The Government of Goa, in supersession toall previous Notifications published in theOfficial Gazette in this behalf, hereby makesthe following rules, namely:—

1. Short title and commencement.— TheseRules may be called the Goa MediaRepresentatives Accreditation Rules, 2012.

2. They shall come into force from the dateof their publication in the Official Gazette.

3. Definition.— In these rules, unless thecontext otherwise requires:—

(a) “Government” means the Governmentof Goa;

(b) “Member Secretary” means theDirector of Information & Publicity of theGovernment;

(c) “Newspaper” means any publication,printed and distributed at fixed intervals,which contains news and comments ofpublic interest as defined in the Press andRegistration of Books Act (25 of 1867) butnot a publication containing information ofsectional interest such as house journals;

(d) “State” means the State of Goa;

(e) “Working Journalist” means a workingjournalist as defined in the WorkingJournalist and other Newspaper employees(Conditions of Service) and MiscellaneousProvisions Act, 1955 (45 of 1955), asamended from time to time;

4. Amendment to rules.— These rules maybe amended/altered/modified/added to, onthe recommendation of the Committee, if aproposal to this effect is made to the Committee,by at least three of its members or the MemberSecretary.

5. Application of rules.— These rules shallapply to the accreditation of mediarepresentatives to the Government.

(i) Accreditation: Recognition granted toR e p o r t e r s / C o r r e s p o n d e n t s / E d i t o r s //Cameramen of Media organizations (asdefined in sub-clause 4) to have access tonews materials, written and pictorial; to officesand officers of the Government at theHeadquarters and other centre for gatheringnews; access for laws, rules, notifications,press releases, background papers, etc., of theactivities of the Government; for invitations andadmission without any hindrance to functions,press conferences, statutory events and otheractivities of the Government; facilities in termsof travel, research, documentation etc.,relating to news gathering. The Accreditationshould be available throughout the State, asdecided by the Committee.

( i i ) Correspondent/Reporter/MediaRepresentative: A working Journalistemployed by a newspaper, magazine, newsagency, television channel, radio organizationor news portal, together and file news itemsregularly for the newspaper, magazine,television channel, radio organization or newsportal, as defined in clause 2 (iv) of these rules.The definition of Working Journalist for printmedia, including newspapers, magazines andnews agencies, shall be generally the sameas the definition in the Working Journalist Act.

(iii) Cameramen: Still and Television

cameramen employed by media organizations

for taking picture or Videograph news events.

(iv) Editor: Editor of a newspaper,magazine, television channel, radioorganization, news portal, who is in chargeof news selection and editorial policy ofthe organization, including Chief Editor,Editor-in-Chief, Managing Editor, ExecutiveEditor, Resident Editor.

(v) Media Organization: Newspaper,magazine, television channel, radioorganization, news portal, recognized by

Government of Goa under relevant laws andrules like PRB Act, up linking Guidelines forTelevision Channels, Prasar Bharati Act, DFP,PIB, Department of Information & Publicity, etc.

(vi) News Media: Shall include newspapers,wire service and non-wire service, newsagencies, news feature agencies, electronicmedia agencies, news portals containing newsand comments on public news.

(vii) Newspaper: Shall have the samedefinition as given in the Press andRegistration of Books Act, 1867. A Dailynewspaper shall be published on not less thanfive days in a week; A Weekly or Fortnightlynewspaper shall have not less than 42 or 22issues in a year respectively. A monthly shallnot have less than 10 issues in a year.

(viii) News Agency: Shall be wire and nonwire organizations which supply news on aminute to minute or daily basis to a number ofmedia organizations, both print and electronic.It should be registered under Shops andEstablishment Act, Companies Act, etc., atthe time of commencement and its standingshould be more than 3 years in the State ofGoa.

Agency shall have minimum 3 payingsubscribers from among accreditednewspapers and media units in the State.

(ix) News Feature Agencies: Shall beagencies which supply news and featuresbased on current affairs to newspaperorganization on a weekly or fortnightly basis.It should be registered under Shops andEstablishment Act, Companies Act, etc., atthe time of commencement and its standingshould be more than 3 years in the State ofGoa.

– Agency shall have minimum 3 payingsubscribers from among accreditednewspapers and media units in the State.

– The applicant shall submit clippings ofthe articles by concerned news feature

agency published in different news-papers/magazines of the State for aperiod of 3 months prior to the date ofapplication for accreditation.

(x) Radio Organization: Means any mediaorganization which broadcast news bulletinsand carries current affairs programmes,including All India Radio which operatesunder the Prasar Bharati Act.

(xi) Television Channel: (a) Shall have thesame meaning as News and Current AffairsChannels permitted under Guidelines of theMinistry of Information and Broadcasting. Thisincludes the news channels of Doordarshanoperating under the Prasar Bharati Act.

(b) Include TV Service providers operatingin Goa and having news telecast of maximum3 hours per day. The organization running thechannel should be registered with theGovernment either under Companies Act,Shops or Establishments Act, etc. Its standingshould be more than 3 years in the State ofGoa.

(xii) Television and Radio News Agency:Shall be media organizations which providesnews clips and feeds to television channels andradio stations.

– It should be registered under Shops andEstablishment Act, Companies Act, etc.,at the time of commencement and itsstanding should be more than 3 years inthe State of Goa.

(xiii) News Portals/news service providers:Are news and current websites which providecontinuous news coverage and current affairsfeatures for minimum period of 02 years.

– Only news portals run by entities dulyregistered under Companies Act, Shopsand Establishment Act, etc., shall beconsidered for the accreditation.

– Its articles should be on current social,political, economic and other matter ofpublic interest.

6. Accreditation Card: The Director ofDepartment of Information & Publicity,Government of Goa who also function asMember Secretary shall issue a photo identitycard to all reporters/correspondents/news//cameraman/videographers and editors towhom the accreditation is granted by theCommittee, and whenever necessary, the cardshould have authorization to enter all premisesof the Central and State Governments, withoutany requirement of obtaining visitor pass.

7. Committee: Committee formed by theGovernment for considering and sanctioningof Accreditation, and to recommend stepsfor facilities for news gathering byaccredited correspondents and newsorganizations.

8. The Press Accreditation Committee: Shallbe a permanent organization, whosemembership will change every two years.There shall be no discontinuity in thefunctioning of the Committee and it shall bethe responsibility of the Government to ensurethat the nomination of fresh members is notifiedbefore the term of the earlier team expires. Incase the Government is unable to nominatethe new members, the old committee willcontinue until the new committee isconstituted.

9. (a) The Press Accreditation Committee

shall consist of not less than 10 members,

representing various recognized mainstream

media organizations.

(b) The Accreditation Committee formed bythe State Government shall have 03Representatives of the Editors Guild, 08Representatives of Goa Union of Journalists//out which 04 shall be from print media, 01shall be a news photographer, 02 fromElectronic Media, (one cameraman and onenews gatherer) and 01 Sports Reporterpreferably recommended by the respectiveorganization.

(c) No member shall continue for more thantwo consecutive terms.

10. The Director of Information & Publicity

shall be Member Secretary. The Member

Secretary shall be responsible for convening

the meetings of the Committee, scheduling the

agenda and for implementing the decisions of

the committee. The Joint Director of

Information and Publicity shall assist the

Member Secretary. Both shall have no right to

vote.

11. The Chairman of the Committee shall be

a senior journalist, who shall be elected by the

committee through a majority vote. The

Chairman shall have minimum 10 years

experience as Working Journalist (preferably

accredited) and shall be ineligible for a second

consecutive term.

12. The Committee shall meet once in a

month, last Friday, if not feasible 1st Friday of

following month or more frequently, if

considered necessary. The quorum shall be

50 percent of the total membership.

13. The Committee shall admit

newspapers, news agencies, magazines, TV

channels, radio organizations, news portals

provided they fulfill the basic criteria of

providing contemporaneous news to their

readers, subscribed, viewers, listeners as the

case may be. They should carry at least 50 per

cent of its contents as news/comments of

general public interest. The decision of the

Committee on whether the applicants carry

50 per cent of content as news is final. These

organizations must be functioning as news

organization for a period of at least six months

before they are eligible for accreditation as an

organization. However, if a publication

changes the periodicity of publication but

continues to carry minimum 50 per cent of

contents as news, current affairs comments of

general public interest, then its admission shall

continue.

– The nature of the content published/

/telecast shall be responsible, impartial

and non-communal in nature.

14. However, if the Committee isunanimously satisfied that news organizationneeds temporary accreditation from the day itstarts the operations, then the Committee maygrant few accreditation to the applicantorganization.

15. (a) The newspapers registered, printedand published in Goa are entitled for 03reporters, 01 sports reporter, 01 newsphotographer based at headquarter at Panajiand 01 reporter, 01 news photographer and01 sports reporter in South.

(b) TV service providers operating inGoa shall be entitled for Press accreditationto two reporters and two camerameneach.

(c) Periodicals like monthlies, fortnightliesand weeklies are entitled for Pressaccreditation to one reporter and one newsphotographer.

(d) Media Organizations like PIB, DDK, DIP,FPO, AIR shall be entitled for two reportersand two Photographers/Videographers.

16. Effect of accreditations: (1) Accredi-tation does not confer any official status on themedia representatives but shall recognize andidentify him/her as a professional journalistdealing with news of public interest. He/sheshall not have letter heads, visiting cards anddisplay boards with the words “Accreditedto the Government of Goa” or any words tosimilar effect.

(2) Accreditation shall be used forjournalistic purpose and for no other purpose.

17. Accreditation is Personal: Accreditationis personal and not transferable.

18. A minimum of three years experience ata stretch in prominent News Organization, isrequired to consider the application of anE d i t o r / R e p o r t e r / C o r r e s p o n d e n t //Photographer/TV Cameraman/Media Officialfor accreditation to the Government of Goa.

The journalist seeking accreditation shallfurnish the prescribed application form dulyfilled authenticated by the editor along withthe company letterhead signed by the editorand enclose appointment/contract letter//latest salary slip/proof of birth. Appointmentshould be of full time journalist.

19. For the purpose of accreditation, Editorshould be considered as being engaged in thenews gathering and should be givenaccreditation. The Committee shall satisfy itselfthat the applicant is fully employed in the newsorganization by asking for the news clippings,video clips, radio clips etc., apart fromemployment certificate, a certificate from thepublisher that the applicant is engaged in thenews reporting. The accreditation of editorshall be recommended by the publisher. TheCommittee shall not give accreditation toadvertising or sales persons who put in a claimthat they are also correspondents.

20. On satisfaction that the applicant meetsthe criterion to be an accreditedcorrespondent, the Committee shall permitgrant of accreditation, subject to the availabilityof the quota of the news organization.

21. The Member Secretary shall issue theaccreditation card for journalist within afortnight of the date of approval by theCommittee. The fee of Rs. 150/- perAccreditation Card shall be paid by thejournalist, subject to revision. In case ofduplicate/renewal of accreditation card thejournalist will have to pay additional fee ofRs. 150/-.

22. In case the Committee rejects theapplication of a media, organization, or ajournalist on behalf of a media organization foraccreditation, then the applicant organization//individual shall be informed the reasons forrejection in writing within a fortnight. Theapplicant organization/individual can makeamends or place other relevant facts before theCommittee for reconsideration within amonth’s times on receipt of letter from MemberSecretary. However, the Committee’s decision,after such reconsideration, shall be final.

23. The Committee can grant accreditationto senior journalists, who are freelancing,provided they have been continuously workingfor news organization for last 25 years, providedthey show evidence that their main vocationis of journalism and that they are earning theirlivelihood through journalism.

24. The Committee may grant specialaccreditation to journalists on application inprescribed form, self authenticated who havedone a long and distinguished service asaccredited correspondents provided they areabove 58 years of age and were accredited forminimum period of 15 years; and are activelypursuing journalism at the time of recognitionof their services. The accreditation issued inthis category is only a recognition and shallnot accrue any benefit as extended to regularaccredited journalist.

25. The accreditation cards issued toE d i t o r s / R e p o r t e r s / C o r r e s p o n d e n t s //Cartoonists/News photographers/TVCameramen, etc., shall be valid for a period oftwo years. Under the general directions of theCommittee, the Member Secretary shall renewthe accreditation of all accredited journalistsonce in two years, ensuring that theaccredited journalist is not deprived of thefacility even for a single day. The Committeeshall consider/treat as cancelled theaccreditation card of accredited journalistwho fails to renew the same within period of30 days.

26. In case a correspondent/reporter

who work for more than one organization,

and requests for additional accreditation,

the Committee may not entertain

such applications to grant additional

accreditation.

27. All Government Ministries, Department,undertakings and other wings shall provideaccess and information to accreditedjournalists, and they shall not discriminateamongst accredited journalist fordissemination of news.

28. The Committee shall withdraw theaccreditation, provided:

– The Editor informs the committee that thejournalist has reassigned within theorganization.

– The Editor informs the Committee that thenews organization has closed down/or isno longer carrying 50 per cent contentas news.

– The journalist is no longer an employeeof the news organization.

– If a journalist has been censured at leasttwice by the Press Council of India forprofessional misconduct.

– If the Committee were to come to theconclusion that the journalist has madegross misuse of the accreditation facility,then he shall be given an opportunity toanswer the charges, and the Committeeshall record its reasons for withdrawal ofaccreditation.

29. Provision: As journalists enjoy theprotection of the Constitution, theAccreditation Committee shall ensure that theaccreditation is not cancelled for any malafideor frivolous reason by the State Governmentor any politician or official who have a grudgeagainst journalists publication news whichmay be unpalatable. No media organization orjournalist shall be deprived of accreditationmerely on the ground that he had publishedwhat was claimed to be an official secret, orthat he has published reports which areunfavourable to the Government or itsMinisters or Officials.

(a) Apart from considering applicationsfor grant and withdrawal of accreditation bynews organization and journalists, theCommittee shall discuss and recommendmeasures for providing additional facilitiesto news organizations and journaliststo improve the quality of newsdissemination.

(b) Editor/Journalists deputed by editors

of newspapers, magazines, news agencies,

television and radio organization, news

portals who are accredited by a State

Accreditation Committee shall be

considered eligible for accreditation to the

Government of India as its headquarters in

New Delhi and offices in State capital/s, even

though they may not be residing in the

National Capital Region, with a view to

ensure that the news relating to

Government of India is disseminated in all

regions and Editors/accredited journalists

from all over India have access to

Government of India’s offices.

30. Government media organization viz.—

The Department of Information & Publicity,

Press Information Bureau of Government of

India, News Services Division of All India

Radio, the News unit of Doordarshan, the Photo

Division of Government of India may be

deemed as equivalent to experience the work

in a news media organization for the purpose

of accreditation. Those officers having

experience of Journalistic Work in Media Unit

of the Information and Publicity Department

of the State Government other than those

referred to above, may also be considered for

the purpose of accreditation, if the Committee

would be satisfied about their journalistic

experience.

31. Accreditation card for press

representative.— (1)Accreditation card

bearing a passport size photograph of the

media representatives will be issued to an

accredited media representative by the

Member Secretary.

(2) The accreditation card will normally be

utilized for attending press conference

convened by the Government, or any

authorized Government Officer and for entry

into Government Offices.

(3) The accreditation card shall not be

admissible for attending special functions or

conferences, where entry is covered by special

invitation cards and security passes.

(4) The accreditation card will entitle the

holder to receive the facilities provided to him/

/her by the Government from time to time in

respect of medical, transport, housing,

Government accommodation in the State of

Goa.

32. Power of Government to take action

deemed fit.— Notwithstanding anything

contained in these rules, the Government

shall be free to take any action warranted

by circumstances in matters relating to

accreditation and disaccreditation and in

giving press facilities and in all these

cases, the Government decision shall be

final.

In exercise of the powers conferred bythe proviso to Article 309 of the Constitutionof India, the Governor of Goa hereby makesthe following rules to regulate the recruitmentto the Group ‘C’, Non-Ministerial, Non--Gazetted posts, in the Office of the DirectorGeneral of Police, Government of Goa,namely:—

1. Short title, application and commence-

ment.— (1) These rules may be called the

General of Police, Group ‘C’, Non-

-Ministerial, Non-Gazetted posts, Recruitment

Rules, 2012.

(2) They shall apply to the posts specified

in column (2) of the Schedule to these rules

(hereinafter called as the “said Schedule”).

(3) They shall come into force from the date

of their publication in the Official Gazette.

2. Number, classification and scale of pay.—

The number of posts, classification of the said

posts and the scale of pay attached thereto

shall be as specified in columns (3) to (5) of

the said Schedule:

Provided that the Government may vary

the number of posts specified in column (3)

of the said Schedule from time to time subject

to exigencies of work.

3. Method of recruitment, age limit and

other qualifications.— The method of

recruitment to the said posts, age limit,

qualifications and other matters connected

therewith shall be as specified in columns (6)

to (14) of the said Schedule.

4. Disqualification.— No person who has

entered into or contracted a marriage with a

person having a spouse living or who, having

a spouse living, has entered into or contracted

a marriage with any person, shall be eligible

for appointment to the service:

Provided that the Government may, if

satisfied that such marriage is permissible

under the personal law applicable to such

person and the other party to the marriage

and that there are other grounds for so doing,

exempt any person from the operation of

this rule.

5. Power to relax.— Where, the

Government is of the opinion that it is

necessary or expedient so to do, it may, by

order, for reasons to be recorded in writing,

relax any of the provisions of these rules with

respect to any class or category of persons.

6. Saving.— Nothing in these rules shall

affect reservation, relaxation of age limit and

other concessions required to be provided for

Scheduled Castes, and other special

categories of persons in accordance with the

orders issued by the Government from time

to time in that regard.

7. These rules are issued in supersession of

the existing Recruitment Rules,—

(i) for the post of Police Sub-Inspector

published vide Notification No. 1/11/2005-

-PER dated 19-06-2008 in the Official

Gazette Series I No. 14 dated 03-07-2008;

and

(ii) for the post of Police Constable

published vide Notification No. 1/11/2005-

-PER dated 07-09-2006 in the Official

Gazette Series I No. 23 dated 07-09-2006.

Notification

1/12/2005-PER (P.F. I)

In exercise of the powers conferred by

the proviso to Article 309 of the Constitution

of India, and in supersession of the existing

Recruitment Rules for the relevant posts,

published vide Government Notification

No. 1/12/2005-PER dated 09-03-2006 in the

Official Gazette, Series I No. 49 dated

13-3-2006, the Governor of Goa hereby makes

the following rules to regulate the recruitment

to the Group ‘C’, Non-Ministerial, Non-

-Gazetted posts for the India Reserve

Battalion, in the Office of the Director General

of Police, Government of Goa, namely:—

1. Short title, application and

commencement.— (1) These rules may be

called the Government of Goa, Office of the

Director General of Police, India Reserve

Battalion, Group ‘C’, Non-Ministerial, Non-

-Gazetted posts, Recruitment Rules, 2012.

(2) They shall apply to the posts specified

in column (2) of the Schedule to these rules

(hereinafter called as the “said Schedule”).

(3) They shall come into force from the date

of their publication in the Official Gazette.

2. Number, classification and scale of pay.—

The number of posts, classification of the said

posts and the scale of pay attached thereto

shall be as specified in columns (3) to (5) of

the said Schedule:

Provided that the Government may vary

the number of posts specified in column (3)

of the said Schedule from time to time subject

to exigencies of work.

3. Method of recruitment, age limit and

other qualifications.— The method of

recruitment to the said posts, age limit,

qualifications and other matters connected

therewith shall be as specified in columns

(6) to (14) of the said Schedule.

4. Disqualification.— No person who has

entered into or contracted a marriage with a

person having a spouse living or who, having

a spouse living, has entered into or contracted

a marriage with any person, shall be eligible

for appointment to the service:

Provided that the Government may, if

satisfied that such marriage is permissible

under the personal law applicable to such

person and the other party to the marriage

and that there are other grounds for so doing,

exempt any person from the operation of

this rule.

5. Power to relax.— Where, the

Government is of the opinion that it is

necessary or expedient so to do, it may, by

order, for reasons to be recorded in writing,

relax any of the provisions of these rules with

respect to any class or category of persons.

6. Saving.— Nothing in these rules shall

affect reservation, relaxation of age limit and

other concessions required to be provided

for Scheduled Castes, and other special

categories of persons in accordance with the

orders issued by the Government from time

to time in that regard.
