Hearing a petition filed by Jammu and Kashmir Veterinary Doctors Association seeking time bound promotion as has been given to doctors of other departments, Justice Tashi Rabstan said the State need not to venture into any such accord having discriminatory ramifica- tions on other section. "The Government actions have a public element and, therefore, there should be fair- ness and equality in all provinces of the society. It may not be out of place to mention here that Article 14 of the Constitution of India strikes at arbitrariness in the State action and ensures fairness and equali- ty of treatment", Justice Tashi recorded in the judgment. Court said the State action must be on some rational and relevant principles and not be arbitrary guided by any extrane- ous or irrelevant consideration which amounts to denial of equality. "Therefore, Veterinarians of Animal and Sheep Husbandry Department (peti- tioners herein) cannot be sin- gled out and denied the benefit of 3rd Time Bound Promotion that is being given to similarly situated persons", Court said. Court, thus, held that mem- bers of petitioner Association (JK Veterinary Doctors Association) are entitled to third time bound promotion, who have completed 20 years of cumulative service before 1st January 2010. Court has also made it clear that any order or communication Excelsior Correspondent JAMMU, Oct 16: The State Government today came out with series of reforms pertain- ing to expenditure especially during last quarter of current financial year from January 1 to March 31, 2018 and announced that all unutilized funds over and above 30 per cent of the budgeted amount will be automatically forfeited and won’t be allowed to be used for any other purposes after December 31, 2017. The reforms announced today by the State Government said that all powers related to re- appropriation and re-distribution of funds vested in the Administrative Departments, Head of Departments (HoDs) and Drawing and Disbursement Officers (DDOs) have been withdrawn. “All the un-utilized funds over and above 30 per cent of the budgeted amount on both Revenue and Capex side as on December 31, 2017, shall be automatically forfeited and will not be allowed to be used for any other purposes,’’ the Government order said. It added that only 30 per cent budget allocation on both Revenue and Capex side will be allowed for utilization during last quarter of current financial year i.e. from January 1, 2018 to March 31, 2018. This, according to official sources, has been done to ensure that there were no financial irregularities during Excelsior Correspondent SRINAGAR, Oct 16: Taking a strong note of the reports of non-availability of specialist doctors in the far flung and rural areas, Chief Minister, Mehbooba Mufti today sought a status report within a week's time from the concerned department and posting of requisite staff at the places where they are needed the most. She gave these directions during a meeting to strengthen the availability of doctors and medical facilities in rural and far flung areas following her feed- back from people who met her during her public outreach pro- grammes recently. Mehbooba, it may be recalled, has recently visited districts of Ramban, Kargil, Kupwara, Pulwama and Budgam during her public out- reach programmes in which peo- ple had complained of non avail- ability of doctors at the health centres in the far flung and dis- tant areas. Minister for Finance, Dr. Haseeb Drabu; Minister for Health & Medical Education, Bali Bhagat and Minister of State for Health & Medical Education, Asiea Naqash were present in the meeting. The Chief Minister direct- ed for taking action against the doctors who do not report to duty in these areas. Besides, she also directed strengthen- ing of the facilities by way of diagnostic equipment, ambu- lances and other testing facili- ties at the hospitals in rural and far flung areas. Mehbooba directed for prop- er and adequate strengthening of district hospitals by way of post- ing of specialist doctors, in par- ticular gynaecologists, anaes- thetists and paediatricians. She said strengthening of district hospitals would provide a one stop healthcare facility to people from all across in the district on one side, it would also enable lessening the burden on tertiary care hospitals in capital cities, thereby relieving patients of travelling long distances for treatment. She directed construction and proper maintenance of resi- dential quarters for doctors at District and Sub District Hospitals. For this, she directed preparation of a proto type design with all the facilities of a decent living to be replicated all across. Vyas; Principal Secretary to Chief Minister, Rohit Kansal; Principal Secretary, Health & Medical Education, Pawan Kotwal and other senior officers CM seeks report on non-availability of docs in far flung areas Sanjeev Pargal JAMMU, Oct 16: The Power Ministry of Jammu and Kashmir Government has detected a major scam that might run into several crores, in allotment of contract for works under two prestigious schemes of Prime Minister Narendra Modi, in six districts of Kashmir valley including Kupwara, Baramulla, Bandipora, Ganderbal, Budgam and Anantnag. Acting swiftly after getting reports or irregularities in allot- ment of works, the Power Ministry immediately ordered an inquiry into them and sus- pended execution of projects under Prime Minister's Development Plan (PMDP- Rural) and Deen Dayal Upadhyaya Grameen Jyoti Yojana (DDUGJY). The inquiry report too has confirmed irregu- larities in allotment of works , directed scrapping of the tenders followed by issuance of new NITs and action against officers and officials, responsible for the irregularities. In the process, execution of works has been delayed to such an extent that ambitious plan of Narendra Modi-- ‘Power for All’ by November 2018-could well be missed in Jammu and Kashmir, which could be a major setback as the Prime Minister has publically declared that the Centre would electrify all villages by November 2018. A copy of the Enquiry report into the 'Bid Evaluation of DDUGJY and PMDP (Rural) for six districts of Kashmir, which is in possession of the Excelsior, has established serious irregular- ities in allotment of works for total negotiated cost of Rs 598 crores and recommended that the contract should be immedi- ately scrapped. It has called for issuance of fresh tenders strictly in terms of the guidelines issued in this behalf by the Ministry of Power, Government of India. The enquiry was conducted by Commissioner/Secretary to Government, Power Development Department (PDD), Dheeraj Gupta on the directions of Deputy Chief Minister, Incharge PDD, Dr Nirmal Singh. According to sources, a "serious and deliberate attempt'' had been made to favour a par- ticular businessman and his firm by the Contract Committee by raising the final offer from 36 per cent to 46 per cent above the estimated cost after negotia- tions. The contracts had been decided by the Contract Committee-1, which was head- ed by the Development Commissioner (Power) and comprised all Chief Engineers of the Department. This is mainly because the contractors have not been showing any interest in the works of the department on the experience of delayed pay- ments and lack of cooperation. Official sources told EXCELSIOR that 132 KV dou- ble circuit transmission line from Rajouri to Draba in Poonch suffered extensive damaged in January 2013 due to heavy snowfall. Similarly, 132 KV sin- gle circuit transmission line from Draba to Chandak which was running along the left bank of river Suran suffered damage in September 2014 due to flash floods. Though 132 KV double cir- cuit transmission line from Rajouri to Draba was restored after more than three years in May 2016 at a cost of Rs 2.81 crore, the work on 132 KV sin- gle circuit transmission line from Draba to Chandak has not begun till date. Since the power supply from Grid Station Chandak was not possible in view of the damage to the transmission line, the Grid Station Draba was augmented from 1*20 MVA to 2*20 MVA capacity under National Disaster Response Fund (NDRF) and the power supply to the affected areas was restored through 33 KV lines, sources said while dis- closing that this was only tem- porary measure and was not suf- ficient for providing dependable electricity supply to the vast area of the border district. Security forces today busted amilitant module with thearrest of three militants fromKulgam area of Kashmir andInspector General of PoliceMuneer Khan said that thenumber of militants in

Kashmir has decreased withcontinued successful opera-tions.

Khan said that three militants- two from the Lashkar-e-Toiba(LeT) and one from the HizbulMujahideen -were arrested overthe past three days from SouthKashmir.

"On October 14, two terror-ists with the intention to snatchweapons of personal securityguards of a protected personfired few rounds at Kund in

Qazigund area.But they had tobeat a retreat due to hue and cryraised by locals," Khan told apress conference here.

He said on receipt of thisinformation, a joint party of thepolice, Army and the CRPFestablished a check point andnabbed the two militants, whowere riding on a motor cycle.

"They were identified asKhursheed Ahmad Dar and HaziqRather.One pistol, some ammuni-tion and a live grenade wererecovered from their possession.They belong to LeT," he added.
