Further Dundalk Deeds: Seatown

When the Roden Estate office in Dundalk closed Mr Redmond Magrath salvaged the

counterpart deeds which were about to be discarded. Eighty-three of these deeds have been published in previous issues of this Journal.1 Those articles dealt with properties in various parts of the town as

well as with the rural part of the estate. The present article will concentrate on one street - Seatown,

where forty-one leases from 1808-19 survive.

It is clear that not all the premises in Seatown are covered by the leases published here. The

marginal map on each indenture shows the neighbouring properties and from these the names of other

residents in the street may be obtained.

It will be noted that all the leases were for one life or for twenty-one years should the named

person die before the expiry ofthat period. These lives were Chichester Fortescue, died 1826 (2 leases,

1808), Faithful Fortescue, died 1844 (5 leases, 1809), Mathew Fortescue, died 1845 (6 leases, 1809; 1 lease, 1817; and 13 leases, 1819), John McClintock, died 1855 (9 leases, 1809) and William Foster

McClintock, died 1838 (5 leases, 1810). In all cases therefore, except for the two leases (nos 100 and

122) made for the life of Chichester Fortescue, the tenancies exceeded the minimum period of twenty one years.

Unfortunately the 1817-19 leases do not continue the earlier practice of stating the

occupation of the tenant. The 26 occupations given include 12 labourers, 8 carmen, 2 carpenters, 1

brogue maker, 1 gardener, 1 jobber and 1 weaver.

It was obviously a closely-knit community with names such as McCourt/McCourth/McQuort

(8 families), Connolly (5), Hoghey (3), Conlon (2), Dunn (2), Fagan (2), and Lappin (2)

predominating.

The thirteen leases made on 10 August 1819 reveal the introduction of an early public health

measure. They included an additional covenant which obliged the tenant 'in March of each year to

whitewash the walls, both inside and out, of every dwelling-house, out-house and office with good hot

lime whitewash'. This measure probably resulted from the outbreak of fever in 1817.2

All except four of the leases carry endorsements which indicate that the tenant was registered as a forty-shilling freeholder and therefore entitled to vote. A sample endorsement (no. 91) reads

'Produced and Registered this 11th day of April 1820, J. Bourne, Clerk of the Peace'. That this is the

significance of these endorsements can be verified by reference to the printed List of Registered Freeholders of the County of Louth for the 1820s/ The letter and number(s) in square brackets appear on the leases and were obviously part of the estate's filing system.

after the first entry.

SEATOWN (north side) 84. Made 1 March 1817 between Hon. Hugh Howard and John Metge, trustees of Lord Roden's estate, of the first part,

Rt. Hon. Robert Earl of Roden of the second part, and Walter Crilly of Dundalk of the third part. That dwelling house and plot of ground on the north side of the street called Back or Lower Seatown containing in breadth in

front to said street 49 feet 6 inches and in rere 47 feet and in depth from front to rere 106 feet meared and bounded as described

my Creator and my body to the earth to rottenness and worms. I will unto my loving wife all that I am possessed of during her

natural life, she to hold and enjoy all the benefits thereof as in my life time, and at the end thereof I will unto my loving son

Owen Mulligan the kitchen of my dwelling house being the one half with the one half of my garden, and also one half of the

back house situate therein. I will and bequeath unto my son Michael the room of my dwelling house being the other half thereof

together with half the back house and also the other half [of] the garden providing that both the said Owen and Michael do each

contribute to defray my funeral expences (sic) and also that they shall each pay the sum of four pounds to say one four pounds for James my son and the other four pounds for Mary my daughter and to be paid them by giving it into the hands of my wife
