WJ:J.ereas Miss Baby J. Phadte was working as a Part-time Asstt. Teacher in Vijayanand High School, Maem, Bicholim from 10-11-1986.

And whereas the Management of Vijayanand High School, Maem, terminated her services vide their office letter, No. VHS/P.B.JP/89-90 dated 4-6-1989 on the, ground that her. se...""Vices were found !slurplus.

And whereas the said Miss Baby J. Phadte vide her representation dt. 12-6-1989 complained that she has· been illegally terminated.

And whereas. the investigations carried out by this office revealed that in.ternal adjustment of divisions has been approved' under this office letter No. DE/ Acad.I/NEZ-Bi/ /7/100/88-89/Vol. IV 1958 dt. 23-6-89 permitting to maintaln the 12 divisions during 1989-90' and therefore the· number of divisions remained the same and therefore there was n.o cause for reduction in establishment .

And whereas the admissibility of staff during 1989-90 was also conveyed vide this office letter No. DE/Acad.I/ /NEZ-Bi/7/100/88-89/Vol. IV /2511 dt. 28-7-89, 'and the said admissibility of staff was based on the information furnished by the school Authorities vide their office letter No. VHS/ /P.EV /89-90/159 dated 8-7-1989.

And whereas it is also clarified that the said admissibility of staff was in conformity and in accordance with the amendment of Rule 80 vide notification No. DE/ Acad. 1/ /Misc/Lab/Asstt. 396/76/VoI. III/786 dated 10'-3-1988 whereby the school, was held admissible for a full time teacher post as against the part time teacher' post.

And whereas the examination of the case revealed that :it was possible to regularise the services of Miss Baby J.' Phadte against, the available vacancy arid accordingly the instructions were issued.

And whereas instructions were also issued under this office letter No. DE/ Acad. I/NEZ-Bi/7 /100/88-89/Vol. IV /63 dated 4-1-90 to regularise the serviCeS of Miss Baby J. Phadte against the saId vacancy of full time teacher and to withdraw the illegal termination order within 15 days.

And whereas reminder was issued under thL office. letter No. DE/ Acad. II NEZ-Bi /7/10'0/88-89/ Part. IV /540 dated 22-3-1990'.

An,d whereas inspite of the instructions issued from time to time the Management of the said school failed to comply with the instructions .issued, and the Government has decided to invoke the provision of section 20 of Education Act, 1984 and in accordance with the said prOVisions issued a Show Cause Memorandum No. DE/ Acad. I/NEZ~Bi/7 /100/ /88-89/Vo!; IV /2741 dated 12-9-1990' ,calling upon the said Management to show cause within 15 days of the receipt

of the said memorandum as to why the said school should not be tak~n over for a . period' of 3 years in the public interest an,d in· the interest of school education alld also inorder to secure a proper Management of the said school by invoJdng the provision of section 20 of Goa; Daman and Diu School Education Act, 1984.

And whereas the Managelnent subinitt~d their reply dated 4-l:0-1990 and the same has been duly scrutinised and the observations ar.e as follow:

1. Instead of properly explaining their case iIi the first instance, the school authorities have tried to caste aspersions on the officers of this Department for taking up this case. This is ,highly objectionable and

. unwarranted. The official correspondence from the school authorities lacks courtesy required in official correspondence.

2. Miss Baby J. Phadte was. appointed as Asstt. teacher (undergraduate categor-y) on part time basis w. e. f. 10-11-1986, her services have b.een, terminated even when the Department has permitted the retension of the number of divisions' 1. e. 12 divisions in 89-90 and also 90-91. The . submission of the management in their reply dated 4-1-1990 to the show cause_noUce stating that the Department has not permitted 12 divisions is not maintainable because this. office letter dated 23-6-1990 was in supersession 0:1; the earlier letter dated 31-5-1990 and 22-6-1990 in which typing errors were noticed. Otherwise the' detention of 12 divisions is as per the prescribed norms under Rule 32 of the Education Rules, 1986. As such there is no malafide involved.

3. The submission that th.e request from the Headmaster of the school dated 23-6-1989 for Science Graduate post has been ~lUmmarily denied is' not correct because, consequent upon the permission granted vide this office letter dated 23-6:1989 the admissibility of staff was assessedan,dcommunica~ tion vide. this office letter dated 28~7-1989 is as follows: -

Therefore, i) Part time post to be converted into full time and services of incumbent to be regularisecl

It is therefore, obvious that additional post is Graduate Category/could not be permitted. It was also not permissible to grant subjectwise teacher i. e. (science teacher) sinc~l the qualified undergraduate teachers are expected to teach' all

. the subjects upto std. VII.

The Management has failed to comply with the instructions issued vide this office letter dated 4-1-1990 and reminder dated 22-2-1990. . . .

And therefore Government is not satisfied with the reply from the Management to this offIce memorandum No. DE/ /Acad~ I/NEZ-Bij7/100/88-89/Vol. IV /2741 datlld 12-9-1990, an,d therefore Government has decided to take over the mana

,gemerit of the school with immediat~' effect in terms of sub:-sectlpn l(H) of Section 20 of the School Education Act, 1984 for'the period of 3 years in the first instance.

2. All persons interested in the said land are hereby warned not to obstruct or interfere with any surveyor or othel' persons employed upein the said land for the purpose of the said acquisition. Any contract for the disposal of th~ said .land by sale, lease, mortgage assignment, . exchange or otherwise or any outlay commenced or improvements made thereon without the sanction of the Collector appointed under paragraph.4 below, after the date of the publication of this Notification, will under clause (seventh) of section 24-of the. said Act, be disregarded by him while assessing compensation for such parts of the said land as may be finally acquired.

If the Government is satisfied that the said land is ,needed for the aforesaid purpose, a declaration to that effect under section 6 of the said Act will be published in the Official Gazette arid in two daily newspapers and public notice thereof shall be given in due course. If the acquisition i~ abandoned wholly or in: part, the fact will also be notified in the same manneT.

section 3 of the said Act the Speciale Land Acquisition Officer (Konkan Railway Line) South Goa Margao to perform the functions of a Collector under the said Act in respect of the said land.

(1) The Presiding Officer is entitled to a fix salary @ Rs. 3,000/- (Rupees three thousand only) per month plus fixed Travelling Allowance of Rs. 480/- per month for minimum of 20 days s!ittings per month.

(2) If the number of sitting are less than 20 an amount of Rs,. 150/- perSiiting will be deducted.

(3) The standard rent shall be paid for Government residential accommodation alloted to the Presiding Officer.. __

(4) A residential telephone will be provided to the Presiding Officer at Government cost.

In exercise of the powers conferred by section 90 read with section 91~A of the 'Employees' State Insurance Act, 1948 (Central A.ct 34 of 1948) (hereinafter called the "said Act"), the Government of Goa, after consultation with the Employees' State Insurance Corporation and, on being satisfied 'that the employ~es of the Goa Tourism' Dev.elopment Corpo_ ration Limited, Panaji-Goa (hereinafter called the ,"said establishment") are otherwise in receipt of benefits substantially similar to the benefits provided under the said Act, hereby exempts the said establishment from the operation of the said. ~ct with effect from 30-3-1982, subject to, the foUo~ng conditions, namely:-

(1) The said establishment shall maintain a register showing the names and deSignations o.f·the exempted employees;

(2) Notwithstanding this exemption, the employees' shall continue; to receive such benefits under the said Act

to which they might have become entitled to on the basis of the contribUtions paid prior to the date from which exemption granted by this notification operates;

(3) The contribution for the exempted period, if already paid shall not be refunded;

(4) The em'ployer of the said establishment shall submit in respect of the period during which that establishment was. subject to the operation of the said Act (hereinafter referred to as the 'said period'), such returns in such form and containing such particulars as were due from it in respect of the said period under the Employees' State Insurance (General) Regulations, 1950;

('5) Any inspector appointed by the Corporation under sub-section (1) of section 45 of the said Act, or other official of the Corporation authorised in this behalf shall for the purposes of-

(i) verifying the particulars contained in any return submitted under sub-section (1) of section 44 of the said Act for the said period; or

(ii) ascertaining whether registers and records were maintained as required by the Employees' State Insurance (General) Regulations, 1950 for the said perio_d; or

(iii) ascertainIng whether the 'employees continue to be entitled to benefits provided by the employer in cash and kind being benefits in consideration of which exemption is being granted under this notificatIon; or

(iv) ascertaining whether any of the provisi:ons of the said Act had been complied with during the period when such proviSions were in force in relation to the said establishment be empowered to-

(a) require the prinCipal or im'mediate employer to furnish to him such information as he may consider necessary; or

(b) enter any'es'tablishment, office or other premises occupied by such principal or immediate employer at any reas'Onable time and require any person found incharge thereof to produce to such, inspector or other official ap,d allow him to examine such accounts, books and 'Other documents relating to the employment of persons and payment of wages or to furnish to him such information as he may consider necessary; or

(c) examine the p'rincipal or immediate employer, his agent, or servant, or any person found in such esta,blIshment, office or any other premises or any person whom the said inspector Oft1 O'thev official has reaeonable causel to' believe' to have been an employee; or

(d) make copies of or take extracts from, any register, account book or other document maintained in such establishment, office or other premises.
