ELECTION OF OFFICERS FOR 2019 Director Botelho was nominated as Chair of the Authority. Director Bilicich was nominated as Vice Chair of the Authority. Motion made by Director Wasserman, seconded by Director Varela to elect Director Botelho as Chair and Director Bilicich as the Vice Chair of the Authority. Motion passed unanimously. Director Caput passed the gavel to Director Bilicich incoming Vice Chair.

6. PRESENTATION A. Draft Audited Financial Statements for FY 2017-2018 Luis Najera, Moss, Levy & Hartzheim, LLP, presented the draft audited financial statements for FY 2017-2018. Mr. Najera reported that the Authority received an unmodified clean opinion and there were no findings. 7. CONSENT A. Minutes of the November 2, 2018 Board of Directors Meeting The minutes of the November 2, 2018 Board of Directors meeting was approved. B. Approval of Payment to Gutierrez Consultants The invoices for services rendered by Gutierrez Consultants from October 2018 – December 2018 were approved. C. Approval of Payment to RAPS, Inc. The invoices for services rendered by RAPS, Inc. from October 2018 – December 2018 were approved. D. ABC Law Firm Invoice The invoice for services rendered by ABC Law Firm was approved. E. Financial Update Report The financial update report was accepted. Motion made by Director Wasserman, seconded by Director Varela to approve the consent agenda. Motion passed unanimously. 8. ITEMS REMOVED FROM CONSENT CALENDAR FOR DISCUSSION AND POSSIBLE ACTION None. 9. PLANNING A. Pajaro River Flood Risk Reduction Project Status Report Mark Strudley, County of Santa Cruz reported that they are nearing the completion of the feasibility phase of the project. They are still on schedule with the Corps to receive the feasibility report and Directors Report by the end of March 2019. Staff will work on bringing together past board members to celebrate the release of the Directors Report. Dr. Strudley

added that there is still a lot of work ahead. The project currently does not have Work Plan funds from the Corps to carry the project forward until the next federal fiscal year cycle. Staff is hard at work continuing to build a case for federal investment in the project. Staff is also working on the application with the State for Subventions funding. Staff has gotten positive responses from officiating staff with the Subventions Program that they will receive a high cost share from them. This is mainly due to the disadvantaged communities that are present along the river, as well as the protection of State facilities within the project. Staff is also continuing to work with Congressman Panetta’s office, Senator Feinstein’s office, and Senator Harris’ office to figure out ways to get appropriations and federal support for the project. Dr. Strudley reported that the Zone 7 Santa Cruz County Flood Control and Water Conservation District Board awarded a contract for a Program Management consultant for the project. Staff will host a kick off meeting within the next week. The Program Management consultant will support the governance and finance strategy for the project, as well as engineering review of the design and hydraulic modeling to support the Corps once they get back to work. RECOMMENDATION:
Staff recommends that the Board approve the attached letter to Rabobank
updating check signing authority for PRWFPA’s bank accounts as detailed
below.
BACKGROUND/DISCUSSION:
PRWFPA requires two signatures on all bank drafts. PRWFPA has not
changed its signature authorization since April 2016. Due to changes in the
PRWFPA Board of Directors, the following individuals should be given access

SUBJECT: Financial Update Report
MEETING DATE: April 5, 2019
RECOMMENDATION:
It is recommended that the Board of Directors accept the financial update
report.
BACKGROUND/DISCUSSION:
Regional Analysis & Planning Services, Inc. (RAPS) provides contract
staffing services to the Pajaro River Watershed Flood Prevention Authority
(PRWFPA). The contract includes administrative and financial services for
the Board as well as the Staff Working Group (SWG). The monthly financial
reporting, budget preparation and audit assistance fall within RAPS, Inc.
duties. The Board packet includes the year-to-date financial reports through
February 28, 2019 as well as a budget-to-actual comparison for fiscal year
(FY) 2018-2019. Amounts in the financial update report are unaudited.
The Balance Sheet reflects a cash balance of $679,792.58. There were no
accounts receivables outstanding as of February 28, 2019.
The current liabilities balance is $11,398.55. PRWFPA has sufficient current
assets on hand to pay all known current obligations.

During the period of July 1, 2018 through February 28, 2019, PRWFPA
incurred routine operational expenditures for contractual services. The
services provided are summarized as follows:
RAPS, Inc.: Staff Working Group (SWG) agenda preparation and
meeting attendance.
Gutierrez Consultants: Work associated the Open Space Authority
(OSA) lease agreement, the Gonzales sale, high speed rail, attended
meetings in Washington DC and SWG meeting preparation and
attendance.
Atchison, Barisone & Condotti: Ongoing legal services consisting of
OSA lease agreement review, comment and revision and review of
the Gonzales sale.
Expenses for the period of July 1, 2018 through February 28, 2019 totaled
$56,591.47, which included professional services, and other expenses.
PRWFPA’s Profit and Loss Statement reflects an excess of revenue over
expense of $9,624.54 for the period July 1, 2018 through February 28, 2019.

SUBJECT: California Department of Water Resources Flood
Emergency Response Grant for Rainfall
Monitoring Equipment
MEETING DATE: April 5, 2019
RECOMMENDATION:
It is recommended that the Board of Directors approve a payment of $20,000
to the Santa Cruz County Flood Control and Water Conservation District to
support the purchase of enhanced rainfall monitoring equipment.
BACKGROUND:
On January 29, 2018, the Santa Cruz County Flood Control and Water
Conservation District (District) submitted a $1.18 million grant application to
the Department of Water Resources (DWR) for funding from the Statewide
Flood Emergency Response Grant for 100 percent of the funding needed to
purchase, install, and configure enhanced rainfall monitoring equipment.
DWR has proposed supporting 75% of the funding needed for this equipment
and service, therefore requiring a 25% local match. The District has accepted
this award, but to do so the District has been seeking regional partner
contributions to help meet the local match requirement.
Because of the regional benefit of enhanced rainfall monitoring equipment,
and particularly the advanced warning this data would provide to Counties to
the east and south of Santa Cruz County, on June 1, 2018 your Board
approved a match contribution of $20,000 to assist the District in accepting

the grant award. The grant funding will be used for the purchase, installation, and
configuration of enhanced rainfall monitoring equipment. The equipment will be able
to monitor storm systems in very high resolution off the Pacific and over northern
San Mateo County, Santa Cruz County, western Santa Clara and San Benito Counties,
and northern Monterey County in real-time. This new service would offer a unique
resource for flood response as well as water supply and stormwater management. As
an affected agency and regional partner in identifying flood protection measures in
the watershed, the Pajaro River Watershed Flood Prevention Authority (FPA)
submitted a letter of support and commitment to participate in meetings and
workshops, as needed, to support the development and implementation of the rainfall
monitoring equipment (Attachment 1).
DISCUSSION:
On February 22, 2019, the District returned a signed copy of the grant agreement to
the Department of Water Resources. Once DWR signs the grant agreement and
returns the signed agreement to the District, work can begin to plan and implement
the installation of rainfall monitoring equipment. Equipment consists of a state-of-
the-art X-band weather monitoring radar that would operate from the top of the
Santa Cruz County administration building in the City of Santa Cruz. Initial tasks
include engineering and radio-frequency studies to ensure a proper installation that is
safe and effective. The District expects these studies to proceed through Summer
2019, with procurement and configuration of the monitoring equipment in Fall and
Winter 2019-2020. The project schedule describes equipment installation occurring
in Summer 2020, followed by calibration and operational testing. This last phase will
introduce initial capabilities to the FPA staff and other interested parties, culminating
in public release of web resources to view the data.
FINANCIAL IMPACT:
Approval of the match contribution at the June 1, 2018 Board meeting added a line
item expenditure of $20,000 in the Fiscal Year 2018-19 PRWFPA budget.

This letter is in reference to an application being prepared by the Santa Cruz
County Flood Control and Water Conservation District (District) for funding to
improve flood emergency response programs in the Central Coast region. The
District is requesting funding under the Statewide Flood Emergency Response
Grant for the purchase, installation, and configuration of enhanced rainfall
monitoring equipment. The equipment will be able to monitor storm systems in
very high resolution off the Pacific and over Santa Cruz County in real-time,
offering a unique resource for flood response as well as water supply and
stormwater management. The real-time data will be available to the public in a
format useful for practitioners as well as community members.
The Pajaro River Watershed Flood Prevention Authority (FPA) appreciates the
opportunity to support and cooperate with the District’s critically needed Flood
Emergency project. The FPA was established by the California State Legislature
in 2000 to “identify, evaluate, fund and implement flood prevention and control
strategies in the Pajaro River Watershed on an intergovernmental basis.” The
Pajaro River watershed encompasses a 1,310 square mile region terminating in
the Monterey Bay. The FPA is made up of the four counties and flood
management agencies in the watershed, including:

The geographical nature of the watershed made it critical that a Joint Powers

BACKGROUND:
As reported at the February 1, 2019 Board meeting, the Army Corps of
Engineers (Corps) Pajaro River Flood Risk Reduction Project (Project) is
moving through the final stages of the Feasibility phase. An integrated
General Reevaluation Report/Environmental Assessment (GRR/EA) and
signed Corps’ Director’s Report are expected to be completed by April 2019.
In parallel with the Corps project development, the Non-Federal Sponsors
continue to complete the local project development responsibilities. In
January 2019, the Santa Cruz County Flood Control and Water Conservation
District, Zone 7 authorized a contract with Peterson Brustad, Inc (PBI), to
perform Program Management (PM) consultant services in support of the
Project. Additionally, on September 18, 2018, Zone 7 authorized contracting
with Cardno to complete the CEQA Environmental Review process and
develop a Final Environmental Impact Report (EIR) for the project and award.

Additionally, the Non-Federal Sponsors continue to work on gaining political and
financial support for the Project. In March 2019, Santa Cruz County Supervisor
Friend and Monterey County Supervisor Phillips sponsored a resolution for
consideration by the National Association of Counties. Zone 7 staff continues to work
closely with State Subventions staff to clarify the cost-share participation from the
Department of Water Resources.
DISCUSSION:
CEQA Compliance
The Cardno CEQA contract includes re-scoping the Project and public scoping
meetings, production of a Notice of Preparation, wetlands delineation, and production
of draft and final EIRs. Zone 7 is integrating the Cardno CEQA efforts with the PBI
program management scope. This coordination will ensure a successful public
outreach campaign as well as speedy completion of CEQA review by leveraging
technical work products developed by PBI. CEQA scoping is anticipated to begin in
May 2019.
Program Management
The PM project team kick-off meeting and field visit were held on February 27, 2019
to initiate the work plan to be performed by the PBI consultant team. Initial work
conducted by the consultant team includes data and document review, data
collection, review of Corps hydraulic modeling, and development of financial and
cash flow modeling to support the project. As stated above, PBI is also interfacing
with Cardno to support technical work required of the CEQA review process.
The PM work will begin immediately with the reconvening of the Pajaro Finance and
Governance Committee (Committee). In October 2016, Pajaro Finance and
Governance Committee activities were placed on hold pending the Corps’ completion
of the GRR/EA. At that time, the Corps’ timeline for completion had slipped by
nearly a year and it was unclear when that major milestone would be accomplished.
As a result, the Non-Federal Sponsors put on hold the Committee’s decision about a
regional governance structure to cost-share and implement the federal Project.
Although we still face significant challenges, we remain optimistic about
opportunities for project implementation following the scheduled completion of the
GRR/EA and signed Director’s Report. With that in mind, the Non-Federal Sponsors
are reconvening the Committee. At the first meeting, Committee members will be
provided an update on the project status and federal process, discuss next steps for
regional governance and local financing, and establish a schedule for future meetings.

A finalized GRR/EA accompanied by a signed Director’s Report will be released by
April 2019. As previously reported, funding for the Project was not included in the
Corps’ FY 2019 Work Plan. Despite an absence of Project funds within the Corps,
staff has insisted on regular communication with San Francisco District Corps
leadership to discuss project status and investment prospects. As we move through
early calendar year 2019, the Corps will be proposing capabilities through the federal
budget approval process for the Project. If funds are awarded to the Project, it will
most likely originate from a Federal FY 2020 Work Plan request. A FY 2020 Work
Plan capability would not be awarded until at least November/December 2019,
following the 60-day capability request formulation period after the FY 2020 federal
Corps budget is approved. The lapse in Federal funding will delay the start of Pre-
Construction Engineering and Design.
National Association of Counties (NACo) Support
In early March, Santa Cruz County Supervisor Friend and Monterey County
Supervisor John Phillips sponsored a resolution brought before the Environment,
Energy, and Land Use (EELU) Steering Committee of the NACo. The resolution
invites NACo’s interest in amending their policy platform to include urging the Corps
and the Office of Management and Budget to use a more holistic approach in
determining the benefits of federal investments for protection of areas at risk for
flooding. A copy of the resolution, which was adopted by the EELU Steering
Committee and which will be brought before the NACo for consideration at the
NACo annual meeting in July 2019, is attached. A voice from NACo on this topic is
very important for the Project.
Subventions Authorization
Zone 7 staff continues to work closely with State Subventions staff to clarify the cost
share participation from the Department of Water Resources. Mapping analysis is
ongoing in support of our Non-Federal Cost Share Report which will substantiate
project benefits to three State transportation routes as well as State-designated
disadvantaged communities within the proposed project benefit area. Initial analysis
suggests the State will cost share at the maximum allowable level of participation.
Assembly member Mark Stone continues to assist the District in this endeavor, and a
proposed bill (AB 489) is circulating through committees that could secure a maximal
cost-share commitment from the State. Staff greatly appreciates Assembly member
Stone’s assistance in securing investment from the State in our project.
FISCAL DISCUSSION
The financial impact of the federal Pajaro River Flood Risk Reduction Project has a
long history of documentation and associated planning. All efforts described in this

status update are aimed at obtaining Federal and State investment in the flood risk
reduction project. Any delays in the production of the Feasibility Report imply
additional costs to the local Sponsors in terms of staff time spent managing the
process. There is no financial impact to the Flood Prevention Authority.
