge as laid down in paragraph 21,-shall apply.
Cost-plus contracts
10. For full services in connection with cost-plus contracts, the fee shall be as set out in paragraphs 2, 3 or 4, as the case may be, and shall include estimates of cost, negotiating the terms and conditions of contract, arranging the conditions for specialist and other subcontracts, auditing time sheets, delivery notes, invoices, etc., checking rates for labour and materials, preparing progressive statements of account, making check measurements of the principal materials used for comparison with invoices and preparing and settling the final account.
Interim fees and partial services
11. (1) Interim fees charged shall be based on the apportionment set out in the Annexure.
(2) Should a project or part thereof be abandoned or deferred-
(a) the fee for services completed shall be determined in accordance with the Annexure.
(b) the fee for services partially completed shall be similarly determined on a quantum meruit basis.
(3) Should the services of a quantity surveyor be dispensed with at any stage, he shall charge fees cal-
H erhalingswerk
9. (1) Vir elke herhaling van 'n hele kompleks of die her haling van individuele afsonderlike geboue of strukture wat deel uitmaak van 'n enkele kontrak of van 'n vorige kontrak, is die gelde ten opsigte van die prototipe 5 persent van die totale gelde soos uiteengesit in paragrawe 2, 3 of 4, na gelang van die geval.
(2) Vir die doeleindes van geldeberekening, moet die waarde van die prototipe en elke herhaling daarvan 'n pro rata deel ten opsigte van voorlopige en algemene items insluit.
(3) Vir die dienste soos uiteengesit in A, C enD van die Aanhangsel ten opsigte van herhalings, geld die toepaslike voile gelde soos in kolom 1 van die Aanhangsel neergele boonop, ongeag die tipe kontrak wat werklik van toepassing is.
(4) Vir enige wysiging van die ontwerp binne 'n protipe wat werk meebring soos in B van die Aanhangsel uiteengesit, moet die toepaslike gelde of anders tydvordering soos in paragraaf 21 bepaal, van toepassing . wees.
K oste-pluskontrakte
10. Vir voile dienste in verband met koste-pluskontrakte is die gelde soos uiteengesit in paragrawe 2, 3 of 4, na gelang van geval, en sluit dit in kosteramings, onderhandelinge in verband met die bedinge en voorwaardes van die kontrak, die reeling van die voorwaardes ten opsigte van spesialis- en ander subkontrakte, die ouditering van tydkaarte, afleweringsnotas, fakture, ens., die nagaan van loontariewe en koste van materiaal, die opstel van progressiewe rekeningstate, toetsopmetings van die vernaamste materiale gebruik in die bouwerk sodat die resultate met fakture vergelyk kan word, en die opstel en skikking van die finale rekening.
Tussentydse gelde en gedeelte/ike dienste
11. (I) Tussentydse gelde wat gevorder word, word gebaseer op die toedeling van gelde aan dienste wat in die Aanhangsel uiteengesit word.
(2) lndien 'n projek of dee I daarvan gestaak of uitgestel word-
(a) word die gelde ten opsigte van voltooide dienste bepaal ooreenkomstig die verdeling soos in die Aanhangsel uiteengesit; en ·
(b) word die gel de ten opsigte van gedeeltelike voltooide dienste desgelyks op 'n quantum meruit basis bepaal.
(3) Indien daar op enige tydstip van die dienste van 'n bourekenaar afgesien word, word die gelde wat ge-

culated in accordance with subparagraph (2).
(4) Where the final value of the works for which fees are charged is unknown the fees shall be calculated on a fair, current estimate of the total final value of the works, excluding any contingency sums.
(5) Should a commission which has been terminated or deferred be resumed without significant change within one year of such termination or deferment, any fee paid in accordance with subparagraphs (2) or (3) shall be considered as payment on account towards the total fees calculated on the final value.
(6) Should a commission be reinstated after a period of one year or within such period but with significant change, such commission may be renewed on a negotiated basis.
(7) Should a commission be undertaken for services in respect of limited trades or other defined portions of the full contract works, the total final value of such trades or portions shall be increased by 20 per cent and the fees calculated in terms of paragraph 2 and the relevant apportionment as set out in the Annexure.
(8) Unless a project is abandoned or deferred there shall be no fragmentation of the percentages for· any sub-sections of services A and C.
Feasibility studies
12. For feasibility studies and the like, involving technical and/or economic investigation and appraisal of a proje.ct to enable a client to decide whether and in what form to proceed, the fee, in addition to any other fcc chargeable. shall be a time charge as laid down in paragraph 21.
Cost planning
13. Where a client lays down special requirements in regard to cost planning, cost analysis and cost monitoring services over and above those set out in the Annexure .the fee shall be a time charge as laid down in paragraph 21.
Annotated Bills of Quantities
14. For additional work in preparing annotations of bills of quantities. the fee shall be a time charge as laid down in paragraph 21.

(5) Indien 'n opdrag wat be<:Hndig of uitgestel is, binne een jaar na sodanige beeindiging of uitstel sonder wesenlike verandering hervat word, word enige gelde wat ooreenkomstig subparagrawe (2) of (3) betaal is, beskou as gedeeltelike betaling op rekening van die totale gelde wat op die finale waarde bereken is.
(6) Indien 'n opdrag na 'n tydperk van een jaar of binne sodanige tydperk maar met wesenlike veranderings, hervat word, mag sodanige opdrag op 'n ooreengekome basis hernieu word.
(7) Indien 'n opdrag onderneem word vir dienste ten opsigte van beperkte ambagte of ander omskrewe gedeejtes van 'n volledige kontrak, word die totale finale waarde van sodanige ambagte of gedeeltes met 20 persent verhoog en die gelde ooreenkomstig paragraaf 2 en die betrokke toedeling van gelde aan dienste wat in die Aanhangsel uiteengesit word, bereken.
(8) Terisy 'n projek gestaak of uitgestel word, sal geen fragmenteringvan enige onderafdeling van dienste A en C wat in die Aanhangsel uiteengesit word, toegelaat word nie.
Gangbaarheidstudies
12. Vir gangbaarheidstudies ·en enige ander studies voor die sketsplanstadium, wat 'n tegniese en/of ekonomiese ondersoek en waardasie van 'n projek behels sodat 'n klient kan besluit of hy en, indien wei, hoe hy moet voortgaan, is die gelde benewens enige ander wat gevorder kan word, 'n tydvordering soos in paragraaf 21 bepaal.
Kostebeplanning
13. Waar die klient spesiale vereistes stel en opsigte van kostebeplanning-, kosteontleding- en kostebeheerdienste bo en behalwe die uiteengesit in die Aanhangsel, is die gelde 'n tydvordering soos in paragraaf21 bepaal.
Geannoteerde hoeveelheidslyste
14. Vir addisionele werk in verband met die annotasie van hoeveelheidslyste word 'n tydvordering soos in paragraaf 21 bepaal, geeis.

Elemental and activity-orientated Bills of Quantities
15. For additional work in preparing elemental, activity-orientated or other specialised forms of bills of quantities, the fee shall be a time charge as laid down in paragraph 21.
Schedules of materials
16. For preparing schedules of materials the fee shall be a time charge as laid down in paragraph 21.
Acting as Primary Agent
17. (1) For acting as the client's primary agent and for receiving the client's brief, advising the client on the legal, functional, technical and financial feasibility of the project, and co-ordinating professional services, an additional fee of 20 per cent of the total fee set out in paragraphs 2, 3 or 4, as the case may be, shall be charged.
(2) For acting as the client's primary agent and for receiving the client's brief, advising the client on the legal, functional, technical and financial feasibility of the project, the co-ordination of professional services, programming of the contract, supervision of work, issuing certificates, commissioning of service installations, handing over the works to the client for occupation, supervision of remedial work to defects and completion of all work in accordance with the contract, an additional fee of 70 per cent of the total fee set out in paragraphs 2, 3 or 4, as the case may be, shall be charged.
Valuation of buildings
18. (1) For surveying works in progress for which the quantity surveyor has not prepared the quantities, taking particulars and preparing valuations for the issue of interim payments, the fee shall be 20 per cent of the total fee set out in paragraph 2.
(2) For preparing valuations of buildings for the assessment of taxation, fire insurance, expropriation, rental return and similar purposes, the fee shall be as follows:
(a) where suitable drawings are available for the determination of measurements, 3 per cent of the total fee set. out in paragraph 2.
(b) where such drawings are not available and measurements are determined on site, 5 per cent of the total fee set out in paragraph '2.
(c) alternatively, where the fees laid down in subparagraphs (a) and (b) are inapplicable, a time

Optrede as primere agent
17. (1) Vir optrede as die klient se primere agent en die ontvangs van die klient se opdrag, advies aan die klient oor die wetlike, funksionele, tegniese en finansiele uitvoerbaarheid van die projek en die koordinering van professionele dienste, word ekstra gelde van 20 persent van die totale gelde, soos in paragrawe 2, 3 of 4, uiteengesit, na gelang van die geval, geeis.
(2) Vir optrede as die klient se primere agent en die ontvangs van die klient se opdrag, advies aan die klient oor die wetlike, funksionele, tegniese en finansiele uitvoerbaarheid van die projek, die koordinering van professionele dienste, die programmering van die kontrak, toesig oor die werk, die uitreik van sertifikate, die inwerking stel van diensinstallasies, die oorhandiging van die werke vir okkupasie aan die kW!nt, toesig oor die herstel van defekte en die voltooiing van alle werk ooreenkomstig die kontrak, word ekstra gelde van 70 persent van die totale gelde, soos in paragrawe, 2, 3 of 4 uiteengesit, na gelang van die geval, geeis.
Waardasie van geboue
18. (1) Vir die opmeet van werke wat nog uitgevoer word en waarvoor die bourekenaar nie hoeveelheidslyste opgestel het nie, die verkryging van besonderhede en die opstel van waardasies vir die uitreiking van tussentydse betalingssertifikate, is die gelde 20 persent van die totale gelde, soos in paragraaf 2 uiteengesit.
(2) Vir die opstel van waardasies van geboue vir belastingdoeleindes, brandversekering, onteiening, huurrendement en dergelike doeleindes, is die gelde soos volg-
(a) waar geskikte tekenmge vir die bepaling van afmetings beskikbaar is, 3 persent van die totale gelde soos in paragraaf 2 uiteengesit;
(b) waar sodanige tekeninge nie beskikbaar is nie en · afmetings op die terrein bepaal word, 5 persent
van die totale gelde soos in paragraaf 2 uiteengesit;
(c) waar die gelde in subparagrawe (a) en (b) uiteengesit, nie as toepaslik beskou word nie, 'n tyd-

charge as laid down in paragraph 21.
Default
19. For additional services required as a result of default by either party to the contract, the fee shall be the appropriate fee in accordance with the apportionment set out in the Annexure or, alternatively, a time charge as laid down in paragraph 21.
Disputes and Litigation
20. For assisting in the settlement of disputes, attending conferences with legal consultants and attending at court, the fee shall be a time charge as laid down in paragraph 21.
Time charge
21. ( 1) Where the work is of such a nature that other provisions herein are inapplicable, the fee shall be a time charge at the following rates per hour or part thereof-
(~)~Principals, partners or directors: R30 00
(~) Salaried Staff: 15 cents for each R 100 of gross annual salary, inclusive of bonus, if any, of the person concerned, subject to a maximum of the rate stated in subparagraph (a).
Acting as Arbitrator
22. (1) For acting as arbitrator where there is more than a single one, the fee shall be the time charge laid down in paragraph 21 plus 25 per cent with a minimum of two hours.
(2) For acting as sole arbitrator or umpire, the fee shall be the time charge laid down in paragraph 21 plus 75 per cent, with a minimum of two hours. ·
(3) The fees laid down in subparagraphs (1) and (2) shall apply to the time spent in establishing procedural matters with the parties, attending the arbitration court, studying the evidence and framing the award.
Disbursements and travelling expenses
23. (1) Disbursements necessarily incurred, copies of documents and drawings, and reasonable travelling and subsistance expenses shall be charged for in addition to professional fees.
(2) An additional time charge, at the rate laid down in section 21, shall be made for time spent in travelling

Optrede as Arbiter
22. ( 1) Vir optrede as arbiter waar daar meer as net een is, is die gelde wat gevra word 'sn tydvordering teen die tarief in paragraaf 21 bepaal plus 25 persent, met 'n minimum van twee ure.
(2) Vir die optrede as die enigste arbiter of, skeidsregter, is die gelde wat gevra word 'n tydvordering teen die tarief in paragraaf 21 bepaal plus 7 5 persent, met 'n minimum van twee ure.
(3) Die gelde in subparagrawe (1) en (2) uiteengesit, is van toepassing op die tyd bestee aan die vasstelling van prosedures in oorleg met die partye, bywoning van die arbitrasiehof, die ondersoek van getuienis en die formulering van die uitspraak.
Uitgawes en reiskoste
23. (I) Benewens die gelde vir professionele dienste word betaling geeis ten opsigte van uitgawes wat noodsaaklikerwys aangegaan word vir afskrifte van dokumente en afdrukke van tekeninge en vir redelike reis- en verblyfkoste.
(2) Waar die werke verder as 50 km van die bourekenaar se praktyk gelee is, word addisionele gelde ten

2. The details given above are intended to indicate the extent of services covered by the fees and not as a list of invariable requirements. In terms of subsection ( 6) of section 7 of the Architects' and Quantity Surveyors' Act, 1979 (Act 13 of 1979), it is hereby made known that the AdministratorGeneral has, under subsection (3) of the said section 7, prescribed the minimum fees set out in the Schedule, which shall be chargeable by an architect for his professional services.

Woordomskrywings
1. In hierdie Kennisgewing, tensy uit die samehang anders blyk, het 'n woord of uitdrukking waaraan in die Wet op Argitekte en Bourekenaars, 1979, 'n betekenis

veyors' Act, 1979, shall bear the same meaning, and-
(a) "project" means a building or scheme for all or part of which an architect has been commissioned;
(b) "supervision" means such periodic visits to the works or related to the works as the architect may consider necessary to satisfy himself that the work is proceeding in accordance with the conditions of contract;
(c) "works" means a building or scheme as executed or in the course of construction.
General
2. ( l) Agreement between client and architect. The services of an ,architect are rendered most effectively when a definite understanding exists between client and architect regarding their respective obligations and responsibilities. It is advisable that there should be a contractural agreement in writing.
(2) Calculation of remuneration
(a) Percentage fee: The architect is normally remunerated· for his services by way of a percentage fee calculated as a percentage of the cost of the works or on the estimated cost of the project, as the case may be. Where, however, the work is of such a nature that percentage or other stated fees are inappropriate or where· there has been prior written agreement with the client, the fee shall be calculated on a time basis at the rates set out in paragraph 4( l ).
(b) Cost of the works: For the purposes of calculating the percentage fee -
(i) "cost of the works" means the cost of all work executed including the cost of electrical, mechanical and other specialist services which form an integral part of the building~
(ii) where the ar:chitect is required to design, specify or coordinate the installation of mach,inery or equipment related to the specific useutlr the building such as those required for production, manufacturing, treatment or processing, his fee for such services shall be negotiated. It shall be based on the magnitude, nature and complexity of the architect's involvement;
(iii) the cost of the works shall include the actual or estimated cost of any work excluded from the contract and in respect of which the

(a) Persentasiegelde: Die argitek word gewoonlik vir sy dienste vergoed deur persentasiegelde wat bereken word, na gelang. van die geval, as 'n persentasie van die koste van die werke .of van die beraamde koste van 'n projek. Waar die werk egter van so 'n aard is dat persentasie- of ander bepaalde gelde nie van toepassing is nie of waar 'n voorgaande ooreenkoms met die klient bestaan, word die gelde bereken teen die tydgeldetariewe in paragraaf 4( 1) uiteengesit.
(b) Koste van die werke: Vir die doeleindes van die berekening van die persentasiegelde beteken -
(i) "koste van die werke" die koste van al die werk wat uitgevoer is met inbegrip van die koste van elektriese, meganise en ander gespesialiseerde dienste wat 'n integrate deel van die gebou vorm;
(ii) waar dit van die argitek vereis word om die installasie van masjinerie of uitrusting verwant aan die spesifieke gebruik van die ge- .
''bou soos die vereis ·vir produksie, vervaardiging, behandeling of verwerking te ontwerp, te spesifiseer of te koordineer, word die gelde vir sodanige dienste bepaal deur onderhandeling. Dit moet gebaseer word op die belangrikheid, aard en . ingewikkeldheid van die argitek se betrokkenheid;
(iii) die koste van die werke sluit in die werklike of beraamde koste van enige werk wat by die kontrak uitgesluit word. en in verband waar-

architect has rendered a normal service;
(iv) the cost of the work does not include the architect's fees and disbursements and those of the quantity surveyor, engineer or other consultants, nor the salaries of the client's technical site personnel;
(v) the cost of old or re-used materials used in the works shall be calculated as if they were new;
(vi) where any materials, labour or carriage are supplied by a client who is not the builder, the cost shall be calculated as if they were supplied by the ~uilder and included in the cost of the works.
(3) Consultants
(a) The architect's services do not include quantity surveying, town planning, civil, structural, mechanical, electrical or heating and ventilating engineering or other consultant's services. The architect shall, however, be responsible for the co-ordination of such services. Where provision of such services falls outside the competence of the architect's own office or where they are provided by consultants in association with the architects, fees shall be calculated in accordance with the scales of fees of the appropriate professional bodies. Time charges shall, however, be charged in accordance with this Notice.
(b) where the services of more than one profession are provided by a single firm or consortium, the fees chargeable shall be the sum of the appropriate fees •for the individual professional services rendered.
( 4) Supervision and inspection
(a) The architect shall supervise the works.
(b) The architect shall not be responsible for the contractor's operational methods, techniques, sequences or procedures or for safety precautions in connection with the work,nor shall he be responsible for any failure by the contractor to carry out and complete the work in accordance with the terms of the building contract between the client and the contractor.
(c) Where the nature of the project is such that it requires a greater degree of contract administration than set out in paragraphs 2 and 3, the client and architect shall agree on the extent of these additional administrative services and on payment therefor.

(3) ~nsultante
(a) Die argitek se werk sluit nie bourekening, stadsbeplanning, siviele-, strukturele-, meganiese-, elektriese- of verwarming- en ventilasie-ingenieurswerk of ander konsultantdienste in nie. Die argitek is egter verantwoordelik vir die koordinasie van sodanige dienste. Waar die voorsiening van sodanige dienste buite die bevoegdheid van die argitek se eie kantoor val of waar hulle verskaf word deur konsultante in samewerking met die argitekte, word gelde bereken volgens die geldeskale van die betrokke professionele liggame. Tydgelde sal egter volgens hierdie Kennisgewing gevorder word.
(b) waar die dienste van meer as een professie deur 'n enkel firma of konsortium verskaf word, is die gelde betaalbaar die totaal van die betrokke gelde vir die individuele professionele dienste wat gelewer is.
(4) Toesig en inspeksie
(a) Die argitek hou toesig oor die werke.
(b) Die argitek is nie verantwoordelik vir die bouaannemer se werksmetodes, tegnieke, order van werkwyse of vir veiligheidsvoorsorgmaatreels in verband met die·werk nie en is ook nie verantwoordelik vir die onvermoe van die bou-aannemer om die werk te doen en te voltooi volgens die vereistes van die boukontrak tussen die klient en bou-aannemer nie.
(c) Waar die aard van die projek sodanig is dat 'n groter mate van kontrakadministrasie nodig is as · wat in paragrawe 2 en 3 uiteengesit is, moet die klient en argitek ooreenkom oor die omvang van hierdie bykomstige administratiewe dienste en betaling daarvoor.

(d) If the client requires full-time inspection during the progress of the work, acceptable technical site personnel shall be retained by the client, preferably in consultation with the architect.
(e) The client shall be responsible for employing and paying site personnel.
Fees for full professional services
3. (l) New works.An architect shall charge for his professional services in connection with new works, a fee of not less than 6 per cent of the final cost of the works.
(2) Works to existing buildings. An architect shall charge for his professional services in connection with works to existing buildings -
(a) a fee of not less than 6 per cent of the final cost of the works;
(b) not less than the time charges prescribed in paragraph 4( I) for the measurement, surveying and recording of the existing structures.
Time charges
4. (I) Hourly rates. The minimum fee per hour when fees are calculated on a time basis shall be -
(a) principals, partners or directors: R30,00;
(b) salaried staff: 15 cents for each R 100 of gross annual salary, inclusive of any bonus of the person concerned, subject to a maximum of the rate prescribed in subparagraph (a).
(2) Services at time charges
(a) Feasibility studies: The undertaking ·of preliminary technical and economic appraisals of projects, advising upon municipal and statutory requirements and any other services of a like nature.
(b) Special consultative services: The preparation for the use of the client, of drawings or documents in addition to working drawings, the preparation of drawings or models for negotiation with landowners, owners of adjoining land, public authorities:''ficensing authorities and others, special research to establish the basis for the design, negotiations arising from applications for building or other licences. town planning, bye-laws or other approvals and negotiations in connection with party walls. rights of light and other servitudes, reservations or restrictions and any other consultative services.
(d) Indien die klient voltydse inspeksie vereis gedurende die vooruitgang van die werk, moet aanvaarbare tegniese personeel deur die klH!nt in diens geneem word, verkieslik na beraadslaging met die argitek.
(e) Die kW!nt is verantwoordelik vir die indiensneming en besoldiging van terreinpersoneel.
Gelde vir volle professionele dienste
(3) (1) Nuwe werke 'n Argitek vorder vir sy professionele dienste in verband met nuwe werke gelde van minstens 6 persent van die finale koste van die werke.
(2) Werke aan bestaande geboue 'n Argitek vorder _vir sy professionele dienste in verband met werke aan bestaande geboue -
(a) gelde van minstens 6 persent van die finale koste van die werke;
(b) minstens die tydgelde voorgeskryf in paragraaf 4(1) vir die meet, opmeet en opteken van die bestaande strukture.
Tydgelde
4. (1) Uurtariewe Die minimum gelde per u_ur wanneer gelde op 'n tydbasis bereken word, is -
(a) prinsipale, vennote of direkteure: R30 00;
(b) gesalarieerde person eel: 15 sent vir elke R 100 van die bruto jaarlikse salaris, met inbegrip van enige bonus, indien daar is, van die betrokke persoon, onderworpe aan 'n maksimum tarief soos in subparagraaf (a) voorgeskryf.
(2) Dienste teen tydgelde
(a) Gangbaarheidstudies: Die onderneem van voorlopige tegniese en ekonomiese waarderings van projekte, raadgewing oor munisipale en statutere voorskrifte en enige ander soortgelyke dienste.
(b) Spesiale konsultdienste: Die voorbereiding van tekeninge of dokumente benewens werktekeninge vir gebruik deur die klient, die voorbereiding van tekeninge of modelle vir onderhandeling met grondeienaars, eienaars van aanliggende grond, openbare owerhede, lisensieowerhede en andere, spesiale navorsing om die basis vir die ontwerp vas te stet, onderhandelings wat voortspruit uit aansoeke om bou- of ander lisensies, stadsbeplanning, verordeninge of ander goedkeurings en onderhandelings in verband met gemeenskaplike mure, ligregte en ander serwitute, voorbehoude of beperkings en enige ander konsultdienste.

(c) Briefmg: The preparation, at the specific request of a client, of a brief of the client's requirements for the design of a project and all consultations in connection therewith.
(d) litigation and disputes: The rendering of professional services in connection with litigation or arbitration, other than those set out in subparagraph (4).
(e) Inspection of building work for which he is not the architect: The periodic inspection of a building in the course of construction and the documents relating thereto on behalf of a mortgagee, reporting thereon and certifying thereof.
(f) The valuation of buildings.
(g) Professional services in connection with work arising out of the insolvency of the employer or contractor.
(h) Extra work caused as a result of delay in receiving instructions, delays in building, changes in the client's instructions or any other cause not attributable to the architect.
(3) Travelling time
(a) Where work is being charged on a time basis, all travelling time shall be charged at not less than the hourly rate.
(b) Where work, charged on a percentage fee basis, is at such a distance that an exceptional amount of time is spent in travelling, additional charges may be made by prior written agreement.
(4) Arbitration
(a) For _acting as arbitrator where there is more than a single one or for acting as assessor, the fee shall be not less than the hourly time charge for P.rincipals and partners prescribed in paragraph 4(1Xa) plus 25 per cent, subject to a minimum charge of twice the hourly rate prescribed in paragraph 4(1Xa).
(b) For acting as -sole arbitrator or umpire the fee shall be not less than the hourly time charge for principals and partners prescribed in paragraph 4(1Xa) plus 75 per cent, subject to a minimum charge of three times the hourly rate prescribed in paragraph 4(1Xa).
(c) The fees prescribed in paragraphs 4(1Xa) and 4(1Xb) relate to time spent in attending the arbitration court, in studying evidence and in framing the award.

(d) Regsgedinge en geskille: Die lewering van ander professionele dienste in verband met regsgedinge of arbitrasies as die uiteengesit in subparagraaf (4).
(e) Inspeksie van bouwerk waarvan hy nie die argitek is nie: Die periodieke inspeksie van 'n gebou in aanbou en die dokumente wat daarop betrekking bet ten behoewe van 'n verbandhouer, verslaggewing daaroor en sertifisering daarvan.
(f) Die waardering van geboue.
(g) Professionele dienste in verband met werk wat ontstaan uit die insolvensie van die werkgewer of bou-aannemer.
(h) Ekstra werk veroorsaak as gevolg van vertraging in die ontvangs van instruksies, vertraging in die bouery, veranderinge ·in die klient se instruksies of om enige ander rede wat nie aan die argitek toegeskryf word nie.
(3) Reistyd
(a) Waar betaling vir werk geskied op 'n tydbasis, word gelde gevorder vir totale reistyd teen minstens die uurtarief.
(b) Waar betaling vir werk wat op 'n persentasiebasis geskied, so ver weg is dat 'n buitengewone hoeveelheid tyd aan die reis bestee word, kan ekstra vorderings gemaak word deur 'n voorafgaande skriftelike ooreenkoms.
(4) Arbitrasie
(a) Vir optrede as arbiter, waar daar meer as een is, of as assessor, is die gelde minstens die uurtarief vir prinsipale en vennote voorgeskryf in paragraaf 4(1Xa) plus 25 persent, onderworpe aan 'n minimum vordering van dubbel die uurtarief voorgeskryf in paragraaf 4(1Xa).
(b) Vir optrede as alleenarbiter of -skeidsregter is gelde minstens die uurtarief vir prinsipale en vennote soos voorgeskryf in paragraaf 4(1Xa) plus 75 persent, onderworpe aan 'n minimum vordering van drie keer die uurtarief voorgeskryf in paragraaf 4(1Xa).
(c) Die gelde voorgeskryf in paragrawe 4(1Xa) en 4(1Xb) het betrekking op die tyd wat in beslag geneem word deur bywoning van die arbitrasiehof, die bestudering van die getuienis en die formulering van die beslissing.

Repeated buildings
5. ( l) Where a building is repeated for the same client and the repeated building is entirely separate therefrom and is a repetition of one type erected from the same drawings and documents, an architect shall charge the following fees -
(a) for the first building, not less than 6 per cent of the final cost of such building;
(b) for identical repeats without modifications, not less than I per cent of the final cost of such building, for the re-use of the documentation of each building, excluding the cost of site works and services;
(c) for preparation of site and service plans, not less than 4,5 per cent of the final cost of the site works and services for the repeated buildings;
(d) for supervision and administration of the repeated works, not less than 1,5 per cent of the final cost thereof, including site works and services;
(e) for any modification to the documentation of the first building, excluding site works and services, not less than the time charges prescribed in paragraph 4( 1 ).
Partial services
6. (I) Where an architect renders only a partial service his fee shall, unless otherwise provided, be as follows-
(a) for the preparation of sketch designs to the client's stated brief, not less than 20 per cent of the fees prescribed in paragraph 3( 1) or 3(2) (a) as the case may be, based on the estimated cost of the project; ·
(b) for the preparation of sketch designs to the client's stated brief and the completion of documents sufficient for the application for approval by local authorities and statutory bodies, not less than 40 per cent of the fee prescribed in
., paragraph 3( I) or 3(2)(a) as the case may be, based ori 'the" estimated cost of the project, less any amounts previously paid in accordance with this paragraph;
(c) for the preparation of sketch designs to the client's stated brief, the completion of documents sufficient for the application .of approval by local authorities and statutory bodies, and the completion of documents sufficient for the preparation of bills of quantities or for the purpose of ob-

5. (1) Waar 'n gebou vir dieselfde klit~nt herhaal word en die herhaalgebou geheel en al apart daarvan is en 'n herhaling van een tipe is wat volgens dieselfde tekeninge en dokumente opgerig word, vra 'n argitek die volgende gelde daarvoor -

(c) vir die voorbereiding van terrein- en diensteplanne, minstens 4,5 persent van die finale koste van die terreinwerke en -dienste in verband met die herhaalgeboue;
(d) vir die toesig oor en administrasie van die herhaalwerke, minstens 1,5 persent van die finale koste daarvan, met inbegrip van terreinwerke en -dienste;
(e) vir enige wysiging van die dokumentasie van die eerste gebou, uitgesonderd terreinwerke en -dienste minstens die tydgelde voorgeskryf in paragraaf 4(1 ).
Gedeeltelike dienste
6. (1) Waar 'n argitek slegs gedeeltelike dienste !ewer, is sy gelde, tensy anders bepaal, die volgende-
(a) vir die voorbereiding van sketsontwerpe ooreenkomstig die gegewe opdrag van die klient, minstens 20 persent van die gelde voorgeskryf in paragraaf 3(1) of 3(2)(a), na gelang van die geval, gebaseer op die beraamde koste van die projek;
(b) vir die voorbereiding van sketsontwerpe ooreenkomstig die gegewe opdrag van die klient en die voltooiing van toereikende dokumente vir die aansoek om goedkeuring deur plaaslike en statutere owerhede, minstens 40 persent van die gelde voorgeskryf in subparagraaf 3(1) of 3(2)(a), na gelang van die geval, gebaseer op die beraamde koste van die projek, min enige vorige betalings ingevolge hierdie paragraaf;
(c) vir die voorbereiding van sketsontwerpe ooreenkomstig die gegewe opdrag van die klient, die voltooiing van toereikende dokumente vir aansoek om goedkeuring deur plaaslike en statutere owerhede, en die voltooiing van toereikende dokumente ter voorbereiding van hoeveelheidslyste of

taining tenders, not less than 7 5 per cent of the fee prescribed in paragraph 3(1) or 3(2Xa) as the case may be, based on the amount, of the accepted tender or, if no tender is accepted, on the lowest bona fide tender or, if no tenders are called for, on the estimated cost of the project at current market prices as determined by a quantity surveyor, or if no quantity surveyor has been appointed, the estimated cost as determined by the architect, less any amounts previously paid in accordance with this paragraph;
(d) for the supervision and administration of the works, not less than 25 per cent of the total percentage fees chargeable for his full services based on the cost of works executed.
Termination of an architect's services
7. (1) If an architect's brief is terminated or materially altered, his fees shall be calculated as follows
(a) if his brief is terminated or materially altered prior to the completion of the sketch design to the client's stated brief, a fee calculated at a rate of not less than the time charges prescribed in paragraph 4(1);
(b) if his brief is terminated or materially altered after completion of the sketch design prepared to the client's stated brief, a fee of not less than 20 per cent of the fee prescribed in paragraph 3(1) or 3(2Xa) as the case may be, based on the estimated cost of the project as at the date of termination;
(c) if his brief is terminated or materially altered prior to the completion of documents sufficient to meet the requirements for the approval by local authorities and statutory bodies, a fee of not less than the fee prescribed in subparagraph (b) plus a fee pro rata to the work done at the rate pre- · scribed in subparagraph (d) or calculated at the time charges prescribed in paragraph 4(1), whichever is the greater;
(d) if his brief is terminated or materially altered after the completion of documents sufficient for the application for the approval by local authorities and statutory bodies, a fee not less than 40 per cent of the fee prescribed in paragraph 3(1)or 3(2Xa), as the case may be, based on the estimated cost of the project, less amounts previously paid in accordance with this paragraph as at the date of termination;
(e) if his brief is terminated or materially altered prior to the completion of such documentation as may be necessary for the preparation of bills of

Beeindiging van 'n argitek se dienste
7. (1) Indien 'n argitek se opdrag beeindig of wesentlik verander word, word sy gelde soos volg bereken-
(a) indien sy opdrag beeindig of wesentlik verander word voor die voltooiing van die sketsontwerp ooreenkomstig die gegewe opdrag van die klient, gelde bereken teen minstens die skaal vir tydgelde voorgeskryf in paragraaf 4(1);
(b) indien sy opdrag beeindig of wesentlik verander word na voltooiing van die sketsontwerp ooreenkomstig die gegewe opdrag van die klient, minstens 20 persent van die gelde voorgeskryf in paragraaf 3(1) of 3(2Xa), na gelang van die geval, gebaseer op die beraamde koste van die projek, ten tyde van die beeindiging;
(c) indien sy opdrag beeindig of wesentlik verander word voor die voltooiing van dokumente wat voldoen aan die vereistes vir goedkeuring deur plaaslike en statutere owerhede, minstens die gelde voorgeskryf in subparagraaf (b) plus 'n pro rata bedrag vir die werk wat verrig is en bereken volgens die skaal voorgeskryf in subparagraaf (d) of volgens die tydgelde voorgeskryf in paragraaf 4(1), watter ook al die grootste is;
(d) indien sy opdrag beeindig of wesentlik verander word na die voltooiing van toereikende dokumente vir aansoek om goedkeuring deur plaaslike en staturere owerhede, minstens 40 persent van die gelde voorgeskryf in paragraaf 3(1) of 3(2Xa), na gelang van die geval, gebaseer op die beraamde koste van die projek, min enige vorige betalings ingevolge hierdie paragraaf, ten tyde van die beeindiging;

quantities or for the purpose of obtaining tenders, a fee of not less than the fee prescribed in subparagraph (d) plus a fee pro rata to the work done at the rate prescribed in subparagraph (f) or calculated at the time charges prescribed in paragraph 4(1), whichever is the greater;
(f) if his brief is terminated or materially altered after the completion of documentation sufficient for the preparation of bills of quantities or for the purpose of obtaining tenders, a fee ofnot less than 75 per cent of the fee prescribed in paragraph 3(1) or 3(2)(a), as the case may be, based on the amount of the accepted tender or, if no tender is accepted, on the lowest bonafide tender or, if no tenders are called for, on the estimated cost of the project at current market prices as determined by a quantity surveyor or, if no quantity surveyor has been appointed, the estimated cost as determined by the architect, less amounts previously paid in accordance with this paragraph: Provided that if a project is terminated or abandoned for any reason and the architect had agreed a cost limit with his client, the amount on which the fee is calculated shall not exceed such cost limit by more than 10 per cent;
(g) if his brief is terminated or materially altered during the execution of the works, a fee in addition to the fees prescribed in subparagraphs (a) to (f) of not less than 25 per cent of the total percentage fees chargeable for his full services based on the cost of works executed on the date of such termination.
Interior design
8. An architect shall for his professional services in connection with special interior design, including the design and selection of furniture, fittings and soft furnishings, charge a fee of not less than 12 per cent of the total cost of such items or at the time charges prescribed in paragraph 4( 1).
Out-of-pockf!l expenses
9. ( l) In addition to the fees under any other paragraph of this Notice, the architect shall be reimbursed for all reasonable out-of-pocket expenses actJ.lally and properly incurred in connection with the commission which shall include the following-
(a) Drawings and documents: Printing, reproduction or purchase costs of all documents, drawings, maps, models. photographs and other records. including all those used in communication between architect, client. quantity surveyor, consultants and contractors and for enquiries to contractors. subcontractors and suppliers, notwith-

(g) indien sy opdrag beeindig of wesentlik verander word gedurende die uitvoering van die- werke, minstens 25 persent van die totale persentasiegelde betaalbaar vir sy voile dienste gebaseer op die koste van die werke wat uitgevoer is op die datum van sodanige beeindiging, bo en behalwe die gelde voorgeskryf in subparagrawe (a) tot (f).
Binnenhuise antwerp
8. 'n Argitek moet vir sy professionele dienste ten opsigte van spesiale binnenhuise ontwerp, met inbegrip van die ontwerp of uitsoek van meubels, toebehore en meubelstowwe, minstens 12 persent van die totale koste van sodanige items in gelde vra, of volgens die tydgelde voorgeskryf in paragraaf 4(1).
Verskotte
9. (1) Bo en behalwe die gelde betaalbaar onder enige ander paragraaf van hierdie Kennisgewing, word die argitek terugb~ta~ . vir enige redelike verskotte werklik en behoorlik aangegaan in verband met die opdrag wat die volgende insluit -
(a) Tekeninge en dokumente: Drukwerk, reproduksie of aankoopkoste van aile dokumente, tekeninge, kaarte, modelle, foto's en ander optekeninge, met inbegrip van die gebruik vir kommunikasie tussen argitek, klient, bourekenaar, konsultante en bou-aannemers en vir navrae by bou-aannemers, onderaannemers en verskaffers,

standing any obligation on the part of the architect to supply such documents to those concerned, except that contractors and suppliers shall pay for any prints additional to those to which they are entitled under the contract.
(b) Hotel and travelling expenses: Hotel and travelling expenses, including mileage allowances for cars at the highest prevailing rates applicable to the Government Service and other similar disbursements.
(c) Disbursements:
(i) all payments made on behalf of the client, including expenses incurred in advertising for tenders, for clerks of work and other resident site staff, including the time and expenses of interviewers and reasonable expenses for the persons interviewed;
(ii) fees and other charges for specialist professional advice, including legal advice, which have been incurred by the architect with the specific authority of the client.
Damage to or destruction of works
10. If, at any time before the completion of the works, any part of the works or of the equipment therefor is damaged or destroyed by operations of war, fire, storm, flood or other cause beyond the control of the architect, the client shall pay to the architect a fee prescribed in paragraph 4(1) for any additional work which may be required from him as a result of such damage or destruction and if the damage is of a nature requiring the rebuilding of the project, the fees shall be determined in accordance with the percentage scale unless there is a written agreement to the contrary.
Abandoned works and resumed commissions
10. (I)' Abandoned works
(a) Where the project is cancelled on the client's instructions or the architect is instructed to stop work idefinitely at any time, the commission shall be deemed to be abandoned and the fees

(b) If instructions necessary for the architect to continue work are not received from the client six months after such instructions were requested, the commission shall, notwithstanding subparagraph (a), be deemed to have been abandoned unless the client and architect have agreed otherwise.

Beskadiging of vernietiging van die werke
I 0. Indien enige deel van die werke of die toerusting daarvoor te eniger tyd voordat die werke voltooi is, beskadig of vernietig word deur krygsverrigtinge, vuur, storm, vloed of enige ander oorsaak buite die beheer van die a.rgitek, betaal die klient aan die argitek die gelde voorgeskryf in paragraaf 4(1) vir enige bykomstige werk wat nodig mag wees as gevolg van sodanige beskadiging of vernietiging en indien die beskadiging van 'n aard is wat die herbou van die projek vereis, word die gelde vasgestel volgens die persentasieskaal tensy 'n skriftelike ooreenkoms bestaan wat vir die teendeel voorsiening maak.
Prysgegewe werke en hervatte opdragte
11. ( 1) Prysgegewe werke
(a) Waar 'n projek in opdrag van die klient opgese word of die argitek te eniger tyd gelas word om werk vir 'n onbepaalde periode te staak, word die opdrag as laat v~~r beskou en die gelde word bereken soos in paragraaf 7 voorgeskryf.
(b) Indien instruksies om a an te gaan met die werk nie van die klient ontvang word binne ses maande nadat daarvoor gevra is nie word die opdrag ondanks subparagraaf (a) as laat vaar beskou tensy die argitek en klient anders ooreengekom het.

(2) Resumed commissions Where a comm1ss1on which has been abandoned is resumed at any time with substantial alteration, any fees paid under subparagraph (l) shall be regarded as final payment for the service originally rendered. The resumed commission shall then be deemed to be separate and fees shall be charged in accordance with paragraph 3 for new works or works to existing buildings, as the case may be. If, however, a substantial amount of the work done during the previous commission is used, a quantum meruit basis shall be negotiated for the new commission.
Interpretation and disputes
11. Where any difference or dispute arising out of the interpretation of any part of this Notice cannot be resolved by negotiation between the parties, it shall be referred to the arbitration of a person to be agreed between the parties or, failing agreement within 14 days after either party has given the other written request to concur in the appointment of an arbitrator, a person to be nominated at the request of either party by the President of the South West African Council for Architects and Quantity Surveyors.
Repeal of government notices
Government Notices R316 of 5 March 1971, R 1408 of 25 July 1975, R867 of 25 April 1980, R89 of 16 January 1981 are hereby repealed.

REGULATIONS MADE UNDER THE ARCHITECTS' AND QUANTITY SURVEYORS' ACT,1979
The Administrator-General has, under section 1.8 of the Architects' and Quantity Surveyors' Act, 1979 (Act 13 of 1979), made the regulations set out in the Schedule.
SCHEDULE
Definitions
I. ( 1) In these regulations, unless the context indicates otherwise.· any expression or word to which a meaning has been assigned in the Act, shall bear the same meaning and-
(i) "president" means the President of the South West African Council for Architects and Quantity Surveyors; (ii)
(ii) "the Act" means the Architects and Quantity Surveyors' Act. 1979 (Act 13 of 1979). (i)

1. ( 1) In hierdie regulasies, tensy uit die samehang anders blyk, het 'n woord of uitdrukking waaraan in die Wet 'n betekenis geheg is, dieselfde betekenis en beteken

Meetings of the council
2. (1) Subject to the provisions of subregulation (2) all meetings of the council shall be held at such times and places as may be fixed by the council: Provided that the council shall meet at least once in every year: Provided further that, if at the close of any meeting the council has not fixed the time and place for its next meeting, such time and place shall be determined by the president.
(2) The president may, at any time, call a meeting of the council to be held at such time and place as he may determine.
(3) The president shall, upon a written and motivated request, signed by not less than four members of the council, call a meeting thereof to be held within four weeks after the date of receipt of such request, at such time and place as he may determine.
(4) A notice in writing, together with the agenda, shall be forwarded to every member of the council at his registered address not less than two weeks before the date of the meeting.
(5) Only such business as is on the agenda shall be discussed at a council meeting, unless the council unanimously resolves otherwise.
( 6) The agenda of any meeting shall be prepared by the president in consultation with the registrar.
(7) A majority of all members of the council shall form a quorum for any meeting of the council.
(8) Any member of the council having a personal or professional interest in a matter discussed at a meeting of the council shall disclose such interest and shall recuse himself if the meeting so resolves.
(9) The decision of a majority of the members of the council present at any meeting of the council, excluding the person presiding, shall constitute a decision of the council, except that in the event of an equality of votes in regard to any matter, the person presiding at the meeting in question shall have a casting vote but not a deliberative vote.
( 10) The procedure at meetings of the committees established by the council in terms of section 10(1) of the Act shall be mutatis mutandis as set out for the meetings of the council.

(1) Aile vergaderings van die raad word, behoudens die bepalings van subregulasie (2) gehou op die tye en plekke wat die raad bepaal: Met dien verstande dat die raad minstens een maal in elke jaar moet vergader: Met dien verstande voorts dat, indien die raad aan die einde van 'n vergadering nie die tyd en plek vir sy volgende vergadering bepaal het nie, die president sodanige tyd en plek moet bepaal.
(2) Die president kan te eniger tyd 'n vergadering van die raad bele op die tyd en plek wat hy bepaal.
(3) Die president moet op 'n skriftelike en gemoti-veerde versoek wat deur minstens vier lede van die raad onderteken is, 'n vergadering van die raad bele wat binne vier weke na die datum van ontvangs van bedoelde versoek gehou moet word op 'n tyd en plek wat hy bepaal.
(4) 'n Skriftelike kennisgewing tesame met 'n sakelys moet aan elke lid van die raad minstens twee weke voor elke vergadering van die raad na sy geregistreerde adres gestuur word.
(5) Slegs die sake op die sakelys mag op 'n vergadering van die raad bespreek word, tensy die raad eenparig anders besluit.
(6) Die sakelys vir enige vergadering word deur die president in oorleg met die registrateur opgestel.
(7) 'n Meerderheid van al die lede van die raad maak 'n kworum vir 'n raadsvergadering uit.
(8) Enige lid van die raad wat 'n persoonlike of professionele belang het by 'n aangeleentheid wat op 'n vergadering van die raad bespreek word, moet sodanige belang openbaar en homself onttrek indien die vergadering so besluit.
(9) Die beslissing van 'n meerderheid van die lede van die raad wat op 'n vergadering van die raad aanwesig is, met uitsondering van die lid wat voorsit, maak 'n besluit van die raad uit, maar in die geval van 'n staking van stemme oor enige aangeleentheid het die lid wat op die betrokke vergadering voorsit 'n beslissende stem maar geen beraadslagende stem nie.
( 10) Die prosedure op vergaderings van komitees ingestel deur die raad kragtens artikellO(l) van die Wet is mutatis mutandis dieselfde as vir vergaderings van die raad.
Register van argitekte en argitekte-in-op/eiding en bourekenaars en bourekenaars-in-opleiding
3. (1) Die register in artikel 7(2) van die Wet bedoe!, moet die voile naam, adres, kwalifikasies en die

and date of registration of any person in respect of whom a registration certificate has been issued under section 11(2), ll(4) or 11(5) of the Act.
(2) The particulars referred to in subregulation (I) shall be entered in the register only upon payment of the prescribed fee under section 7( IXh) of the Act.
(3) The date of registration referred to in subregulation (I) shall be the date which appears on the certificate of registration issued to him under the Act.
( 4) The registrar shall keep the register correctly and, in accordance with the provisions of the Act, shall remove therefrom the name of any architect or architectin-training or quantity surveyor or quantity surveyor-intraining who has died or whose registration has been cancelled or has lapsed in terms of section 11(8) or 11(9) of the Act or who has been suspended from his profession under section 15(1) thereof by reason of improper conduct. or under section 17(2) thereof by reason of mental disability, and shall, from time to time make the necessary alterations or additions.
(5) No particulars in regard to any degree, diploma or certificate shall be entered in the register unless the council is satisfied that the person claiming to possess such degree, diploma or certificate is entitled thereto.
(6) Any entry which is proved to the satisfaction of the council to have been made in error or through fraudulent misrepresentation or under circumstances not tenable in law shall be deleted from the register.
(7) Whenever any entry inr espect of any person has been deleted under authority of the council, the registrar shall notify the person concerned in writing thereof at his last known address within seven days after such deletion.
(8) Any certificate of registration issued under section I 1 of the Act shall be deemed to be cancelled from the date upon which the relative registration has been cancelled by the council under the Act or has lapsed under section 11(9) thereof.

(9) The register shall be kept in the office of the council and the registrar may from time to time cause copies of the register to be printed and published.
(I 0) The registrar shall issue a duplicate registration certificate to any registered person or a certified extract from the register to any person upon payment of such fees and subject to such conditions as the council may from time to time prescribe.

(4) Die registrateur moet die register noukeurig hou en, ooreenkomstig die bepalings van die Wet, die naam van enige argitek of argitek-in-opleiding of bourekenaar of bourekenaar-in-opleiding wat oorlede is of wie se registrasie ingevolge artikel11(8) of 11(9) van die Wet gekanselleer is of verval het of wat ingevolge artikel 15(1) daarvan weens onbehoorlike gedrag of kragtens artikel 17(2) daarvan weens gekrenkte geestesvermoe geskors is, daaruit verwyder en moet van tyd tot tyd die nodige veranderings of aanvullings bewerkstellig.
(5) Geen besonderhede aangaande ·•n graad, diploma of sertifikaat word in die register ingeskryf nie, tensy die raad daarvan oortuig is dat die persoon wat daarop aanspraak maak dat hy in besit is van sodanige graad, diploma of sertifikaat, daartoe geregtig is.
(6) Indien die raad op grond van gelewerde bewys daarvan oortuig is dat 'n inskrywing per abuis plaasgevind het of ten gevolge van bedrieglike wanvoorstellings of onder omstandighede wat nie regtens verdedigbaar is nie, moet sodanige inskrywing uit die register geskrap word.
(7) Wanneer 'n inskrywing ten opsigte van 'n persoon op gesag van die raad geskrap is, moet die registrateur die betrokke persoon binne sewe dae na sodanige skrapping skriftelik by sy laaste bekende adres daarvan in kennis stet.
(8) 'n Registrasiesertifikaat wat kragtens artikel 11 van die Wet uitgereik is, word geag gekanselleer te wees vanaf die datum waarop die betrokke registrasie deur die raad kragtens die Wet gekanselleer is ofkragtens artikel 11(9) daarvan verval het.
(9) Die register word gehou in die kantoor van die raad en die registrateur kan van tyd tot tyd eksemplare van die register laat druk en publiseer.
( 1 0) Die registrateur moet 'n duplikaat van 'n registrasiesertifikaat aan 'n geregistreerde persoon of 'n gewaarmerkte uittreksel uit die register aan enigiemand uitreik by betaling van sodanige gelde en onderworpe aan sodanige voorwaardes as wat die raad van tyd tot tyd voorskryf.

Code of professional conduct applicable to architects and architects-in-training
4. (1) An architect or, where applicable, an architect-in-training shall, in carrying on his profession, comply with the following rules -
(a) he shall, in the performance of his functions, have full regard for the public interest;
(b) he shall order his conduct so as to uphold the dignity, standing and reputation of his profession;
(c) he shall not conduct himself dishonourably in connection with the work performed by him as an architect;
(d) he shall not conduct himself in such a manner as to bring discredit upon his profession;
(e) he shall order his conduct in connection with architectural work outside the borders of the territory in accordance with these regulations: Provided that where there are recognised standards of professional conduct in a country outside the territory he shall adhere to those standards;
(t) he shall not maliciously or recklessly injure, whether directly or indirectly, the professional reputation, professional prospects or business of any other architect;
(g) he shall discharge his duties to his employer or client in an efficient and competent manner with complete fidelity, without undue delay and with full regard to public safety;
(h) subject to paragraph (i) he shall not -
(i) engage or participate in any of the building trades, except in his capacity as the owner or part owner of a building to be or being erected;
(ii) serve as an employee or a director of or in any other like capacity in any company, firm or undertaking carrying on any contracting, supplyin~,! -or . manufacturing business involved in building or construction work;
(iii) either personally or through the agency of any other person, have any fmancial interest in any company, firm or undertaking carrying on any contracting, supplying or manufacturing business involved in building or construction work: Provided that nothing herein contained shall prevent him from in-

4. (1) 'n Argitek of, waar van toepassing, 'n argitekin-opleiding, moet by die uitoefening van sy beroep die volgende reels nakom -

(e) hy moet sy gedrag in verband met argitekswerk buite die grense van die gebied skik ooreenkomstig hierdie regulasies: Met dien verstande dat waar daar in 'n land buite die gebied erkende standaarde van professionele gedrag bestaan, hy sodanige standaarde moet eerbiedig;
(t) hy moet nie, regstreeks of onregstreeks, kwaadwilliglik of op roekelose wyse, die professionele aansien, professionele vooruitsigte of sake van 'n ander argitek benadeel nie;
(g) hy moet sy verpligtinge teenoor sy werkgewer of klierit op 'n doeltreffende en bevoegde wyse met volkome getrouheid, sonder onredelike versuim nakom en moet die veiligheid van die publiek ten voile in ag neem;
(h) behoudens paragraaf (i) mag hy nie -
(i) gemoeid wees met of aandeel he in enige van die boubedrywe nie, behalwe as eienaar of mede-eienaar van 'n gebou wat opgerig word of gaan word;
(ii) dien as 'n werknemer of as 'n direkteur van of in enige ander soortgelyke hoedanigheid in enige maatskappy, firma of ondememing wat besigheidsbelange het in enige kontrakwerk, leweransiering of vervaardiging wat aan bou- of konstruksiewerk verwant is nie;

vesting in the stocks and shares of any public company whose stocks and shares are quoted on a licensed stock exchange;
(i) he shall, whilst serving as an employee or as a director or in any other like capacity in any company, firm or undertaking carrying on any contracting, supplying or manufacturing business connected with building or construction work, or whilst having a financial interest in any such company, firm or undertaking other than a public company complying with the proviso to paragraph (h) (iii) -
(i) not do or hold himself out to do the work of an architect whether from remuneration or otherwise, except directly and only for such company, firm or undertaking;
(ii) not hold himself out to be in private practice as an architect or to be in a position to give independent advice on matters of contract, pricing or costs;
(iii) ensure that his name and professional designation are not used in brochures or advertisements issued by such company, firm or undertaking or by any other means in a manner which states or implies that an independent architectural service can be provided; ·
G) he shall not use the advantages of a salaried position to compete unfairly with other architects;
(k) he shall not issue any drawings or specifications or professional documents in respect of work performed by himself or by some person in his employ or by any member or employee of the company of which he is a member, unless they bear his name or the name of his firm or the name of the company of which he is a member;
(I) he shall not sign as arr-architect or otherwise identify as having been issued by him, any building plan or other document of which he or his firm or a member or employee of the company of which he is a member is not the bona fide author;
(m) he shall not take part in any architectural competition, limited or otherwise, within the territory, unless the conditions have been submitted to and approved by the council;

(iii) verseker dat sy naam en professionele ampstitel nie gebruik word in brosjures of advertensies wat deur sodanige maatskappy, firma of onderneming uitgereik word of op enige ander wyse wat aandui of impliseer dat 'n onafhanklike argiteksdiens verskaf kan word nie;
G) hy moet nie die voordele verbonde aan 'n gesalarieerde betrekking gebruik om op onbillike wyse met ander argitekte mee te ding nie;
(k) hy moet geen tekeninge of spesifikasies of professionele dokumente uitreik ten opsigte van werk wat deur hom verrig word of deur iemand in sy diens of deur enige lid of werknemer van die maatskappy waarvan hy 'n lid is nie, tensy sy naam of die naam van sy firma of die maatskappy waarvan hy 'n lid is, op genoemde stukke voorkom;
'
(I) hy moet nie as argitek deur ondertekening of enige ander wyse van identifikasie voorgee dat hy die uitreiker is van enige bouplanne of ander dokumente, waarvan hy of sy firma of 'n lid of werknemer van die maatskappy waarvan hy 'n lid is, nie die bonafide-opsteller is nie;
(m) hy moet nie deelneem aan enige argitektuurkompetisie, beperk of andersins, binne die gebied, tensy die voorwaardes voorgele is aan, en goedgekeur is deur, die raad;

(n) he shall not attempt in any way to secure work for which a competition has been instituted, except as a competitor and in accordance with the conditions of such competition;
( o) he shall not attempt to influence, directly or indirectly, the award in a competition;
(p) he shall not act as an architect or joint architect for any work in respect of which he or his partner or a member of the company of which he is also a member has been nominated as assessor or has accepted the assessorship of any architectural competition or has acted as assessor or adjudicator for such competition, unless the council consents to his appointment as architect or joint architect for such work;
( q) he shall not review the work of another architect or the work of a company of which he is not a member for the same client except with the knowledge of such architect or company unless the engagement of such architect or company for the work which is being reviewed has been terminated;
(r) he shall not knowingly undertake a commission while a claim for compensation of an architect previously employed on that commission and whose employment has been terminated remains unsatisfied, without first notifying the council and the architect previously employed;
(s) he shall not undertake or offer to undertake a commission for remuneration less than the fees prescribed under the Act without obtaining the prior consent of the council;
(t) he shall not obtain or attempt to obtain architectural work by means of offering or paying a monetary or other valuable consideration or inducement;
(u) he shall not receive directly or indirectly any royalty, gratuity, commission or other remuneration or any article or process used in or for the purposes of the work in respect of which he is employed unless or until he has notified his employer or client, in writing, of such royalty, gratuity, commission or other remuneration;
(v) he shall neither personally nor through the agency of any other person, whether or not such person is in his employ, canvass nor solicit professional employment nor offer to make, by way of commission or otherwise, payment for the obtaining of such employment;
(n) hy moet nie op enige wyse werk probeer verkry waaroor daar 'n kompetisie uitgeskryf is, behalwe as mededinger en ooreenkomstig die voorwaardes van sodanige kompetisie;

(q) hy moet nie die werk van 'n ander argitek of die werk van 'n maatskappy waarvan hy nie 'n lid is nie vir dieselfde klient nasien sonder die medewete van sodanige argitek of maatskappy nie, _tensy sodanige argitek of maatskappy se diens in verband met die werk wat nagesien word, beeindig is;
(r) hy moet nie willens en wetens 'n opdrag onderneem terwyl 'n eis om vergoeding van 'n argitek van wie se dienste voorheen gebruik gemaak is en wie se dienste beeindig is, nog onbetaald is, sonder om eers die raad en die vorige argitek in kennis te stet nie;
(s) hy moet nie sonder die voorafverkree toestemming van die raad 'n opdrag ondemeem of aanbied om te ondemeem teen vergoeding minder as die gelde wat kragtens die Wet voorgeskryfis nie;
(t) hy moet nie argitekswerk verkry of probeer verkry deur 'n geldelike of ander waardevolle vergoeding of lokmiddel aan te bied of te betaal nie;
(u) hy moet nie regstreeks of onregstreeks vergoeding by wyse van tantieme, gratifikasie, kommissie of ander besoldiging ontvang ten opsigte van 'n artikel of proses wat gebruik word by of vir doeleindes van die werk ten opsigte waarvan hy in diens is nie, tensy of alvorens hy sy werkgewer of klient skriftelik van sodanige tantieme, gratifikasie, kommisisie of ander besoldiging verwittig het;
(v) hy moet nog persoonlik nog deur bemiddeling van enige ander persoon, ongeag of sodanige persoon in sy diens is, professionele werk werf of aanvra of aanbied om te doen of by wyse van kommissie of andersins vir die verkryging van sodanige werk te betaal;

(w) he shall not prepare or submit either directly or indirectly any building plans or schemes for projects or similar documents for which he or his firm or the company of which he is a member has not been professionally engaged;
(x) he shall not advertise or issue circulars or letters to any person or body other than those with whom a business relationship exists, in a manner calculated to attract clients: Provided that he shall not be debarred from taking part by invitation in radio or television programmes, films or other public appearances featuring an architect's work or submitting articles and scripts of his own or another architect's work to the press in which the work is discussed in a manner generally calculated to further the interests or to promote the study and science of architecture;
(y) he shall not act unfairly against the interests of any party to a building contract;
(z) he shall not knowingly compete for professional work with a fellow practitioner with whom any negotiations are taking place in respect of such work~
(aa) he shall not, in his capacity as an architect in private practice, enter into or dissolve any form of professional partnership or association, nor shall be become a member or cease to be a member of any company without notifying the council:
(bb) he shall not, in his capacity as· an architect in private practice, enter into partnership or other association with any person other than an architect or a quantity surveyor in private practice except with the prior approval of the council;
(cc) he shall, within two months after having been instructed, in writing, by the council to do so, dissolve any partnership or other association, or cease to be a member of a company of which he is a member: Provided that the council shall issue such an instruction only if it is satisfied, after due and proper enquiry. that one or more of the other members or employees of the partnership or association or company concerned, who are not registered under section II of the Act, have been guilty of an offence which. had they been so registered, would have constituted a contravention of any provision of these regulations:
(dd) he shall display on all the letterheads of his practice or firm or the company of which he is a member. the name or names of the principal or principals and all the partners or directors thereof

(y) hy moet nie onregverdiglik optree teen die belange van enige party by 'n boukontrak nie;
(z) hy moet nie willens en wetens om professionele werk meeding met 'n mede-praktisyn met wie enige onderhandelings ten opsigte van sodanige werk aan die gang is nie;
(aa) hy moet, in sy hoedanigheid as 'n argitek in private praktyk, geen vorm van professionele vennootskap aangaan of beeindig, of lid word of ophou om lid te wees van enige maatskappy sonder om die raad daarvan in kennis te stel nie;
(bb) hy moet nie sonder die voorafverkree goedkeuring van die raad in sy hoedanigheid as 'n argitek in private praktyk 'n vennootskap of ander assosiasie met enige ander persoon as 'n argitek of bourekenaar in private praktyk aangaan nie;
(cc) hy moet binne twee maande nadat hy skriftelik deur die raad gelas is om dit te doen, enige vennootskap of ander assosiasie beeindig of ophou om 'n lid te wees van 'n maatskappy waarvan hy 'n lid is: Met dien verstande dat die raad sodanige opdrag uitreik slegs indien hy, na deeglike oorweging en behoorlike ondersoek, oortuig is dat een of meer van die ander lede of werknemers van die betrokke vennootskap of assosiasie of maatskappy wat nie ingevolge artikel 11 van die Wet geregistreer is nie, skuldig gemaak het van 'n misdryf wat, indien bulle aldus geregistreer was, 'n oortreding van enige voorskrif van hierdie regulasies sou uitmaak;
(dd) hy moet die naam of name van die prinsipaal of prinsipale en alle vennote of direkteure van die praktyk of firma of maatskappy waarvan hy 'n lid is, op aile briefuoofde toon en moet die dienste

and shall describe the services rendered by the firm or company in a factual manner and related only to the professional work of the professional disciplines represented in the firm or company;
(ee) he shall not use a name with any misleading content for the title and style or name of his firm or of his firm in association with another firm or of the company of which he is a member, nor shall he use any name other than his personal name or names for such title and style or name without the approval of the council: Provided that such title and style or name may include the name of a person of whom he is the bonafide successor in title;
(fi) he shall not perform the work of an architect in private practice within the borders of the territory unless he shall maintain an office within the borders of the territory;
(gg) he shall not maintain any office for the purpose of there carrying on the work of an architect in private practice unless such office shall be under the continual, direct and personal supervision of a registered architect, nor shall he indicate by any means whatsoever that his practice as an architect extends to any office other than the one complying with the terms of this paragraph;
(hh) he shall notify the council without delay of any change of address or employment;
(ii) if he has acted in a consultative capacity in respect of a project for which another architect was employed and whose services were subsequently dispensed with, he shall not undertake such project himself without the consent of the council;
(jj) he shall not wilfully destroy or fail, without a satisfactory reason, to produce original drawings and any other documentary evidence necessary for the verification of his work until three years after the final completion of the contract and settlement of all accounts;
(kk) he shall not engage or act in private practice as an architect under the style of a company or through the medium of a company or practice in association with a company purporting to do work which has been prescribed under section 7(3Xb) of the Act, unless-
(i) the company is a private company limited by shares and incorporated under the Companies Act, 1973, the memorandum of association of

(gg) hy moet nie 'n kantoor aanhou met die doel om daar die werk van 'n argitek in private praktyk te beoefen nie, tensy sodanige kantoor onder die voltydse, regstreekse en persoonlike toesig is van 'n geregistreerde argitek en hy mag ook nie op enige wyse hoegenaamd aandui dat sy praktyk as argitek enige ander kantoor as die wat aan die bepalings van hierdie regulasie voldoen, behels nie;
(hh) hy moet die raad sonder versuim van enige verandering van besigheidsadres of werkkring verwittig;
(ii) hy moet nie nadat hy in 'n konsulterende hoedanigheid opgetree het by werk waarvoor 'n ander argitek aangestel was en wie se dienste daarna beeindig is, sodanige werk self onderneem sonder die goedkeuring van die raad nie;
(jj) hy moet nie willens en wetens die oorspronklike . planne of enige ander dokumentere bewys vir die kontrolering van sy werk, vernietig of sonder 'n aanneemlike rede versuim om dit voor te le voordat 'n tydperk van drie jaar na die finale voltooiing van die kontrak en die vereffening van aile rekeninge verloop het nie;
(kk) hy moet nie in die private praktyk onder die naam van 'n maatskappy of deur middel van 'n maatskappy as argitek optree of praktiseer of in assosiasie met 'n maatskappy wat voorgee dat hy werk doen wat kragtens artikel 7(3Xb) van die Wet voorgeskryf is, praktiseer nie, tensy-
(i) die maatskappy 'n private maatskappy is wat deur aandele beperk is en geinkorporeer is ingevolge die Maatskappywet, 1973, waar-

which shall contain -
aa a provision to the effect that the directors and former directors of the company shall be liable, jointly and severally, together with the company, for such debts and liabilities of the company as are, or were, contracted during their periods of office;
bb subject to paragraph (dd) the name of the company with the word "incorporated" as the last part of its name;
cc a provision to the effect that the company is established for the purpose of carrying out the work of an architect or any work incidental thereto and such work only: Provided that -
i the work aforesaid may include the work of a quantity surveyor and any other work approved by the council;
ii the company shall not carry out the work of an architect unless at least one of its members is an architect;
(ii) the articles of the company shall contain provisions to the effect that -
aa the members of the company shall be natural persons only who are architects registered under the Act: Provided that-
i the members may include quantity surveyors registered under the Act and any other person approved by the council; and
ii in the event of the death of a member or in the event of his ceasing to be qualified as a member for any reason, any shares in the company held by such member prior thereto may continue to be held by him or his estate for such period as the council may determine but the voting rights attached to such shares shall, during such period, be exercised by a member of the company nominated in writing by the deceased or disqualified member prior to his death or disqualification or, failing such nomination, by the chairman for the time being of the company, who shall be deemed to have been so nominated;
van die akte van oprigting moet bevat -

i die lede bourekenaars wat kragtens die Wet geregistreer is en enige ander persoon deur die raad goedgekeur, kan insluit; en
ii indien 'n lid te sterwe kom of om enige rede ophou om te kwalifiseer as lid, enige aandele in die maatskappy deur sodanige lid voor so 'n gebeurtenis gehou, in sy of sy boedel se besit kan bly vir sodanige tydperk as wat die raad vasstel, maar dat die stemreg wat aan sodanige aandele gekoppel is, gedurende sodanige tydperk uitgeoefen word deur 'n lid van die maatskappy wat skriftelik deur die oorledene of gediskwalifiseerde lid, voor sy dood of diskwalifikasie genomineer is, of, by gebrek aan so 'n nominasie, deur die diensdoen~e voorsitter van die maatskappy, \ wat geag word aldus genomineer- te wees;

bb every director of the company shall be a member thereof and every member, whether a director or not, shall be the beneficial owner of the shares registered in his name;
cc in the event of the death of a member or in the case of his ceasing to be qualified as a member for any reason, the remaining directors shall take steps to ensure that the provisions of subparagraph (ii)aa are complied with within the period determined by the council;
(2) Any act done by or on behalf of a company by any member or employee thereof which would constitute improper conduct if done by an architect shall be deemed to have been done by each member of the company who is an architect unless it is proved that he did not knowingly take part in the commission of the act and could not have prevented it.
(3) No architect shall be permitted to do anything through a company which he would not be permitted to do otherwise.
Code of professional conduct applicable to quantity surveyors and quantity surveyors-in-training
5. (1) A quantity surveyor or, where applicable, a quantity surveyor-in-training, shall in carrying on his profession, comply with the following rules -
(a) he shall, in the performance of his functions, have full regard for the public interest;
(b) he shall order his conduct so as to uphold the dignity, standing and reputation of his profession;
(c) he shall not conduct himself dishonourably in connection with the work performed by him as a quantity surveyor;
(d) he shall not conduct himself in such a manner as to bring discredit upon his profession;
(e) he shall order his conduct in connection with quantity surveying work outside the borders of the territory in accordance with '{these regulations: Provided that where there are recognised standards of professional conduct in a country outside the territory, he shall adhere to those standards;
(t) he shall not undertake work of a quantity surveying nature for the execution of which his training and experience have not rendered him competent;

Professionele gedragskode van toepassing op bourekenaars en bourekenaars-in-opleiding
5. (1) 'n Bourekenaar of, waar van toepassing, 'n bourekenaar-in-opleiding, moet by die uitoefening van sy beroep die volgende reels nakom -
(a) hy moet in die uitvoering van sy werksaamhede die openbare belang ten voile in ag neem;
(b) hy moet hom so gedra dat die waardigheid status en goeie naam van sy beroep hoog gehou word:
(c) hy moet homself nie op 'n oneerbare wyse gedra in verband met werk wat deur hom as bourekenaar gedoen word nie;
(d) hy moet homself nie op so 'n wyse gedra dat sy beroep daardeur in oneer gebring word nie;
(e) hy moet sy gedrag in verband met bourekenaarswerk buite die grense van die gebied skik ooreenkomstig hierdie regulasies: Met dien verstande dat waar daar in 'n land buite die gebied erkende standaarde van professionele gedrag bestaan, hy sodanige standaarde moet eerbiedig;
(t) hy moet nie werk van 'n bourekenkundige aard onderneem as sy opleiding en ondervinding hom nie vir die uitvoering daarvan bevoegd maak nie;

(g) he shall not maliciously or recklessly injure, whether directly or indirectly, the professional reputation, professional prospects or business of any other quantity surveyor;
(h) he shall discharge his duties to his employer or client in an efficient and competent manner with complete fidelity and without undue delay;
(i) subject to paragraph G), he shall not -
(i) engage or participate in any of the building trades, except in his capacity as the owner or part owner of a building to be or being erected;
(ii) serve as an employee or a director of or in any other like capacity in any company, firm or undertaking carrying on any contracting, supplying or manufacturing business involved in building or construction work;
(iii) either personally or through the agency of any other person, have any financial interest in any company, firm or undertaking carrying on any contracting, supplying or manufacturing business involved in building or construction work: Provided that nothing herein contained shall prevent him from in
vesting in the stocks and shares of any public company whose stocks and shares are quoted on a licensed stocks exchange;
U) he shall, whilst serving as an employee or as a director or in any other like capacity in any company, firm or undertaking carrying on any contracting, supplying or manufacturing business involved in building or construction work, or whilst having a financial interest in any such company, firm or undertaking other than a public company complying with the proviso to paragraph (i)(iii)-
(i) not do or hold himself out to do the work of a quantity surveyor whether for remuneration or otherwise, except directly and only for such company, firm or undertaking;
(ii) not hold himself out to be in private practice as a quantity surveyor or to be in a position to give independent advice on matters of contract. pricing or costs:
(iii) ensure that his name and professional designation are not used in brochures or ad-

(i) gemoeid wees met of aandeel he in enige van die boubedrywe nie, behalwe as eienaar of mede-eienaar van 'n gebou wat opgerig word of gaan word;
(ii) dien as 'n werknemer of as 'n direkteur van of in enige ander soortgelyke hoedanigheid in enige maatskappy, firma of onderneming wat besigheidsbelange het in enige kontrakwerk, leweransiering of vervaardiging wat aan bouof konstruksiewerk verwant is nie;
(iii) 6f persoonlik 6f deur bemiddeling van enige ander persoon enige finansiele belange he in enige maatskappy, firma of onderneming wat besigheidsbelange het in enige kontrakwerk, leweransiering of vervaardiging wat aan bouof konstruksiewerk verw11nt is nie:-Met dien verstande dat niks hierin vervat hom verhoed om beleggings te maak in effekte en aandele van enige openbare maatskappy waarvan die effekte en aandele genoteer word op 'n gelisensieerde aandelebeurs nie;
G) hy moet, terwyl hy dien as 'n werknemer of 'n direkteur van of in enige ander soortgelyke hoedanigheid in enige maatskappy, flrma of onderneming wat besigheidsbelange het in enige kontrakwerk, leweransiering of vervaardiging wat aan bou- en konstruksiewerk verwant is, of terwyl hy finansiele belang in enige sodanige maatskappy, firma of onderneming het, uitgesonderd 'n openbare maatskappy wat aan die voorbehoudsbepaling van paragraaf (i)(iii) voldoen -
(i) nie die werk van 'n bourekenaar doen of voorgee om sodanige werk te doen teen vergoeding of andersins nie, tensy regstreeks en slegs vir sodanige maatskappy, flrma of onderneming;
(ii) nie voorgee dat hy in private praktyk as 'n bourekenaar is of by die vermoe is om onafhanklike advies te bedien oor aangeleenthede aangaande kontrak, prysbepaling of koste nie;
(iii) verseker dat sy naam en professionele ampstitel nie gebruik word in brosjures of

vertisements issued by such company, firm or undertaking or by any other means in a manner which states or implies that an independent quantity surveying service can be provided;
(k) he shall not use the advantages of a salaried position to compete unfairly with other quantity surveyors;
(I) he shall not issue any bills of quantities, specifications, final accounts, certificates or professional documents in respect of work performed by himself or by some person in his employ or by any member or employee of the company of which he is a member unless they bear his name or the name of his firm or the name of the company of which he is a member;
(m) he shall not sign as quantity surveyor or otherwise identify as having been issued by him any bills of quantities or other documents of which he or his firm or an employee of the company of which he is a member is not the bonafide author;
(n) he shall not review the work of another quantity surveyor or the work of a company of which he is not a member for the same client except with the knowledge of such quantity surveyor or company unless the engagement of such quantity surveyor or company for the work which is being reviewed has been terminated;
(o) he shall not knowingly undertake a commission while a claim for compensation of a quantity surveyor previously employed on that commission and whose employment has been terminated remains unsatisfied, without first notifying the council and the quantity surveyor previously employed;
(p) he shall not undertake or offer to undertake a commission for remuneration less than the fees prescribed under the Act without obtaining the prior consent of the council:
(q) he shall not obtain or attempt to obtain quantity surveying work by means of offering or paying a monetary or other valuable consideration or inducement;
(r) he shall not receive directly or indirectly any royalty, gratuity, commission or other remuneration on any article or process used in or for the purposes of the work in respect of which he is employed unless or until he has notified his employer or client in writing of such royalty, gratuity, commission or other remuneration;

(m) hy moet nie as bourekenaar deur ondertekening of enige ander wyse van identifikasie voorgee dat hy die uitreiker is van enige hoeveelheidslyste of ander · dokumente, waarvan hy of sy firma of 'n lid of werknemer van die maatskappy waarvan hy lid is, nie die bona fide-opsteller is nie;
(n) hy moet nie die werk van 'n ander bourekenaar of die werk van 'n maatskappy waarvan hy nie 'n lid is nie vir dieselfde klient nasien sonder die medewete van sodanige bourekenaar of maatskappy nie, tensy sodanige bourekenaar of maatskappy se diens in verband met die werk wat nagesien word, beeindig is;
(o) hy moet nie willens en wetens 'n opdrag onderneem terwyl. 'n eis om vergoeding van 'n bourekenaar van wie se dienste voorheen gebruik gemaak is en wie se dienste beeindig is, nog onbetaald is, sonder om eers die raad en die vorige bourekenaar in kennis te stel nie;
(p) hy moet nie sonder die voorafverkree toestemming van die raad 'n opdrag ondemeem of aanbied om te onderneem teen vergoeding minder as die statutere tarief van gelde wat kragtens die Wet voorgeskryf is nie;
(q) hy moet nie bourekenaarswerk verkry ofprobeer verkry deur 'n geldelike of ander waardevolle vergoeding of lokmiddel aan te hied of te betaal nie;
(r) hy moet nie regstreeks of onregstreeks vergoeding by wyse van tantieme, gratifikasie, kommissie of ander besoldiging ontvang ten opsigte van 'n artikel of proses wat gebruik word by of vir doeleindes van die werk ten opsigte waarvan hy in diens is nie, tensy of alvorens hy sy werkgewer of klient skriftelik van sodanige tantieme, gratifikasies, kommissie of ander besoldiging verwittig het;

(s) he shall neither personally nor through the agency of any other person, whether or not such person is in his employ, canvass nor solicit professional employment nor offer to make, by way of such commission or otherwise, payment for the obtaining of such employment;
(t) he shall not prepare or submit either directly or indirectly bills of quantities, estimates of cost, feasibility studies or similar documents for which he or his firm or the company of which he is a member has not been professionally engaged;
(u) he shall not advertise or issue circulars or letters to any person or body other than those with whom a business relationship exists, in a manner calculated to attract clients: Provided that he shall not be debarred from taking part by invitation in radio or television programmes, films or other appearances featuring quantity surveying work or submitting articles and scripts of his own or another quantity surveyor's work to the press
in which the work is discussed in a manner generally calculated to further the interests or to promote the study and science of quantity surveying;
(v) he shall not act unfairly against the interests of any part to a building contract;
(w) he shall not knowingly compete for professional work with a fellow practitioner with whom any negotiations are taking place in respect of such work;
(x) he shall not, in his capacity as a quantity surveyor in private practice, enter into or dissolve any form of professional partnership or association, nor shall he become a member or cease to be a member of any company without notifying the council;
(y) he shall not, in his capacity as a quantity surveyor in private practice, enter into partnership or other association with any person other than a quantity surveyor or architect in private practice, except with the prior consent of the council;
(z) he shall, within two months after having been instructed in writing by the council to do so, dissolve any partnership or other association or cease to be a member of a company of which he is a member: Provided that the council shall issue such an instruction only if it is satisfied, after due and proper enquiry, that one or more of the other members or employees of the partnership or association or company concerned, who are not registered under section 11 of the Act, have been

(u) hy moet nie adverteer of omsendbriewe of briewe uitstuur aan enige ander persoon of instansie as die met wie hy besigheidsbande het nie, met die doe! om kliente te lok: Met dien verstande dat hy egter nie belet word om dee! te neem aan radioen televisieprogramme, films of ander openbare optrede wat 'n bourekenaar se werk uitbeeld of om artikels en manuskripte in verband met sy eie of 'n ander bourekenaar se werk te publiseer in die pers nie waarin die werk op 'n wyse bespreek word wat in die algemeen daarop gemik is om die belange en studie van bourekenkunde as 'n wetenskap te bevorder;
(v) hy moet nie onregverdiglik optree teen die belange van enige party by 'n boukontrak nie;
(w) hy moet nie willens en wetens om professionele werk meeding met 'n mede-praktisyn met wie enige onderhandelings ten opsigte van sodanige werk aan die gang is nie;
(x) hy moet in sy hoedanigheid as bourekenaar in private praktyk geen vorm van professionele vennootskap of assosiasie aangaan of beeindig, of 'n lid word of ophou om lid te wees van enige maatskappy sonder om die raad daarvan in kennis te stel nie;
(y) hy moet nie sonder die voorafverkree goedkeuring van die raad in sy hoedanigheid as bourekenaar in private praktyk 'n vennootskap of ander assosiasie met enige ander persoon as 'n bourekenaar of argitek in private praktyk aangaan nie;
(z) hy moet binne twee maande nadat hy skriftelik deur die raad gelas is om dit te doen, enige vennootskap of ander assosiasie beeindig of ophou om 'n lid te wees van 'n maatskappy waarvan hy 'n lid is: Met dien verstande dat die raad sodanige opdrag mag uitreik slegs indien hy, na deeglike oorweging en behoorlike ondersoek, oortuig is dat een of meer van die ander lede of werknemers van die betrokke vennootskap of assosiasie of maatskappy wat nie ingevolge ar-

guilty of an offence which, had they been so registered, would have constituted a contravention of any provision of these regulations;
(aa) he shall display on all the letterheads of his practice or the firm or the company of which he is a member, the name or names of the principal or principals and all the partners or directors thereof and shall describe the services rendered by the firm or company in a factual manner and related only to the professional work of the professional disciplines represented in the firm or company;
(bb) he shall not use a name with any misleading content for the title and style or name of his firm or of his firm in association with another firm or of the company of which he is a member, nor shall he use any name other than his personal name or names for such title and style without the approval of the council: Provided that such title and style or name may include the name of a person of whom he is the bona fide successor in title;
(cc) he shall not perform the work of a quantity surveyor in private practice within the borders of the territory unless he shall maintain an office within the borders of the territory;
(dd) he shall not maintain any office for the purpose of there carrying on the work of a quantity surveyor in private practice unless such office shall be under the continual, direct and personal supervision of a registered quantity surveyor, nor shall he indicate, by any means whatsoever, that his practice as a quantity surveyor extends to any office other than one complying with the terms of this paragraph;
(ee) he shall notify the council without delay of any change of address or employment;
(tl) he shall not wilfully destroy or fail, without a satisfactory reason, to produce original dimensions and any other documentary evidence necessary for the verification of his work until three years after the final completion: t>f'the contract and settlement of all accounts;
(gg) he shall not engage or act in private practice as a quantity surveyor under the style of a company or through the medium of a company or practice in association with a company purporting to do

(bb)· hy moet nie sonder die goedkeuring van die raad 'n naam met misleidende inhoud gebruik vir die titel en naam van sy firma of van sy firma in assosiasie met 'n ander firma of van 'n maatskappy waarvan hy 'n lid is nie, en mag ook nie enige ander naam as sy persoonlike naam of name vir sodanige titel en firmanaam of naam gebruik nie: Met dien verstande dat die titel en firmanaam of naam die naam van 'n persoon van wie hy die bona fide-opvolger in titel is, kan bevat;
(cc) hy moet nie die werk van 'n bourekenaar in private praktyk binne die grense van die gebied verrig tensy hy 'n kantoor binne die grense van die gebied aanhou nie;
(dd) hy moet nie 'n kantoor aanhou met die doel om daar die werk van 'n bourekenaar in private praktyk te beoefen nie, tensy sodanige kantoor onder die voltydse, regstreekse en persoonlike toesig is van 'n geregistreerde bourekenaar en hy mag ook nie op enige wyse hoegenaamd aandui dat sy praktyk as bourekenaar enige ander kantoor as die wat aan die bepalings van hierdie regulasie voldoen, behels nie;
(ee) hy moet die raad sonder versuim van enige verandering van besigheidsadres of werkkring verwittig;
(tl) hy moet nie willens en wetens die oorspronklike meetwerk en enige ander dokumentere bewys wat nodig is vir die kontrolering van sy werk vernietig, of sonder 'n aanneemlike rede versuim om dit voor te le voordat 'n tydperk van drie jaar na die finale voltooiing van die kontrak en die vereffening van aile rekenings verloop bet nie~
(gg) hy moet nie in die private praktyk onder die naam van 'n maatskappy of deur middel van 'n maatskappy as 'n bourekenaar optree of praktiseer of in assosiasie met 'n maatskappy wat

work which has been prescribed under section 7(3)(b) of the Act, unless -
(i) the company is a private company limited by shares incorporated under the Companies Act, 1973, the memorandum of association of which shall contain -
aa a provision to the effect that the directors and former directors of the company shall be liable, jointly and severally, together with the company, for such debts and liabilities of the company as are, or were, contracted during their periods of office;
bb subject to paragraph (z), the name of the company with the word "Incorporated" as the last part of its name;
cc a provision to the effect that the company is established for the purpose of carrying out the work of a quantity surveyor or any work incidental thereto and such work only: Provided that-
the work aforesaid may include the work of an architect or other work approved by the council;
ii the company shall not carry out the work of a quantity. surveyor unless at least one of its members is a quantity surveyor;
(ii) the articles of the company shall contain provisions to the effect that -
aa the members of the company shall be natural persons only who are quantity surveyors registered under the Act: Provided that-
the members may include architects registered under the Act and any other person approved by the council; and
11 in the event of the death of a member or in the event of his ceasing to be qualified as a member for any reason, any shares in the company held by such member prior thereto may continue to be held by him or his estate for such period as the council may determine but voting rights attaching to such shares shall. during such period, be exercised by a member of the com-

pany nominated in writing by the deceased or disqualified member prior to his death or disqualification or, failing such nomination, by the chairman for the time being of the company, who shall be deemed to have been so nominated;
bb every director of the company shall be a member thereof and every member whether a director or not, shall be the beneficial owner of the shares registered in his name;
cc in the event of the death of a member or in the event of his ceasing to be qualified as a member for any reason, the remaining directors shall take steps to ensure that the provisions of subparagraph (ii)(aa) are complied with within the period determined by the council.
(2) Any act done by, or on behalf of the company through any member or employee thereof which would constitute improper conduct if done by a quantity surveyor shall be deemed to have been done by each member of the company who is a quantity surveyor, unless it is proved that he did not knowingly take part in the commission of the act and could not have prevented it.
(3) No quantity surveyor shall be allowed to do anything through a company which he would not be allowed to do otherwise.
Enquiry into the conduct of an architect or architect-intraining or a quantity surveyor or a quantity surveyorin-training
6. (1) In respect of an enquiry into a case of improper conduct under section 15(1) of the Act, the council may require any person making an allegation of improper conduct to file further particulars of any matter complained of and may require the complaint or any part thereof to be verified by affidavit.
(2) If the council deems it necessary to give further consideration to the complaint, it shall furnish the person against whom the allegation of improper conduct has been made with a statement of the complaint and call upon him to reply thereto within 14 days or such longer time as the council may, in its discretion, allow.
(3) If, after due consideration of the matter or matters complained of, the couucil deems it necessary to institute an enquiry into the conduct of the architect or quantity surveyor or architect-in4raining or quantity surveyor-in-training complained of, he shall be duly charged within a reasonable time with the alleged improper conduct.

Ondersoek na die gedrag van 'n argitek of 'n argitek-inopleiding of 'n bourekenaar of 'n bourekenaar-in-opleiding
6. (1) Die raad kan, in verband met 'n ondersoek na 'n geval van onbehoorlike gedrag ingevolge artikel 15(1) van die Wet die persoon wat die bewering van onbehoorlike gedrag maak, vereis om verdere besonderhede van enige sake waaroor hy kla voor te le en kan eis dat die klagte of 'n deel daarvan deur 'n beedigde verklaring gestaaf word.
(2) Indien die raad dit nodig ag om die klag verder te oorweeg, moet hy die persoon teen wie die klag van beweerde onbehoorlike gedrag gebring is, voorsien van 'n uiteensetting van die klag en hom versoek om binne 14 dae of so 'n Ianger periode as wat die raad na sy goeddunke mag toelaat, daarop te antwoord.
(3) Indien die raad na deeglike oorweging van die aangeleentheid of aangeleenthede waaroor gekla word, dit nodig ag om ondersoek in te stel na die gedrag van 'n argitek of 'n bourekenaar of argitek-in-opleiding of bourekenaar-in-opleiding waaroor gekla word, moet die persoon binne 'n redelike tyd na sodanige beweerde onbehoorlike gedrag aangekla word.

(4) The council shall set down the date and time for the enquiry and shall give the person charged at least 14 days notice thereof.
(5) An architect or quantity surveyor or architect-intraining or quantity surveyor-in-training against whom a complaint is lodged shall be entitled to appear by himself or to be represented by some other person duly authorised, in writing, on his behalf and to produce evidence, call and examine witnesses on his behalf and cross-examine other witnesses.
(6) Verbal evidence shall be taken on oath or on affirmation administered by the president and shall be recorded in such manner as the council may determine.
(7) The council, after having enquired into the alleged improper conduct of an architect or quantity surveyor or architect-in-training or quantity surveyor-intraining, may -
(a) take no further action; or
(b) impose a punishment provided for under regulation 7 of these regulations; and
(c) make such order as to the costs incurred in connection with the enquiry as it may deem fit.
(8) Any enquiry that is commenced during the tenure of office of a council shall continue until its completion by that council, and its president shall continue to preside notwithstanding that a new council and president may have been elected after the commencement of such enquiry and before the enquiry is concluded.
(9) The finding of the council may be made public in part or in full at the discretion of the council.
Punishments which may be imposed in respect of im-proper conduct and offences ·
7. ( 1) Any person registered as an architect or a quantity surveyor or an architect-in-training or a quantity surveyor-in-training who, after an enquiry by the council as laid down in section 15 of the Act and these regulations. has been found guilty of improper conduct or conduct which, in the opinion of the council, constitutes improper conduct or any person referred to in section 14(2) or 14(3) of the Act who has been convicted by a court of law of any offence shall, subject to the provisions of section 15( 1) of the Act, be liable to one or more of the following punishments -
(a) reprimand:
(b) caution:
(c) a fine not exceeding two thousand rand;

(7) Die raad kan, nadat hy ondersoek ingestel het na die beweerde onbehoorlike gedrag van 'n argitek of 'n bourekenaar of 'n argitek-in-opleiding of 'n bourekenaar-in-opleiding -
(a) geen verdere stappe doen nie; of
(b) 'n straf ople waarvoor in regulasie 7 van hierdie regulasies voorsiening gemaak word; en
(c) sodanige bevel uitvaardig insake die koste aangegaan in verband met die ondersoek as wat hy goed ag.
(8) 'n Ondersoek wat tydens die ampsduur van 'n raad begin het, moet deur daardie raad afgehandel word en die president van sodanige raad moet as voorsitter aanbly nieteenstaande die feit dat 'n nuwe raad en 'n nuwe president verkies mag word na die aanvang van sodanige ondersoek en voordat die ondersoek voltooi is.
(9) Die bevinding van die raad kan, na goeddunke, 6f ten volle of ten dele bekendgemaak word.
Strawwe wat ten opsigte van onbehoorlike gedrag en oortredings opge/e kan word
7. (1) Iemand wat as 'n argitek of 'n bourekenaar of 'n argitek-in-opleiding of 'n bourekenaar-in-opleiding geregistreer is en na 'n ondersoek deur die raad soos in artikel 15 van die Wet en hierdie regulasies bepaal, skuldig bevind is aan onbehoorlike gedrag of gedrag wat na mening van die raad op onbehoorlike gedrag neerkom, of iemand van wie in artikel 14(2) of 14(3) van die Wet melding gemaak word en wat deur 'n geregshof skuldig bevind is aan 'n misdryf is, behoudens artikel 15(1) van die Wet strafbaar met een ofmeer van die volgende strawwe, naamlik-
(a) 'n berisping;
(b) 'n waarskuwing;
(c) 'n boete van hoogstens tweeduisend rand;

In terms of section 7(6) ofthe Architects' and Quantity Surveyors' Act, 1979 (Act 13 of 1979), it is hereby made known that the South West African Council for Architects and Quantity Surveyors has, under section 7(1)(h) of the said Act, prescribed the fees set out in the Schedule.
SCHEDULE
1. In this Notice, unless the context indicates otherwise, an expression or word to which a meaning has been assigned in the Act, shall bear the same meaning and-
(i) "annual fee" means the fee payable annually on 1 March by an architect or architect-in-training or quantity surveyor or quantity surveyor-intraining, as the case may be: Provided that where such architect or architect-in-training or quantity surveyor or quantity surveyor-intraining is registered after 1 March of any year, the annual fee shall be payable within 60 days of the date of registration;

Dit word hierby ingevolge artikel 7(6) van die Wet op Argitekte en Bourekenaars, 1979 (Wet 13 van 1979), bekend gemaak dat die Suidwes-Afribanse Raad vir Argitekte en Bourekenaars kragtens artikel 7(l)(h) van genoemde Wet die gelde uiteengesit in die Bylae voorgeskryf het.
BYLAE
1. In hierdie Kennisgewing, tensy uit die samehang anders blyk, het 'n woord of uitdrukking waaraan in die Wet 'n betekenis geheg is, dieselfde betekenis en beteken-
(i) "die Wet" die Wet op Argiteke en Bourekenaars, 1979 (Wet 13 van 1979);
(ii) "jaar" die tydperk wat op 1 Maart van 'n jaar begin en op laaste dag van Februarie van die daaropvolgende jaar eindig;

(ii) "registration fee" means the fee payable when a person applies in terms of section 11 of the Act for registration as an architect or architect-intraining or quantity surveyor or quantity surveyor-in-training, as the case may be;
(iii) "the Act" means the Architects' and Quantity Surveyors' Act, 1979 (Act 13 of 1979).
(iv) "year" means the period commencing on 1 March of any year and ending on the last day of February of the next succeeding year.
2. Architects and quantity surveyors
(l) Registration fee - R20 00: Provided that the registration fee of a person who has already been registered as an architect-in-training or a quantity surveyor-in-training, as the case may be, shall be reduced by the amount paid by him in respect of such registration and provided further that the registration fee, if a person who was registered as an architect with the South African Council for Architects or a quantity surveyor with the South African Council for Quantity Surveyors, immediately prior to the commencement of the Act shall be reduced by R 10,00.
(2) Annual fee - R35 00.
3. A rchilects-in-training and quantity surveyors-intraining
( I) Registration fee - R 5,00 (2) Annual fee - R 5 00
4. Non-returnable portion of registration fee
The council may, in its discretion, refund the registration fee or part thereof to an applicant if his application for registration has not been accepted.
5. Duplic'!te registration certificate
Fee for issuing - R 10 00. Provided that the applicant submits an affidavit to the effect that the original certificate was lost. that all possible steps had been taken to trace it and that he had nevertheless not succeeded in finding the certificate concerned.
6. Scrutinising of the register of architects or quantity surveyors
R5 00

(1) Registrasiegeld - R20 00: Met dien verstande dat die registrasiegeld van 'n persoon wat reeds as 'n argitek-in-opleiding of bourekenaar-in-opleiding geregistreer is, na gelang van die geval, verminder word met die bedrag wat hy ten opsigte van sodanige registrasie betaal bet: Met dien verstande voorts dat die registrasiegeld van 'n persoon wat onmiddellik voor die inwerkingtreding van die Wet as 'n argitek deur die Suid-Afrikaanse Raad vir Argitekte of as 'n bourekenaar deur die Suid-Afrikaanse Raad vir Bourekenaars geregistreer was, verminder word met RlOOO.

4. Nie-terugbetaalbare gedeelte van registrasiegelde
Die raad kan na goeddunke die registrasiegeld of 'n deel daarvan aan 'n applikant terugbetaal indien sy aansoek om registrasie nie aanvaar word nie.
5. Duplikaat-registrasiesertiflkaat
Uitreikingsgeld - R 10 00 : Met dien verstande dat die applikant 'n beedigde verklaring voorle met die strekking dat die oorspronklike sertiftkaat verlore gegaan het, dat aile moontlike stappe gedoen is om dit op te spoor en dat hy die betrokke sertifikaat desondanks nie kan vind nie.

The kinds of work reserved in connection with projects, undertakings and services for architects by Government Notice R 1769 of 17 August 1979, and which are deemed in terms of section 24(2) of the Architects' and Quantity Surveyors' Act 1979 (Act 13 of 1979), to have been so reserved in respect of the territory of South West Africa under section 7(3Xb) of the said Act, are hereby made known for general information as set out in the Schedule.
SCHEDULE
(a) The designing and planning; and
(b) the supervising of the erection;
of buildings and structures within the area of jurisdiction of a local authority or within a proclaimed township which is not situated within the area of jurisdiction of a local authority: Provided that-
(i) subject to the provisions of section 13(1XaXii) of the Architects' and Quantity Surveyors' Act, 1979 (Act 13 of 1979), nothing herein contained shall detract from any provision made or to be made by notice in the Official Gazette under section 7(3)(c) of the Professional Engineers' Act, 1968 (Act 81 of 1968);

RESERVERING VAN SEKERE SOORTE WERK VIR ARGITEKTE
Die soorte werk wat in verband met projekte, ondernemings en dienste vir argitekte by Goewermentskennisgewing R 1769 van 17 Augustus 1979 gereserveer is, en wat ingevolge Artikei 24(2) van die Wet op Argitekte en Bourekenaars, 1979 (Wet 13 van 1979), geag word kragtens artikel 7(3(b) van genoemde Wet aldus ten opsigte van die gebied Suidwes-Afrika
gereserveer te gewees het, word hierby vir algemene inligting soos in die Bylae uiteengesit, bekendgemaak.
BYLAE
(a) Die ontwerp en beplanning; en
(b) toesig oor die oprigting;
van geboue en strukture wat val binne die regsgebied van 'n plaaslike owerheid of binne 'n geproklameerde dorpsgebied wat nie binne die regsgebied van 'n plaaslike owerheid gelee is nie: Met dien verstande dat -
(i) behoudens die bepalings van artikel 13(1XaXii) van die Wet op Argitekte en Bourekenaars, 1979 (Wet 13 van 1979), niks hierin vervat afbreuk doen aan enige voorsiening wat kragtens artikel 7(3Xc) van die Wet op Professionele Ingenieurs, 1968 (Wet 81 van 1968), by kennisgewing in die Offisiele Koerant gemaak is of word nie;
(ii) behoudens die bepalings van artikel 13(1XaXii) van die genoemde Wet, niks hierin vervat afbreuk doen aan enige voorsiening wat kragtens artikel 7(3Xb) van die Wet op Argitekte en Bourekenaars, 1979 (Wet 13 van 1979), (ten opsigte van bourekenaars) by kennisgewing in die Offisie7e Koerant gemaak is of word nie;

(iii) subject to the provisions of section 13(l)(aXii) of the said Act, nothing herein contained shall prevent any person registered as a land surveyor in terms of the Land Surveyors' Registration Act, 1950 (Act 14 of 1950), or any person who is the holder of a university degree or an equivalent qualification directly related to the building profession from carrying out such portion of the kinds of work reserved in terms of this notice as for which he is qualified by his training and experience;
(iv) nothing herein contained shall be construed to include the execution and supervision of the aforesaid projects, undertakings or services by a contractor, foreman, superintendent or inspector of works, provided that the said execution or supervision is done under the direction of an architect;
(v) subject to his exercising direction and control and subject further to his assuming unconditional responsibility therefor, an architect may be assisted by any person not registered as an architect in the carrying out of the aforesaid kinds of work;
(vi) the provisions of this notice shall not
(vii)
apply to the types of buildings and structures referred to in the Annexure; and
the terms of this notice shall not apply to projects, undertakings or services in respect of which a commission was awarded in writing prior to 17 August 1979.
ANNEXURE
!. Public services- Lighthouses, hangars, heliports, electricity generating and distribution works, water towers, pumping stations, abattoirs, bridges, sewage and water purification works, municipal markets and storage sheds.
2. Transport - Goods stations, lineside buildings, signal boxes, workshops, repair shops, bus, engine and carriage sheds. underground parking garages.
3. Industries - Engineering works, warehouses, storage sheds. buildings directly required for mining operations, factory buildings in proclaimed or approved industrial areas and in other areas reserved under any law primarily for specific or general industrial purposes and purposes incidental thereto but excluding in all instances detached and semi-detached factory offices and welfare blocks.
(iii) behoudens die bepalings van artikel 13(1)(a)(ii) van die genoemde Wet, niks hierin vervat enigeen geregistreer as 'n landmeter ingevolge die Landmetersregistrasiewet, 1950 (Wet 14 van 1950), of enige persoon wat die houer is van 'n universiteitsgraad of 'n gelykwaardige kwalifikasie wat direk betrekking het op die bouberoep, verhinder om die deel van die soorte werk wat kragtens hierdie kennisgewing voorbehou word, te verrig waarvoor sy opleiding en ervaring hom bekwaam nie;
(iv) niks hierin vertolk word as sou dit die uitvoering van en toesig oor voormelde projekte, ondernemings of dienste deur 'n aannemer, voorman, superintendent of inspekteur van werke insluit nie, mits gemelde uitvoering of toesig geskied onder die beheer van 'n argitek;
(v) 'n argitek in die uitvoering van voormelde soorte werk bygestaan kan word deur enigeen wat nie as 'n argitek geregistreer is nie, mits die argitek Ieiding gee en beheer uitoefen en verder ook onvoorwaardelik verantwoordelikheid vir die werk aanvaar;
(vi) die bepalings van hierdie kennisgewing nie van toepassing is op die tipes geboue en strukture genoem in die Aanhangsel nie; en
(vii) die bepalings van hierdie kennisgewing nie van toepassing is op projekte, ondernemings of dienste waarvoor 'n skriftelike aanstelling voor 17 Augustus 1979 gedoen is.
AANHANGSEL
1. Openbare dienste - Vuurtorings, vliegtuigloodse, helikopterhawens, elektriese ontwikkeling- en verspreidingwerke, watertorings, pompstasies, slagpale, briie, riolering- en watersuiweringswerke, munisipale marke en -bewaringsloodse.
2. Vervoer- Goederestasies. lynkantgeboue, seinhuisies, werkwinkels, herstelwinkels, bus- en lokomotief- en waloodse, ondergrondse parkeergarages.
3. Industrie- Ingenieurswerkplase, pakhuise, bewaarloodse, geboue wat regstreeks vir mynbouwerksaamhede nodig is, fabriekgeboue in geproklameerde of goedgekeurde nywerheidsgebiede en in ander gebiede wat kragtens enige wet hoofsaaklik gereserveer is vir spesifieke of algemene nywerheidsdoeleindes en vir doeleindes · wat daariT1ee in verband staan, maar uitgesonderd in aile gevalle vrystaande of half-vrystaande fabriekskantore en welsyngeboue.

4. Recreation - Swimming-pools, pavilions, grand stands.
5. Scientific buildings - Planetariums, observatories and meteorlogical, geophysical and seismographical stations.
6. Agricultural buildings - Fodder and implement sheds, repair workshops for agricultural plant and equipment.
7. Any other building or structure not exceeding 500 square metres in architectural area, the architectural area of a building being the sum of the areas of the several floors of the building, including basements, mezzanine and intermediate floored tiers and penthouses of headroom height, measured from the exterior faces of exterior walls.

RESERVATION OF CERTAIN KINDS OF WORK FOR QUANTITY SURVEYORS
The kinds of work reserved in connection with projects, undertakings and services for quantity surveyors by Government Notice R 1452 of 17 August 1973, and which are deemed in terms of section 24(2) of the Architects' and Quantity Surveyors' Act 1979 (Act 13 of 1979), to have been so reserved in respect of the territory of South West Africa under section 7(3)(b) of the said Act, are hereby made known for general information as set out in the Schedule.
SCHEDULE
The kinds of work in connection with projects, undertakings or services of a quantity surveying nature which shall be reserved for quantity surveyors are those which involve-
(i) the measurement and calculation of the quantities representing work which has been or is to be executed in the erection of buildings, structures or construction works, whether contemplated or existing, and the documentation of the information so obtained in schedules or bills of quantities or variation accounts or final accounts (all of which shall be as defined below), or in any document of a substantially similar nature; and/or
(ii) the establishment, synthesis or analysis from such measurement, calculation and documenta-

RESERVERING VAN SEKERE SOORTE WERK VIR BOUREKENAARS
Die soorte werk wat in verband met projekte, ondernemings en dienste vir bourekenaars by Goewermentskennisgewing R 1452 van 17 Augustus 1973 gereserveer is, en wat ingevolge Artikel24(2) van die Wet op Argitekte en Bourekenaars, 1979 (Wet 13 van 1979), geag word kragtens artikel 7(3)(b) van genoemde Wet aldus ten opsigte van die Gebied Suidwes-Afrika gereserveer te gewees het, word hierby vir algemene inlig-ting soos in die Bylae uiteengesit, bekendgemaak.
BYLAE
Die soorte werk in verband met projekte, ondernemings of dienste van 'n bourekenkundige aard wat vir bourekenaars voorbehou moet word, is die wat die volgende behels -
(i) die opmeting en berekening van die hoeveelhede wat werk verteenwoordig wat uitgevoer moet word of uitgevoer is, by die oprigting van geboue, strukture of konstruksiewerke, wat beoog word of reeds bestaan, en die dokumentering van die inligting aldus verkry in skedules of lyste van hoeveelhede of wysigingsrekeninge, of finale rekeninge (alma! soos hieronder omskryt), of in enige dokumente wat wesenlik van 'n derglike aard is, en/of
(ii) die vasstelling, samevatting of ontleding op grond van sodanige opmeting, berekening en doku-

tion of any or all aspects of the cost or value of such buildings, structures or construction works;
provided that -
(i) nothing herein contained shall prevent any person registered as an architect in terms of the Architects' and Quantity Surveyors' Act, 1979 (Act 13 of 1979), from carrying out such portion of the kinds of work referred to above as are normally associated with the practice of his profession;
(ii) nothing herein contained shall prevent any person registered as a professional engineer in terms of the Professional Engineers' Act, 1968 (Act 81 of 1968), from carrying out such portion of the kinds of work referred to above, in respect of the engineering aspects of such buildings, structures or construction works, as are normally associated with the pr~ctice of his profession.
(iii) nothing herein contained shall prevent any person engaged in building and construction work from carrying out, directly and only for the organisation in which he is engaged, such portion of the kinds of work referred to above as are normally associated with the operations or duties attaching to such engagement;
(iv) subject to his exercising direction and control and subject further to his assuming unconditional responsibility therefor, a quantity surveyor may be assisted by any person not registered as a quantity surveyo_r in the carrying out of the kinds of work aforesaid.
DEFINITIONS
Schedules or bills of quantities are documents consisting of items containing the descriptions and quantities of work which has been or is to be executed in the erection of buildings, structures or construction works.
Variation accounts are bills of quantities in respect of work to be added to and/or omitted from that originally contemplated, as a result of variations in the requirements for buildings, structures and construction works. for the purpose of establishing the price or value of such variations.
Final accounts are bills of quantities in respect of completed buildings, structures or construction works representing the work as executed. for the purpose of establishing the final price or value thereof.

met dien verstande dat -
(i) niks hierin vervat enigiemand wat as 'n argitek kragtens die Wet op Argitekte en Bourekenaars, 1979 (Wet 13 van 1979), geregistreer is, verhinder om sodanige deel van die soorte werk hierbo vermeld, uit te voer as wat normaalweg met die beoefening van sy professie geassosieer word nie;
(ii) niks hierin vervat enigiemand wat as 'n professionele ingenieur kragtens die Wet op professionele lngenieurs, 1968 (Wet 81 van 1968), geregistreer is, verhinder om ten opsigte van die ingenieursaspekte van sodanige geboue, strukture of konstruksiewerke, sodanige deel van die soorte werk hierbo vermeld, as wat normaalweg met die beoefening van sy professie geassosieer word, uit te voer nie;
(iii) niks hierin vervat enigiemand wat bou- en konstruksiewerk verrig, verhinder om sodanige deel van die soorte werk hierbo vermeld as wat normaalweg met die werksaamhede of pligte verbonde aan sodanige bedrywigheid geassosieer word, regstreeks en slegs vir die organisasie waar hy in diens is, uit te voer nie;
(iv) 'n bourekenaar by die uitvoering van voormelde soorte werk bygestaan kan word deur enigeen wat nie as 'n bourekenaar geregistreer is nie, mits hy Ieiding gee en beheer uitoefen en verder ook onvoorwaardelik verantwoordelikhied vir die werk aanvaar.
DEFINISIES
Skedules of lyste van hoeveelhede is dokumente bestaande uit items wat beskrywings en hoeveelhede bevat van werk wat by die oprigting van geboue, strukture of konstruksiewerke uitgevoer is of uitgevoer moet word.
Wysigingsrekeninge is lyste van hoeveelhede ten opsigte van werk wat as gevolg van wysigings in die vereistes vir geboue, strukture en konstruksiewerke tot die oorspronklik beoogde werk bygevoeg en/of daaruit weggelaat moet word, welke lyste opgestel is met die doel om die prys of die waarde van sodanige wysigings te bepaal.
Finale rekeninge is lyste van hoeveelhede ten opsigte van voltooide geboue, strukture en konstruksiewerke wat die uitgevoerde werk verteenwoordig, wat opgestel is met die doel om die finale prys of waarde daarvan te bepaal.
