VACo’s Preliminary 2013 Legislative Program released

The development of 2013 Legislative Program was initiated in the spring when VACo leaders hosted regional meetings and VACo staff attended various county boards of supervisors’ meetings. Those meetings provided VACo members with the opportunity to highlight legislative issues of concern. Steering committees met Aug. 17 in Richmond, and the Resolutions Committee met on Sept. 28 via conference call. Click here to read Preliminary 2013 Legislative Program. The new legislative program is to be adopted during the annual conference at The Homestead in Bath County. VACo’s eight steering committees will finalize and adopt their policy sections on Sunday, Nov. 11. Henry County and Martinsville officials recently approved measures to ensure that contributions made by the late Henry County administrator Benny Summerlin will be remembered in the future. “Benny Summerlin served Henry County for 31 years. The impact he had on county government” and in the city will be felt for years,” said Tim Hall, who became county administrator after Summerlin’s Aug. 15 death. “The Martinsville-Henry County community is better for Summerlin’s service,” Iriswood District Supervisor Milton Kendall said minutes before the Henry County Board of Supervisors approved a joint resolution with Martinsville City Council to rename the former Martinsville-Henry County Rescue Squad on Hooker Street “Summerlin Station.” Several city council members commended Summerlin after the council approved the resolution Tuesday. “He always did what was best for the county ... but he also cared a lot for the city,” said Councilman Gene Teague. He described Summerlin as being a “straightforward, honest” man with a lot of integrity.

Summerlin was “a natural leader,” said Councilman Mark Stroud. “I can’t say I always agreed with him (on issues), but I always respected him,” added Vice Mayor Kimble Reynolds Jr. The supervisors also approved a motion to rename the first-floor meeting room of the Henry County Administration Building the “Summerlin Meeting Room.” When presenting the sign bearing that phrase, board Chairman Jim Adams told Summerlin’s wife, Robin, that it is impossible to enter the board room “and not think about Benny.” Robin Summerlin hung the plaque on

the wall underneath the county seal. Summerlin had served as county administrator for 10 years, and began his career in community service when he was in the eighth grade by volunteering with what was then the Martinsville-Henry County Rescue Squad. Kendall read the resolution, which stated in part that Summerlin had served as a role model and a mentor for many. It recognized Summerlin’s “lifelong dedication to the art of public service.” Robin Summerlin, supervisors and several county staff members also attended the city council meeting.

Campbell County is pleased to announce that Tracy M. Fairchild has been selected to fill the role of Public Safety Director, effective Oct.1. Drawing from nearly two decades of experience in public safety service, emergency communications management and crisis planning, Fairchild will oversee the locality’s Emergency Communications, Emergency Medical Services (EMS), Emergency Planning, Animal Control and Fire divisions. Fairchild, a Rustburg native, began her public safety career in 1993 by serving in the Campbell County Sheriff’s Office as a dispatcher. With the development of a new Public Safety Department in 1998, Fairchild advanced to the position of E-911 Communications Supervisor that same year. She was selected as the department’s deputy director of communications in 2003. Since that time, Tracy played integral roles in developing Public Safety’s Emergency Medical Dispatching (EMD) program, enhancing 911 and emergency communication operations within the County, expanding local and regional emergency management efforts and implementing the first multi-agency strategic plan toward emergency service delivery. She assumed the role of Acting Director of Public Safety on June 18 following the position’s recent vacancy. In addition, Fairchild holds both a bachelor’s degree in Business Administration

Dale Wagoner, who has served Henry County as the Director of Public Safety since 2007, was promoted into the dual roles of Deputy County Administrator and Assistant General Manager of the Public Service Authority. The announcement was made by County Administrator Tim Hall. “It has been an honor to serve the citizens of Henry County,” said Wagoner. “I look forward to working with the remarkable staff and to serve our community in this broader role.” Wagoner, 41 years old, joined Henry County as a college intern in 1992 and was hired as the Emergency Medical Services Training Coordinator later that same year. Since then, he has been promoted through the ranks of Emergency Medical Services Coordinator, interim Human Resources Director and Deputy Director of Public Safety.

Wagoner named new deputy county administrator “Dale Wagoner is dedicated to our community,” said Hall. “His education and experience will be valuable assets as we all work together to move Henry County forward.” Wagoner is a 1989 graduate of Bassett High School and a 1993 graduate of Ferrum College with a Bachelors of Science degree in Computer Science. He earned a Masters of Public Administration (MPA) degree from Virginia Tech in 2002. Wagoner completed The Rocky Mountain Program for state and local executives at the University of Colorado-Denver in 2000 and completed the LEAD Virginia program in 2011. Wagoner was recently honored with the “Excellence in EMS” award by the Western Virginia EMS Council and is an automatic nominee for a Governor’s award in the same category.

She successfully completed the LEAD program at the University of Virginia and was recognized by the Blue Ridge Emergency Medical Services (EMS) Council as “Communications Officer of the Year” in 2006. “Having the opportunity to serve Campbell County, which has always been home to me and my family, is truly an honor,” stated Fairchild. “I’m very proud to be a part of such a dedicated team of public safety and law enforcement career and volunteer professionals, citizens and neighbors, who continually work together to meet the emergency needs of others while striving to keep our locality safe. This is a position I approach with gratitude and with a sincere commitment to offer my best efforts back to the community which means so much to me.” “Tracy’s overall experience and knowledge of local public safety frameworks, coupled with her professional values of cooperation and dedication to service, will certainly be a benefit to residents, as well as to our overall County organization,” offered R. David Laurrell, County Administrator. “Tracy offers a unique combination of skills and collaborative approach that will no doubt serve her well in this position. We’re pleased to welcome her to our Leadership and

Management Teams.” Fairchild is a member of the Virginia Emergency Management Association (VEMA), the Blue Ridge Emergency Medical Services Council and the Association of Public Safety Communication Officials. She and her husband (Tom) are the parents of three children and enjoy family sporting events and other outdoor recreational activities.

The United States Department of Agriculture (USDA) announced through Administrative Notice 4679 that current area eligibility for its rural development programs will remain unchanged until March 27, 2013, when the continuing resolution funding all federal programs ends. After that date, USDA will use 2010 Census data to determine what places fit the various definition of rural, unless Congress extends grandfathering of housing program eligibility for growing rural communities. Before Congress adjourned two new bills were introduced: S. 3541 would grandfather currently eligible places for ten years, H.R.

Secretary of Transportation Sean T. Connaughton and the Commonwealth Transportation Board (CTB) today announced that nine public meetings will be held across the state this fall so that the public may discuss projects and programs in the CTB’s current Six-Year Improvement Program (SYIP) and provide comments for the development of the Fiscal Years 2014-2019 SYIP, including multimodal initiatives for highways, rail and transit. Information regarding the Statewide Transportation Improvement Program (STIP), which includes all SYIP projects eligible for federal funding, will also be available. The meetings will include an open house from 6 to 6:30 p.m. Representatives from various state transportation agencies, Metropolitan Planning Organizations and Planning District Commissions will be available during each open house session to provide information and highlight their transportation programs. Displays and handouts will be available at each of the meetings. Additionally, an Amtrak Virginia Kiosk will be available for citizens to purchase Amtrak Virginia tickets. Following the open house session, individuals can provide oral or written comments at the meetings. After the meetings, comments can be submitted to Public Information Officer, DRPT, 600 E. Main St., Suite 2102, Richmond, VA 23219, or [email protected] for rail and public transportation and transportation demand management projects and to Programming Director, VDOT, 1401 E. Broad St., Richmond, VA 23219, or [email protected] for highway projects. Materials for the meetings will be made available as of October 25, 2012 at http://www.virginiadot.org/fallmeetings, and comments may be submitted online. Comments will be accepted until November 30, 2012. A draft of the new SYIP will be available next spring, and public hearings will be held before the program is finalized in June 2013.The public is encouraged to attend and provide comments during one of the following meetings:

The Local Government Attorneys of Virginia, Inc., (LGA) has named Andrew R. McRoberts of the Richmond law firm of Sands Anderson the 2012 winner of the Edward J. Finnegan Award. Sands Anderson is a VACo associate member. This Award was established in 1991 and renamed in 1993 to honor the legal career of Edward J. Finnegan who died in 1993. Finnegan was a long-time member of LGA and the recipient of the Award in 1992. At the time of his death, Finnegan was a member of the law firm of Shaw, Pittman, Potts and Trowbridge. Prior to entering private practice, Finnegan served for nine years as the county attorney for Loudoun County and for four years as an assistant county attorney for Fairfax County. The Edward J. Finnegan Award is presented to an individual in the Commonwealth of Virginia who has made significant contributions to local government or the LGA. McRoberts began his local government career in 1990 in private practice assisting local governments in land use litigation. Leaving private practice in 1994, McRoberts became an Arlington assistant county attorney and in 1996 county attorney for Culpeper County. In 2001, he became Goochland’s county attorney and brought local government West Creek Associates v. County of Goochland, an important local taxation Virginia Supreme Court decision. From 2009 to the present, McRoberts diligently has focused his Sands Anderson private practice on representing numerous local governments and governmental entities across the Commonwealth in a variety of matters including land use, taxation and a host of other legal matters. Throughout his local government career in the public and private sectors, McRoberts has served the LGA through his numerous committee positions and his membership on LGA’s Board of Directors, also having served as LGA’s president from 2005 to 2006. He has authored amicus briefs on LGA’s behalf and is a frequent LGA conference speaker on a variety of topics. McRoberts is also the author of the Virginia Local Government Law Blog and is an active participant on local government Twitter. The LGA recognized McRoberts’ professional achievements in local government law by presenting him with the Finnegan Award on October 8 at its Fall 2012 Conference in Alexandria.

The Center for Innovative Technology (CIT) recently announced the launch of its redesigned website that enhances customer experience with easier navigability and an updated interface. CIT is a VACo associate member. Pete Jobse, President and CEO of CIT, said, “Our new website makes it easier for clients, stakeholders and visitors to find the CIT services they need. In addition, the site is more interactive for entrepreneurs, researchers and others who are currently doing business with CIT and prospective customers. In addition to the above enhancements, Jobse said that the site incorporates social media tools and allows for faster updates with a better content management system. In this ‘Year of the Entrepreneur,’ the new site helps our young startup companies navigate both public and private resources that will assist them throughout company formation and funding.”

included in the catalog was a troubling trend of a 60 percent increase of State Fiscal Preemption mandates, from two mandates in 2011 to five mandates in 2012. Those mandates are state laws that result in a net reduction of revenues collected by a locality or restriction on a locality’s authority to collect revenues. While the task force continues to meet to identify more mandates for elimination, local governments may also be the beneficiary of a new effort launched by the governor in early September to reduce state regulations.

According to news reports, state agencies have been called upon to identify regulations that “are no longer necessary or are overly burdensome” so they can be repealed or improved. Those agencies have until Oct. 31 to develop a work plan for identifying regulations for elimination or consolidation with the aim of completing the work by mid-November in case legislative action is required. Although the main beneficiaries of such a review will be regulated industries or professions, localities also hope for some relief from the governor’s initiative.

On Oct. 9, Joe Sheffey, Chair of VACo’s Education Committee and member of the Pulaski County Board of Supervisors, provided testimony to the Board of Education (BOE) about VACo’s concerns relating to possible changes in the Standards of Quality (SOQ). Currently, BOE is in the initial stages of a multi-year study on the SOQ. This study is expected to result in several recommendations to the General Assembly on possible ways to change the current SOQ structure. When making his testimony, Sheffey reiterated several points made by VACo and VML in a joint statement presented to BOE last June. One of VACo’s major concerns is the increasing costs for public education that have been gradually shifted to local governments in recent years.

The Virginia Department of Conservation and Recreation (DCR) is offering a series of 6-hour sessions statewide to educate local government staff and other stakeholders about the history and implementation of Virginia’s Stormwater Management Law and Regulations. The session will also provide information about the 2012 Stormwater “integration” legislation passed by the 2012 General Assembly. Below is a list of training sessions scheduled to date.
