Accounting10. 1 A ledgershall bemaintainedat the CentralRegistry andby theclerk of every court

of sum’naryjurisdiction.2 Where moneysare paid to an officer of a Court pursuantto an order or registered

agreementmadeby it or registeredin it, the officer shall disbursethosemoneysto thepersonnamedin theorderor registeredagreementasbeing entitledto receivepaymentin accordancewith the termsof the orderor registeredagreementor to theattorneyof that person.

3 Subjectto any expressdirectionsgivenby the personmaking thepayment,moneypaidpursuantto a provision of an order or registeredagreementis deemedto be a paymentmadeto thepersonentitled to receive it in satisfactionto theextentof thepaymentfirstly of anyfeespayablein respectof theenforcementand secondlyto amountsdueand unpaidunder theprovision an amountdue at anearlier date being satisfiedbeforean amount dueat a laterdate.

4 Where a personmaking thepaymentdoesso before the date on which the moneysaredue and payablethe Collector or clerk of the court to which payment hasbeen made maydisbursethem beforethat date if thepersongivesan authorityin writing to that effect and anindemnity in writing in respectof theearlypayment.

5 Wherea personwho is obliged to makepaymentsunder 2 or moreprovisionsof an orderor registeredagreementor underprovisionsof 2 or moreordersor registeredagreementspaysan amount that is less than the aggregateamountpayableunder those provisions, withoutgiving any directionsas to the appropriationof the moneysso paid,the Collectoror theclerkof the court to which thepaymenthasbeen mademay, subjectto subregulation4, appropriatethe moneysso paidfor or towards thesatisfactionof theamountspayable,in suchmannerashe thinksproper.

Notice of election11. 1 Subject to regulation 12 1 a personwho is entitled to enforceoneor more of the

provisionsof a maintenanceorder or registeredagreementmayelectnot to enforcea specifiedprovision.

2 An election undersubregulation1 shall be madeby noticein writing to theCollectororclerk of thecourt in which themaintenanceorderor registeredagreementis enforceable.

3 The Collectoror clerk referred to in subregulation2 shall causenoticeof theelectiontobe given to the personor personsliable to make paymentsunderthe maintenanceorder orregisteredagreementand theprovisionspecifiedin thenotice shall not be enforcedsubjecttoregulation12 3 without leaveof theCourt or relevantcourt of summaryjurisdiction.

4 A notice of electiongiven under this regulationshall not affect the enforcementof anyotherprovision of themaintenanceorder or registeredagreement.

Notice of withdrawal of election12. 1 A notice of electionreferredto in regulation11 may be withdrawn at any time by

thepersonentitled to enforcethemaintenanceorder or registeredagreement.2 Thewithdrawalof a noticeof electionshall be madeby noticein writing to theCollector

or clerkof thecourt referredto in regulation11 2.3 TheCollector or clerk referredto in subregulation2 shall causenoticeof withdrawal of

the notice of election to be givento thepersonor personsreferredto in regulation11 3 andtheprovision specifiedin thenoticeof electionshall be enforceable,from thedayof thenoticeof withdrawalwithout leaveof theCourt or relevantcourt of summaryjurisdiction.

Dutiesof Collector orclerk as to enforcement13. On applicationby or on behalfof anypersonentitledto enforcea maintenanceorderor

registeredagreementto the Collector or to the clerk of the court in which the order orregisteredagreementis enforceablethe Collector or that clerk may take all or any stepsnecessaryor expedientto enforcetheorderor registeredagreementbut thepersonmakingtheapplication shall have the same liability for all costs properly incurred in or about theenforcementproceedingsas if they had been taken by that personand the Collector or theclerk mayrefuseto act on theapplicationwhereit appearsto him unreasonableto do so.

9. 1 Thepracticeandprocedureof theCourt and courtsof summaryjurisdictioa relatingto matters in their non-federaljurisdiction, except those conferred on the Court by theAdoption of ChildrenAct 1896, shall be thesame,as nearlyas may be, asthe practice andprocedureprovided in the Family Law Rules relating to like matters,unless a contraryintentionappearsin a written law.

2 In this rule practiceand procedureincludesall matterswith respectto which rulesmaybe madeundertheAct.

CostswheretheCourt hasno jurisdiction10. Where a matter is brought in the Court or in a court of summaryjurisdiction over

which the Court hasno jurisdiction, the Judgeor Magistrate shall order the matter to bestruck out, and theCourt or court of summaryjurisdiction haspowerto awardcosts to thesameextent,and recoverablein thesamemanner,as if the Court hadjurisdiction therein andthe person bringing the matter had not appearedin the Court or the court of summaryjurisdiction or hadso appearedand failed to establishhiscase.

Personswho may take affidavits11. An affidavit requiredfor usein or before the Court or any officer of the Court, or in a

court of summaryjurisdiction, and a recognizancerequiredto be filed therein, may be swornor executedbefore a Judge,a Registrar, a Deputy Registrar,the Marshal, the Collector ofMaintenance,a Magistrate,a Justiceof the Peaceor any otherpersonallowedby anywrittenlaw ortheFamily Law Rulesto take anaffidavit or recognizance.

PartIV-AppealsNotice of Appeal

12. 1 An appealunder section812 of theAct to the Court from a court of summaryjurisdiction shall be institutedby filing a noticeof appeal.

2 A noticeof appealreferredto in subrule1 shall be-a in the form of the form of notice of appealprescribedby the Family Law Rules in

relation to appealsfrom courts of summaryjurisdiction under section 96 of theFamily Law Act; and

b filed in the Court within 28 daysafter themakingof thedecreein relationto whichtheappealis madeor suchfurther time astheCourt mayallow.

3 A copyof the noticeof appealshall, in accordancewith theprovisionsof theFamily LawRules relating to service of notices of appeal from courts of summaryjurisdiction undersection96 of theFamily Law Act, be servedon-

a all partiesto theproceedings;andb theclerk ofthe court appealedfrom,

within 14 daysafter thefiling of thenoticeof appeal.4 Where notice of appealunder section 81 2 of the Act to the Court from a court of

14. Compensationshall not be payableto the lessee inrespectof any improvementseffectedby him on thedemisedland and remainingthereonat theexpiration or earlier determinationof the lease.

THE Departmentof Computing and Information Technology hasissueda Requestfor Proposalsfor the development and operationof a telecommunicationsinfrastructureandcommonnetwork for theWA public sector.

The proposal which forms a part of the WesternAustralian Government’s Strategic TelecommunicationsPlan seeksthe co-ordination and provision of operationalmanagement,carrier servicesandnetwork equipmenton awhole-of-governmentbasis. A key elementis the development of a common network infrastructureservingGovernment agenciesthroughout the State and linking the PerthCentralBusinessDistrict to regionalcentres.

Copiesof the Requestfor Proposalsare being issuedtoorganisations who have indicated their interest inparticipating in the project. The purposeof this advertisement is to provide anopportunityfor otherorganisationstoseek further information and, if required, a copy of theRequestfor Proposals.
