PUBLIC HEALTH & SAFETY COMMITTEE Date and Time: Monday, June 19, 2017, at 5:15 pm, (Council Chambers) Members Present: Rasmussen, Wagner, Kellbach, McElhaney, Peckham Others Present: Alfonso, Rayala, Baeten, Kujawa, Goede, Mielke, Schock, Nutting Minutes of the previous meeting(s) (5/15/17) Motion by Kellbach, second by McElhaney to approve the minutes of previous meetings. (5/15/17). Motion carried 5-0. Consider various license applications Rasmussen indicated there were denial recommendations for Michelle Smith, Bradley Rick, Gene Podella, and Anthony Roberts. It was noted that none of these individuals were present to appeal. Rasmussen indicated there was a new event for Maker’s Market. Badger State Games is requesting street closure on the 400 block of 3rd Street for 3 hours for a skateboarding event. Other miscellaneous licenses were on the list, and there was a premise transfer for Vino Late’. Motion by Kellbach, second by Peckham to approve or deny license applications as recommended by staff. Motion carried 5-0. Consider Central Business District Obstruction Permit (Wausau River District) Rasmussen stated this request is to allow for a few more painted pianos downtown. Motion by Wagner, second by Peckham to approve the Obstruction Permit for Wausau River District. Motion carried 5-0. Discussion and possible action regarding ordinance repealing Section 9.20.010(d) Regulation of persons. Rasmussen explained a concern was brought forward by Alderperson Neal about an activity that was taking place occasionally downtown called “busking.” Busking is basically spontaneous popup music, where musicians will show up downtown, on the River District, or on public right of way to play for tips. There was a question as to whether this is prohibited or allowed. She commented, given the fact that we have placed painted pianos on the sidewalks downtown, this item is timely because it really is encouraging spontaneous music. Alfonso stated our current ordinance is a little too general and should be repealed so people understand they are not hampered from busking. She noted this particular section is only related to parks. Motion by Peckham, second by McElhaney to approve the repeal of Section 9.20.010(d). Motion carried 5-0. Discussion and possible action regarding ordinance creating Section 5.62.045 Special Youth Vending License and repealing Section 5.62.040(g) Numbers and replacing with an editorial comment Rasmussen indicated a resident called regarding his 12 or 13 year old son who wanted to travel about his neighborhood with a three-wheeled bike with a cooler on the back to sell ice cream. The parent had met with the Health Department to get proper licensing for food, however, the current city street vendor ordinance requires an individual to be 18 years old. There were costs involved with the permit and insurance requirements that seemed to be a bit of overkill for a young person who may want to sell small items. Rasmussen stated the proposed ordinance is creating a special class of permit specifically for youths. Wagner commented this goes with the spirit of entrepreneurism and some of the best ideas that come through his office are from young middle school kids and high school students. He felt the hoops that they have to jump through to go into business were too much for kids and that having the parent be the co-signer and responsible party solves that problem. He noted the Health Department requirements for food products are still built in. He encouraged them to approve the ordinance. Motion by Peckham, second by McElhaney to approve the ordinance creating the Special Youth Vending License. Motion carried 5-0.

Discussion and possible action authorizing the addition of fees to the City of Wausau Fees and Licenses Schedule adopted pursuant to Wausau Municipal Code §3.40.010(a). Rasmussen noted this is for the fee for the Youth Vendor permit. Motion by Peckham, second by Kellbach to approve the addition of the fees to the Fees & License Schedule. Motion carried 5-0. Discussion and possible action regarding ordinance amending Section 5.72.020 Insurance required, Section 5.72.090 permit required Alfonso explained there were two parts to the amendment. She indicated there has been some discussion between herself, the clerk’s office, and police department regarding when taxi drivers are found to be driving without their Public Transport Driver license, whether to cite the taxi company or the driver. This amendment makes it clear that the owner of the company is just as responsible to ensure their drivers have obtained a license and can be cited. The second part of the amendment is to update the insurance requirements that were outdated in our current code. Motion by Wagner, second by McElhaney to approve the ordinance amendments. Motion carried 5-0. Operations Report from Fire Department for May 2017 Kujawa noted today was Lt. Doug Flory’s last day at the department; he has retired after 31 plus years of service to the city and the Wausau Fire Department. Report placed on file. Tavern Activities / Compliance Checks / Law Enforcement Activities Baeten presented the Tavern Report for May 3, 2017 through June 4, 2017. (See attached) Peckham commented he observed accusations of police entrapment on social media regarding the compliance checks done by PD sending in underage volunteers into taverns to buy alcohol. He asked Cpt. Baeten to comment on this. Cpt. Baeten stated alcohol compliance checks were conducted in the city on June 14th. He explained the underage volunteers work in concert with sworn officers to ensure our licensed establishments are checking IDs properly and not servicing underage individuals. He indicated of the 10 businesses checked on June 14th, five sold to underage persons, which is 50% failure and unacceptable. He stated our main goal is compliance. Rasmussen stated compliance checks are legal and necessary and have been going on in the city for years. She pointed out the volunteers are using their actual IDs showing that they are underage. Alfonso commented in most cases she as prosecuted the underage person was either not carded at all or they showed their ID to the bartender who served them anyway. She stated entrapment is when you encourage or entice someone to do something that they are not inclined to do and bring pressure to get them to do it. There is no pressure applied in this situation and the identification is real. Communications None. Adjourn Motion by Kellbach, second by Peckham to adjourn the meeting. Motion carried unanimously. Meeting adjourned at 5:45 p.m.

1. Two Denial Recommendations by Chief Hardel:  Operator’s License for Chinsia Lee (3 OWI convictions: 

2017, 2013; Possession of drug paraphernalia 2015); Public Transport Driver for Sean Zyduck (Wisconsin 

Driver’s License suspended for failure to pay fine, not eligible for reinstatement until 3/14/2018.) 

 

2. Rosatis Sports Pub is re‐applying for liquor license under a new corporate entity, AMG Sports Pub –

Wausau, LP.  (Formerly AMG‐ America Management Group Inc.) 

 

3. Hmong Eggrolls is renewing their Class B Beer/Class C Wine license after relocating from the Thomas 

Street premise to the former Paradox building.  They missed the license renewal during the relocation. 

 

4. Various retail picnic licenses and temporary operators for the Wisconsin Valley Fair. 

 

5. Special event applications submitted, some just submitted and pending the return of authorization forms.  

Late applications that were assessed late fees:  Unity Concert and Guys Who Grill

Malarkey’s, 412 N. 3rd St. M & R Station, 818 S. 3rd Ave, North End Pub, 1002 N. 3rd Ave. Closed when Officers checked it. Mountain Lanes/Jump On It, 1401 Elm St. Oz, 320 Washington St.

Bartender on duty did not have a valid operator’s license on his person. In-house records did not indicate a renewal. He did provide a receipt that was from the City of Wausau, dated 06/27/17, that was for a cash payment of $115.00, towards an operator/bartender license, but it had no name on the receipt. He was advised that he would be given the benefit of the doubt, and I e-mailed the City Clerk for confirmation. Bartender was advised that if the license was not verified, he would receive a citation. I later received confirmation that he had applied for a renewal, however he had not been mailed his provisional license due to other financial obligations to the City. On 07/07/17, I went to the bar and spoke with the owner. I advised him of the fact that the bartender in question would not be able to work alone until he went to the City and fulfilled his obligations with the City and received his provisional license.

Cop Shoppe Pub, 701 Washington Street

(1) Event #170066712, 06/11/17 at 4:14 PM: A person that refused to identify themselves called to report that there was a woman in a van in the parking lot of the tavern that had “K2” and marijuana. The caller also stated that she might have kids in the car. Officers responded, however the car was gone on their arrival.

(2) Event #170072461, 06/24/17 at 11:22 PM: An anonymous caller reported that the noise from the bar (live band) was too loud. Officers made contact with the bartender, and the doors/windows were closed. They monitored the noise and considered it to be still too loud. They made contact again and asked that the amps be turned down. This significantly quieted the situation. There was also person in the parking lot that was listening to music in their car. They were also asked to turn the music down.

Domino Bar, 740 Washington Street

(1) Case #17-6746, 06/14/17 at 8:24 PM: ALCOHOL COMPLIANCE CHECK; An underage volunteer attempted to buy an alcoholic beverage from the bartender. The bartender checked the ID, but still sold to the underage person. The bartender was cited, and twenty-five (25) Demerit Points are assessed to the bar.

Glass Hat Bar, 1203 N. 3rd Street

(1) Event #170065107, 06/07/17 at 7:54 PM: An anonymous (refused) caller reported that there was a male on probation in the bar drinking, which was a violation of his probation rules. Officers responded and were not able to locate the male named and described by the caller. The bartender knew the male the Officers were looking for, and said the male had not been in the bar for over a month.

(2) Event #170066103, 06/10/17 at 3:15 AM: An anonymous (refused) caller reported that there was a woman that left the bar, stumbling, and got into her car. They provided a vehicle description and license plate number. Officers responded to the bar, but were unable to locate the vehicle there. They then responded to the address of the registered owner, and found the vehicle parked in the driveway and empty. Officers knocked on the door and a woman answered, who was intoxicated, but denied operating the vehicle. She asked Officers to leave her property. She was identified as the same woman that was recently cited for being intoxicated while serving at a different tavern.

Intermission, 325 N. 4th Street (1) Case #17-6745, 06/14/17 at 8:39 PM: ALCOHOL COMPLIANCE CHECK; An

underage volunteer attempted to purchase an alcoholic beverage. The bartender checked the underage person’s ID, but still sold the alcoholic beverage to the underage person. The bartender was cited, and the bar is assessed twenty-five (25) Demerit Points.

(2) Event #170071157, 06/21/17 at 10:50 PM: Community Service Officers (CSOs) stopped in front of the bar for a disturbance. Officers arrived shortly after. They made contact with a woman that had been in a verbal argument with her boyfriend in the bar, but he had taken her keys and she did not know where he had gone. She was intoxicated and had gone out to the vehicle and was honking the horn repeatedly. She was no longer in the car when the Officers got there. She was encouraged to take a cab home. No other action was taken.

(3) Event #170073672, 06/28/17 at 12:14 AM: Officer stopped a male that was behind the bar urinating in the alley. The male was cooperative and was given a warning. He admitted that he was outside smoking and didn’t want to go back into the bar to use the bathroom.

Loppnow’s Bar, 1502 N. 3rd Street

(1) Event #170075182, 07/01/17 at 1:49 AM: Officers responded to a report of a fight involving four males. On Officers’ arrival, they did not find anyone fighting. They made contact with two patrons, who advised they had too much to drink, but were buddies, and didn’t want anything done. The Officers did not know who the caller was, so no other action was taken.

Wausau on the Water (WOW), 1300 N. River Drive

(1) Event #170070575, 06/20/17 at 6:23 PM: Officer responded to a call from an anonymous (refused) caller about a dog inside a parked car in the lot. The Officer checked on the dog and did not find it to be in distress. The windows were cracked. No action was taken by the Officer.

Bull Falls Brewery, 901 E. Thomas Street

(1) Event #170066890, 06/12/17 at 5:26 AM: Officers responded to a report of an open door. A door for one of the loading docks was left open a couple of feet. Access was gained to the majority of the building, but it did not appear that anything was amiss. Contact was made with an employee, who advised that he would check the building and call if there were any issues. He thought it was likely left open by American Welding and Gas that had delivered a gas tank.

Cabaret Bar, 204 E. Rib Mountain Drive

(1) Event #170075523, 07/01/17 at 8:15 PM: A bar employee called to report a complaint about fireworks going off. Officer checked the area and observed nothing.

Christine’s Bar, 936 S. 3rd Avenue (1) Event #170069487, 06/18/17 at 12:55 AM: A bar employee called, as did one other

patron regarding a fight that occurred when three males “jumped” one other patron. The victim fled on foot but called from his residence. He did not want to pursue charges. Information was received that the suspects claimed to be “ORB” (Oriental Ruthless Boys) gang members. Since the victim was uncooperative, no further action was taken.

Roc’s Place, 810 S. 3rd Avenue

(1) Event #170069066, 06/17/17 at 2:01 AM: Three calls were received, to include one from an employee, reporting a fight in the parking lot involving two people. Officers responded and determined that there had been four people involved. Two white females and a black male had left in an SUV. Officers checked several addresses but were not able to locate the suspect vehicle. No suspects were identified or located. The victim did not wish to pursue charges, so only disorderly conduct would have applied had suspects been located.

(2) Event #170069452, 06/17/17 at 11:06 PM: Officers were in the area on another complaint when they heard the music from the bar from a block away. The bar had its doors propped open. They were asked to shut them, and the bartender complied.

(3) Event #170072118, 06/24/17 at 1:07 AM: An anonymous (refused) caller reported that there was a male at the tavern that was on probation and not to be drinking. Officers responded and checked the tavern (and another nearby tavern) and were unable to locate the male.

(4) Event #170072490, 06/25/17 at 12:45 AM: An anonymous (refused) caller reported that there was a large group yelling in front of the bar. Officers responded and located only a single male outside talking on his cell phone. The male said he had not seen anything. Officers also spoke with security, who said it had been calm.

(5) Case #17-7292, 06/30/17 at 11:28 PM: A bar employee called to report that there was a woman on the premise that was refusing to leave. Officers responded and made contact with the woman. The woman admitted to having been told several times not to be on the property, and was loud, profane and bothering customers. She was cited for trespassing and left the property.

respond to the tavern to check on the welfare of a possible suicidal subject that was believed to be there. The male was not located at the bar, and was later found by Lincoln County.

M & R Station, 818 S. 3rd Avenue

(1) Event #170068052, 06/14/17 at 6:45 PM: A patron called to report that he was being harassed by another person not at the bar. The male was given some advice. No other Law Enforcement action was taken and the call did not involve the bar.

(2) Event #170075666, 07/02/17 at 1:43 AM: An anonymous caller (refused) reported that there was arguing and fighting at the bar. Officers were unable to locate any disturbance.

Player’s, 4411 Stewart Avenue

(1) Event #170066516, 06/11/17 at 2:10 AM: An anonymous (refused) caller reported some sort of fighting and revving of engines coming from the parking lot. It was only something the caller could hear, not see. Officers responded and found no problems. They checked with the bartender, who also reported having no problems.

(2) Event #170066527, 06/11/17 at 2:54 AM: An anonymous (refused) caller reported that there was loud talking outside the bar. Officers responded and located some individuals outside. They were simply talking. They were advised of the complaint and left agreeably.

Whiskey River Bar & Grill, 5512 Stewart Avenue

(1) Case #17-674, 06/14/17 at 7:26 PM: ALCOHOL COMPLIANCE CHECK; Volunteer’s ID was checked and bartender still served the underage person an alcoholic beverage. The bartender was cited. Twenty-five (25) Demerit Points are assessed to the bar.

(1) Case #17- 6742, 06/14/17 at 7:44 PM: ALCOHOL COMPLIANCE CHECK; An underage volunteer went into the tavern to attempt to purchase an alcoholic beverage. The bartender sold the beverage to the underage person without asking for ID. The bartender was cited and twenty-five (25) Demerit Points were assessed to the tavern.

The following dates were logged as extra patrols, with no problematic activity noted: 06/11/17 at 12:00AM and 1:41 AM; 06/17/17 at 2:21 AM; 07/02/17 at 2:16 AM; 07/03/17 at 10:05 PM (Bar check);

(1) Case #17-6841, 06/18/17 at 2:21 AM: Officers responded to the location for an extra patrol. On arrival, they noticed the lot was very full of cars and a large crowd. Officer noted that in approximately three minutes of sitting in the parking lot, they observed two different males urinating along the north side of the building. A female was lying on her back in a puddle due to what appeared to be intoxication as her friends were trying to carry her. One male was stopped after being observed to be drinking a bud light beer. That male was cited for open intoxicants, however it was not noted that the beer had come from the establishment. The Officer noted that there were four bouncers on the premises, but they were all pushing people out of the bar, not watching the parking lot. The owners were contacted by Officers at the scene, and they also spoke with the bouncers about what to do and to also monitor the parking lot.

(2) Event #170071479, 06/22/17 at 4:58 PM: An off-duty Detective was contacted by the Department of Revenue, who was requesting an officer to respond to the tavern, as they had found violations during an inspection of the premises. It was determined that the staff was using generic brand liquor to refill top-shelf bottles. There was unlabeled liquor, and several bottles filled with bugs and mold. A couple days after this incident, the property owner, C. Nowicki, contacted me to see what I knew about what had happened. I advised her of the information the Officer had entered in the CAD call. She said she was planning on serving the business with a five-day notice on July 1, 2017. Her position was to evict them, unless they pay her money she is owed, and even if they do, she would substantially re-work their lease as she is not happy with how they have been running their business. She mentioned that she has not been able to monitor them as closely as she would have liked due to having been dealing with a serious medical condition.

(3) Event #170075422, 07/01/17 at 3:00 PM: An unidentified complainant (refused) reported a general complaint of engines revving and people yelling between the hours of 2:15 AM and 3:00 AM, making it hard for the neighbors to sleep.

twenty-five (25) Demerit Points as a result of failing Alcohol Compliance Checks. Whiskey River is at seventy-five (75) Demerit Points, and Domino Bar is at fifty (50) Demerit Points.

The Store #62 (Stewart Avenue) was the only Gas Station/Convenience Store to fail the Alcohol Compliance Check. They were assessed twenty-five (25) Demerit Points.

Limmericks and Campus Pub both had Demerit Points drop off due to time limits, to a total of zero (0).
