Background

The National Marine Fisheries Service (NMFS) is responsible for implementing the Endangered Species Act (ESA), Marine Mammal Protection Act (MMPA), and Magnuson-Stevens Fisheries Conservation Act (MSA). Through programs conducted under each of these statutes, NMFS seeks to protect and preserve our nation's living marine resources through scientific research, fisheries management, enforcement, and habitat conservation.

To achieve this mission and advance sound stewardship of these resources, NMFS works closely with tribes, local, state, and Federal agencies, and our stakeholders and partners (e.g., corporations, farmers and ranchers, homeowners, non-profit organizations, trade groups) to find science-based solutions to complex ecological issues. The Oregon-Washington Coastal Office advances these ends through a variety of interagency consultations as requested by Federal agencies (or, in the case of the MMPA, citizens who request authorization for incidental take of marine mammals) to help manage, conserve, and protect living marine resources in inland, coastal, and offshore waters of the United States. Task & Deliverables

The Contractor shall provide the following services throughout the period of performance and complete the following projects and deliver them to the NMFS Project Leader no later than the end of the period of performance for each line item:

Conduct ESA, MMPA, and MSA program consultation and document preparation activities in the North Puget Sound and Willamette Branches. In addition to the tasks listed below, the Contractor will coordinate daily with their supervisor on assignments and work products. Although this position might involve opportunities to consult in the field, this position consists mainly of administrative duties.

a. Task A1) Description: Respond to inquiries from action agencies, applicants, and their

representatives, provide pre-consultation technical assistance to action agencies, applicants, or their representatives during regular business hours. Examples of technical assistance likely to be provided include:

Initial contact with consulting agency, applicant, or non-federal representative,Explanation of consultation process and information requirements, if necessary,Preparation or review of species lists,Recommendation of conservation measures to minimize adverse effects to listed species,Feedback on draft documents submitted by action agencies,Engineering review of designs, andSite visits to potential project areas.

2) Deliverable: Provide technical assistance, documentary review, and site visits with and for action agencies, applicants, and their representatives.

b. Task B1) Description: Review consultation initiation packages for accuracy and completeness,

and develop requests for further information sufficient to support initiating consultation, as needed.

2) Deliverable: Provide feedback in the form of further information requests or confirmation of consultation initiation.

c. Task C1) Description: Consult with action agencies and their representatives or applicants as

required to ensure action agency compliance with each statute, as needed. Communicate with Government manager to coordinate NMFS response to each consultation.

2) Deliverable: Prepare appropriate consultation documentation including, but not limited to, ESA letters of concurrence, ESA biological opinions, MSA essential fish habitat consultations, programmatic responses, and MMPA incidental harassment authorization letters.

d. Task D

1) Description: Prepare appropriate documentation for each consultation and follow West Coast Region protocol for quality assurance.

Deliverable: Prepare related documentation, including assembling and managing administrative records as necessary to provide adequate and proper evidence of agency business, timely response to requests for information, and compliance with NMFS internal directives, including memos to the file that show compliance with West Coast Region quality assurance process.

Requirements

Selected individual(s) must have the following minimum qualifications:

Bachelor’s degree or higher from an accredited college or university with a major in biological sciences, engineering, or natural resource management, and an emphasis in fisheries, oceanography, social science, natural science, mathematics, or hydrology, plus five (5) years of experience in a related field or combination of such totaling nine (9) years combined education/experience. Master’s Degree in related field plus one (1) year experience or Ph.D. may be substituted for experience.

Additional required qualifications include:

Experience with or knowledge of the requirements of ESA section 7(a)(2), MMPA section 101(a)(5)(D), or MSA section 104-297 and their respective consultation processes.Writing and editing skills.Strong communication and interpersonal skills.Computer skills including Microsoft Office, Excel, PowerPoint, and email.

Additional preferred qualifications include:

Experience providing biological, economic, or social analyses to support recommendations for natural resource conservation measures.Experience assessing the impacts of human activities on marine, estuarine, or anadromous species and their habitats as part of a regulatory program.Experience developing policy or procedures for the management and conservation of protected species including marine fish, mammals, or sea turtles.

California Central Valley Office - FEMA Assistance

Requirement #2

I. BACKGROUND

The California Central Valley Office responsibilities focus on the Sacramento and San Joaquin River basins and Sacramento-San Joaquin Delta. The office works to protect species listed under the Endangered Species Act (ESA) by evaluating the impact of proposed federal actions, developing recovery plans, seeking conservation partnerships with local governments and landowners, and ensuring safe fish passage past federal and some private dams.

The Contractor shall assist the NMFS West Coast Region (WCR) Central Valley Office in performing section 7(a)(2) consultations by carrying out activities associated with the review of various projects submitted to NMFS by other federal agencies pursuant to section 7(a)(2) of the ESA. Prior to permitting, funding, or conducting activities that may affect species listed under the ESA, federal agencies must perform a section 7(a)(2) consultation with NMFS to ensure their actions do not jeopardize the continued existence of listed species.

Specifically, the contractor shall assist with tracking all FEMA project review requests under the Memorandum of Understanding regarding National Environmental Policy Act, Endangered Species Act, Magnuson-Stevens Fishery Conservation and Management Act, National Historic Preservation Act, Rivers and Harbors Act Section 10 Act, and Clean Water Act Section 404 Permits for Federal Emergency Management Agency Emergency (FEMA) Projects in California, Nevada and Arizona with U.S. Department of Homeland Securities FEMA and U.S Army Corps of Engineers, the U.S Fish and Wildlife Service and the National Marine Fisheries Service (NMFS). The Contractor shall also track all FEMA programmatic consultations with NMFS pursuant to section 7(a)(2) of the Endangered Species Act for covered activities related to FEMA emergency response and impacts to federally listed species throughout the state of California including, threatened California Central Valley steelhead, federally threatened Central Valley spring-run Chinook salmon, federally endangered Sacramento River winter-run Chinook salmon, and federally threatened Southern Distinct Population Segment of the North American green sturgeon, threatened California Coastal Chinook salmon, Central California Coast steelhead, Southern California Coast steelhead, Central California coast coho salmon, black abalone, and eulachon.

Required Knowledge and Experience

1. QualificationsSelected individual(s) must have the following minimum qualifications:

Bachelor's degree and four (4) years of experience or Master’s degree from an accredited college or university in biology or field of study relating and two (2) years of experience relating to the specific task order.

Additional required qualifications include:

Excellent verbal and written communication skills.A working knowledge of Salmonid and Sturgeon life history with the California Central Valley.A general understanding of the Endangered Species Act Section 7(a)(2) consultation process.

4. Description of Services and Deliverables

The Contractor shall provide the following services throughout the period of performance and complete the following projects and deliver them to the NMFS Project Leader no later than April 29, 2020.

The Contractor shall provide services such as assisting federal action agency staff with preparation of biological assessments, reviewing project descriptions and identifying potential environmental impacts, participating in site visits, participating in meetings with applicants, state, and federal agency representatives and writing technically and legally-sound concurrence letters and biological opinions consistent with NOAA/NMFS policies and procedures.

Task A:Description: Provide technical assistance and consultation services for projects proposed by the Federal Emergency Management Agency (FEMA). This may include review of data sets, reports, or other documents produced by non-governmental organizations, or state or federal entities including but not limited to the California Office of Environmental Services, the California Department of Fish and Wildlife Service, the United States Fish and Wildlife Service, the United States Bureau of Reclamation, and the California Department of Water Resources. Technical assistance is defined as pre-consultation assistance, which includes meetings, emails, phone calls and other correspondence with the action agency in order to determine impacts of federal actions on Endangered Species managed by the NMFS in California (green sturgeon, salmon, steelhead, abalone and eulachon). These actions include the issuance of a federal permit or funding for land and water repair projects, infrastructure repair project (levees and bridges), or habitat restoration projects, or the completion of such projects by a local or state agency funded by FEMA.

Deliverable: Provide a monthly progress report summarizing status of tasks. Due by the 5th work day following the end of the month.

Task B:Description: Review and evaluate FEMA-related proposed projects and applications pursuant to section 7(a)(2) of the ESA. This may include review of data sets, reports, or other documents produced by non-governmental organizations, or state or federal entities including but not limited to the California Office of Environmental Services, the California Department of Fish and Wildlife Service, the United States Fish and Wildlife Service, the United States Bureau of Reclamation, and the California Department of Water Resources.

Deliverable: Attendance at weekly status update meetings. Summary report to all NMFS California office supervisors of all FEMA projects received each week and coordination of NMFS response to FEMA for each project. ESA consultations completed as pursuant to 7(a)(2) of the Endangered Species Act due on an as needed/ongoing basis.

Task C:Description: Evaluate and analyze effects of proposed actions, conservation measures, and mitigation activities on ESA-listed salmon, steelhead, and green sturgeon, black abalone, eulachon and their habitat.

Deliverable: Drafts of ESA section 7(a)(2) concurrence letters and biological opinions related to assigned FEMA projects. Proposed actions are to be determined. Production of each draft letter and biological opinion shall consist of production of an initial draft and second draft, which addresses NMFS comments on the first draft. The initial draft and subsequent drafts shall be completed at deadlines established by project leader.

Task D:Description: Develop recommendations on ways to minimize adverse effects to ESA listed fish and their habitat associated with proposed activities for FEMA emergency response. This may include working with local governmental agencies such as counties, cities, water districts, reclamation districts throughout the state of California.

Deliverable: The number and content of written environmental and procedural documents will be coordinated with the project leader, but will consist of submittal of draft letters, draft biological opinions, draft transmittal memos, and drafts of other written documents as needed. The contractor’s performance in the deliverable will be determined by the number, quality of written documents and/or complexity of projects worked on. Due on an as needed/ongoing basis.

Task E:Description: Develop written environmental and procedural documents including drafting section 7(a)(2) consultation letters and biological opinions, transmittal memos, programmatic biological opinions, and other written documents as needed to provide support for FEMA emergency response activities.

Deliverable: All documents related to the associated assignments, are to be incorporated into project and administrative records, shall be compiled, scanned, organized, and provided to NMFS. Due on an as needed/ongoing basis.

Task F:Description: Compile complete administrative records necessary to support the projects worked on. Participate in meetings and/or site visits concerning projects assigned with non-governmental organizations, or state or federal entities including but not limited to the California Office of Environmental Services, the California Department of Fish and Wildlife Service, the United States Fish and Wildlife Service, the United States Bureau of Reclamation, FEMA, and the California Department of Water Resources.

Deliverable: All project files shall be delivered to the NMFS project leader in an organized fashion including relevant emails, incoming and outgoing documents, and similar documentation. Due no later than April 29, 2020 for projects worked on during the Base Period of performance.

Task G:Description: Field/site visits to evaluate potential projects and/or perform routine fisheries related tasks, such as netting fish, taking notes, documenting with photos, etc.

Deliverable: Up to 5 daily no-cost site visits using supplied government vehicles and equipment.

The California Central Valley Office has responsibility for salmon, steelhead, and green sturgeon conservation and recovery in the geographic region from the San Francisco Bay east including waters of the Sacramento-San Joaquin Delta and its tributaries to their headwaters in the Sierras.

Under this Performance Work Statement (PWS), the contractor will assist with Central Valley Project/State Water (CVP/SWP) Project ESA Section 7(a)(2) consultation efforts, CVP/SWP

Data compilation and analysis of impacts to Endangered Species Act-listed (ESA-listed) species, and assistance with other Section 7(a)(2) consultations. The CVP/SWP consultation is large scale and complex consultation involving the transmission of water through California’s water operations and delivery system. NMFS’s consultation for this project (A Biological Opinion or “Opinion”) analyzes the impacts of that project on federal endangered and threatened species managed by the California Central Valley Area Office (CCVAO). These species covered by this Opinion include federal threatened California Central Valley steelhead, federally threatened Central Valley spring-run Chinook salmon, federally endangered Sacramento River winter-run Chinook salmon, and federally threatened Southern Distinct Population Segment of the North American green sturgeon.

The first iteration of this Opinion was completed in 2009, and there continues to be data collection and analysis associated with it. The contractor shall provide data compilation services for NMFS, CCVAO related to the Opinion. Specifically, the contractor shall compile all data sets commonly used for water operations into one universal data set for the office to be used for implementation of the CVP/SWP pursuant to section 7(a)(2) of the Endangered Species Act.

This Opinion is also currently being reinitiated on an expedited schedule under order of the President, who released a Presidential Memorandum addressing the project on October 19, 2018. The contractor will assist with the composition of sections of the new Opinion. After the Opinion is complete, they will continue to assist with data analysis needs to evaluate the impacts of the CVP/SWP on the above ESA-listed Species.

Other duties include assistance with the integrated annual review and development of data summaries associated with the CVP/SWP Opinion and assistance with other ESA section 7(a)(2) consultations, described in greater detail below.

REQUIRED SERVICES

Selected individual(s) must have the following minimum qualifications:

Bachelor's degree and four (4) years of experience or a Master’s degree from an accredited college or university in biology or field of study relating and two (2) years of experience relating to specific task order.

Additional required qualifications include:

Task BDescription: Identify which data sets are preliminary, final, available to public, and so forth regarding CVP/SWP water operations and the effects of these operations on the ESA-listed species managed by the NMFS CCVO office (green sturgeon, salmon, and steelhead). Compile these data sets into a single data set. Update universal data set as new data are received.

Deliverable: Draft data sets described above shall be completed and submitted on a monthly basis. Draft compiled data set shall be completed and submitted by May 31 of the period of performance. Final compiled data set shall be completed and submitted by April 29 of the performance period.

Task CDescription: Provide standard data summaries and data analysis of water operations and fisheries data related to the CVP/SWP Opinion as requested. Participate inregularly scheduled meetings regarding data sources and associated information for these subjects.

Task EDescription: Assist in the completion of draft formal and informal ESA section 7 consultation documents. These will be completed pursuant to section 7(a)(2) of the Endangered Species Act.

Deliverable: Draft informal and formal ESA section 7 consultation documents. This could include letters of non-concurrence or technical assistance to the Action Agency, which may be the Army Corps of Engineers, United States Fish and Wildlife Service or the United States Bureau of Reclamation. These Action Agencies are the requesters of these formal and informal consultations. Technical assistance is defined as pre-consultation assistance, which includes meetings, emails, phone calls and other correspondence with the action agency in order to determine impacts of federal actions on Endangered Species managed by the NMFS Central Valley Office (green sturgeon, salmon, and steelhead). These actions include the issuance of a federal permit for land and water development projects, infrastructure projects (levees and bridges), or habitat restoration projects, or the completion of such projects by a federal agency.

II. BACKGROUNDThe West Coast Region (WCR) Interior Columbia Basin Office has designed and implemented a custom database to manage the voluminous records required to be cataloged by the area office. The Database was custom designed by Amelia Langston using SQL as the back-end and Access as the front end. The Database contains reference information for documents used in development of the NOAA Fisheries Federal Columbia River Power System (FCRPS), Upper Snake, Willamette and FERC decision documents. It is used to generate court filings and to provide a searchable database of reference materials. Sensitive documents are not scanned and are therefore not available for viewing on the intranet search page, though they are listed and noted as sensitive. Many non-sensitive documents are available for viewing and download through a custom webpage maintained on our WCR Intranet site. The custom database is on its own virtual server and all updates and system requirement (security, etc.) are made by this specialist.

Specific tasks and deliverables include:

Task A:Description: Work with staff to maintain and update the new server and windows programs as HQ and/or the local IT staff launches new programs. This work will take place throughout the period of performance as IT and HQ launces new and updated programs.

Deliverable: As system upgrades happen, rewrite necessary code to resume all functionality for the Database and the Intranet site.

Task B:Description: Maintain search page on Intranet. This will take place throughout the period of performance on an as needed basis. The intranet site goes down periodically for unknown reasons; due to HQ updates and security enhancements.

Deliverable: Use ASP.NET to keep page working and make changes as needed.

Task C:Description: Update DB application. This will take place throughout the period of performance on an as needed basis. The IT department updates software, security and platforms throughout the year and the application will go down and need to be updated to make compatible with the new IT requirements.

Deliverable: Test and launch the new versions of SQL and ACCESS. Repair tables and links as needed.

Task D:Description: Update User Clients. Deploy any changes needed to the user clients. This will take place throughout the period of performance on an as needed basis. Our hiring needs are driven by litigation and FOIA needs.

Deliverable: Create new user accounts when new employees are hired and delete user accounts as employees leave.

Task E:Description: Fix bugs in DB as they appear and work with users on work flow. This will take place throughout the period of performance on an as needed basis. End users will identify issues that need to be addressed and programmer will be notified.

Deliverable: Research needed DB fix and repair database as appropriate. Communicate repair to end users and provide training as needed.

RequirementsSelected individual(s) must have the following minimum qualifications:

High school graduate with a minimum of Ten (10) or more years of experience and a Bachelor’s degree in a scientific or information management related field, Master’s degree or higher in related field plus four (4) years of experience may be substituted for experience. A minimum of ten years of experience may be substituted for a degree.

Additional required qualifications include:

a. Ten or more years’ experience creating, updating, and maintaining desktop web applications and databases.

Operational Hours

Each contractor shall work during the normal operating hours of the facility, which are a standard eight (8) hours per day, five (5) days per week. Hours under this requirement should not exceed the estimated 60 labor hours for each period of performance without approval from the Government.

An alternate work schedule may be requested and approved by the NMFS Project Leader, provided the Contractor’s work hours do not total more than 40 hours per week unless overtime is an approved part of this order.

Period of Performance

The is from April 30, 2019 through April 29, 2020 with four (4) option years through April 29, 2024.

Removing Contractors for Misconduct or Security Reasons

The Government may, at its sole discretion (in coordination with the Contracting Officer where practical), direct the Contractor to remove any Contractor employee from NOAA facilities for misconduct or security reasons. Removal does not relieve the Contractor of the responsibility to continue providing the services required under the contract. The Contracting Officer will provide the Contractor with a written explanation to support any request to remove a Contractor.

Post-Award Conference

The Contractor shall attend a Post Award Conference (i.e. “kickoff” meeting) with the Contracting Officer and the COR no later than 10 business days after the date of award. The purpose of the Post Award Conference, which will be chaired by the Contracting Officer, is to discuss technical and contracting objectives of this contract and review the Contractor's draftproject plan. The Post Award Conference will be held at via teleconference.

Confidentiality and Data Privacy

This contract may require that services contractors have access to Privacy Information. Services contractors are responsible for maintaining confidentiality of all subjects and materials and may be required to sign and adhere to a Non-disclosure Agreement (NDA).

Intellectual Property Rights

All deliverables are the property of the U.S. Government. All documents, analyses, files (digital or other), reports, notes and photos are to be used only by Contractor personnel assigned to this Task Order. Documents, files and other data are to be stored exclusively on Government owned equipment and at no point should be saved or archived on personal drives or devices. Copies are not to be disseminated to anyone outside of the NMFS or to any other contractor personnel without explicit release from the NMFS Project Leader.

IT Security

The contractor must meet the Department of Commerce IT Security Program Policy and Minimum Implementation Standards (found at https://connection.commerce.gov/collection/it-security-policy-and-fisma-reporting-program).
