OVERSEAS CONTINGENCY OPERATIONS DEPARTMENT OF DEFENSEMILITARY PROGRAMS MILITARY PERSONNEL ACTIVE AND RESERVE FORCES The following amounts include funds for pay, allowances, subsistence, and other personnel costs for Active and Reserve component service members activated for duty in Afghanistan and other areas around the world in support of Operation Freedom's Sentinel, Operation Inherent Re- solve, and post-Operation New Dawn and European Reassurance Initiative activities. The request includes funding for Guard and Reserve mobilization costs and many special pays for deployed troops, including imminent danger pay, family separation allowance, hardship duty pay, and other special and incentive pays. OPERATION AND MAINTENANCE

The requests that follow would fund operation and maintenance activitiesfor the Active and Reserve components of all Military Services, DefenseAgencies, and Defense-Wide Activities supporting military operations inAfghanistan, in Iraq and the Levant, and other areas in direct support ofOperation Freedom's Sentinel and Operation Inherent Resolve. Theseactivities include: ground combat operations; flying hours; steaming days;military intelligence activities; subsistence and logistics support; fuel andsupply purchases; base and facility support to include the Logistics CivilAugmentation Program; contract oversight; communications; and mainten-ance. In addition, the requests include funding to support: significantEuropean reassurance activities; coalition support reimbursements; theAfghanistan security forces; the Iraq Train and Equip Fund; the Syria Trainand Equip Fund; the Counterterrorism Partnerships Fund; detainee opera-tions; pre-deployment training; personal protective equipment; the DefenseHealth Program; family support programs; counterdrug activities; intelli-gence, surveillance, and reconnaissance activities; the Commander'sEmergency Response Program in Afghanistan; and the Office of SecurityCooperation—Iraq. Funding is also included for classified activities.

For an additional amount for "Operation and Maintenance, Defense-Wide",[$5,665,633,000]$5,982,173,000: Provided, That of the funds provided under thisheading, not to exceed [$1,160,000,000]$1,100,000,000, to remain available untilSeptember 30, [2017]2018, shall be for payments to reimburse key cooperatingnations for logistical, military, and other support, including access, provided toUnited States military and stability operations in Afghanistan and to counter the Is-lamic State of Iraq and the Levant: Provided further, That such reimbursementpayments may be made in such amounts as the Secretary of Defense, with the con-currence of the Secretary of State, and in consultation with the Director of the Officeof Management and Budget, may determine, based on documentation determinedby the Secretary of Defense to adequately account for the support provided, andsuch determination is final and conclusive upon the accounting officers of the UnitedStates, and 15 days following notification to the appropriate congressional commit-tees: Provided further, That these funds may be used for the purpose of providingspecialized training and procuring supplies and specialized equipment and providingsuch supplies and loaning such equipment on a non-reimbursable basis to coalitionforces supporting United States military and stability operations in Afghanistan andto counter the Islamic State of Iraq and the Levant, and 15 days following notificationto the appropriate congressional committees: Provided further, That [these fundsmay be used to support the Governments of Jordan and Lebanon, in such amountsas the Secretary of Defense may determine, to enhance the ability of the armedforces of Jordan to increase or sustain security along its borders and the ability ofthe armed forces of Lebanon to increase or sustain security along its borders, upon15 days prior written notification to the congressional defense committees outliningthe amounts intended to be provided and the nature of the expenses incurred:Provided further, That of the funds provided under this heading, up to $30,000,000shall be for Operation Observant Compass] not to exceed $15,000,000 can be usedfor emergencies and extraordinary expenses, to be expended on the approval orauthority of the Secretary of Defense, and payments may be made on his certificateof necessity for confidential military purposes: Provided further, That the authorityin the preceding proviso may only be used for emergency and extraordinary expenses

IRAQ TRAIN AND EQUIP FUND

For the "Iraq Train and Equip Fund", [$715,000,000]$630,000,000, to remainavailable until September 30, [2017]2018: Provided, That such funds shall beavailable to the Secretary of Defense, in coordination with the Secretary of State,to provide assistance, including training; equipment; logistics support, supplies, andservices; funding, including payments and stipends; infrastructure repair, renovation,and sustainment, to military and other security forces of or associated with theGovernment of Iraq, including Kurdish and tribal security forces or other local se-curity forces, with a national security mission, to counter the Islamic State of Iraqand the Levant: Provided further, That the Secretary of Defense shall ensure thatprior to providing assistance to elements of any forces such elements are appropriatelyvetted, including at a minimum, assessing such elements for associations with ter-rorist groups or groups associated with the Government of Iran; and receivingcommitments from such elements to promote respect for human rights and the ruleof law: Provided further, That the Secretary of Defense may accept and retain con-tributions, including assistance in-kind, from foreign governments, including theGovernment of Iraq, and other entities, to carry out assistance authorized under thisheading: Provided further, That contributions of funds for the purposes providedherein from any foreign government or other entities, may be credited to this Fund,to remain available until expended, and used for such purposes: [Provided further,That not more than 25 percent of the funds appropriated under this heading may beobligated or expended until not fewer than 15 days after: (1) the Secretary of Defensesubmits a report to the appropriate congressional committees, describing the planfor the provision of such training and assistance and the forces designated to receivesuch assistance; and (2) the President submits a report to the appropriate congres-sional committees on how assistance provided under this heading supports a largerregional strategy: Provided further, That of the amount provided under this heading,not more than 60 percent may be obligated or expended until not fewer than 15 daysafter the date on which the Secretary of Defense certifies to the appropriate congres-sional committees that an amount equal to not less than 40 percent of the amountprovided under this heading has been contributed by other countries and entities forthe purposes for which funds are provided under this heading, of which at least 50percent shall have been contributed or provided by the Government of Iraq: Providedfurther, That the limitation in the preceding proviso shall not apply if the Secretaryof Defense determines, in writing, that the national security objectives of the UnitedStates will be compromised by the application of the limitation to such assistance,and notifies the appropriate congressional committees not less than 15 days in ad-vance of the exemption taking effect, including a justification for the Secretary'sdetermination and a description of the assistance to be exempted from the applicationof such limitation:] Provided further, That the Secretary of Defense may waive aprovision of law relating to the acquisition of items and support services or sections40 and 40A of the Arms Export Control Act (22 U.S.C. 2780 and 2785) if the Sec-retary determines such provisions of law would prohibit, restrict, delay or otherwiselimit the provision of such assistance and a notice of and justification for such waiveris submitted to the appropriate congressional committees: Provided further, Thatthe term "appropriate congressional committees" under this heading means the"congressional defense committees", the Committees on Appropriations and ForeignRelations of the Senate and the Committees on Appropriations and Foreign Affairsof the House of Representatives: Provided further, That amounts made availableunder this heading are designated by the Congress for Overseas Contingency Oper-ations/Global War on Terrorism pursuant to section 251(b)(2)(A)(ii) of the Balanced

SYRIA TRAIN AND EQUIP FUND

For the "Syria Train and Equip Fund", $250,000,000, to remain available untilSeptember 30, 2018: Provided, That such funds shall be available to the Secretaryof Defense, in coordination with the Secretary of State, to provide assistance, includ-ing training, equipment, supplies, stipends, construction of training and associatedfacilities, and sustainment, to appropriately vetted elements of the Syrian oppositionand other appropriately vetted Syrian groups and individuals for the followingpurposes: defending the Syrian people from attacks by the Islamic State of Iraq andthe Levant, and securing territory controlled by the Syrian opposition; protectingthe United States, its friends and allies, and the Syrian people from the threats posedby terrorists in Syria; and promoting the conditions for a negotiated settlement toend the conflict in Syria: Provided further, That the Secretary may accept and retaincontributions, including assistance in-kind, from foreign governments and otherentities to carry out activities authorized under this heading: Provided further, Thatcontributions of funds for the purposes provided herein from any foreign governmentor other entities, may be credited to this Fund, to remain available until expended,and used for such purposes: Provided further, That for purposes of the provision ofassistance under this heading, the Secretary may waive any provision of law if theSecretary determines that such provision of law would (but for the waiver) impedenational security objectives of the United States by prohibiting, restricting, delaying,or otherwise limiting the provision of such assistance: Provided further, That theSecretary may provide assistance to third countries for purposes of the provisionof assistance authorized under this heading: Provided further, That the term "appro-priately vetted" shall be construed to mean, at a minimum, assessments of possiblerecipients for associations with terrorist groups including the Islamic State of Iraqand the Levant (ISIL), Jabhat al Nusrah, Ahrar al Sham, other al-Qaeda related

PROCUREMENT

The requests that follow would fund the acquisition of combat and supportvehicles, aircraft, weapons, preferred munitions, communications andother equipment needed to support Operation Freedom's Sentinel, OperationInherent Resolve, and other areas in direct support of these operations.There is also significant investment in the European reassurance initiative.Funds provided will be used to replace equipment worn out by combatoperations or lost in battle, as well as replace munitions expended in combatoperations. Additional funding is provided to improve the force protectioncapabilities of units and equipment, including enhanced protection againstimprovised threats. These requests will also fund classified activities.

MILITARY CONSTRUCTION

The request that follows would fund military construction activities forthe Active components of all Military Services, and Defense-Wide Activ-ities supporting military operations in Europe, the Middle East (Levant),and East Africa (Djibouti) in direct support of the European ReassuranceInitiative, Operation Freedom's Sentinel, and Operation Inherent Resolve.Funds provided would bolster security of U.S. NATO Allies and partnerstates in Europe and deter aggressive actors in the region by enhancingprepositioning and weapons storage capabilities, improving airfield andsupport infrastructure and 5th generation warfighting capability, andbuilding partnership capacity. Chabelley Airfield investments support anexpanded OEF-Horn of Africa mission. Further, planning and design in-vestments in the Levant will improve the Department's posture in the regionas the Transregional Counterterrorism Strategy intensifies operations tocounter the Islamic State of Iraq and the Levant (ISIL) and other transreg-ional terrorist organizations.

GENERAL PROVISIONS—THIS TITLESEC. 9001. Notwithstanding any other provision of law, funds made available in

this title and designated for Overseas Contingency Operations/Global War on Ter-rorism pursuant to section 251(b)(2)(A)(ii) of the Balanced Budget and EmergencyDeficit Control Act of 1985, as amended, are in addition to amounts appropriatedor otherwise made available for the Department of Defense for fiscal year [2016]2017.

(INCLUDING TRANSFER OF FUNDS)SEC. 9002. Upon the determination of the Secretary of Defense that such action

is necessary in the national interest, the Secretary may, with the approval of theOffice of Management and Budget, transfer up to $4,500,000,000 between the ap-propriations or funds made available to the Department of Defense in this title anddesignated for Overseas Contingency Operations/Global War on Terrorism pursuantto section 251(b)(2)(A)(ii) of the Balanced Budget and Emergency Deficit ControlAct of 1985, as amended: Provided, That the Secretary shall notify the Congresspromptly of each transfer made pursuant to the authority in this section: Providedfurther, That the authority provided in this section is in addition to any other transferauthority available to the Department of Defense and is subject to the same termsand conditions as the authority provided in section [8005]8003 of this Act.

SEC. 9003. Supervision and administration costs and costs for design during con-struction associated with a construction project funded with appropriations availablefor operation and maintenance or the "Afghanistan Security Forces Fund" providedin this Act and executed in direct support of overseas contingency operations inAfghanistan, may be obligated at the time a construction contract is awarded:Provided, That, for the purpose of this section, supervision and administration costsand costs for design during construction include all in-house Government costs.

SEC. 9004. From funds made available in this title, the Secretary of Defense maypurchase for use by military and civilian employees of the Department of Defensein the United States Central Command area of responsibility: (1) passenger motorvehicles up to a limit of $75,000 per vehicle; and (2) heavy and light armored vehiclesfor the physical security of personnel or for force protection purposes up to a limitof $450,000 per vehicle, notwithstanding price or other limitations applicable to thepurchase of passenger carrying vehicles.

SEC. 9005. Not to exceed $5,000,000 of the amounts appropriated by this title anddesignated for Overseas Contingency Operations/Global War on Terrorism pursuantto section 251(b)(2)(A)(ii) of the Balanced Budget and Emergency Deficit ControlAct of 1985, as amended, under the heading "Operation and Maintenance, Army"may be used, notwithstanding any other provision of law, to fund the Commanders'Emergency Response Program (CERP), for the purpose of enabling military com-manders in Afghanistan to respond to urgent, small-scale, humanitarian relief andreconstruction requirements within their areas of responsibility: Provided, That eachproject (including any ancillary or related elements in connection with such project)executed under this authority shall not exceed $2,000,000: Provided further, Thatnot later than 45 days after the end of each 6 months of the fiscal year, the Secretaryof Defense shall submit to the congressional defense committees a report regardingthe source of funds and the allocation and use of funds during that 6-month periodthat were made available pursuant to the authority provided in this section or underany other provision of law for the purposes described herein: Provided further, That,not later than 30 days after the end of each fiscal year quarter, the Army shall submitto the congressional defense committees quarterly commitment, obligation, andexpenditure data for the CERP in Afghanistan: Provided further, That, not less than15 days before making funds available pursuant to the authority provided in thissection or under any other provision of law for the purposes described herein for aproject with a total anticipated cost for completion of $500,000 or more, the Secretaryshall submit to the congressional defense committees a written notice containingeach of the following:

(1) The location, nature and purpose of the proposed project, including howthe project is intended to advance the military campaign plan for the country inwhich it is to be carried out.

(2) The budget, implementation timeline with milestones, and completion datefor the proposed project, including any other CERP funding that has been or isanticipated to be contributed to the completion of the project.

(3) A plan for the sustainment of the proposed project, including the agreementwith either the host nation, a non-Department of Defense agency of the UnitedStates Government or a third-party contributor to finance the sustainment of theactivities and maintenance of any equipment or facilities to be provided throughthe proposed project.

SEC. 9006. Funds available to the Department of Defense for operation andmaintenance may be used, notwithstanding any other provision of law, to providesupplies, services, transportation, including airlift and sealift, and other logisticalsupport to coalition forces supporting military and stability operations in Afghanistanand to counter the Islamic State of Iraq and the Levant: Provided, That the Secretaryof Defense shall provide quarterly reports to the congressional defense committeesregarding support provided under this section.[SEC. 9007. None of the funds appropriated or otherwise made available by this

or any other Act shall be obligated or expended by the United States Governmentfor a purpose as follows:

(1) To establish any military installation or base for the purpose of providingfor the permanent stationing of United States Armed Forces in Iraq.

(2) To exercise United States control over any oil resource of Iraq.(3) To establish any military installation or base for the purpose of providing

for the permanent stationing of United States Armed Forces in Afghanistan.]SEC. [9008]9007. None of the funds made available in this Act may be used in

contravention of the following laws enacted or regulations promulgated to implementthe United Nations Convention Against Torture and Other Cruel, Inhuman or De-grading Treatment or Punishment (done at New York on December 10, 1984):

(1) Section 2340A of title 18, United States Code.(2) Section 2242 of the Foreign Affairs Reform and Restructuring Act of 1998

(division G of Public Law 105–277; 112 Stat. 2681–822; 8 U.S.C. 1231 note)and regulations prescribed thereto, including regulations under part 208 of title

[SEC. 9009. None of the funds provided for the "Afghanistan Security ForcesFund" (ASFF) may be obligated prior to the approval of a financial and activity planby the Afghanistan Resources Oversight Council (AROC) of the Department ofDefense: Provided, That the AROC must approve the requirement and acquisitionplan for any service requirements in excess of $50,000,000 annually and any non-standard equipment requirements in excess of $100,000,000 using ASFF: Providedfurther, That the Department of Defense must certify to the congressional defensecommittees that the AROC has convened and approved a process for ensuringcompliance with the requirements in the preceding proviso and accompanying reportlanguage for the ASFF.]

SEC. [9010]9008. Funds made available in this title to the Department of Defensefor operation and maintenance may be used to purchase items having an investmentunit cost of not more than $250,000: Provided, That, upon determination by theSecretary of Defense that such action is necessary to meet the operational require-ments of a Commander of a Combatant Command engaged in contingency operationsoverseas, such funds may be used to purchase items having an investment item unitcost of not more than $500,000.[SEC. 9011. From funds made available to the Department of Defense in this title

under the heading "Operation and Maintenance, Air Force", up to $80,000,000 maybe used by the Secretary of Defense, notwithstanding any other provision of law,to support United States Government transition activities in Iraq by funding the op-erations and activities of the Office of Security Cooperation in Iraq and securityassistance teams, including life support, transportation and personal security, andfacilities renovation and construction, and site closeout activities prior to returningsites to the Government of Iraq: Provided, That to the extent authorized under theNational Defense Authorization Act for Fiscal Year 2016, the operations and activ-ities that may be carried out by the Office of Security Cooperation in Iraq may, withthe concurrence of the Secretary of State, include non-operational training activitiesin support of Iraqi Minister of Defense and Counter Terrorism Service personnel inan institutional environment to address capability gaps, integrate processes relatingto intelligence, air sovereignty, combined arms, logistics and maintenance, and tomanage and integrate defense-related institutions: Provided further, That not laterthan 30 days following the enactment of this Act, the Secretary of Defense and theSecretary of State shall submit to the congressional defense committees a plan fortransitioning any such training activities that they determine are needed after theend of fiscal year 2016, to existing or new contracts for the sale of defense articlesor defense services consistent with the provisions of the Arms Export Control Act(22 U.S.C. 2751 et seq.): Provided further, That, not less than 15 days before makingfunds available pursuant to the authority provided in this section, the Secretary ofDefense shall submit to the congressional defense committees a written notice con-taining a detailed justification and timeline for the operations and activities of theOffice of Security Cooperation in Iraq at each site where such operations andactivities will be conducted during fiscal year 2016: Provided further, That amountsmade available by this section are designated by the Congress for Overseas Contin-gency Operations/Global War on Terrorism pursuant to section 251(b)(2)(A)(ii) ofthe Balanced Budget and Emergency Deficit Control Act of 1985.][SEC. 9012. Up to $600,000,000 of funds appropriated by this Act for the Coun-

terterrorism Partnerships Fund may be used to provide assistance to the Governmentof Jordan to support the armed forces of Jordan and to enhance security along itsborders.][SEC. 9013. None of the funds made available by this Act under the heading "Iraq

Train and Equip Fund" may be used to procure or transfer man-portable air defensesystems.][SEC. 9014. For the "Ukraine Security Assistance Initiative", $250,000,000 is

hereby appropriated, to remain available until September 30, 2016: Provided, Thatsuch funds shall be available to the Secretary of Defense, in coordination with theSecretary of State, to provide assistance, including training; equipment; lethalweapons of a defensive nature; logistics support, supplies and services; sustainment;and intelligence support to the military and national security forces of Ukraine, andfor replacement of any weapons or defensive articles provided to the Governmentof Ukraine from the inventory of the United States: Provided further, That the Sec-retary of Defense shall, not less than 15 days prior to obligating funds provided underthis heading, notify the congressional defense committees in writing of the detailsof any such obligation: Provided further, That the United States may accept equip-ment procured using funds provided under this heading in this or prior Acts that wastransferred to the security forces of Ukraine and returned by such forces to the UnitedStates: Provided further, That equipment procured using funds provided under this

heading in this or prior Acts, and not yet transferred to the military or National Se-curity Forces of Ukraine or returned by such forces to the United States, may betreated as stocks of the Department of Defense upon written notification to thecongressional defense committees: Provided further, That amounts made availableby this section are designated by the Congress for Overseas Contingency Opera-tions/Global War on Terrorism pursuant to section 251(b)(2)(A)(ii) of the BalancedBudget and Emergency Deficit Control Act of 1985.][SEC. 9015. Funds appropriated in this title shall be available for replacement of

funds for items provided to the Government of Ukraine from the inventory of theUnited States to the extent specifically provided for in section 9014 of this Act.][SEC. 9016. None of the funds made available by this Act under section 9014 for

"Assistance and Sustainment to the Military and National Security Forces of Ukraine"may be used to procure or transfer man-portable air defense systems.][SEC. 9017. (a) None of the funds appropriated or otherwise made available by

this Act under the heading "Operation and Maintenance, Defense-Wide" for paymentsunder section 1233 of Public Law 110–181 for reimbursement to the Governmentof Pakistan may be made available unless the Secretary of Defense, in coordinationwith the Secretary of State, certifies to the congressional defense committees thatthe Government of Pakistan is—

(1) cooperating with the United States in counterterrorism efforts against theHaqqani Network, the Quetta Shura Taliban, Lashkar e-Tayyiba, Jaish-e-Mo-hammed, Al Qaeda, and other domestic and foreign terrorist organizations, in-cluding taking steps to end support for such groups and prevent them from basingand operating in Pakistan and carrying out cross border attacks into neighboringcountries;

(2) not supporting terrorist activities against United States or coalition forcesin Afghanistan, and Pakistan's military and intelligence agencies are not inter-vening extra-judicially into political and judicial processes in Pakistan;

(3) dismantling improvised explosive device (IED) networks and interdictingprecursor chemicals used in the manufacture of IEDs;

(4) preventing the proliferation of nuclear-related material and expertise;(5) implementing policies to protect judicial independence and due process of

law;(6) issuing visas in a timely manner for United States visitors engaged in

counterterrorism efforts and assistance programs in Pakistan; and(7) providing humanitarian organizations access to detainees, internally dis-

placed persons, and other Pakistani civilians affected by the conflict.(b) The Secretary of Defense, in coordination with the Secretary of State, may

waive the restriction in subsection (a) on a case-by-case basis by certifying inwriting to the congressional defense committees that it is in the national securityinterest to do so: Provided, That if the Secretary of Defense, in coordination withthe Secretary of State, exercises such waiver authority, the Secretaries shall reportto the congressional defense committees on both the justification for the waiverand on the requirements of this section that the Government of Pakistan was notable to meet: Provided further, That such report may be submitted in classifiedform if necessary.]

[(INCLUDING TRANSFER OF FUNDS)][SEC. 9018. In addition to amounts otherwise made available in this Act,

$500,000,000 is hereby appropriated to the Department of Defense and madeavailable for transfer only to the operation and maintenance, military personnel, andprocurement accounts, to improve the intelligence, surveillance, and reconnaissancecapabilities of the Department of Defense: Provided, That the transfer authorityprovided in this section is in addition to any other transfer authority provided else-where in this Act: Provided further, That not later than 30 days prior to exercisingthe transfer authority provided in this section, the Secretary of Defense shall submita report to the congressional defense committees on the proposed uses of these funds:Provided further, That the funds provided in this section may not be transferred toany program, project, or activity specifically limited or denied by this Act: Providedfurther, That amounts made available by this section are designated by the Congressfor Overseas Contingency Operations/Global War on Terrorism pursuant to section251(b)(2)(A)(ii) of the Balanced Budget and Emergency Deficit Control Act of1985: Provided further, That the authority to provide funding under this sectionshall terminate on September 30, 2016.][SEC. 9019. None of the funds made available by this Act may be used with respect

to Syria in contravention of the War Powers Resolution (50 U.S.C. 1541 et seq.),including for the introduction of United States armed or military forces into hostilitiesin Syria, into situations in Syria where imminent involvement in hostilities is clearlyindicated by the circumstances, or into Syrian territory, airspace, or waters whileequipped for combat, in contravention of the congressional consultation and reportingrequirements of sections 3 and 4 of that law (50 U.S.C. 1542 and 1543).][SEC. 9020. None of the funds in this Act may be made available for the transfer

of additional C-130 cargo aircraft to the Afghanistan National Security Forces or

The Overseas Contingency Operations (OCO) funding requested forDiplomatic and Consular Programs (D&CP) will address the extraordinarycosts associated with deploying, securing and supplying the Department'scivilian presence in Iraq, Afghanistan, Pakistan, other areas of unrest, andtransition operations related to Syria as well as counter-ISIL public dip-lomacy. The request for Iraq supports the normalization of the diplomaticpresence in Baghdad and the provinces, including the full-year costs forsecurity and logistical support. The embassy and consulates play a vitalrole in building relationships with the Iraqi people, managing ongoingprograms and mitigating potential conflict. The requests for Afghanistanand Pakistan support implementation of a comprehensive diplomatic anddevelopment strategy to defeat Al Qaida and support the Afghan people.D&CP funding for Afghanistan and Pakistan enables a civilian presence,including diplomats, development specialists, and civilian expertise fromacross the U.S. Government, along with critical security and logisticalsupport. In Syria, the Department intends to continue operations in supportof reestablishing its diplomatic presence, counter sectarian strife and terror-ism, and enable transition to peace and democracy.

This appropriation provides funds for the United States to support unfore-seen requirements of peacekeeping operations and activities, includingpeace enforcement missions undertaken directly by the United Nations, orby regional coalition forces. The purpose of this appropriation is to ensurethat the United States can respond quickly to emergent needs of such oper-ations and activities without disrupting continued American support forany such ongoing activities that serve U.S. interests in promoting interna-tional peace and security, stability, and rule of law. The 2017 International Disaster Assistance Overseas Operations Contin-gency request of $1,832 million will provide funds to save lives, reducesuffering, and mitigate and prepare for natural disasters and complexemergencies through relief, rehabilitation, and reconstruction assistance,including food assistance, activities that transition to development assistanceprograms, and disaster preparedness/risk reduction activities. This requestincludes $1,001 million for the USAID Office of U.S. Foreign DisasterAssistance to prepare for and respond to natural disasters, civil strife andprolonged displacement of populations that continue to hinder the advance-ment of development and stability. It also includes $831 million for theUSAID Office of Food for Peace for emergency food responses with arange of interventions such as local and regional purchase of agriculturalcommodities near crises, food vouchers and cash transfers.

GENERAL PROVISIONS

ADDITIONAL APPROPRIATIONS

SEC. 8001. Notwithstanding any other provision of law, funds appropriated in thistitle and designated for Overseas Contingency Operations/Global War on Terrorismpursuant to section 251(b)(2)(A)(ii) of the Balanced Budget and Emergency DeficitControl Act of 1985, as amended, are in addition to amounts appropriated or other-wise made available in this Act for fiscal year [2016]2017.

EXTENSION OF AUTHORITIES AND CONDITIONS

SEC. 8002. Unless otherwise provided for in this Act, the additional amounts ap-propriated by this title and designated for Overseas Contingency Operations/GlobalWar on Terrorism pursuant to section 251(b)(2)(A)(ii) of the Balanced Budget andEmergency Deficit Control Act of 1985, as amended, to appropriations accounts inthis Act shall be available under the authorities and conditions applicable to suchappropriations accounts.

TRANSFER AUTHORITY

SEC. 8003. (a)(1) Funds appropriated by this title in this Act under the headings"International Disaster Assistance", "Transition Initiatives", "Complex Crises Fund","Economic Support Fund", "Migration and Refugee Assistance", "InternationalNarcotics Control and Law Enforcement", "Nonproliferation, Anti-terrorism, De-mining, and Related Programs", "Peacekeeping Operations", and ["Assistance forEurope, Eurasia and Central Asia"]"Foreign Military Financing Program" may betransferred to, and merged with, funds appropriated by this title under such headings.

[(2) Funds appropriated by this title in this Act under the headings "Interna-tional Narcotics Control and Law Enforcement", "Nonproliferation, Anti-terror-ism, Demining and Related Programs", "Peacekeeping Operations", and "ForeignMilitary Financing Program" may be transferred to, and merged with, fundsappropriated by this title under such headings.][(3) Of the funds appropriated by this title under the heading "International

Disaster Assistance", up to $600,000,000 may be transferred to, and mergedwith, funds appropriated by this title under the heading "Migration and RefugeeAssistance".](b) Notwithstanding any other provision of this section, not to exceed

[$15,000,000]$25,000,000 from funds appropriated under the [heading] headings"International Narcotics Control and Law Enforcement", "Nonproliferation, Anti-terrorism, Demining, and Related Programs", "Peacekeeping Operations", and"Foreign Military Financing Program" by this title in this Act [and made availablefor the Europe and Eurasia Regional program] may be transferred to, and mergedwith, funds previously made available under the heading "Global Security Contin-gency Fund" [which shall be available only for programs in the Europe andEurasia region].

[(c) The transfer authority provided in subsection (a) may only be exercised toaddress contingencies.]

([d]c) The transfer authority provided in subsections (a) and (b) shall be subjectto [prior consultation with, and] the regular notification procedures of, theCommittees on Appropriations: Provided, That such transfer authority is in addi-tion to any transfer authority otherwise available under any other provision of law,including section 610 of the Foreign Assistance Act of 1961 which may be exer-cised by the Secretary of State for the purposes of this title.

FOREIGN MILITARY FINANCING PROGRAM LOAN

SEC. 8004. Notwithstanding any other provision of law, during fiscal year 2017,direct loans under section 23 of the Arms Export Control Act may be made availablefor Iraq, gross obligations for the principal amounts of which shall not exceed$2,700,000,000: Provided, That funds appropriated under the heading "ForeignMilitary Financing Program" in title IV of this Act and prior Acts and title VIII ofthis Act or the Overseas Contingency Operations title of prior Acts making appro-priations for the Department of State, foreign operations, and related programs thatare designated by the Congress for Overseas Contingency Operations/Global Waron Terrorism pursuant to section 251(b)(2)(A)(ii) of the Balanced Budget andEmergency Deficit Control Act of 1985, as amended, may be made available for thecosts, as defined in section 502 of the Congressional Budget Act of 1974, of suchdirect loans: Provided further, That such costs, including the cost of modifying suchloans, shall be as defined in section 502 of the Congressional Budget Act of 1974,and may include the costs of selling, reducing, or cancelling any amounts owed tothe United States or any agency of the United States by Iraq: Provided further, Thatamounts repurposed pursuant to the language under this heading from prior Actsthat were previously designated by the Congress for Overseas Contingency Opera-tions/Global War on Terrorism pursuant to section 251(b)(2)(A)(ii) of the Balanced

Budget and Emergency Deficit Control Act of 1985, as amended, are designated bythe Congress for Overseas Contingency Operations/Global War on Terrorism pur-suant to section 251(b)(2)(A)(ii) of such Act and shall be available only if the Pres-ident subsequently so designates all such amounts and transmits such designationsto the Congress: Provided further, That the Government of the United States maycharge fees for loans under this heading, which shall be collected from borrowersin accordance with section 502(7) of the Congressional Budget Act of 1974: Providedfurther, That no funds made available to Iraq under this or any other Act may beused for payment of any fees associated with these loans: Provided further, Thatsuch loans shall be repaid in not more than 12 years, including a grace period ofup to 1 year on repayment of principal.
