SUBJECT: MODIFICATION OF ARTICLE NINTH OF RESOLUTION J.D. NO.064-2010

The purpose of this circular is to inform the new guidance from the General Directorate of Seafarers and General Directorate of Merchant Marine, related to the procedure to be followed by Merchant Marine Consulates and Authorized Offices, in regards to fees for checking and handling documentation related to the certification of seafarers as established in Resolution J.D. No.040-2014 of November 12, 2014, published in the Official Gazette No.27679 of December 12, 2014; which modifies Article Ninth of Resolution J.D. No.064-2010 of July 22, 2010. In this sense, we inform that starting from January 1, 2015, for each process performed (endorsement and license) of TEN DOLLARS1 with 00/100 (USD10.00), that is reflected on the Receipt for the Issuance of the Seafarer’s License, Consulates and Authorized Offices in charge of collecting fees for checking and handling documents will retain the sum of FIVE DOLLARS with 00/100 (USD5.00) in favor of the Consulate where the solicitude was presented and processed in concept of services fees, and the other FIVE DOLLARS with 00/100 (USD5.00) will be sent to the Panama Maritime Authority as an additional collection remittance. In case of issuing any other technical certificate duly authorized by the General Directorate of Merchant Marine or through SEGUMAR Offices, the Merchant Marine Consulate duly authorized for this purpose, will remit to the Panama Maritime Authority, as an additional collection remittance, the sum of FIFTY DOLLARS with 00/100 (USD50.00) from the ONE HUNDRED DOLLARS with 00/100 (USD100.00) fee, and the other FIFTY DOLLARS with 00/100 (USD50.00) will remain in favor of the Consulate where the technical certificate was presented, evaluated, processed and issued, in concept of services fees for the checking and handling of documentation. Regarding the monthly report submitted to the Consular Financial Control and others dependencies, the retained sums in concept of the referred fees, will be considered as other incomes for financial effects, and must be included in the column detailing the official receipts that are part of the mentioned report. For this purpose, a modified report by the Consular Financial Control is attached with the new format, where a new column is

added for “other incomes (Checking and Handling)” in the official receipts worksheet, and in the analysis sheet is included the sum retained for the consul in this concept. Taking into consideration that the services regarding Seafarers and Technical Certificates involve direct payment of fees retained by the Consul in concept of checking and handling of the documentation, in conformity with the mentioned regulation, the amount of the collected sums by consulates for the issuance of the Licenses and documentation related with the certification of seafarers, and also for the issuance of technical certificates by the Merchant Marine and SEGUMAR, and their own fees charged for checking and handling cannot be added to the fees that the consul and its subordinates gain, based on the Decree of Cabinet No.75 of July 19, 1990, so these incomes will not be subject to any additional retention or additional charge. Consequently, once the sum in concept of fees gained by the Consul is received, it must be fully remitted to the Panama Maritime Authority at the closure of every monthly period. Regarding the paragraph in which a fee of TWENTY DOLLARS with 00/100 (USD20.00) is established, the same will not be regulated, so it cannot be charged. /CV/CG/jmss
