    Subject: Discrepancy in pay fixation.Reference is invited to this office circular of even No. dated 02-02-2012 wherein it wasinstructed to provide pay protection to those erstwhile HS grade employees who got financial

    upgradation under ACP scheme (in the pay scales of Rs 5000 - 8!g) between the period from 01-01-2006 to -r1-08-2008 at the time of fixation of their pry *."i o1-ol-2oa6 as a consequence ofrestructuring of Artisan Staff.The matter has been examined de-novo at this end with reference to the clarification issuedvide MoD iD No' 13,t5)/2aa9-D(Civ-l) dated 01-12-2010 and following revised instructions are issued.Para 2(ii) of the above mentioned MoD lD af o1-L2-2010 clearly stipulates that the benefit ofsuch non-functional upgradation should not be withdrawn as one time measure. But pay protectionneither ensures protection of his grade pay to which he became entitled due to the upgradation norensilres dravral of PW earnings with reference to the upgraded corresponding minimum pay of thepay scales of 5'r'CPC i.e. Rs.5000- 8000 because his regular pay in the pay band and grade paywillbe in the corresponding 5'l' CPC pay scales of Rs 4500-7000. The pay protection thus virtually deniesthe benefit of non functional up-gradation which is in contrary to the MOD clarification.ln view of the above it has been decided that the allsuch affected Highly Skilled Workers (inthe pay scales of Rs. 4000-6000) who got non functional Financial upgradation (in the pay scales of

    Rs 5000-8000) between the period from 0L-01-2C06 to 31-08-2008 should be allowed to draw pay inPB-2 with grade pay of Rs 4200/- and their earnings should be calculated at Rs. 5000/- (rninimum ofthe corresponding pay scale in pre-revised pay as one time measure. However this benefit cannot beextended in general in any subsequent case citing reference to this as this benefit is of exceptionalnature and applicable only as one time measure .
