Dr. Natalie Stavas...

THE BOSTON GLOBE’S2013 BOSTONIAN OF THE YEARDr. Natalie Stavas is a physician at Boston Children’s Hospitaland an instructor in pediatrics at Harvard Medical School.Described as a healer, educator and Boston community leadershe received the 2012 Change Maker award from The BostonFoundation.

On April 15, 2013 Dr. Stavas approached the finish line of her fifthBoston marathon. Just blocks away, she heard explosions andran towards them. Arriving at the scene she went to work admin-istering CPR, applying tourniquets and triaging the wounded.

Following these actions President Barack Obama, Katie Couric,and Anderson Cooper honored her for actions. ImproperBostonian magazine named Dr. Stavas one of “Boston’s Best”and The Boston Globe awarded her with “2013 Bostonian of theYear” – an honor bestowed upon those that shape the biggeststory of the year in a remarkable way.

After the bombings Dr. Stavas increased her efforts in preventingchildhood violence and improving the health of urban communi-ties. She is a mentor for Sole Train – a non-profit organizationguiding inner-city youth on a path towards their full potentialthrough running. She is also the medical advisor for theAppalachian Mountain Club, helping improve the health ofchildren by getting them outside.

Dr. Stavas’ work goes beyond borders – traveling to Haitithroughout the year Dr. Stavas provides medical care to childrenand helps strengthen the fragile medical infrastructure. Adocumentary featuring this work as a medical pioneer premieredat the 2014 South by Southwest film festival.

Dr. Stavas writes for multiple outlets including Huffington Postand the Medical Bag. Dr. Stavas has been featured in RunnersWorld, The New York Times, LA Times, The Boston Globe, TheNew Yorker, Time and People.

U.S. CONSUMER PRODUCTSAFETY COMMISSIONCOMMISSIONERJoseph P. Mohorovic was sworn in as a Commissioner of the U.S.Consumer Product Safety Commission (CPSC) on July 28, 2014, toa term that expires in October 2019.

Prior to joining the Commission, Mohorovic was Senior VicePresident of Intertek, a global leader in product testing, where hewas responsible for all aspects of performance, growth andstrategic management in the North American region. Beforejoining Intertek, Mohorovic’s public service included two termsas State Representative for New Mexico’s 28th District beforeresigning elected office to serve in the CPSC administration offormer Chairman Hal Stratton from 2002 through 2007.

Mr. Mohorovic graduated from the University of Texas at Austinand he holds an M.B.A from the University of New Mexico.

Where historytakes the field...Fenway Park

In today's world some of the best things are those that changelittle, remaining basically the same for decades. Fenway Park isa perfect example of this. Today, the Boston Red Sox remaincommitted to staying at this classic ballpark that they havecalled home since 1912. Fenway Park is the oldest major leagueballpark in use and still retains the same feel and characteris-tics as it did when the very first pitch was thrown. a department of Justice updateregarding doJ FCpa, ukBa,oFaC and ITarThis session will discuss the developments in enforcement bythe DOJ and SEC as it pertains to the Foreign CorruptPractices Act, The United Kingdom Bribery Act, Office ofForeign Asset Controls and International Traffic in ArmsRegulations. General Counsel need to be apprised of the newenforcement, what countries are prohibited from businesstrade by as U.S. company or its subsidiaries or partners aswell as what products may be deemed a violation of ITAR,such as the selling of a simple yet specific bolt to an entitywhich may have ties to an undesired foreign party. The cost ofdoing business also includes proper compliance and knowingwhat the risks are and understanding and reviewing thechange in regulations and enforcement trends by not only theU.S. government, but government abroad as well.

Who is the general Counsel’s Client?This panel will discuss identifying who actually is the clientfor General Counsel and who can make a claim, what typesof federal and state claims can result in personal liability forthe General Counsel’s office. A General Counsel is the legalofficer for the company, but is often asked to providebusiness advice and prepare documents relied upon byshareholders and outside investors and participate in acqui-sition and merger discussions. General Counsel always needto aware of changes in the law, but also to be cognizant ofthe advice being provided and who will be relying upon thisadvice. This panel will provide insight to General Counsel onhow to walk this delicate path.

do’s and don’ts for general Counsel When General Counsel learn of a complaint, subpoena, civilinvestigative demand or worse of a raid by government agentsthere should be a plan in place to properly address how thecompany and the business division should provide the legaldocument or notice of appearance by government agents tothe General Counsel’s office and the best manner to set upthis plan and implement it. Next General Counsel should knowexactly how to protect the attorney client privilege, properlyinvestigate the allegation, utilize proper Upjohn warnings anddevelop the necessary response. There are plenty ofexamples of companies encountering more trouble by notproperly responding to a subpoena or civil investigativedemand and even more examples of counsel not protectingthe necessary privileges. After this panel’s presentation,attendees will know of different strategies to invoke and plansto implement to assure recognition of these legal documentsand proper timelines and communications for establishing thebest response on behalf of the company.

What keeps general Counselup at NightThis GC-led session will address recent legal issuesthat keep them up at night. Topics could include but arenot limited to data privacy and security, acquisitionliability, SEC filings, supplier liability, etc. The sessionattendees will then be asked to provide examples ofhow they have or would address the issues.

The Product Liability Track and four hours of sessions willutilize the facts based on the crash of Colgan Flight 3407which occurred on February 12, 2009, outside of Buffalo,New York, which resulted in 50 deaths.

Subsequent to the accident, litigation followed inUnited States District Court and in New York SupremeCourt. The federal court cases were consolidated fordiscovery in multi-district litigation in the Western Districtof New York, while the state court cases proceeded undera combined case management plan. The litigationproceeded aggressively for more than five years.

More than 200 depositions of fact and expertwitnesses were conducted. Extensive motion practiceensued, on issues relating to discovery, the reliability ofproffered expert testimony, the application of the legal

standard of care, the limiting of trial evidence, and theviability of punitive damage claims.

In connection with that litigation the defenseconducted very costly mock jury exercises to assess anumber of core issues, including developing a favorabledefense juror profile, theme development in thecatastrophic case, and strategies to mitigate the risk ofpunitive damages.
