CHAPTER 1GENERAL

. Short Title

$ This Proclamation may be cited as the "determiningprocedures of Public Procurement and Establishing itsSupervisoryAgency Proclamation No. 430/2005."

2. Definitions

In this Proclamation:

a) "Goods" Means raw material, products andequipment and commodities in solid, liquid orgaseous form, and electricity, as will asinstallation, transport, maintenance or similarobligations related to the supply of the goods iftheir value does not exceed that of the goodsthemselves:

b) "Services" means any object of procurementother than works, goods and consultancyservices:

c) "Works" means all work associated with theconstruction, reconstruction, demolition, repair orrenovation of a building, rood, or structure, such assite preparation, excavation, installation of equipmentand materials, decoration, as. well as servicesincidental to works, if the value of those services doesnot exceed that of the works themselves and includesbuild, own operate and build own operate transfercontracts;

d) "Consultancy Service" means a service of anintellectual and advisory nature provided byconsultants using their professional skills tostudy, design and organize specific projects,advise clients, conduct training and transferknowledge;

e) "Procurement" means the purchasing hiring orobtaining by any other contractual means of.goods, works and services;

t) "Procuring entity" means public body, which ispartly or wholly financed by Federal Governmentbudget, higher education institutions and publicinstitutions of like nature;

g) "Public Funds" means any monetary resourcesappropriated to procuring entities from the FederalGovernment treasury or aid grants and credits put atthe disposal of procuring entities by foreign donorsthrough the Federal Government internal revenue ofprocuring entities;

h) "Public Procurement" means procurement byprocuring entities using public funds;

i) "Supplier" means a physical or juridical person undercontract with' a procuring entity to supply goods,works or services;

j) "Candidate" means a physical or juridical personinvited to take part in public procurement or seekingto be so invited;

k) "8idder" means a physical or juridical personsubmitting a bid;

1) "Bid documents" means the documentsprepared by the procuring entity to bidders as abasis for preparation of their bids;

m) "Procurement dire~tives" are the directivesissued by the Minister under this Proclamation;

n) "Minister or Ministry" means the Minister orthe Ministry of Finaq.ce and EconomicDevelopment respectively'

0) "Person" means natural or juridical person

3. Scope of Application

1/ This Proclamation applies to all Federal publicprocurement.

2/ Notwithstanding Sub-Article (1) of this Article,the Minister, in consultation with the relevantpublic bodies, may in the interest of nationalsecurity or national defense decide to use adifferent procedure, in which case the Ministershall define the method of procurement to befollowed in order to serve the interest of economyand efficiency,

7/ maintains a list of suppliers who by reason ofhaving seriously neglected their obUgationsunder a public procurement contract, or havingprovided false information about theirqualifications or having offered inducements ofthe kind referred to in Article 24, have beendebarred trom participating in publicprocurement by the Agency;

81 conduct periodic inspections of the records andproceedings of the procuring entities to ensurefull and correct application of thisProclamation;

13. Organization of the Agency

The Agency shall have:

1/ The General Manager shall be the chiefexecutive officer of the Agency and shallsubject to the general directives of the Minister,direct and administer the activities. of theAgency.

b) employ, administer and dismiss personnelof the Agency in accordance with theFederal Civil service law;

c) prepare the work program and budget ofthe Agency and implement the same uponapproval;

d) prepare and submit to the Ministeroperational and financial report on theactivities of the Agency.

e) represent the Agency in all its relationswith third parties.

3/ The General Manager may delegate part of his powersand duties to other officials and employees of ,theAgency to the extent necessary for the effectivemanagement of the Agency.

15. Source of Budget

The budget of the Agency shall be drawn from thefollowing sources:

11 The Agency shall keep complete and accuratebooks of accounts,

31 Any requirement established pursuant to thisArticle shall be set forth in the bid documentsor other documents for solicitation of proposals,and shall apply equally to all candidates.

41 The procuring entity shall evaluate thequalifications of candidates in accordance withthe criteria and procedures set forth in thedocuments referred to in Sub-Article (3) of thisArticle.

51 The procuring entity shall disqualify a candidatewho submits a document containing basic errorfor purposes of qualification; it may disqualifya candidate if it finds at any time that theinformation submitted concerning thequalifications of the candidates was materiallyinaccurate or materially incomplete.

61 In order to simplify the process of demonst -rating, and verifying, the formal qualificationsof candidates of the kind set out in Sub-Article(I ), Sub Articles (b)-(d), the Agency shallreview in a speedy manner, and recorddocumentary evidence submitted by candidatesfor registered supplier status. Such recordsshall be periodically updated. Excerpts from therecord shall be made available to registeredcandidates and procuring entities on request.The Agency shall issue detailed rulesconcerning the registration procedure.

24, Inducements from Candidates

The procuring entity shall reject a bid, proposal orquotation if the candidate that submitted it gives orpromises to give, directly or indirectly to any officeror employee of the procuring entity or othergovernmental authority a gratuity in any form, anemployment or any other thing or service of value,as an inducement with respect to an act or decisionof, or procedure followed by the procuring entity inconnection with the procurement proceedings. Suchrejection of an offer and the reasons therefore shallbe recorded in the record of the procurementproceedings and promptly communicated to thecandidate concerned.

CHAPTER IVCHOICE OF PROCUREMENT METHODS

d) within limits defined in the procurementdirectives, for new works consisting of therepetition of similar works which conformto a basic project of which an initialcontract was awarded on the basis of openor restricted bidding.

e) within limits defined in the procurementdirectives, for continuation of consultantservices, where the original contract hasbeen satisfactorily performed and thecontinuation is likely to lead to gains ineconomy and efficiency.

f) for purchase of goods made underexceptionally advantageous conditionswhich only arise in the very short term.This provision is intended to cover unusualdisposals by firms, which are not normallysuppliers. It is not intended to coverroutine purchases from regular suppliers.

g) the head of the procuring entity hasdetermined that the need is one of pressingemergency in which delay would createserious problems and therefore injurious tothe performance of that procuring entity.

34. Provision of bid documents

Bid documents shall be made available tocandidates in an expeditious manner, at a price notexceeding the cost of reproduction and delivery tocandidates, and otherwise in the manner specified inthe invitation to bid.

35. Modifications to bid documents

\I At any time prior to the deadline for submission ofbids, the procuring entity may, on its own initiativeor in response to an inquiry by a candidate havingpurchased the bid documents, modify the biddocuments by issuing an addendum. which becomesan integral part of the bid documents.

2/ Any addendum shall be communicated promptlyto all candidates having purchased the biddocuments.

3/ If the procuring entity considers it necessary toamend the bid documents, and if it determinesthat there is no enough time to incorporate themodification shall postpone the closing date bya number of days, depending on theprocurement object, which is sufficient toenable the bids to take the addendum intoaccount in preparing their bids.

36. Bid Security

1/ Unless otherwise provided in this Proclamation,the procuring entity shall include in the biddocuments a condition that bids must beaccompanied by security in the form of adeposit or bid guarantee. The amount of suchsecurity shall be sufficient to discourageirresponsible bids and shall remain withinlimits stated in the procurement directives.

2/ Any bid security will be forfeited if a bidderwithdraws his bid within the validity periodthereof or, in the case of a successful bidder, ifthe bidder repudiates the contract or fails tofurnish performance security, if so required.

3/ Subject to Sub-Article (4), of this Article, theprocuring entity may regard a bid as responsiveonly if it conforms to all requirements set forthin the bid documents.

4/ The procuring entity may regard a bid asresponsive even if it contains minor deviationsthat do not materially alter or depart from thecharacteristics, terms, conditions and otherrequirement set fortH in bid documents or if itcontains errors or oversights that are capable ofbeing corrected without touching on thesubstance of the bid. Any such deviations shallbe quantified, to the extent possible, andappropriately taken account of in the evaluationand comparison of bids.

5/ The procuring entity shall not award a contract.when:

21 The existence of a contract shall be confirmedthrough the signature of a contracrdocumentincorporating all agreements between theparties.

43. Contract Security

A supplier shall provide the procuring entity with acontract security to make good on any default by thesupplier under the contract. The type ofprocurement for which contract security is requiredand the type and amount of contract security shallbe determined by a directive to be issued by theMinister.

44. Restricted Tendering Procedures

Restricted tendering procedures are the same asthose applied in open tendering, except that:

1/ the invitation to bid is addressed to a limitednumber of qualified candidates which havedeclared an interest in submitting bids. Theselection should be made in a non-discriminatory manner, and the number ofcandidates invited should be, if possible,sufficient to ensure effective competition;

2/ procuring entities. shall select candidates to beinvited to bid from among those registered inthe suppliers list. Any selection shall allowequitable opportunities for suppliers on the list.The procuring entity may .also advertise theopportunity to bid in the manner provided forunder Article 31 (5) , inviting candidates tosubmit expressions of interest in being invitedto bid.

53. Reviews by the Agency

1/ Upon receipt of a complaint, the Agency shallpromptly give notice of the complaint to therespective procuring entity. Such actionautomatically suspends further action by theprocuring entity until the Agency has settled thematter.

21 The Agency, unless it dismisses the complaint,may prohibit the procuring entity from acting ordeciding unlawfully or from following anunlawful procedure may order the procuringentity to proceed in a manner conforming. to hisProclamation and may annul, in whole or inpart an unlawful' act or decision by the'procuring entity other than a decision to awardor conclude a contract.

3/ The Ag~ncy shall before taking any decisionregarding a complaint notify interestedcandidates of the complaint and shall take intoaccount information and arguments receivedfrom such candidates and from the procuringentity .

4/ The Agency shall issue its decision within 15days of receiving the complaint stating thereasons for its decision and remedies granted ifany,

54. Offences and Pugishment

1/ Every person appointed to or employed by aprocuring entity in carrying out the provisionsof this Proclamation who:

a) receives any payment for the performanceof his official duty except as provided bylaw;

b) conspires or colludes with any person todefraud the procuring entity or provides anopportunity for any person to defraud theprocuring entity;

c) contravenes this Proclamation orintentionally permits any contravention ofthe law; ,

d) willfully makes or signs any false entry inany document or willfully makes or signsfalse certificates; is liable on conviction toa fine not less than Birr 25,000 and notmore than 35,000 and to a rigorousimprisonment for a:term of not less than 10years and not more than 15 years.

2/ A procurement officer employed in carrying outthe provisions of this Proclamation, except suchinformation is required by this Proclamation tobe official, who:

a) discloses to any person or that person'srepresentative any matter in respect ofanother person that may in tht? exercise ofthe procurement officer's powers or theperformance of the procurement officer'sduties come to the procurement officer'sknowledge;

b) permits any other person to have access-torecords in the possession or custody of theProcuring entity, except in the exercise ofthe procurement officer's powers or theperformance of the procurement officer'sduties under this Proclamation or by order0;' a court;

II commits an offence and is liable onconviction to a fine of not less than Birr5,000 and not more than Birr 10,000 and toimprisonment for a term of not less than 2years and not more than 5 years.

3/ Every person appointed to or employed by aprocuring entity in carrying out the provisionsof this Proclamation who:

a) directly or indirectly asks for or receives inconnection with any of his duties apayment or gift whether pecuniary orotherwise or promise or security for thatpayment or reward;

b) enters into or acquiesces in an agreement todo or to abstain from doing, permit conceal,or connive at any act or thing whereby theprocurement is or may be defrauded orwhich is contrary to the provisions of this
