B1. Probable Cause StatementON 3/14/18 AT ABOUT 0012 HOURS, THE VICTIM WAS SHOT AND KILLED WHILE RIDING HISBIKE HOME FROM WORK AT 704 N 4 ST, CITY OF AVONDALE, COUNTY OF MARICOPA, STATEOF ARIZONA. VIDEO SURVEILLANCE CAMERAS IN THE AREA CAPTURED FOOTAGE OF THESHOOTING. THE SUSPECT VEHICLE DEPICTED IN THE VIDEO FOOTAGE WAS IDENTIFIED AS AWHITE 2000S MODEL HONDA CIVIC WITH A SUNROOF. THE VEHICLE FOLLOWS THE VICTIM ASHE RIDES HIS BIKE EASTBOUND ON E LAWRENCE BLVD, THEN NORTHBOUND ONTO N 4 ST, ANDTHEN SLOWS DOWN AS THE VICTIM GETS OFF OF HIS BIKE IN FRONT OF HIS APARTMENT AT704 N 4 ST AT WHICH POINT 9 SHOTS ARE FIRED FROM THE DRIVER SIDE WINDOW OF THEHONDA CIVIC (OBSERVED AND HEARD ON VIDEO FOOTAGE). THE VIDEO FOOTAGE WAS NOTCLEAR ENOUGH TO OBTAIN A LICENSE PLATE OR SUSPECT DESCRIPTION. 3 9MM SPENT SHELLCASINGS WERE RECOVERED FROM THE SCENE, BUT THE REMAINING 6 SPENT SHELL CASINGSWERE NOT LOCATED. THE GUN USED WAS NOT RECOVERED AT THE SCENE. FOLLOW UP WASCONDUCTED WITH THE VICTIM'S EX-GIRLFRIEND, FAMILY, COWORKERS, AND FRIENDS;HOWEVER, NO MOTIVE FOR THE SHOOTING WAS DISCOVERED. THE VICTIM DID NOT APPEAR TOBE INVOLVED IN DRUG USE OR GANG ACTIVITY. THE VICTIM WORKED SWING-SHIFT AT ANEARBY AIRPORT AND RODE HIS BICYCLE TO SAVE MONEY. THE VICTIM LIVED ALONE ANDPLAYED ONLINE VIDEO GAMES AND HAD TWO PETS THAT HE CARED FOR. THE VICTIM DID NOTHAVE ANY OUTSTANDING FINANCIAL DEBTS AND KEPT A CLEAN AND ORGANIZED RESIDENCE.FOR WEEKS, A MOTIVE AND OR EXPLANATION FOR THE SHOOTING WAS UNKNOWN. ON 3/30/18,A SEARCH WARRANT WAS DRAFTED, APPROVED, AND SUBMITTED TO GOOGLE REQUESTING IN-FORMATION ON ANY WIRELESS COMMUNICATION DEVICES THAT PASSED THROUGH THE SAMEGEOGRAPHICAL LOCATIONS AS THE SUSPECT VEHICLE DID WHILE DEPICTED IN VIDEO FOOT-AGE THAT CAPTURED THE SUSPECT VEHICLE DRIVING THROUGH THE AREA ON THE NIGHT OFTHE MURDER. ON 10/2/18, AVONDALE POLICE RECEIVED RETURN INFORMATION FROM GOOGLEIN RESPONSE TO THE SEARCH WARRANT PREVIOUSLY SUBMITTED. GOOGLE ADVISED THAT 4DEVICES CONNECTED TO THEIR SERVICES PASSED THROUGH THE SAME GEOGRAPHICAL LOCA-TIONS AS THE SUSPECT VEHICLE DID WHILE DEPICTED IN VIDEO FOOTAGE THAT CAPTUREDTHE SUSPECT VEHICLE DRIVING THROUGH THE AREA ON THE NIGHT OF THE MURDER. DETECT-IVES REVIEWED THE GEOGRAPHICAL LOCATION INFORMATION FOR EACH OF THE 4 DEVICESPROVIDED BY GOOGLE AND COMPARED THAT INFORMATION TO THE KNOWN TIMELINE OF EVENTSCAPTURED ON VIDEO THE NIGHT OF THE MURDER. 1 DEVICE, WHICH GOOGLE LABELED AS -760578518, CLOSELY MATCHED THE MOVEMENT OF THE SUSPECT VEHICLE AS DEPICTED INTHE VIDEO FOOTAGE. THE SUBSCRIBER INFORMATION FOR THE DEVICE GOOGLE LABELED AS -760578518 WAS REQUESTED F SUBSCRIBER JORGE MOLINA,WITH AN E-MAIL ADDRESS OF THE TELEPHONE NUMBER AS-SOCIATED TO THIS DEVICE WA AVONDALE P EPORTMANAGEMENT SYSTEMLISTED ADDRESS OFSAME TELEPHONE NUATELY 2 MILES FROM TH ENE. JORGE ALSO HAS A PLATE(Ianovz FOR A

CIVIC 4-DOOR BEARING ARIZONA LICENSE PLATE AND VINae. DETECTIVES WERE ABLE TO SUCCESSFULLY LOC VEHICLE IN

THAT JORGE RESIDES WITHIN AND CONFIRMED THAT IT HAS A SUNROOFAND CLOSELY MATCHES THE PHYSICAL APPEARANCE OF THE SUSPECT VEHICLE FROM THEVIDEO SURVEILLANCE OF CIDE. UPON FURTHER RESEARCH, THE SERVICE PROVIDERFOR THE PHONE NuMBER WAS DETERMINED TO BE WITH A SEARCHWARRANT, SUBSCRIBER FOR TELEPHONE NUMBERP| WAS OBTAINEDFROM T-MOBILE, S IBER WITH A LIS-TED ADDRESS 0i. CELL TOWER INFORMATION WASOBTAINED FROM IME FRAME OF 1/1/18 THROUGH6/30/18. CELL TOWER INFORMATION SHOWED JORGE'S PHONE TO BE IN THE GEOGRAPHICALAREA OF THE MURDER DURING THE TIMEFRAME THAT THE HOMICIDE OCCURRED.

NDED DETAILS REGARDING JORGE'S COMMUNICATIONS, SEARCH HISTORY, AND GPS LOCA-TION DURING THE TIME FRAME OF THE HOMICIDE BEING INVESTIGATED IN THIS CASE. THEINFORMATION REQUESTED ALSO ENCOMPASSED MONTHS PRIOR TO AND AFTER THE MURDER,WHICH WERE REQUESTED TO DEMONSTRATE HISTORICAL NORMS FOR JORGE'S USE OF HIS

IT WAS FOUNDTHAT DURING THE TIMEFRAME OF THE MURDER, JORGE'S GOOGLE ACCOUNT WAS ACCESSED ONA DEVICE WHICH WAS IN NEAR PROXIMITY TO THE MURDER SCENE AND WAS ALSO CONSISTENTWITH CELL TOWER INFORMATION ALREADY OBTAINED FROM T-MOBILE FOR JORGE'S CELLPHONE. ADDITIONALLY, SEARCH HISTORY FOR JORGE'S ACCOUNT SHOWED A SEARCH ON THEEVENING OF 3/14/18 FOR "SHOOTINGS IN AVONDALE AZ LAST NIGHT". THE SEARCH HISTORYALSO SHOWED GOOGLE SEARCHES FOR "SNIPER I17" AND “PHOENIX SHOOTER TODAY" ON3/15/18. JORGE'S GOOGLE ACCOUNT INFORMATION SHOWED THAT HE BANKED WITH WELLSFARGO. JORGE'S WELLS FARGO BANKING INFORMATION AND ACCOUNT HISTORY WERE OBTAINEDSHOWING JORGE TO BE USING HIS WELLS FARGO ACCOUNT WITHIN HOURS OF THE MURDER. ON12/13/18 AT 0850 HOURS, JORGE WAS ARRESTED AT HIS PLACE OF WORK IN GOODYEAR, AZ,WHILE IN POSSESSION OF HIS PHONE AND VEHICLE. SUBSEQUENT SEARCH WARRANTS WEREEXECUTED ON JORGE'S VEHICLE AND RESIDENCE; HOWEVER, NO GUN OR SHELL CASINGS WERELOCATED IN OR AT EITHER. DURING A SEARCH OF JORGE'S VEHICLE, A USABLE AMOUNT OFMARIJUANA AND A GLASS PIPE WERE LOCATED. JORGE WAS INTERVIEWED POST-MIRANDAWARNINGS. JORGE ADVISED THAT THE WHITE HONDA CIVIC WAS HIS AND WAS THE ONLY ONETHAT SHOULD BE DRIVING IT. JORGE ADVISED THAT HIS STEPFATHER MARCOS HAD DRIVENIT A FEW TIMES WITHOUT JORGE'S PERMISSION. JORGE ADMITTED TO USING ILLICIT DRUGSTO INCLUDE MARIJUANA AND COCAINE AS WELL AS DRINKING ALCOHOL. JORGE ADVISED HISBANK ACCOU OWN AND NO ONE ELSE USED IT. JORGE CONFIRMED HIS PHONE NUM-BER TO2 AND CONFIRMED THAT HE WAS THE ONLY ONE ON HIS PHONE LINE.JORGE CON NO ONE ELSE USES HIS GOOGLE LOGIN INFORMATION. JORGE CON-FIRMED THAT HE WAS CLOSE FRIENDS WITH ALESIA MORALES, WHO WAS CALLED RIGHT AFTERTHE MU ROM JORGE'S PHONE. JORGE CONFIRMED THAT NO ONE ELSE IN HIS FAMILYcaLLs SHE IS HIS FRIEND. JORGE DENIED ANY KNOWLEDGE OF THE SHOOTING ORMURDE ING THAT HE COULD NEVER DO THAT. WHEN CONFRONTED WITH THE FACT THATPOLICE HAD IDENTIFIED HIS VEHICLE AT THE SCENE OF THE CRIME, HIS CELL PHONE INTHE AREA OF THE CRIME, HIS GPS LOCATION THROUGH GOOGLE SERVICES AT THE SCENE OFTHE CRIME, AND HIS BANK CARD USED BY HIM SHORTLY BEFORE AND AFTER THE TIMECRIME, JORGE COULD NOT PROVIDE AN EXPLANATION FOR THESE THINGS. JORGE ULTIMATELYREQUESTED A LAWYER AND THE INTERVIEW ENDED.
