    TENDER NOTICE

    Tender Notice No. OMD/ 39 /2010-11, dated 07.03.2011

    1. Sealed Tender in prescribed format provided in the Tender Schedule are invited from reputedmanufacturer/auth. Dealer for procurement, installation and commissioning and after sales comprehensive

    maintenance of solar street lightsas per detail specified mentioned in technical description page no.2. The

    prescribed tender documents can be obtained from the Sr. Manager(Finance), Thakurani on payment ofRs. 104.00 only in shape of Cash on any working day on or before 06.04.2011 by 12.00 Noon or can bedownloaded from our websitewww.birdgroup.gov.inand NIC portal, which shall be deposited along witha demand draft for Rs.104.00 drawn on any nationalized/scheduled bank in favour of The Orissa

    Minerals Development Company Limited payable at Barbil.

    2. Tender in prescribed format complete in all respects accompanied with the earnest money deposit of Rs16,000.00 (Rupees sixteen thousand only) per unit in the form of Bank draft/Pay order from anyNationalized bank drawn in favour of THE ORISSA MINERALS DEVELOPMENT CO. LTD.

    payable at Barbil should reach or dropped in the tender box of the office of the Sr. Manager (F),Thakurani on or before the scheduled date and time given below.

    3. The offer should reach the office of The Sr. Manager (Finance) on or before 3.30 P.M. on dated

    06.04.2011.

    4. The Tender shall be opened at the office of Sr. Manager (Finance) at Thakurani, Barbil in presence of the

    Tenderers or their accredited representatives at 4.00 P.M. on dated 06.04.2011. .

    5. The Company shall not be liable for any delay in submission of the tender documents due to postal delayand no extension of date for tender submission/tender opening shall be given for this reason.

    6. The company reserves the right to accept the tender in part or in full without assigning any reasonwhatsoever. The Company reserves all the rights not to accept the lowest offer.

    7. The company reserves the right to divide the Supply among more than one party. The company alsoreserves the right to cancel the tender and in such an event no claim of any tenderer for such a decision bythe company shall be entertained.

    TERMS AND CONDITIONS OF ENQUIRY

    1. EARNEST MONEY DEPOSIT:

    Each Tenderer must be accompanied with the non interest bearing pre-bid Earnest Money Deposit (as

    prescribed) of Rs 16,000( Rupees Sixteen thousand only) in shape of Bank draft/Pay order drawn on any

    Schedule/Nationalized Bank in favour of The Orissa Minerals Development Company Limited. payable at

    Barbil. Name of the remitter shall be mentioned in the DD/PO. Tender without prescribed earnest moneyshall be rejected. The earnest money of the successful bidder shall be converted into security deposit which

    bears no interest.

    Note: - Earnest money of the unsuccessful bidder will be refunded after award of the contract.

    2. PERFORMANCE GUARANTEE:

    The Agency has to submit an irrecoverable Bank Guarantee in favor of The Orissa Minerals Development

    Company Ltd. for an amount of equivalent to 5% of total contract value having validity period of five

    year from the date of signing of agreement. The Bank Guarantee is to be submitted in the prescribed

    format at the time of signing of agreement. The OMDC have the absolute right to en-cash the said BankGuarantee in the event of failure of the agency to discharge their contractual/statuary obligation &

    liabilities. However this does not absolve the agency from his statuary contractual liabilities or otherwise

    which may be found more than the amount of Bank Guarantee.

    3. Time Schedule for Delivery:

    Delivery should be within 15 days from the date of issue of Purchase Order to the site.

    4. Transportation

    The successful tenderer shall deliver the items at OMDC Central Stores, At/PO-Thakurani, Via-Barbil,

    Dist: Keonjhar, State-Odisha, Pin-758035.

    5. Basis of order placement

    The landed cost ofitems as per annexure-A on FOR Destination basis.

    6. Warranty

    The tenderer shall provide warrantee for 60 months from the date of delivery of the materials.

    7. Terms of Payment

    For Equipment

    80% of the total order value shall be paid against receipt and acceptance of materials at site. On making

    such payment, OMDC shall have lien on the materials pending for successful commissioning at site.

    10% of the total order value shall be paid against successful commissioning at our site.

    The balance 10% of the total order value shall be paid 90 days from date of commissioning along-with

    refund of EMD.

    8. Erection and Commissioning

    To be carried out by the successful tenderer within 15 (Fifteen) days from the date of receipt the solar

    street light fittings at site. OMDC shall give intimation towards receipt of materials at site on the date of

    receipt of equipment. OMDC provide free accommodation and transportation at site to the erection and

    commissioning personnel.

    The rate quoted/offered shall be inclusive of all taxes and duties. The tenderer shall clearly furnish thedetails of the taxes and duties with percentage presently payable in the price schedule.

    10. Legal Capacity

    The bidder shall satisfy OMDC (The Orissa Minerals Development Company Ltd.) that he is competentand authorized to submit tender and / or to enter into a legally binding contract with OMDC. To this effect,any person signing the tender shall render relevant documentary evidence, like Power of Attorney, that hissignature on the tender submitted by him is legally binding upon himself and the supplier.

    A person signing the tender or any document forming part of the contract on behalf of another shall bedeemed to warrant that he has authority to bind such other and if it is discovered that at any time the personso signing had no authority to do so, OMDC may without prejudice to other civil and criminal remedies,cancel the contract and hold the signatory liable for all cost and damages.

    11. The bidder should enclose copy of manufacturer or authorized dealer certificate.

    12. The bidder has to submit the copy of the TIN as per sales tax act.

    13. Validity of Tender

    The tender and the prices quoted shall remain valid for a period of 3 (three) months from the due date of

    submission of the tender.

    14. Arrangement of Tender

    The tender shall be neatly arranged, legible and typewritten with consecutively numbered pages in solidbinding. They should not contain any term and condition, printed or otherwise, which are not applicable to

    this tender.

    Insertions, postscripts, additions and alternation shall not be recognized, unless authenticated by the

    tenderers signature.

    15. Exclusions and Deviations

    Exclusions / Deviations in the offer if any, shall be clearly stated under separate heading EXCLUSIONS /DEVIATION quoting the respective clause with justification. Such deviation shall be subject to OMDCsapproval.

    Tenderers are to indicate whether or not their tender conforms to the requirements of the TenderDocument. Non-conformance with any specific requirement of this tender should be clearly listed in undera separate heading EXCLUSIONS / DEVIATIONS, quoting the respective Clause with justification. Thisshall be submitted in the techno-commercial part of the offer. Acceptance of any such Exclusion /

    Deviation shall be the sole discretion of OMDC.
