    Tria l Chamber V ("Chamber") of the Internat ional Criminal Court ("Court" , " ICC") , inthe case of The Prosecutor v. William Samoei Ruto and Joshua Arap Sang, having regard toArticle 64 of the Rome Statute ("Statute") and Rule 132 of the Rules of Procedure andEvidence, issues this Order scheduling status conferences and vacating the trial start date.

    1. O n 12 Ap ril 2013, the Office of the Prose cuto r ("P rose cutio n") filed a req ues t toadd five witnesses to i ts witness l ist and add their evidence to i ts l ist of evidence.In addit ion , the Prosecu tion req ueste d the C ham ber to hold an ex parte hearing.^

    2. On 16 April 2013, the defence for Mr Ruto ("R uto Defence") inform ed theCh am ber that i t did n ot object to the reque st for an ex parte, Prosecu tion onlyhearing,^ bu t requ ested that i t be followed by a status conference wi th al l part iespre sen t and that the Ch am ber also hold a subse qu ent ex parte, Defence only,hearing to address defence invest igation issues.^

    3. On 18 Ap ril 2013, the defence for Mr Sang ("Sang Defence") joined the RutoDefence 's request for a status conference,^ indicating that i t wished to discuss thePro secu tion's re que st to add ne w witnes ses, as well as the feasibil ity of the 28 May2013 da te for th e star t of trial.

    4. On 22 April 2013, the Ruto Defence fi led the Second Defence Request to Vacatethe Trial Commencement Date ("Second Defence Request"), in which i t requestedthat th e trial date of 28 M ay 2013 be vaca ted 'm ord er to al low the Defencead equ ate t im e to prep are i ts case.^

    5. On 2 M ay 2013, the Prosecution re spo nd ed to the requ ests by the Ruto Defenceand the Sang Defence, stating that it did not object to a status conference or to theex parte hearin g requ ested by th e Ru to Defence.^

    6. The Chamber considers i t necessary to receive addit ional information from theProsecution about the request to add five witnesses to the Prosecution's witnesslist . The req ues t for an ex parte. Prosecu tion, only h earin g is therefore gran ted.This status conference w ill take place on 7 May 2013.

    7. The Cham ber also considers i t necessary to hold a status conference with b othpart ies and the representat ive for vict ims in order to address both the Prosecutionrequest to add five witnesses and the Defence request to vacate the trial start date.Accordingly, the Chamber hereby schedules a status conference for 14 May 2013.

    8. Finally, the R uto Defence h as req ueste d an ex parte. Defence only, statusconference in order to raise "cri t ical defence invest igative issues" relevant to theviabil i ty of the trial start date.^ Both Defence tea ms w ere asked to prov ide detailsto the Chamber concerning precisely which issues they would l ike to raise in an exparte status conference.^ These details were p rov ide d on 3 May 2013.^ TheCh am ber cons iders i t op po rtu ne to hold a n ex parte, Defence on ly, hearingimm edia tely p rece ding the inter partes status conference on 14 M ay 2013.

    9. The Ch amb er cannot decide on the pen ding reques ts de ta i led above unt i l havingheard fur ther submissions by the par t ies . In addi t ion, a number of proceduralissues relat ing to the conduct of proceedings st i l l remain to be determined. Giventhese facts and bearing in mind that the Registry and the Vict ims and WitnessesUni t wi l l need a minimum of two weeks to make the necessary arrangements for

    the start of trial, the Chamber considers that it is not feasible, at this stage, toretain 28** of May 2013 as the start date for the trial . Therefore, the Chamberhereby, wi thout pre judice to the Chamber 's decisions on the pending requests ,vacates the trial date of 28 May 2013. The new start date for trial will be set in theChamber's decision on the Second Defence Request , which will be rendered indue course .
