Excelsior daily REGD.NO.JK-71/15-17 RNI No. 28547/1992 Vol No. 52 No. 41 JAMMU, THURSDAY, FEBRUARY 11, 2016 18 Pages ` 4.00 Mohinder Verma JAMMU, Feb 10: In a major embarrassment for the State Government, the Division Bench of High Court comprising Chief Justice N Paul Vasanthakumar and Justice Tashi Rabstan has impleaded Administrative Secretaries of 13 key depart- ments as party respondents with the direction to file status of pending departmental enquiries within next two weeks or appear in person on next date of hearing to explain their contemptuous attitude towards the numerous direc- tions issued till date. The Division Bench also observed, in the open court, that due to inordinate delay on the part of the Administrative Secretaries in completion of 147 departmental enquiries all those officers who have been accused of indulging in misconduct, mal-administration and corrup- tion, continued to remain unpunished and even posted on prime positions. The Public Interest Litigation (PIL) highlighting the dilly dallying approach towards completion of 147 departmental enquiries was filed on the basis of startling revelations made by EXCEL- SIOR in its edition dated February 24, 2014 wherein it was highlighted that account- ability in the Government functioning has suffered a big blow due to inordinate delay in initiating action against officers and officials facing 147 departmental enquiries during the past several years. It was also highlighted in this exclusive news-item that allegations against the indicted officers were of serious in nature and had they been taken to task the same would have yielded deterrent effect on the other officers and officials. When this PIL filed by Sheikh Mohammad Shafi and Prof S K Bhalla came up for hearing today, Advocate Sheikh Shakeel Ahmed drew the atten- tion of Division Bench headed by Chief Justice N Paul Vasanthakumar towards the order dated April 4, 2014 passed by the then Chief Justice M M Kumar wherein it was observed that the status report filed by the General Administration Department was revealing less and concealing much more. “With these observations, the DB had directed that a com- plete disclosure with regard to the stage of enquiries, nature of charges, status of officers and their present postings be made so that appropriate orders are passed”, Advocate Ahmad said, adding “despite these explicit directions almost all the Government departments are soft-paddling on the completion of enquiries with the sole inten- tion of shielding the corrupt officials”. Stating that despite numer- ous directions issued by Division Bench from time to time in this PIL the depart- ments have not mend their ways and efforts to shield the officers and officials are still on, Advocate Ahmad further said, “the latest status report filed by GAD in pursuance to the last order is a testimony of soft-paddling on the part of those at the helm of affairs in the departments”, adding “so far only five departments have responded with the fresh sta- tus report and the response Govt deptt s continue to sof t paddle on 147 pending enquiries DB expresses anguish, directs 13 Adm Secys to file status or appear in person *AG admits deptts not cooperating with GAD Neeraj Rohmetra JAMMU, Feb 10: Senior leaders of RSS and BJP today during a high-level meeting in New Delhi reviewed the per- formance of the PDP-BJP coalition Government in the border State and discussed various options to resolve the on-going political impasse. While there were divergent views about the performance of the then coalition Government, most of the par- ticipants favoured continua- tion of the coalition with PDP and early formation of demo- cratically elected Government in the State. Reliable sources told EXCELSIOR, "the meeting which took place in the after- noon at RSS headquarter was attended by senior functionaries of the RSS, BJP and three senior leaders of the party from the State. The Central leadership held threadbare discussions over the Agenda of Alliance that was agreed upon between the two coalition partners before Government formation and as to what were the achievements of the coalition during its eight month tenure". "The leaders discussed in detail the performance of State unit of BJP while being in Government and the response of PDP to all issues confronting the State. The leaders also confabu- lated the status of BJP's own agenda and status of various issues including that of border residents, refugees and return of Kashmiri Pandits", sources said, adding, "Prime Minister's Rs 80,000 crore economic package to the State was also discussed in the meeting and the steps required to ensure its implemen- tation on ground at the earliest possible". Leaders, who were privy to the meeting, were categorical that most of the leaders favoured continuation of the alliance with PDP, which had catapulted BJP to power for the first time in the border State. "There was near con- sensus that efforts should be initiated for early resolution of the political impasse so as to pave way for Government for- mation. But, there should be no deviation from the already agreed Agenda of Alliance between the two coalition partners and all future discus- sions should take place between the parameters of the already agreed roadmap", sources asserted. BJP's national general secre- tary and point-man of J&K, Ram Madhav when contacted told EXCELSIOR, "talks were going on with BJP through some channels and we are hoping for early end to the political stale- ment in the State". Asked about his proposed visit to Kashmir for taking the dialogue with PDP further, he said, "I shall be visiting Kashmir to discuss the issues raised by PDP leadership, but the date hasn't been finalised". To a pointed query if the PDP has set forward some new conditions, he said, "it wouldn't be appropriate to comment at this stage". It is pertinent to mention here that PDP president, Mehbooba Mufti has categorically told that the Modi-led Government at the Centre needs to take certain Top leadership of RSS, BJP favours continuation of coalition with PDP *Ram Madhav visiting Srinagar on Feb 15 Excelsior Correspondent JAMMU, Feb 10: In order to ensure punctuality and pro- mote transparency and effi- ciency in its offices and estab- lishments, Government has decided to switch over to the Aadhaar Based Biometric System on or before March 31, 2016 and a detailed directions have been issued to all the concerned for strict compli- ance. According to the directions issued by the General Administration Department, no salary or wages would be drawn in favour of the Government employees of any category for the month of March 2016 onwards unless they have enrolled themselves in the Aadhaar Based Biometric System. This condition also applies to the PSU employees, contractual, consolidated and casual workers drawing wages in any form from the public exchequer. The DDOs have been direct- ed to ensure enrolment in the system before March 31 and furnish a certificate for the same along with salary/wage bill pre- sented in the Treasury without which the Treasury Officers will not entertain any salary/wage bill. Stating that from April 1, 2016 onwards the marking of attendance in the system would be compulsory for all categories of employees and wage earners, the GAD said, "it would be only after scruti- ny of monthly attendance, the DDOs would prepare salary/wage bill and a certifi- cate in this regard would be accordingly furnished along with the bill to the Treasuries concerned". Even the pensioners have also been asked to enroll them- selves by obtaining Aadhaar number by March 31 as this would help them to digitally identify themselves in future at the nearest Common Service Centre/ Khidmat Centre or any other place having the system installed. They would not be required to physically present themselves before the pre- scribed authorities to prove that they are alive. "This initiative is being undertaken as a part of Jeevan Parnam Scheme", the GAD said. It has also been decided that all persons drawing bene- fits like old aged pension, widow pension, student schol- arship, stipend, honorarium, wages under MGNREGA or any other similar cash benefit from the Government would need to enroll themselves in Aadhaar based Biometric System initially and mark their continued eligibility periodically as decided by the concerned department by pre- senting and marking before the concerned authority. "The concerned departmen- tal officers will be responsible for getting enrolled all such ben- eficiaries in the system for their identification without which they would not draw any benefit after April 1, 2016", the GAD said. The proposal is being considered against the backdrop of a decline in both passenger and freight earnings and the additional burden of Rs 32,000 cr towards implementing the 7th pay com- mission recommendations, Railway Ministry sources said. (Contd on page 6 Col 5) Sanjeev Pargal JAMMU, Feb 10: The Election Commission has set the process into motion for holding elections to 78 Municipal bodies including two Corporations and six Councils after receiving reports from all Deputy Commissioners on reservation of Wards for women, Scheduled Castes and Scheduled Tribes. The State Election Commission will segregate and publish draft electoral rolls of all Urban Local Bodies (ULBs) by the middle of this month, anytime on or after February 15 and give 15-days time for objec- tions before final publication of rolls. Chief Electoral Officer (CEO) Shantmanu told the Excelsior that the process for holding elections to 78 Municipal bodies after a gap of about 11 years has been set into motion after receiving report from all 22 Deputy Commissioners of Jammu and Kashmir on reservation of Wards of the ULBs, falling within their territorial jurisdic- tion. “We have received the report of all 22 Deputy Commissioners on reservation of Wards of the ULBs. The DCs had earlier been asked to submit the report on rotation of reserved Wards within 15 days after completing the exercise in consultations with the concerned departments. The DCs have submitted their reports,” Shantmanu said, adding the reports were being studied by the Election Department and would be finalized in next about one week. Earlier, there was a view within the Election Commission to hold the Municipal elections without rotating the reserved Wards but later the Commission had left the matter up to the Deputy Commissioners and asked them to submit their report to this effect. The DCs had been asked to examine rota- tion of Wards and report back to the Election Commission within a fortnight, which they have done. Sources said there was a general view that rotation of Wards could take time and, therefore, the Commission should go ahead with the exist- ing reserved Wards but a final decision would be taken within a week. In another decision aimed at expediting the process for holding the Urban Local Bodies elections in the State, the Election Commission would be publishing segregat- ed draft electoral rolls for all 78 ULBs by the middle of Poll process set into motion, rolls by Feb 15 EC receives report on rotation of reserved Wards, decision soon Gopal Sharma JAMMU, Feb 10: It may sound incredible but it is true that against the strength of nearly 4500 employees in the CAPD department working in Kashmir province, hardly 613 are running the affairs of the department in Jammu province. Making startling revelations highly placed sources in the CAPD department told the "Excelsior" that against the sanctioned strength of 4900 employees in the CAPD depart- ment in Kashmir, just 980 is the sanctioned strength of employees including Gazetted, Non-Gazetted and Class- IV in Jammu region, despite the fact that Kashmir region's area is equivalent to erstwhile Doda district of Jammu region. This glaring example of dis- crimination within the depart- ment has exposed the system and the people at the helm of affairs, who never bothered to do justice with the other region and allowed the people to suffer in view of poor delivery of essential services for decades. The CAPD supplies in many area like Kishtwar, Chhatroo, Paddar, Wadwan, Doda, Bhalessa, Rajouri, Budhal, Khwas, Mahore, Gulabgarh, Chassana, Dudu- Basantgarh, Pancheri-Ladhar, Bani, Lohai - Malhar, Machhedi etc in Jammu province could not be streamlined since independence because no sincere efforts were made by the concerned Ministers and bureaucrats dur- ing past several decades. They failed to maintain the balancing act. Even after the creation of new administrative units about two years back, includ- ing formation of new Tehsils like Marheen, Dinga Amb, Ramkot, Lohai Malhar, Machhedi, Rajpura in Kathua; Doongi-Garati, Beri Pattan, Qila Darhal, Khawas, Siot, Ladoka, Manjakote, Mogla etc in Rajouri and other districts and Sub Divisions, no new infrastruc- ture was developed by the department or much needed staff appointed there. Total 77 new Tehsils were created in Jammu province and 56 in Kashmir but new TSOs and other staff was not appointed till date. New units were allowed to function through the old existing system within the department. Sources in the CAPD Department further disclosed that in Jammu province, the department is reeling under the shortage of 40 to 45 % staff. Siachen braveheart battles for life; nation prays for his early recovery

The condition of Lance Naik Hanumanthappa Koppad, whosurvived a six-day burial under an avalanche in Siachen, deterio-rated today at the Army's RR Hospital here, even as the entirenation right from the top political leadership to Mumbai's iconicDabbawala prayed for the braveheart.

"His condition has deteriorated despite aggressive therapy andsupportive care," said the medical bulletin, issued by the ArmyHospital (Research & Referral) here in the evening.

SRINAGAR, Feb 10: Weatherman today predicted snow andrainfall in Kashmir Valley even as the minimum temperature roseabove the freezing point at most places in Kashmir after lightsnowfall in hills and drizzle in plains.

A Meteorological Department official said that the snow andwidespread rainfall is expected in the Valley tomorrow. JNU administration today ordered a "disciplinary" enquiry intoholding of an event on campus against the hanging of Parliamentattack convict Afzal Guru despite cancellation of permission say-ing any talk about country's disintegration cannot be "national".

Rail budget may hike passenger faresNEW DELHI, Feb 10:

Facing resource crunch, Railways is said to be mulling the pos-sibility of effecting a 5 to 10 per cent increase in the passengerfares in the coming budget.

The proposal is being considered against the backdrop of adecline in both passenger and freight earnings and the additionalburden of Rs 32,000 cr towards implementing the 7th pay com-mission recommendations, Railway Ministry sources said.

On top of this, the gross budgetary support for the 2015-16 hasalso been slashed by Rs 8,000 cr by the Finance Ministry due tolow spending by the Railways.

Election Commission has setthe process into motion forholding elections to 78Municipal bodies includingtwo Corporations and sixCouncils after receivingreports from all DeputyCommissioners on reservationof Wards for women,Scheduled Castes andScheduled Tribes.

The State ElectionCommission will segregate andpublish draft electoral rolls ofall Urban Local Bodies (ULBs)by the middle of this month,anytime on or after February 15and give 15-days time for objec-

tions before final publication ofrolls.

Chief Electoral Officer(CEO) Shantmanu told theExcelsior that the process forholding elections to 78Municipal bodies after a gap ofabout 11 years has been set intomotion after receiving reportfrom all 22 DeputyCommissioners of Jammu andKashmir on reservation ofWards of the ULBs, fallingwithin their territorial jurisdic-tion.

“We have received thereport of all 22 DeputyCommissioners on reservationof Wards of the ULBs. TheDCs had earlier been asked tosubmit the report on rotation

of reserved Wards within 15days after completing theexercise in consultations withthe concerned departments.The DCs have submitted theirreports,” Shantmanu said,adding the reports were beingstudied by the ElectionDepartment and would befinalized in next about oneweek.

Earlier, there was a viewwithin the Election Commissionto hold the Municipal electionswithout rotating the reservedWards but later the Commissionhad left the matter up to theDeputy Commissioners andasked them to submit theirreport to this effect. The DCshad been asked to examine rota-

tion of Wards and report back tothe Election Commission withina fortnight, which they havedone.

Sources said there was ageneral view that rotation ofWards could take time and,therefore, the Commissionshould go ahead with the exist-ing reserved Wards but a finaldecision would be taken withina week.

sound incredible but it is truethat against the strength ofnearly 4500 employees in theCAPD department working inKashmir province, hardly 613are running the affairs of thedepartment in Jammuprovince.

Making startling revelationshighly placed sources in theCAPD department told the"Excelsior" that against thesanctioned strength of 4900employees in the CAPD depart-ment in Kashmir, just 980 isthe sanctioned strength ofemployees including Gazetted,Non-Gazetted and Class- IV in

Jammu region, despite the factthat Kashmir region's area isequivalent to erstwhile Dodadistrict of Jammu region.

This glaring example of dis-crimination within the depart-ment has exposed the systemand the people at the helm ofaffairs, who never bothered todo justice with the other regionand allowed the people to sufferin view of poor delivery ofessential services for decades.The CAPD supplies in manyarea like Kishtwar, Chhatroo,Paddar, Wadwan, Doda,Bhalessa, Rajouri, Budhal,Khwas, Mahore, Gulabgarh,Chassana, Dudu- Basantgarh,Pancheri-Ladhar, Bani, Lohai -

Malhar, Machhedi etc inJammu province could not bestreamlined since independencebecause no sincere efforts weremade by the concernedMinisters and bureaucrats dur-ing past several decades. Theyfailed to maintain the balancingact.

Even after the creation ofnew administrative unitsabout two years back, includ-ing formation of new Tehsilslike Marheen, Dinga Amb,Ramkot, Lohai Malhar,Machhedi, Rajpura inKathua; Doongi-Garati, BeriPattan, Qila Darhal, Khawas,Siot, Ladoka, Manjakote,Mogla etc in Rajouri and

other districts and SubDivisions, no new infrastruc-ture was developed by thedepartment or much neededstaff appointed there. Total 77new Tehsils were created inJammu province and 56 inKashmir but new TSOs andother staff was not appointedtill date. New units wereallowed to function throughthe old existing system withinthe department.

Sources in the CAPDDepartment further disclosedthat in Jammu province, thedepartment is reeling under theshortage of 40 to 45 % staff.Even some TSOs, inspectors,
