Autumn has come to Guilderland much more quietly than last year. Our generally

dry summer makes Tropical Storms Irene and Lee seem like only a distant memory at this time, although the storms aff ected Guilderland residents, as well as many others throughout the Capital Region seriously.

Th e Guilderland Highway Department will begin its annual leaf pick-up program for 2011 on Monday, October 15. As residents work on their fall cleanup activities, crews from the Town Highway Department will circulate throughout the Town with their leaf vacuum equipment. Th e leaf collection schedule for both the leaf vacuum trucks, and for bagged leaf pickup in those areas where the leaf vacuum cannot safely operate, is available in the “Guilderland TowNews”

newsletter mailed to Guilderland residents in late September. Th e schedule can also be accessed on-line at Guilderland’s municipal website, www.townofguilderland.org . We ask all of our residents to cooperate to insure the safety of all by placing only leaves and evergreen needles at the edge of the pavement in areas where the vacuum trucks operate, and by placing bagged leaves and needles at the edge of the road where the vacuum cannot operate. Please avoid creating hazardous

conditions by piling leaves so high that they reduce visibility, or putting them in spots where they limit the vision of pedestrians, bicyclists, and drivers. If you have any questions about the leaf pick-up program, please contact the Guilderland Highway Department at 861-5108.

Th ere is still plenty of time this fall to enjoy some pleasant golfi ng weather at Western Turnpike Golf Course. Th e air is crisp and clear, and the course has stayed in good condition throughout the season. Please call the Pro Shop at 456-0786 to check on special promotions for the Fall season, or to reserve a tee time. If you don’t golf, but would enjoy a pleasant walk in the Autumn weather, visit Tawasentha Park and take a hike around our 5-mile network of hiking trails, or play basketball or tennis on the courts that will stay open throughout the fall. For a bit of peaceful enjoyment, visit our neighborhood parks as well. We recently resurfaced the walking path at the McKownville Reservoir Park to improve walking and bicycling conditions.

We have worked hard to complete work on Guilderland’s 2013 Town budget. As I am sure everyone is aware, the condition of the national, New York State, and regional economies make this a challenging exercise. Th e Supervisor’s Preliminary budget is now available in the Town Clerk’s offi ce and on the Guilderland website. A series of public budget workshops were held prior to submission of the Supervisor’s Preliminary Budget. A Final Budget for 2012 will be discussed and voted on by the Town Board at its November 8 meeting.

As the days grow shorter, please travel about the Town safely, and be mindful of pedestrians, cyclists, and especially stopped school buses as you drive.

If so, we want to hear from you!Community volunteer sought to serve on the district Audit CommitteeTh e Guilderland Central School District is presently seeking an interested community representative to serve on the Board of Education Audit Committee. Th e Audit Committee consists of three members of the Board of Education, appointed annually, and two representatives from the community. Th e Committee typically meets monthly during the school year in late afternoon. Currently, we have a need for one community representative.Th e duties of the Audit Committee are advisory in nature and include:

• Recommending appointment of the external auditor;• Meeting with the external auditor prior to the

commencement of the annual audit;• Reviewing and discussing with the external auditor

any risk assessment of the school district's operations developed by the auditor;

• Reviewing the draft audit report and management letter, and assist the full Board in interpreting them;

• Recommending the acceptance of the annual audit report; and

• Reviewing the corrective action plan and assist in the implementation of such plan.

A few weeks ago I attended a sports chiropractic seminar taught by the Medical Director for the

Olympic Training Center. I was like a kid the night before Christmas listening so attentively to all the stories and case reports from this year’s Olympic Games in London. It was neat to hear fi rsthand accounts of what happens behind the scenes with these amazing athletes and their injuries. But was most fascinating to me is that this Medical Director is not a famous orthopedic surgeon or sport medicine physician but rather a sports chiropractor.

Sports chiropractic has been a growing specialty within the discipline of Chiropractic for many years. Each year the American Chiropractic Board of Sports Physicians continues to educate more and more chiropractors about sports injuries and how to access and manage them conservatively. Th e demand is growing in professional sports to employ sports chiropractors as part of their sports medicine team to work with the athletic trainer and team physician. In past years, the US would select only one chiropractor to be a part of the Olympic Sports Medicine Team. Th is past year they took ten.

But why is there such a demand? Th e reason is because it works! Sports injuries, especially spine related injuries respond well to chiropractic care. Chiropractic speeds recovery from injury, enhances performance and helps prevent future problems. Many athletes who have been receiving chiropractic care know how subtle structural imbalances can aff ect their performance. Th ey can feel when their joints are limited with their range of motion and when their body proprioception is not on target. And when the stakes are high, every bone, muscle, ligament and tendon must be healthy and in it’s place for these athletes to have their best biomechanical advantage.

I can tell you from my fi rst-hand experiences working with many athletes over the years in football, soccer, rugby, baseball, dance, gymnastics, golf, running and wrestling that chiropractic works. A few years ago, I remember being called at the clinic one day during state high school wrestling championship. Th e local high school team was competing and the coach called me and two of my colleagues to come down to the state tournament to treat the athletes. We had been working with the team all season and they didn’t want to go into the most important match without their chiropractic team.

I have always loved sports and working with athletes. I feel it is very important for my patients (athlete or not) to understand the biomechanics of their sport, job or activity. A major focus during treatment is oft en incorporating sport specifi c core strengthening and fi xing muscle imbalance issues. Th us, we are changing the name of the Spinal Wellness Center to include sports. We are now Sports & Spinal Wellness Center. My mission is to get you back to doing what you love no matter what your age, your sport or activity.

Fall is upon us!! Th is is really my favorite season for decorating. I love the corn stalks on my

front porch and mums in bushel baskets. For me it is also a time to look around and start a long awaited project.

My customers often tell me that they struggle to get a project started. Th ey have a hard time visualizing the fi nished product or imaging what will work with their existing décor. Finding inspiration can be challenging but once you get moving in the right direction, things start to fall into place and the excitement starts to build.

Th e fi rst thing we will do is take a look at what existing elements will stay in the room. If you are going to be replacing furniture and fl ooring then I always suggest that you make those selections fi rst. If there will be a new wall color, I will suggest not fi nalizing that choice until you have had a chance to select fabrics for your window coverings. Remember, when you go to the paint store there are hundreds of shades to choose from and you want to make the right choice or it could throw off the whole color palette in the room.

Now for the style of window treatment, for instance is it formal or more casual. Will it be decorative or does it need to be functional. Are you looking to control draft from your window by insulating the treatments around them. Once we discuss their function, we can begin to fi ne tune the look. For one particular customer, she had privacy shades

on the window and they were mounted on the outside of the window so part of her requirement was to hide the headrail of that shade. She knew she wanted pleated stationary drapery panels for her formal dining room. So we incorporated a faux hobbled shade valance that sat behind the drapery

panels. We browsed through fabrics and ordered samples before fi nalizing her selections. We reviewed the options for drapery hardware and for the fun part selected a ball fringe for the valance and a decorative tape for the leading edge of the panels. Once it was installed she acknowledged that it was more than she had imagined. My goal is to hear every customer say that. I am a tough consumer and I bring that to my business. I strive to make sure that the work I do for you is as close to perfection as I can come.

As you head inside for the fall, look around and see where you can make simple changes that will help you

Gordon Bok found his fi rst music in his own dooryard. His family sang Scots, German, Italian, Australian and American traditional and popular songs—all learned in places they had lived. As he grew up around the boatyards of Camden, Maine, that repertoire expanded to include the many tunes, sea songs, stories, legends and ballads learned from the people he worked with on schooners and yachts. Where he couldn’t fi nd songs that matched his experiences or needs, he began to write his own, and has kept up a lively fl ow of poems, songs, stories, choral and instrumental works.

Bok has performed extensively in the United States, and in the United Kingdom, Australia, and New Zealand. He has appeared on the radio show, A Prairie Home Companion with Garrison Keillor. Gordon’s music has been sung by many other performers and has been used for fi lms, most notably the documentary Coaster: Th e Adventure of the John F. Leavitt for which he won an award. Gordon received an honorary Doctorate of Science from the Maine Maritime Academy for his refl ection of Maine’s maritime heritage in his compositions and performances.

Gordon Bok’s legacy includes over thirty recordings featuring his own compositions and folk tunes from around the world. His extensive repertoire provides a rich well to draw upon for his concerts, guaranteeing a unique experience everywhere he performs. He has never sung the same solo concert twice. He calls himself a ‘rememberer’: a keeper of songs and stories, a keeper of our traditions, our ways of thinking, that set us apart from others yet confi rm our pace in the fl ow of humanity.

Saying “I Do” Does Not Mean 50/50

When I meet with a client for the fi rst time, a primary concern of the client is how assets

will be distributed in a divorce. It is not uncommon for the client to come in with the assumption that all assets will be equally divided. It is at this point that I have to inform the client that this assumption is not correct.

New York is an equitable distribution state. Th is means that marital property and liabilities will be divided “equitably” between the spouses. Absent a few exceptions, if the property or debt was acquired during the marriage then it will be equitably distributed. Marital property can include a myriad of assets, such as real property, retirement, savings, and businesses; it can even include a license or degree earned during the marriage.

“Equitable” does not always mean equal. In determining how to distribute assets and liabilities, the Court must consider the statutory factors set forth in Section 236 Part B of the New York Domestic Relations Law. No single factor is more important than the other, and the Court does not need to consider each and every factor. Th ere are fourteen statutory factors for the Court to consider. Here are a few of them:

(1) Th e duration of the marriage – if the marriage is a lengthy one it is common for the Court to equally divide the property and debts;

(2) Age and health of both parties – if one spouse is older than the other, or in poorer health, then it is possible that the Court will give a greater share of the assets to the spouse that has the greater need;

(3) Th e direct or indirect contributions made by either spouse in acquiring the property, such as contributions and services as a spouse, parent, wage earner and homemaker, and to the career or career potential of the other spouse – although one spouse may make very little fi nancial contribution to the acquisition of an asset, her indirect contributions will still have signifi cant value.

For example, the wife may be the homemaker and care for the children while the husband owns and operates a business. While the wife made no fi nancial contributions towards the business, her caring for the home and the children enabled the husband to pursue his business interests. Th e Court will consider the wife’s indirect contributions in determining how to equitably distribute the value of the business.

When you walk down the aisle after saying “I do”, you do not automatically turn “yours” into “ours.” First you need to be married to acquire property during the marriage, and then a Court needs to look at what each person has contributed to the marriage, whether fi nancial or otherwise.

How property is equitably distributed is heavily dependent on the facts and circumstances of each particular case. Rather than make your own conclusions, you should speak with an experienced matrimonial attorney for guidance about how equitable distribution and the statutory factors will impact the distribution of your assets and liabilities.

I was fortunate to be able to spend last week in Texas at the “mega camp” convention for top Realtors from around the country. It was a great experience and served to remind me how important the stan-dards we set for ourselves are in life.

On my way to Texas I had a layover in Detroit. By luck I ran into a friend in the Delta Terminal that I mastermind with every few months heading to the same convention. He is a Realtor that lives in Michigan, is still in his 20’s, and has built a $25 Million dollar a year (sales) business. To put it in perspective, he is operating at a level in his 20’s that 99% of Realtors will not achieve over a lifetime.  He is clearly an “outlier” on the performance graph.  As we spoke, he told me how just 8 years ago he had been a skycap in the very terminal we were standing in.   “I got sick of lugging other people’s Coach bags around” is what is said. Our conversation had me pondering what separates a high achiever from an average achiever.  It is important to note I am writing solely about performance and achievement not “success”.  Th ere is a huge diff erence. I am sure there are many Sky-caps I would consider more successful than some of the top produc-ing Realtors or business leaders I know. It’s an important distinction but that topic is for another time. I really wanted to quantify what separated a top producer from an average producer. I get asked often by competitors how we sell so many homes in a down market and I never really have a concise answer.

I came up with a list on the fl ight of top producer traits that was a page long. It included drive, discipline, work ethic, accountability, ability to manage risk, ability to take risks, enthusiasm, integrity, team builder, willingness to make sacrifi ces, visionary, ability to lead, charisma, humility, and the list went on. But what is the single most important trait of a top performing “outlier”?

Th en it dawned on me that I should have realized it sooner. I already knew the answer from attending a Tony Robbins conference over a year ago. Th e number one trait that separates a top producer in any-thing from an average performer is the standards they are willing to accept in their lives.  You can be the hardest working, smartest, and most disciplined person in the world but if you set the bar too low you will never ever know your full potential.  Th e standards you set for yourself will aff ect your performance level. My friend got sick of carry other people’s bags and decided one day the next Coach bag he carried would be his wife’s.  He changed his standards on what was acceptable for him and his family and it changed the outcome of his life. Th en he set some absurdly high standards for what was acceptable in his real estate business.

We have standards set for us and set standards all the time without really thinking about it. Th ere isn’t a parent out there that wants to raise a below average kid, and we impose standards on them daily. Your boss or manager likely imposes standards on you every day,

month, or quarter. We get conditioned and used to having others set standards for us in our lives. However, the real question is what standards do you impose on yourself?   It is what you demand of yourself that really matters.

Real estate is a bizarre business that has a low barrier to entry. I hate to say it but mediocre performance is the norm. Th e average Realtor will sell about eight homes per year according to the National As-sociation of Realtors which is an absurdly low number.  Th e more I thought about standards the more I realized that if I worked for a larger fi rm I would likely have failed in the business.  Here is why. I would judge myself by the performance standards of my co work-ers. I would sell 16 homes a year and feel like I was doing a great job because I was doubling the performance of the typical agent in the offi ce.   I wouldn’t realize my performance potential. Now the only thing I compare myself to are my own standards and expecta-tions. It’s a critical point. I just came off a week that I was fortunate to have been able to help more sellers reach their goal of selling in seven days then an average agent will in a year. If my standards said eight home sales a year was an acceptable level I would never ever be able to sell over a 100 homes a year. If you really want to reach peak performance don’t base your performance on others or gauge your success in terms of others.  SET YOUR OWN STANDARDS ON WHAT YOU ARE WILLING TO ACCEPT IN YOUR LIFE NOT THOSE SET OR ACCEPTED BY OTHERS.  

So if you aren’t happy with some area of your life think about the standards you allow to exist. You owe it to yourself set them higher.   Maybe it is your relationship, your health, your fi nancial goals, or you career, it doesn’t matter.   Raise your expectations to a level you feel is so high your aren’t really sure you can obtain it. Now double it!  Th at’s the standard you want to live by and are likely capable of!

Th e next time I get asked by a competitor how we sell so many homes the answer will be simple. We have higher standards on what we expect and accept in our business.

In just one short month it will be election time. Th is

year features a presidential election. As citizens of

the United States of America we have a responsibility

to vote. I will not use this space for the promotion of

any political ideals, but I will use

it to remind everyone that

they have a responsibility

to exercise their right

to vote. Your voice,

no matter how small,

must be heard. So

many people that I

meet every day have

a negative attitude

about our government

and elections. I always

try to teach that we must

not only complain or just be

negative without taking action.

It is, of course, acceptable to be

dissatisfi ed with a situation, even to complain about

it, but not without taking some sort of action to make

change.

Aft er you demonstrate great character by voting for

your candidate for president, and for the local offi ces,

you then have to again apply your great character to

support the victors. Not everyone likes to do this,

many seem to like complaining, even using their

negativity about the situation as a reason not to

stand straight during the Pledge of Allegiance or the

National Anthem. We live here, we are citizens and

we have a civic responsibility to support our country.

If we do not agree with the things that are happening,

we take responsible, peaceful action. We do not pout

about it.

During a football season mistakes are made by any

player, group of players or coaches. Decisions are

made under the given circumstances and sometimes

things don’t work out, some times they do. What

really matters is that all the players support each other

and the coaches with positive attitude and focus.

If they start the blame game, the whole game, even

the whole season, can start to go down the tubes. If

we keep in mind that each participant has the best

interests of the team in mind, then this is easy and

shows excellent team work. I have observed our own

Dutchmen in action demonstrating this excellent

character ever game!

Th e members of our military; a really huge team, will

all vote. Regardless of the winners, they have the the

responsibility to serve our country and they will still

follow their new or incumbent commander-in¬chief.

Th ey support and defend our country, not the people

that are currently running it. Th ey understand, as we

also must, that our country represents so much more

than the people that are currently in offi ce.

In Taekwondo we practice great character every

day. We focus on positive attitude, plans of

action, teamwork and responsibility. Demonstrate

responsibility by going to the polls and voting for your

candidates. Have a positive attitude about the results

and be a team player as a citizen of our great country,

and if you are dissatisfi ed and unhappy, make a plan of

action, and begin your work on it.
