AFFIDAVIT
Our names are Wilhelm F. Anderson and Pamela S. Anderson. We are the
Trustees of the Wilhelm F. Anderson Revocable Trust UTA December 15, 2014, and the
Pamela S. Anderson Revocable Trust UTA December 15, 2014. The two (2) Trusts are
the owners of real property known as 1242 Washington Drive, Annapolis, Maryland,
21403. The property is further described as Lot 47 in Block 5, as shown on a Plat entitled
"Plat Number One (1) Oyster Harbor, near Arundel on the Bay," which Plat is recorded
among the Land Records of Anne Arundel County in Plat Book 22, page 9.
Wilhelm F. Anderson transferred his interest in the property to Wilhelm Anderson
and Pamela Anderson by Deed dated July 18, 2003. That Deed is recorded in the Land
Records of Anne Arundel County in Book 13594, page 409. We transferred the property
to our Trusts by Deed recorded at Book 29452, page 354.
The property was originally purchased in the name of Wilhelm F. Anderson
pursuant to a Deed dated October 31, 1995, which Deed is recorded in the Land Records
of Anne Arundel County in Book 7208, page 774.
We have owned the property since October 31, 1995.
When we purchased the property, it was improved by a pier and a home that had
been used by our predecessors in title, Nathaniel McPherson and Ella McPherson, from
whom Wilhelm F. Anderson, purchased the property. The McPherson’s purchased the
property in July 1952.
Since the time the property was purchased in 1995, we have rebuilt the home and
made modifications to the pier and the waterfront of the property.
During the time that we have owned the property, we have never been advised
that we did not have riparian rights. We have always used and enjoyed the waterfront to
the exclusion of all others, believing that we have riparian rights.
We have written to the Oyster Harbor Homeowners Association and inquired as to
the exclusive riparian rights to the property. The president of the Association advised us
that he, on behalf of the Association, is unaware of any claim that the community may
have to the riparian rights of our property.
