1718SeptemberProsecutorBensoudatravelledtoStockholm,attheinvitationoftheSwedishMinistryofForeignAffairs,for
meetingswithGovernmentrepresentativesaswellasalectureattheSwedishInstituteforInternationalAffairs.
During the visit, Prosecutor BensoudametwithMs. BirgittaOhlsson,Minister for EU
Affairs, as well asMr. Frank Belfrage,State Secretary for
Foreign Affairs.The Prosecutor thanked the Swedish
Governmentforitscommitmentandtheconsistentsupportfor
theCourtandtheOfficeoftheProsecutor, bothatthepolitical
andoperational level. Issuesdiscussedduring thesemeetings
includedState cooperation, complementarity, sexual and
gender basedviolence,andothermattersofmutualconcern.
Prosecutor Bensouda alsometwithsenior officials of theMinistryof Foreign Affairs,
includingMr. Björn Lyrvall,DirectorGeneral for Political Affairs, andMr. Anders
Rönquist,DirectorGeneral for LegalAffairs;theMinistry of Justice, includingMs.AnnaCarinSvensson,DirectorGeneral
forInternationalAffairs;andMr.AndersPerklev,theSwedishProsecutorGeneral.
Prosecutor Bensouda concluded the visit with a key note speech at a seminar organised by the Swedish Institute for
InternationalAffairs,addressingsomechallengesandprospectsfortheOfficeoftheProsecutorinwhichshesaid:“Thesystem
establishedbytheRomeStatuteisbasedontheconceptof independent judicialactivity.Withoutitsindependence’,theCourtriskslosing
itsvalue”.Shealso indicated that“anyadditional[budget]cutswillhaveconsiderableimpactsonOffice’scapacitytodoitsworkand
fulfillitsmandate givenbyStates.”
Prosecutor’smissiontoNewYorkinthemarginsoftheHighLevelRuleofLawEvent
oftheUNGeneralAssembly
2025September Duringher trip, theProsecutorparticipated in“High level
BreakfastMeetingonProtectionofEducationDuring InsecurityandConflict:
Legal Response”, organized by Education Above All. Prosecutor Bensouda
announced theOTP’sdecision todevelop apolicypaperon children,which
willincludethematterofeducation.Shealsoannouncedtheorganizationofa
onedaystrategicmeetingon“Sharingeducationalexperiencestopromoteand
increaseeducationforpeaceand justice”on18OctoberinTheHaguetogether
withtheUNmandatedUniversityforPeaceCenter.Themeetingwillallowforanexchangeofstrategies, bestpracticesand
contentproposals between interestedorganizations.This informationwill then be compiledand sharedwithMinistriesof

systems.InthemarginsofthemeetingProsecutorBensoudahad bilateralexchangeswithHerHighnessSheikhaMoza bint
NasserofQatar,UNESCOSpecialenvoyforBasicandHigherEducation.
ProsecutorBensoudaparticipatedinaHighLevelsideeventorganized byUNWomenandFinlandtitled“Womenaccessto
justice”onthemarginsoftheHighlevelRuleofLawEvent.TheOTPalsoparticipatedinthediscussionon‘Preventingsexual
andgender basedcrimes inconflictandsecuring justiceforsurvivors’hosted byWilliamHague,UKForeignMinister,UN
Women,theNobelWomen’sInitiativeandSpecialRepresentativetotheSecretaryGeneral,ZainabBangura.
The Prosecutor also participated in an event entitled “International Criminal Court: A New
ApproachtoInternationalRelations”,organized bytheAmericanSocietyofInternationalLawand
theCouncilonForeignRelations,whereshestated“theRomeStatuteoffersasolution,creating global
governance without a global government but with international law and courts, a new paradigm in
internationalrelations:utilizinglawasa globaltoolto promote peaceandinternationalsecurityandto put
anendtoimpunity”.
TheProsecutoralsometwiththeAdvisoryBoardoftheCICCandmetwiththemembersofNobel
Women’sInitiativeandInternationalCampaigntoStopRape&GenderViolenceinConflict. The

and prosecutions,whichareat theheartof whatmyOfficedoes“. ProsecutorBensouda furtherasserted that“With thenecessary
support fromtheStatesParties,inthecomingmonthsand years,theOfficeof theProsecutorwillcontinuetoimprovethequalityof its
prosecutions.Thedecision of TrialChamber I sentencingThomas Lubanga to 14 years imprisonment, aswell as thedecision on the

I.PreliminaryExaminationsPreliminaryexaminationsrefertotheanalyticalprocess bywhichtheOTPassesseswhetherthereisareasonable basistoproceedwithan
investigationinagivensituation.
In accordancewithArticle 15 of the Statute, theOTP proactively gathers and evaluates information frommultiple sources, including
“communications”fromindividualsandpartiesconcerned(phase1–initialreview).Followingasequentialprocess,andirrespectiveofthe
mechanism bywhich the jurisdictionof theCourt is triggered, theOffice thenapplies thesame legalcriteria laidout inArticle53of the
Statute, namely temporal/territorial/personal jurisdiction (phase 2a), subjectmatter jurisdiction (phase 2b), admissibility , including
complementarityandgravity(phase3)andtheinterestsofjustice(phase4).

connectionwith proceedingsattheICC.”Mr.Itumbiaverredthathissubmissionwas“a preliminarysteptorequestingcompensation
underarticle85(1)of theRomeStatute.”On22March2012,Mr.Itumbiwasarrested byKenyanlawenforcementofficers.
Mr.ItumbinotedinhisSeptember2012submissionthatinOctober2011theformerProsecutor,Mr.LuisMorenoOcampowas
quotedinthemediawarningsocialmediauserswhowereinterferingwithwitnessesthattheCourtwasinvestigatingthem,
and they could beheld accountable before the ICC.Mr. Itumbi also cited aMarch 2012Kenyannewspaper articlewhich
stated, “Luis MorenoOcampo has focused his lenses on the Kenyan case writing a letter to Attorney General over intimidation of
witnesses.”Mr.Itumbi’sapplicationaskedthePreTrialChamber“torulethatthe Applicantwasillegallyarrestedinthecontextof
an
investigation
instigated
on
the
initiative
of
the
OTP
or,
otherwise,
in
connection
with
ICC
proceedings
in
general.”
On25September2012,PreTrialChamber IIdismissedMr Itumbi’sapplication in limine.TheChamber referred toarticles
61((9)and64(4)oftheRomeStatuteandcontendedthatTrialChamberVisresponsiblefortheconductofproceedingsrelated
tothetwoKenyacases beforetheTrialChamber.

this

12SeptemberTrialChamberVrejectedtheRequest bytheKenyattaDefenceTeamtopermanentlyreclassify,asaconfidential
document,AnnexD to the Prosecution’s Submission of the updatedDocumentContaining theCharges (DCC).AnnexD
comprises a chart identifying the issues indispute between theparties in relation to theprosecutionsproposedupdated
documentcontainingthecharges.Itincludesthepartiessubmissionsoneachoftheseissues.AnnexDwasfiledasapublic
redacteddocumenton24August2012withtherelevantredactionsmaskingthenamesofindividualswhoseidentitieswere
alsoredactedinthePreTrialChambersConfirmationDecision.On27August2012,inresponsetoanurgentemailrequestof
thedefence,
the
Chamber
ordered
the
Registry
to
temporarily
remove
Annex
D
from
the
Court
swebsite
and
disable
public
accesstoitpendingadecision bytheChamberonitsreclassification.TheDefencesubmittedthatAnnexDcontainsdetailed
submissionsonevidential issuesand that,given theheightenedmediaattentionon theKenyacases,apublic filingof the

1OctoberProsecutorBensoudaparticipatedinaWorkshoponcooperationorganized bytheRoyalNorwegianEmbassyand
theCourtattheseatof theCourt, in thecontextof theHWGcooperationfacilitation.Thepurposeof theworkshopwas to
discuss issues of cooperationwith theCourtwith relevant States and international organizations representatives,with a
specialfocusontheissueofidentification,freezingandseizureofassets.TheProsecutornotedthatalthoughcooperationwith
theCourtisgenerallyforthcoming,greatchallengesremain,notablyregardingtheexecutionofoutstandingarrestwarrants,
the existence of domestic procedures available for the processing of theCourt’s requests, aswell as requests beyond the
specificscopeofPart9oftheRomeStatute,suchasrelatingtoissuanceof‘emergency’visastofacilitateaccesstowitnessesfor
Courtofficials.
26SeptemberTheProsecutor briefedthe19thsessionoftheCommitteeonBudgetandFinanceregardingtheOTPstrategy,its
goalsforthecomingyears,itsassumptionsfor2013,theongoingefficiencygainsand budgetevolutionfrom2012to2013,as
wellastheimpactsofthe2012 budgetcutsontheOTPactivities.
20SeptemberProsecutorBensoudagaveaspeechattheUPEACETheHagueInauguralConference–“PeaceforHumanity
in the 21st century” titled “Just Peace: Prosecution ofWarCrimes and Peace building”. Prosecutor Bensouda stated: “The
international community has put in place some clear divisions of responsibility. The UN Security Council is in charge of peace and
security.TheICCisdoing justice…The policyof theOfficeisto pursueitsindependentmandatetoinvestigateand prosecutethose few
mostresponsible,
and
to
do
so
in
amanner
that
respects
the
mandates
of
others
and
seeks
to
maximize
the
positive
impact
of
the
joint
efforts
of all.”
19 September TheUN Security Council discussed the violation of rights of children by armed groups and adopted a
resolutionstating itsreadiness to imposesanctionsagainstparties thatpersistentlyviolated therightsofchildren inarmed
conflict,stronglycondemningtheirrecruitment,killing,maiming,sexualabuse,abductionanddenialofaid,aswellasattacks
on schools and hospitals.Adopting resolution 2068 (2012) by a vote of 11 in favour, to none againstwith 4 abstentions
(Azerbaijan,China,Pakistan,RussianFederation),theCouncilexpresseddeepconcern thatcertainperpetratorspersisted in
committingviolations,and calledonMemberStates to bring them to justice throughnational judicial systemsand,where
applicable, internationalmechanisms.The representativeofGuatemala said: “TheCouncilmust reaffirm itswillingness toact,
while also emphasizing State responsibility to end impunity and prosecute the perpetrators. It must be ensured thatStatesdeveloped
nationallegislation
that
penalized
the
crimes
via
their
national
institutions,
or
the
cases
must
be
referred
to
international
tribunals”
whereasGermanyindicated“theconsequentreleaseof tensof thousandsof childsoldiersandtherecentconvictionsof ThomasLubanga
andCharlesTaylorweresignificantachievementsinthe protectionof therightsof childreninarmedconflict.”
19September TheUNGeneralAssemblyexpressedsupportfortheactivitiesoftheCourt inthe“DeclarationoftheHigh
levelMeeting of theGeneralAssembly on theRule of Law at theNational and International Levels”,which states: “We
recognize the roleof the ICC inamultilateral system thataims to end impunityand establish the ruleof law,and in this respect,we
welcometheStatesthathavebecome partiestotheRomeStatuteof theICC,andcalluponallStatesthatarenot yet partiestotheStatute
toconsiderratifyingoraccedingtoit,andemphasizetheimportanceof cooperationwiththeCourt”.
14September AheadofaHighLevelmeeting in theGeneralAssembly,UNHighCommissioner forHumanRightsNavi
Pillay calledon allUNMemberStates topledge that theywillwork to strengthen the ruleof law, in their countries and
internationally,inlinewith internationalhumanrights lawandstandards. “The principleof accountabilitymustalsotakecentre
stage inanydiscussionson the ruleof law.Withoutaccountability,human rightsaredenied, crime flourishes,and impunity persists,
underminingthe prospects forreconciliationintheaftermathof conflictor grossviolationsof humanrights…Statesshould findwaysto
effectively meet their obligations to grant remedies and reparations to victims of human rights violations and crimes, with special
consideration for groupsmostaffectedbytheseactsandthosewhohavetraditionallybeenexcluded fromormarginalized inreparations
programmes,suchasvictimsof sexualand genderbasedviolence ,”shesaid.
13SeptemberAttheUN128thPlenaryMeetingoftheGeneralAssembly,Mr.ThomasMayrHarting,HeadoftheDelegation
oftheEuropeanUniontotheUnitedNations,deliveredastatementexpressingsupporttoICCinthepeacevs. justicedebate:
“RegardingInternational law,westresstheneed formediatorstoactstrictlywithintheestablishednormative framework.Forexample,
whenit
comes
to
inclusivity,
we
see
that
contacts
of
UN
mediators
with
actors
that
have
been
indicted
by
the
ICC
are
to
be
limited
essential
contactonly, forexampletowhatisrequiredinordertosavelives.Whenitcomesto judicial processes,werecallthe previousreportsof the
