Section VI - MASS HOMELAND EXCEPTIONS These Rules are exceptions to the 2007 AIB Massachusetts Private Passenger Automobile Insurance Manual. All Other Provisions of the AIB Manual will apply. Page A – 2007 Memorandum of Changes is deleted from this Manual. RATE SECTION – Memorandum – Paragraphs 1 and 2 of this section are deleted. Rule 1 - MASSACHUSETTS AUTOMOBILE INSURANCE POLICY – ELIGIBILITY is replaced in its entirety by the following. All individually owned vehicles registered under the Massachusetts Compulsory Motor Vehicle Law and rated in accordance with this Manual may be written on a Massachusetts Automobile Insurance Policy. Coverage for risks not subject to the Compulsory Law may be provided under the countrywide Personal Auto Policy and the Massachusetts Amendment of Policy Provisions Endorsement MP 00 99 at rates determined in accordance with this Manual. RULE 4. STANDARD PROCEDURES Section A. Renewals.2 is replaced with the following. The remainder of the Rule remains A.2. The Company may elect to secure payment of a deposit premium. The premium quotation shall be based on the latest classification information and premium charges established for the renewal policy. RULE 11 – PREMIUM CALCULATION RULE The following step sequence shall be used in rating the policy. The manual rate includes any premium adjustment as may be necessary to increase, reduce or eliminate the deductible amount applicable to Parts 7, 8 and 9, or to apply Waiver of Deductible under Part 7.

1. Apply the appropriate Category factor under Rule 59, to the Class-Territory base rates for Parts 1,2,4,5,7,9, and the Flat rates for Parts 3,6,10,11,12.

2. Apply the appropriate rating factor under Rule 24, to the manual rate for Parts 7 and 9, if applicable.

3. Apply the appropriate rating factor under Rule 48 to the rate for Parts 7, 8 or 9, if applicable.

4. Apply the appropriate discount to the premium developed in Step 3. Refer to

Rule 19, 64 and 65 for a definition of the available discounts.

Parts 1 through 9 and Part 12 may be subject to more than one discount. In such case, the order of discounts shall be (1) annual mileage, (2) multi car, (3) passive restraint, (4) anti theft, (5) Companion Property Discount, (6) Class15 and (7) Approved Group Discounts. The discount shall be rounded to the nearest dollar

5. Apply the appropriate Safe Driver Insurance Plan points or credit to the premium

developed in step 4. Rule 56 - The Safe Driver Insurance Plan (SDIP) Any reference to the Commissioner in this Rule is replaced by the Company. Prior Insurance Points are awarded if the Named Insured had no prior insurance. Prior Insurance points do not apply on renewal. “No Prior Insurance” points are assigned if the Named Insured has not had continuous auto insurance in the 12 months immediately prior to the effective date of the policy. Prior Insurance includes being listed on a policy as a non deferred operator and non excluded operator.

Award points based on the counts of non-chargeables of all listed operators in the last 5 years from the effective date of the policy. Do not include Incidents for deferred or excluded operators. Definitions:

• Not-at-fault accidents – A not at fault accident is one in which the company makes a claim payment of at least $500 and determines that the listed operator is 50% at fault or less. Claims that are subrogated against another party are also included in this category if the net payment by the Company is at least $500.

• At Fault accidents less than the threshold are accidents where the claim payment for Bodily Injury Liability, Damage to Someone Else’s Property, Collision, or Limited Collision is less than $500 and is not surcharged as part of Rule 56 – The Safe Driver Insurance Plan (SDIP).

• Comp claims are any claims paid by an insurance company under Comprehensive coverage excluding Glass claims or Towing and Labor claims.

The Category Factor is applied to the Base Rates for all coverages. Rule 60 – Loan Lease Coverage Loan/Lease coverage can extend comprehensive and collision coverages to provide for the difference between indebtedness under a Loan/Lease agreement on a new vehicle and the actual cash value of the vehicle. Increased vehicle leasing in recent years and the use of longer loan periods has created the exposure to which this coverage applies. 1. Eligibility A policy providing both Part 7 - Collision and Part 9 - Comprehensive coverage may be extended to provide coverage for the difference between the outstanding indebtedness on a loan/lease agreement on a new vehicle, and the actual cash value of the vehicle, subject to the following: a. Auto Loan/Lease Coverage may be provided only to a vehicle that is a private

passenger auto, pickup or van that qualifies for coverage as set forth in Rule 1. Massachusetts Automobile Insurance Policy – Eligibility; and

b. The insured must request the auto loan/lease coverage within 30 days of leasing or financing a new vehicle.

Note: A new vehicle as used in this rule is a vehicle that has not previously been titled under the motor vehicle laws of any state.

2. Rates

Charge 7% of both the Part 7 – Collision and Part 9 – Comprehensive Coverage premiums for the auto loan/lease coverage.

3. Endorsement Attach the auto loan/lease coverage endorsement to the policy. Use form G11995 Rule 61 – Model Year Rating Rate Model Year 2009 vehicles by applying the following factors to the applicable Model Year 2008 rates: 2009 Model Year Factor Coverage Applicable to Model Year 2008 Collision 1.047 Comprehensive 1.008

Rule 62 – Identity Theft Resolution Assistance For no additional premium, Identity Theft Resolution Assistance applies to all automobile policies. Referral will be made to a firm that provides a. A Personal Advocate who works with insured.

b. Comprehensive notifications to relevant institutions c. Case file resolution d. Post resolution follow-up in order to report or resolve identity theft.

Endorsement Attach the Identity Theft Resolution Assistance endorsement SA 00751107 to all Mass Auto policies.

Rule 63 – Auto Security Plus Package Eligibility This package of optional coverages may be added to policies that provide Collision and Comprehensive coverage. It provides additional coverage and limits to some of the insured’s current coverages plus several additional enhancements. The endorsement includes:

• Additional Limits Transportation Expenses; • Use of Original Equipment Manufacturers Parts until the insured vehicle is

3 model years old; • Increased Supplementary Payments; • Auto loan/lease coverage; • Optional Supplementary Payments; • Travel Expense Coverage; • Auto Theft Reward; • Accidental Air Bag Deployment; and • Emergency Roadside Assistance Coverage.

Coverage is provided on a per vehicle basis and is available if the insured has Collision and Other than Collision coverages on the insured vehicle. Rating The premium charge for this coverage is $82 per vehicle. Endorsement Attach the Automobile Security Plus Package endorsement to the policy. Use form SA00741107. Rule 64 – Companion Property Discount (excludes Dwelling Fire forms) If the named insured or spouse is also the named insured on an OneBeacon Insurance Group or any affiliate or subsidiary Property Policy, except for a Dwelling Fire policy, apply a 10% companion policy discount to all coverages and premiums. This discount may be added at any time when the eligible Companion Property Policy becomes effective. This discount does not apply to policies assigned to Category A as determined by Rule 59. Rule 65 – Approved Group Discounts Group discounts are downward deviations to the premiums otherwise calculated by the rules and rates in the manual and are subject to the Commissioner’s approval under Chapter 175, Section 193R.

Installment Payment of Premium Plan – Private Passenger Automobile Policies The following provides details of the plan that is offered policyholders that choose to pay their premium on an installment basis: New Business One option consists of a minimum down payment of twenty five percent (25%) with the balance of the premium payable over a maximum of nine (9) equal installments for a total of ten (10) payments. Any prior deposit received will reduce the minimum due on the first bill.

The second option consists of a "level bill" offering up to twelve (12) monthly installments. This option is only open to insureds that elect our OnTime electronic funds transfer program. Renewals One option consists of a minimum down payment of twenty percent (20%) with the balance of the premium payable over a maximum of nine (9) equal installments for a total of ten (10) payments. The second option consists of a "level bill" offering up to twelve (12) monthly installments. This option is only open to insureds that elect our OnTime electronic finds transfer program. Installment Charge If an installment payment method is elected by the insured, a fee of $5.00 per installment will be applied to the policy, except for single vehicle policies rated SDIP 5 points to 45 points. These polices will incur a fee of 1.25% per installment to be applied to the outstanding balance due. Each installment bill will afford the insured the opportunity to pay the balance of the premium in full and thus eliminate any future installment fees for that policy term. Late Payment Fee A $20.00 late payment fee will be charged to an insured’s policy every time that a Statutory Notice of Intent to Cancel is issued in a policy term. Dishonored Check Charge A $25.00 fee will be charged to an insured’s policy for each a check that is dishonored by the financial institution to which the check is presented for payment.

The Category Factor is applied to the Base Rates for all coverages. Rule 60 – Loan Lease Coverage Loan/Lease coverage can extend comprehensive and collision coverages to provide for the difference between indebtedness under a Loan/Lease agreement on a new vehicle and the actual cash value of the vehicle. Increased vehicle leasing in recent years and the use of longer loan periods has created the exposure to which this coverage applies. 1. Eligibility A policy providing both Part 7 - Collision and Part 9 - Comprehensive coverage may be extended to provide coverage for the difference between the outstanding indebtedness on a loan/lease agreement on a new vehicle, and the actual cash value of the vehicle, subject to the following: a. Auto Loan/Lease Coverage may be provided only to a vehicle that is a private

Charge 7% of both the Part 7 – Collision and Part 9 – Comprehensive Coverage premiums for the auto loan/lease coverage.

Rule 63 – Auto Security Plus Package Eligibility This package of optional coverages may be added to policies that provide Collision and Comprehensive coverage. It provides additional coverage and limits to some of the insured’s current coverages plus several additional enhancements. The endorsement includes:

• Additional Limits Transportation Expenses; • Use of Original Equipment Manufacturers Parts until the insured vehicle is

3 model years old; • Increased Supplementary Payments; • Auto loan/lease coverage; • Optional Supplementary Payments; • Travel Expense Coverage; • Auto Theft Reward; • Accidental Air Bag Deployment; and • Emergency Roadside Assistance Coverage.

Coverage is provided on a per vehicle basis and is available if the insured has Collision and Other than Collision coverages on the insured vehicle. Rating The premium charge for this coverage is $82 per vehicle. Endorsement Attach the Automobile Security Plus Package endorsement to the policy. Use form SA00741107. Rule 64 – Companion Property Discount (excludes Dwelling Fire forms) If the named insured or spouse is also the named insured on an OneBeacon Insurance Group or any affiliate or subsidiary Property Policy, except for a Dwelling Fire policy, apply a 10% companion policy discount to all coverages and premiums. This discount may be added at any time when the eligible Companion Property Policy becomes effective. This discount does not apply to policies assigned to Category A as determined by Rule 59. Rule 65 – Approved Group Discounts Group discounts are downward deviations to the premiums otherwise calculated by the rules and rates in the manual and are subject to the Commissioner’s approval under Chapter 175, Section 193R.

Installment Payment of Premium Plan – Private Passenger Automobile Policies The following provides details of the plan that is offered policyholders that choose to pay their premium on an installment basis: New Business One option consists of a minimum down payment of twenty five percent (25%) with the balance of the premium payable over a maximum of nine (9) equal installments for a total of ten (10) payments. Any prior deposit received will reduce the minimum due on the first bill.

The second option consists of a "level bill" offering up to twelve (12) monthly installments. This option is only open to insureds that elect our OnTime electronic funds transfer program. Renewals One option consists of a minimum down payment of twenty percent (20%) with the balance of the premium payable over a maximum of nine (9) equal installments for a total of ten (10) payments. The second option consists of a "level bill" offering up to twelve (12) monthly installments. This option is only open to insureds that elect our OnTime electronic finds transfer program. Installment Charge If an installment payment method is elected by the insured, a fee of $5.00 per installment will be applied to the policy, except for single vehicle policies rated SDIP 5 points to 45 points. These polices will incur a fee of 1.25% per installment to be applied to the outstanding balance due. Each installment bill will afford the insured the opportunity to pay the balance of the premium in full and thus eliminate any future installment fees for that policy term. Late Payment Fee A $20.00 late payment fee will be charged to an insured’s policy every time that a Statutory Notice of Intent to Cancel is issued in a policy term. Dishonored Check Charge A $25.00 fee will be charged to an insured’s policy for each a check that is dishonored by the financial institution to which the check is presented for payment.
