CASEY HAMILTON, WARDEN

Northeast Oklahoma Correctional Center

Casey Hamilton began his career with the Oklahoma Department of

Correct ions in 2008 as a probation and parole off icer at the Region I

probation off ice in Tulsa.

In 2012, he became a fugitive apprehension agent for the Off ice of Fugit ive

Apprehension and Investigations and was named the Oklahoma Department

of Correct ions’ Employee of the Year in 2014.

In 2015, Mr. Hamilton promoted to deputy warden at the James Crabtree

Correct ional Center. He was appointed as warden in 2016 at the

Northeastern Oklahoma Correct ional Center.

Mr. Hamilton received his Bachelor of Arts in Sociology from Northeastern

State University in 2006.

ITEM PRESENTER

1. Call to Order Frank X. Henke, IV, Chair Chair Henke called the regular meeting of the Oklahoma Board of Corrections (BOC) to order at 1:00 PM on Thursday, September 20, 2018, at the Jackie Brannon Correctional Center ( JBCC) in McAlester, Oklahoma. The meeting was preceded by advance not ice of the date, t ime, and place, f i led with the Oklahoma Secretary of State on November 14, 2017. An announcement was also given at least twenty -four (24) hours in advance by posting notice of the date, t ime, place, and agenda of the meeting at 2:30 PM on September 17, 2018, at the principal off ice of the Oklahoma Department of Corrections (ODOC), located at 3400 North Martin Luther King Avenue in Oklahoma City . An amended agenda was posted at 12:00 PM on September 18, 20 18, at the principal off ice of the ODOC, located at 3400 North Martin Luther K ing Avenue in Oklahoma City .

Region I Ms. Newton-Embry introduced Mr. Bresl in to the BOC members and Director Al lbaugh, providing his biographical information to the meeting attendees. A copy of his biography was inc luded in the BOC Packet for September 20, 2018. There was no further discussion.

Mr. Bresl in welcomed the members and other attendees to the faci l ity. Histor ical information on JBCC along with current inmate data was shared with attendees. Mr. Bresl in stated there are m ultiple programs, training and work opportunit ies avai lable for the inmate population. There was no further discussion.

6. Approval of Board of Corrections Regular Meeting

Minutes for July 31, 2018 Frank X. Henke, IV, Chair

Chair Henke stated the BOC had previously received the regular meeting minutes from July 31, 2018, and he would entertain a motion to approve. A copy of the meeting minutes was included in the BOC Packet for September 20, 2018. Motion: Mr. Holder made a motion to approve the minutes and Mr. Henke seconded the motion. The results of the roll cal l were: Mr. Gross – yes; Mr. Haynes – abstain; Mr. Henke – yes; Mr. Holder – yes; Ms. Owens – yes. The minutes were approved by majority vote. There was n o further discuss ion.

7. Approval of Greg Bresl in as Warden of the

Region I Ms. Newton-Embry presented and requested approval from the BOC for appointment of Greg Bresl in as warden of the Jackie Brannon Correct ional Center . A copy of Mr. Breslin’s résumé was included in the BOC Packet for September 20, 2018. Motion: Mr. Gross made a motion to approve Greg Bresl in as the warden of JBCC and Mr. Holder seconded the motion. The results of the roll cal l were: Mr. Gross – yes; Mr. Haynes – Yes; Mr. Henke – yes; Mr. Holder – yes; Ms. Owens – yes. The appointment was approved by majority vote. Warden Bresl in thanked members of the BOC and Director Allbaugh for the opportunity. H e then recognized several of his family members who were in attendance at the meeting. He also expressed his gratitude to several staff members who had mentored and helped prepare him throughout his career for this posit ion. There was no further discussion .

8. Approval of Rick Whitten as Warden of the James

Crabtree Correctional Center Wil l iam Monday, Director

Region I I Mr. Monday presented and requested approval from the BOC for appointment of Rick Whitten as warden of the James Crabtree Correctional Center . A copy of Mr. Whitten’s résumé was included in the BOC Packet for September 20, 2018. Motion: Mr. Haynes made a motion to approve Rick Whitten as the warden of JCCC and Mr. Holder seconded the motion. The results of the roll ca l l wer e: Mr. Gross – yes; Mr. Haynes – Yes; Mr. Henke – yes; Mr. Holder – yes; Ms. Owens – yes. The appointment was approved by major ity vote. Warden Whitten thanked the members of the BOC, Director Al lbaugh and Wil l iam Monday, director of Region I I , for their support. He also thanked Warden Jeorld Braggs Jr , Lexington Assessment and Reception Center, for his mentorship. Finally, he recognized his wife, who was in

9. Director’s Comments

Performance Audit of the Oklahoma Department of Correct ions by Alvarez & Marsal for the Agency Performance and Accountabi l ity Commission (APAC)

Joe M. Al lbaugh, Director

Director Al lbaugh stated the agency is currently undergoing an audit by Alvarez & Marsal as directed by the Agency Performance and Accountabil ity Commission (APAC). They have begun meeting with key staff in the agency and their interviews wil l take several weeks as they learn about processes within the ODOC. Director Allbaugh noted several other studies and audits – Performance Audit for the Legis lative Service Bureau of the Oklahoma Legis lature by MGT of America, Inc. in 2007, Durrant Architecture and Engineering Center Assessment in 2009 , and the Performance Audit by the Oklahoma State Auditor in 2013 – which al l detail the issues of the agency including overpopulat ion and continuing growth, underpaid employees, understaffed faci l it ies, etc. He stated he hopes the Alvarez & Marsal audit wi l l provide a new viewpoint of the agency’s resources and issues while providing direct ion on addressing those areas.

10. Inmate/Offender Population Update Laura Pitman, Ph.D., D irector

Population, Programs, and Strategic Planning Dr. Pitman provided the agency’s population update as of August 31, 2018. A copy of the update was included in the BOC Packet for September 20, 2018. BOC members expressed disappointment over community sentencing numbers showing a decrease. Dr. Pitman noted that Probation and Parole Services staff have worked dil igently to obtain accurate data for those offenders participating in community sentencing. There was no further discuss ion.

11. FY 2018 ODOC Budget Update

FY 2019 ODOC Budget Update Ashlee Clemmons, Director

Business Services Ms. Clemmons provided the agency’s FY 2018 budget update as of June 30, 2018, as well as the FY 2019 budget update as of July 31, 2018, explaining increases and decreases over the f iscal year. A copy of both updates was inc luded in the BOC Packet for September 20, 2018. There was no further discuss ion.

12. FY 2018 Internal Financial Audit Quarter ly Update

(Apri l 1, 2018 – June 30, 2018) Patrick Donnelly, Auditor Audit ing and Compliance

Mr. Donnelly provided the quarterly FY 2018 Internal F inancial Audit update as of June 30, 2018, explaining f indings and corrective actions taken. A copy of the update was included in the BOC Packet for September 20, 2018. There was no further discussion.

13. Discuss ion and approval of an Oklahoma Corrections

Industr ies (OCI) contract between the Oklahoma Department of Correct ions and E&K Industrials, LLC , to provide steel fabrication services us ing inmate labor at the Dick Conner Correctional Center

Ms. Lewis presented and requested approval from the BOC for the polic ies as presented this date. The pol icies contained minor wording changes that d o not affect the intent of the pol icy. Chair Henke stated the BOC had previously received the recommended pol icy revis ions for review and he would entertain a motion to approve. A copy of the f inal vers ion of the polic ies was included in the BOC Packet for September 20, 2018. Motion: Mr. Gross made a motion to approve the policies and Mr. Holder seconded the motion. Motion: Mr. Holder made return from Executive Session and Mr. Haynes seconded the motion. The results of the rol l cal l were: Mr. Gross – yes; Mr. Haynes – yes; Mr. Henke – yes; Mr. Holder – yes; Ms. Owens – yes. The return from Executive Sess ion was approved by majority vote and the meeting resumed at 2:25 PM.

Uniform Personnel Standards The Oklahoma Department of Corrections (ODOC) creates and administers procedures which ensure the agency’s human resources practices comply with all applicable state and federal laws. These procedures establish a professional and ethical standard for the recruitment, selection, retention and promotion of qualified individuals and also serve as a guide for the appropriate management of employee services, benefits, and relations. (2-CO-1C-01, 2-CO-1C-24) I. Merit System of Employment

The agency’s human resources procedures and practices adhere to the principles and guidelines of the Oklahoma Personnel Act and the Merit Rules for Employment pertinent to the rights and responsibilities of employees, supervisors and applicants for employment. II. Equitable Administration

Request # 19-08 BASICS OF THE INITIATIVE This legislative initiative seeks to remove the Department of Corrections as the monitoring authority for defendants who are charged with aggravated trafficking and placed on GPS monitoring as a condition of their bond. ODOC has had up to 10 people at one time on GPS monitoring with this program. As of 8/27/2018 the agency has 4 people being monitored under this statute. Canadian County and Beckham County are the only two counties utilizing this section of statute with Canadian County using it the most. WHAT IS THE FINANCIAL IMPACT? The ODOC pays monthly payments to the GPS vendor for the use of monitors ($165.00 per month per GPS monitor utilized) which is supposed to be paid by the defendants, but when Probation and Parole was questioned about our collection rate they did not know of any monitoring fees we have been able to collect. There are also GPS monitors being lost by the defendants, and those costs are not reimbursed to ODOC. There are currently 7-10 GPS monitors utilized per this statute. This would be a cost savings between $13,000.00 and $20,000.00 per year for the agency. Not including the cost to pay staff to operate the program. PROPOSED AMENDMENT TO STATUTE

Public Health and Safety Chapter 2 - Uniform Controlled Dangerous Substances Act Trafficking in Illegal Drugs Act Article Article 4 - Penalties - Offenses Section 2-420 - Report of Convictions Related to Controlled Dangerous Substances Cite as: O.S. §, __ __

A. Any person charged with aggravated trafficking pursuant to Section 2-415 of this

title shall not be subject to pretrial release as specified in Section 1105.3 of Title 22 of

the Oklahoma Statutes and shall not be released on bail without a Global Positioning

System (GPS) monitoring device attached to the person and cost thereof paid by such

person at his or her own expense until after the conclusion of the criminal case. The

Department of Corrections shall monitor such GPS monitoring device and the person

until the conclusion of the case, and the person shall pay a supervision fee as provided

for other persons subject to supervision by the Department. At the conclusion of the

case, the court shall order the removal of the GPS monitoring device if the person is

acquitted or is to be incarcerated or the case is dismissed.

B. The Department of Corrections shall maintain statistical records on any aggravated trafficking offense, including a calculation of the time period from arrest to disposition,

All Department of Corrections owned AND operated facilities are listed in statute, therefore in order for us to change the name of a facility we would need legislative approval. This name change will more closely identify the property and it’s functionality with the Oklahoma Department of Corrections. Request # 19-11 BASICS OF THE INITIATIVE This initiative would amend 74 O.S. 2011, Section 150.23, where it allows correctional officers to purchase their rifles or shotguns. It seeks to include all officers with ODOC who are certified to carry. Officers will only be eligible to purchase weapons immediately prior to retiring and it must be the rifle or shotgun that was assigned to them. During the 2018 session, without prompting from the ODOC, a lawmaker amended statute so correctional officers who carry rifles or shotguns as part of their duties can purchase them when they retire. Agents with the Fugitive Apprehension and Investigations Unit were not included in this statute change. WHAT IS THE FINANCIAL IMPACT The cost to the retired agent of purchasing the rifle or shotgun, or both, will be the price the Oklahoma Department of Corrections paid at the time of purchase, and upon payment of that price, the retired agent shall be entitled to ownership of the rifle, shotgun, or both. Agents will be paying the original purchase price no matter the age of the weapon, and firearms need to be periodically replaced anyway. ODOC would be relieving ourselves of an asset at a higher price than we would receive at state surplus. PROPOSED AMENDMENT TO STATUTE

An officer, investigator, or agent of the Oklahoma State Bureau of Investigation, the Oklahoma State Bureau of Narcotics and Dangerous Drugs Control, the Department of Wildlife Conservation, the Law Enforcement Division of the Oklahoma Horse Racing Commission, the State Fire Marshal's Office, the Oklahoma Tourism and Recreation Department, the Office of Inspector General and the Oklahoma Child Support Services divisions of the Department of Human Services, a Probation and Parole officer or Internal Affairs agent of the Department of Corrections, law enforcement officers employed by the Grand River Dam Authority or the office of a district attorney shall be entitled to receive, upon retirement by reason of length of service, the continued custody and possession of the sidearm and badge carried by such officer, investigator, or agent immediately prior to retirement.

B. An officer, investigator, or agent specified in subsection A of this section may be entitled to receive, upon retirement by reason of disability, the continued custody and possession of the sidearm and badge carried by such officer or agent immediately prior to retirement upon written approval of the applicable Director of the appropriate Bureau, Department, Commission, or district attorney.

C. Custody and possession of the sidearm and badge of an officer, investigator, or agent who dies while employed by any Bureau, Department, Commission, or office specified in subsection A of this section may be awarded by the applicable Director of the appropriate Bureau, Department, Commission, or office to the spouse or next of kin of the deceased officer, investigator, or agent.

D. A correctional officer of the Oklahoma Department of Corrections shall be entitled to receive, upon retirement by reason of length of service, the continued custody and possession of the firearm and badge carried by such officer immediately prior to retirement.

E. In addition to the firearm carried by a correctional officer, or a peace officer of the Department of Corrections, the retired correctional officer, or peace officer may purchase the rifle or shotgun, or both, issued to the correctional officer or peace officer immediately prior to retirement. The cost to the retired agent of purchasing the rifle or shotgun, or both, shall be the price the Department of Corrections paid at the time of purchase, and upon payment of that price, the retired correctional officer or peace officer shall be entitled to ownership of the rifle or shotgun, or both.

F. In addition to the sidearm carried by a retired agent of the Oklahoma State Bureau of Investigation, the retired agent may purchase the rifle or shotgun, or both, issued to the retired agent immediately prior to retirement. The cost to the retired agent of purchasing the rifle or shotgun, or both, shall be the price the Oklahoma State Bureau of Investigation paid at the time of purchase, and upon payment of that price, the retired agent shall be entitled to ownership of the rifle or shotgun, or both.

Request # 19-12 BASICS OF THE INITIATIVE This initiative makes all officers, investigators, agents and immediate supervisory staff, in certain positions that are assigned to the Investigations Division of ODOC, peace officers as defined by statute. Officers, investigators, agents and immediate supervisory staff of the investigations division shall meet all of the training and qualifications for peace officers required by Section 3311 of Title 70 of the Oklahoma Statutes. Definition of a peace officer from 70 OS 3311: 6. For purposes of this section, a police or peace officer is defined as a full-time duly appointed or elected officer who is paid for working more than twenty-five (25) hours per week and whose duties are to preserve the public peace, protect life and property, prevent crime, serve warrants, transport prisoners, and enforce laws and ordinances of this state, or any political subdivision thereof; provided, elected sheriffs and their deputies and elected, appointed, or acting chiefs of police shall meet the requirements of this subsection within the first six (6) months after assuming the duties of the office to which they are elected or appointed or for which they are an acting chief; provided further, that this section shall not apply to persons designated by the Director of the Department of Corrections as peace officers pursuant to Section 510 of Title 57 of the Oklahoma Statutes. A. There is hereby created the Investigations Division within the Department of Corrections. The purpose of the Division shall be to investigate allegations of criminal acts by inmates, offenders or employees of the Department, as well as to investigate allegations of constitutional or policy violations. B. The Director of the Department of Corrections shall employ the proper personnel and adopt the necessary procedures to carry out the duties of the Investigations Division and shall appoint a Director of the Division who shall administer the activities of the Division. C. The Investigations Division of the Department of Corrections shall have the jurisdiction and authority to investigate all allegations of criminal behavior at any facility

The Investigations Division shall have jurisdiction and authority to investigate any escape committed by prisoners under the custody and control of the Department of Corrections. If it is determined that a prisoner has escaped the custody of the Department, in violation of Section 443 of Title 21 of the Oklahoma Statutes, the Department is authorized to issue a warrant for the arrest of the escapee and the warrant shall have the force and effect of any warrant of arrest issued by a district court in the state. Nothing in this section shall affect the authority of a district attorney to issue an arrest warrant for the escapee.

E. All officers, investigators, agents and immediate supervisory staff of listed positions assigned to the Investigations Division shall be deemed peace officers and shall possess the powers granted by law to peace officers. Officers, investigators, agents and immediate supervisory staff of the investigations division shall meet all of the training and qualifications for peace officers required by Section 3311 of Title 70 of the Oklahoma Statutes.

Request #19-13 and #19-14 BASICS OF THE INITIATIVE This initiative cleans up statute so that it no longer refers to the Mental Health Unit at the Oklahoma State Penitentiary (OSP), and does not specify that the ODOC Special Care Unit be placed at OSP. Statute dictates where the ODOC Special Care Unit is supposed to be placed. Recently, this unit was moved to the Joseph Harp Correctional Center (JHCC) as a cost saving measure and so it can function more effectively. In order for statute to match practice at ODOC we will need to amend Title 43A Section 5-204 and remove the reference to “the State Penitentiary”. We will also need to amend Title 57 (7A) Section 400, by taking out references to “the State Penitentiary” and removing the requirement for the Carl Albert Mental Health and Substance Abuse Services Center to provide a psychiatrist to the Special Care Unit. WHAT IS THE FINANCIAL IMPACT Potentially, this could be a cost savings to ODOC if we no longer have to contract with a DMHSAS psychiatrist for our Special Care Unit. PROPOSED AMENDMENT TO STATUTE

A. Appropriate treatment and medication, including psychotropic medication, may be administered to a consenting individual:

1. During the detention periods authorized by the Mental Health Law;

2. During the time set forth in the Mental Health Law for the precommitment screening examination; or

3. While in the custody of the Department of Corrections.

B. Treatment and medication may be administered to a nonconsenting individual upon the written order of the physician who:

1. Has personally examined the consumer;

2. Finds the medication or treatment is necessary to protect the consumer, the facility or others from serious bodily harm; and

C. Any physician who orders medication in good faith and any employee of the facility who administers medication in good faith pursuant to the written order of a physician, under the provision of this section, shall be immune from civil suits for damages that occur from the administration of medication.

D. Seclusion or restraint may be administered to a nonconsenting individual upon the written order of a physician who:

1. Personally examined the consumer; and

2. Finds that seclusion or restraint is necessary to protect the consumer, the facility, or other persons. The physician shall note in the chart of the consumer an explanation of the decision to administer seclusion or restraint, including administration of psychotropic medication. This shall not prohibit emergency seclusion or restraint, including mechanical restraint, pending notification of a physician.

E. If the consumer is under the influence of psychotropic medication during any court hearing held pursuant to Section 5-401 of this title, the court, and the jury, if any, shall be advised by the district attorney at the beginning of the hearing that:

1. The consumer is under the influence of psychotropic medication;

2. The purpose of the medication; and

3. The effect which such medication may have on the actions, demeanor and participation of the consumer at the hearing.

F. If an inmate in the custody of the Department of Corrections has been properly assigned and committed to the Special Care Unit at the State Penitentiary a unit described in Section 400 of Title 57 of the Oklahoma Statutes, the provisions of this section shall apply.

Request #19-17 BASICS OF THE INITIATIVE This initiative will strengthen the statute requiring state agencies to purchase goods from the Oklahoma Corrections Industries (OCI). The intent would be to provide more business for OCI and better value for state agencies who purchase from OCI. Oklahoma Statutes Citationized Title 57. Prisons and Reformatories Chapter 8 - Oklahoma Corrections Act of 1967 Section 549.1 - Authority and Manner of Purchasing Materials and Services Cite as: 57 O.S. § 549.1 (OSCN 2018)

A. The Department of Corrections is authorized to purchase in the manner prescribed by law, facilities, equipment, raw materials and supplies, and to engage the supervisory personnel necessary to establish and maintain for this state at the penal institutions, now or hereafter under the control of the State Board of Corrections, industries and agricultural programs for the utilization of services of prisoners in the manufacture, production, processing or assembly of the articles or products as may be needed for the construction, operation, maintenance or use of any office, department, institution or agency supported in whole or in part by this state and the political subdivisions thereof. Upon the request of the Oklahoma Historical Society or the Oklahoma Tourism and Recreation Department, the Department of Corrections shall provide labor for and shall produce or manufacture articles, products or materials needed for the repair, construction and maintenance of historical sites and state parks including, but not limited to, the production of materials and products needed for the reconstruction of historic forts in the state.

B. All articles and services provided by the Department of Corrections in the state correctional institutions, and not required for use therein, shall be purchased as required by all offices, departments, institutions, agencies, counties, schools, colleges, universities, or political subdivisions or any agency thereof of this state which are supported in whole or in part by this state, if such article or service is the lowest and best bid, and no such article or product may be purchased by any such office, department, institution, agency, county, school, college, university, or political subdivisions or agency thereof from any other source unless excepted from the provisions as hereinafter provided. Purchases made by the above-described state

agencies may be made by submitting the proper requisition through the Office of Management and Enterprise Services or by direct order to the prison industries program of the Department of Corrections.

C. If a requisition is received by the Office of Management and Enterprise Services or a direct order is received by the Prison Industries Program of the Department of Corrections from a state agency for any product or service provided by the Department of Corrections and such product or service is also available from a severely handicapped person or a qualified nonprofit agency for the severely handicapped as provided in Section 3001 et seq. of Title 74 of the Oklahoma Statutes at a comparable price, then the product or service shall be purchased from such severely handicapped person or qualified nonprofit agency for the severely handicapped. If the product or service is not available within the time period required by the purchasing state agency, then such product or service shall be purchased from the Department of Corrections under the provisions of this section.

D. All offices, departments, institutions, agencies, counties, cities, districts or political subdivisions, schools, colleges, or universities, or any agency thereof, or any agencies of the state, which are supported in whole or in part by this state, may purchase the goods or services manufactured, produced, processed or assembled by the prison industries of the Department of Corrections through their properly authorized purchasing authority, or they may place a direct order without competitive bid, with the prison industries of the Department of Corrections.

E. Not-for-profit corporations or charitable agencies chartered in Oklahoma or other states may purchase such goods and services. Units of the federal government and units of government in other states may also purchase such goods and services. All entities which contract with the state, its political units, its agencies, its public institutions, not-for-profit corporations or charitable agencies chartered in Oklahoma may purchase goods or services from the Department of Corrections which are used in the performance of such contracts. Any church located in the State of Oklahoma may also purchase goods and services manufactured, produced, processed or assembled by the prison industries of the Department of Corrections. Any community action agency or council of governments within this state may purchase housing components produced by the prison industries of the Department of Corrections. Nothing shall prohibit the Department from bidding on portions of a state contract which are subcontracted by the primary contractor.

F. Others are prohibited from purchasing such goods and services, with the exception that all surplus agricultural products may be sold on the open market or bartered and exchanged for other food, feed or seed products of comparable value. The Department of Corrections shall keep complete and accurate records of any such barters or exchanges in such form and manner as the Office of Management and Enterprise Services may prescribe. A copy of such records shall be filed with the Office of Management and Enterprise Services no later than March 1 of each year for all barters or exchanges occurring in the previous calendar year. When practicable, the Department of Corrections may accept and process agricultural products from the public and may export the resulting products to foreign markets.

G. Products manufactured, produced, processed or assembled by the Department of Corrections shall be of styles, patterns, designs and quantities specified by the Department of Corrections except where the same have been or may be specified by the Office of Management and Enterprise Services. Products shall be provided at a fair market price for comparable quality.

H. State agencies shall make maximum utilization of such products and no similar products shall be purchased by state agencies from any other source than the Department of Corrections except as provided in subsection C of this section, unless the Department of Corrections certifies to the State Purchasing Director that it is not able to provide products, and no claim therefor shall be paid without such certification.

I. Exceptions from the mandatory provisions hereof may be made in any case where, in the opinion of the Office of Management and Enterprise Services, the article or product does not meet the reasonable requirements of or for such offices, departments, institutions or agencies, or in any case where the requisitions made cannot be reasonably complied with. No such offices, departments, institutions or agencies, shall be allowed to evade the intent and meaning of this section by slight variations from standards adopted by the Office of Management and Enterprise Services, when the articles, services or products produced, manufactured, processed or assembled by the Department of Corrections, in accordance with established standards, are reasonably adapted to the actual needs of such offices, departments, institutions or agencies.

J. In the event of disagreement between the Department of Corrections and the State Purchasing Director on fairness of price, ability to comply to specifications, reasonableness of specifications and timeliness of delivery of products the matter will be resolved by the Purchasing Director of the Office of Management and Enterprise Services.

K. The Office of Management and Enterprise Services shall cooperate with the Department of Corrections in seeking to promote for use in state agencies and by all other eligible customers, the products manufactured and services provided by the prison industries.

L. The Department of Corrections shall prepare catalogs containing the description of all goods and services provided, with the pricing of each item. Copies of such catalog shall be sent by the Department of Corrections to all offices, departments, institutions and agencies of this state, and shall be available for distribution to all other eligible customers. In lieu of preparing and distributing catalogs, the Department of Corrections may maintain a website that contains a description of all goods and services provided, with the pricing of each item.

M. The Department of Corrections may keep confidential:

1. Business plans, feasibility studies, financing proposals, marketing plans, financial statements or trade secrets submitted by a person or entity seeking a corrections industries partnership with the Department of Corrections;

Request 19-19 BASICS OF THE INITIATIVE This initiative would give immunity to individuals who work for private companies under contract with the ODOC when using Opiate Antagonists (ie. Narcan). Currently, statute provides immunity for law enforcement, but halfway house employees and private prison employees who are not medical professionals would not fall in that category. Halfway houses are a concern, because you are more likely to encounter someone overdosing on opioids. WHAT IS THE FINANCIAL IMPACT There is no financial impact to the agency. PROPOSED AMENDMENT TO STATUTE

Oklahoma Statutes Citationized Title 63. Public Health and Safety Chapter 1 - Oklahoma Public Health Code Article Article 25 - Oklahoma Emergency Response Systems Development Act Section 1-2506.1 - Authority of First Responders to Administer Opiate Antagonists Cite as: O.S. §, __ __

A. First responders shall have the authority to administer, without prescription, opiate antagonists when encountering an individual exhibiting signs of an opiate overdose. For the purposes of this provision, a first responder shall include:

1. Law enforcement officials; 2. Emergency medical technicians; 3. Firefighters; 4. Medical personnel at secondary schools and institutions of higher education; and 5. Forensic laboratory personnel of the Oklahoma State Bureau of Investigation as designated by the Executive Director.

B. An employee of an entity contracting with the Department of Correction, whereby the contract provides for the housing, care, and control of state inmates in a nondepartmental facility operated by the contractor, shall have the authority to administer, without prescription, opiate antagonists when encountering an individual exhibiting signs of an opiate overdose.

B. C. Any first responder individual listed in section A and Section B administering an opiate antagonist in a manner consistent with addressing opiate overdose shall be covered under the Good Samaritan Act.

Request: Carryover from the 2018 Session; Pre-sentence Investigations

BASICS OF THE INITIATIVE This initiative would clarify who the court can designate to perform a pre-sentence investigation (PSI) when a non-violent crime is involved. During the 2017 session language was added to statute that would narrow the circumstances under which ODOC would perform a PSI. The language that was added in 2017 was: B. Whenever a person has a prior felony conviction and is convicted of a nonviolent offense the court may, before imposing a sentence, order a presentence investigation be made of the offender by a private provider or someone designated by the court. Some courts in Oklahoma are interpreting this as allowing them to name the ODOC as

“someone designated by the court”. This goes against the intention of the change

made in 2017.

During the 2018 session ODOC worked with the Administrative Office of the Courts on compromise language that would work for both parties. Unfortunately, by the time this language was agreed upon the deadline had passed. WHAT IS THE FINANCIAL IMPACT If we can get courts to assign a PSI to ODOC in only the most appropriate circumstance then we are saving the agency money and staff time. PROPOSED AMENDMENT TO STATUTE PSI Bill Compromise with the Courts (22 O.S § 982)

A. Whenever a person is convicted of a violent felony offense whether the conviction is for a single offense or part of any combination of offenses, except when the death sentence is available as punishment for the offense, the court may, before imposing the sentence, require a presentence investigation be made of the offender by the Department of Corrections. The court shall order the defendant to pay a fee to the Department of Corrections of not less than Five Dollars ($5.00), nor more than in the amount of Five Hundred Dollars ($500.00) for the presentence investigation. In hardship cases, the court shall set may reduce the amount of the fee and establish a payment schedule.

B. Whenever a person has a prior felony conviction and is convicted of a nonviolent offense the court may, before imposing a sentence, order a presentence investigation be made of the offender by a private provider or someone designated by the court other than the Department of Corrections. The court shall order the defendant to pay to the private provider or court designee assigned to complete the presentence investigation a fee of not less than Five Dollars ($5.00) nor more than Five Hundred Dollars ($500.00). In hardship cases, the court shall set the amount of the fee and establish a payment schedule.

B. Whenever a person has a prior felony conviction and is enters a plea of guilty or nolo contendere to a felony offense other than a violent felony offense, the court may only require a presentence investigation be made by the Department of Corrections when the plea of guilty or nolo contendere is without an agreement by the district attorney regarding the sentence to be imposed. The fee provided in subsection A of this section shall apply to persons subject to this subsection.

C. Whenever a person has entered a plea of not guilty to a felony offense other than a violent felony offense and is found guilty by a court following a non-jury trial, the court may require a presentence investigation be made by the Department of Corrections. The fee provided in subsection A of this section shall apply to persons subject to this subsection.

CD. When conducting a presentence investigation, the Department shall inquire into the circumstances of the offense and the characteristics of the offender. The information obtained from the investigation shall include, but not be limited to, a voluntary statement from each victim of the offense concerning the nature of the offense and the impact of the offense on the victim and the immediate family of the victim, the amount of the loss suffered or incurred by the victim as a result of the criminal conduct of the offender, and the age, marital status, living arrangements, financial obligations, income, family history and education, prior juvenile and criminal records, associations with other persons convicted of a felony offense, social history, indications of a predisposition to violence or substance abuse, remorse or guilt about the offense or the harm to the victim, job skills and employment history of the offender. The Department shall make a report of information from such investigation to the court, including a recommendation detailing the punishment which is deemed appropriate for both the offense and the offender, and specifically a recommendation for or against probation or suspended sentence. The report of the investigation shall be presented to the judge within a reasonable time, and upon failure to present the report, the judge may proceed with sentencing. Whenever, in the opinion of the court or the Department, it is desirable, the investigation shall include a physical and mental examination or either a physical or mental examination of the offender.

DE. The district attorney shall may have a presentence investigation made by the Department on each person charged with a violent felony offense and entering a plea of guilty or a plea of nolo contendere as part of or in exchange for a plea agreement for a violent felony offense. The presentence investigation shall be completed before the terms of the plea agreement are finalized. The court shall not approve the terms of any plea agreement without reviewing the presentence investigation report to determine whether or not the terms of the sentence are appropriate for both the offender and the offense. The fee provided in subsection A of this section shall apply to persons subject to this subsection and shall be a condition of the plea agreement and sentence.

EF. The presentence investigation reports specified in this section shall not be referred to, or be considered, in any appeal proceedings. Before imposing a sentence, the court shall advise the defendant, counsel for the defendant, and the district attorney of the factual contents and conclusions of the presentence investigation report. The court shall afford the offender a fair opportunity to controvert the findings and conclusions of the

FG. The required presentence investigation and report may be waived upon written waiver by the district attorney and the defendant and upon approval by the Court.

GH. As used in this section, "violent felony offense" means:

1. Arson in the first degree;

2. Assault with a dangerous weapon, battery with a dangerous weapon or assault and battery with a dangerous weapon;

3. Aggravated assault and battery on a police officer, sheriff, highway patrol officer, or any other officer of the law;

4. Assault with intent to kill, or shooting with intent to kill;

5. Assault with intent to commit a felony, or use of a firearm to commit a felony;

6. Assault while masked or disguised;

7. Burglary in the first degree or burglary with explosives;

8. Child beating or maiming;

9. Forcible sodomy;

10. Kidnapping, or kidnapping for extortion;

11. Lewd or indecent proposition or lewd or indecent acts with a child;

12. Manslaughter in the first or second degrees;

13. Murder in the first or second degrees;

14. Rape in the first or second degrees, or rape by instrumentation;

15. Robbery in the first or second degrees, or robbery by two or more persons, or robbery with a dangerous weapon; or

16. Any attempt, solicitation or conspiracy to commit any of the above enumerated offenses.

Request: Carryover from 2018: Patrol of the Town of Taft BASICS OF THE INITIATIVE This initiative would repeal section 509.2 of title 57. This section requires the ODOC to patrol the town of Taft, OK. Included in this section is a requirement for the Department of Public Safety to establish a permanent trooper position in Taft. It is the intent of DPS to also remove this from statute. WHAT IS THE FINANCIAL IMPACT There is no financial impact to ODOC since we have not been performing this duty. However, if we were forced to start patrolling Taft it would cost the agency money and staff time. PROPOSED AMENDMENT TO STATUTE

A. In addition to their other security and oversight obligations, the Department of Corrections shall patrol the perimeters of the Jess Dunn Correctional Center and the George Nigh Training Center and also make patrols through the town of Taft.

B. Due to the unusual circumstance that the facilities named in Section 1 of this act are so closely situated to the town of Taft and for the further reason that said town is without any local law enforcement officer on an ongoing basis, it is the intent of the Legislature that the Department of Public Safety shall establish a permanent trooper position to be based and stationed in the town of Taft.
