In supersession of all earlier transfer policies issued by the Chief Commissioner's
Office, following transfer policy will hereafter determine the guidelines for transfer and
rotationof alt grades of officers in Customs (Preventi-'e) Zone, Patna'
1. Aim of the Policy:-
The aim of the transfer policy is to provide transparency, objectivity, fair play
and clarity in the Annual General Transfer and promote integrity, efficiency and
improved performance following the principle of PATH (Professional, Accountable,
Transparent & Honest). The new policy shall come in force from immediate effect'
The Annual General Transfer of all grades should'be affected once in a year
during the beginning of each financial year'
2. Allocation/Postingof officers:
(t) Allocation of officers to.the Customs (Prev.) Commissionerates - Patna /Lucknow shall be done by the respective Cadre Controlling Authorities namely.
Chief Comrnissioner, Central Excise, Ranchi Zorre, Patna and Chief
Commissioner, Central Excise and Service Tax, Lucknow respectively as per
. the existing policy.
(ii) Allocation of officers to the office of Commissioner (Appeals) will be done in
consultation with the concerned Commissioner'
(iil) AGT for all the grades within a Commissionerate, shall be done by the
jurisdictional Commissioner, excePt for the postings to the Most Sensitive
places, detailed below.

Cut-off Date:
The Cut-off date for deciding tenure shall be 31st Augtlst of the AGT Year for
computing the tenure in Customs side'
For example, alter AGT, if an officer joins in Customs side on or before 31't
August of the said AGT, the date of next AGT will be considered as
completion of one Year tenure'
(i) The posting to most sensitive places in respect of GrouP 'B', Executive
Gazetted & Non-Gazetted officers shatl be done by the Chief Commissioner/
Customs (Preventiv e) zone, Patna at all times. For this PurPose the Chief
Commissioner, may constitute a Zonal Placement Committee which would
screen the eligibility of the officers and reconunend the names of the officers
to the Chief Commissioner of Customs (Preventive) Zone' Patna for his
considerations. At present the screening Committee detailed below [at Para
4(iixb),4(iii) and a(iv)l will function for reconunending the names of officers
to the Chief Commissioner, customs (Preventive) Patna zorte, Patna for most
sensitive Postings.
(ir) The posting to L-CS Raxaui for Group'B', Executive Gazetted & Non-Gazetted
officers shall be done on the basis of Board guidelines laid down under
Chairman, CBEC, New Delhi's letter Dy. No. 1'-64/CH(CBEC)/2002 dated
n.01'.2002, in the following manner:
(u) The number of vacancies in each grade may be worked out before hand'
(b) The screening Committee comprising of Commissioner Customs (Preventive)
Patna, Commissioner of Central Excise & sewice Tax, Patna and Commissioner
(Appeal), Patna will screen the ACRs/APARs of all the officers in each grade
' borne on the strength of Patna Customs (P) Commissionerate' A panel may be
drawn for the required number of vacancies on the basis of ACR/APAR
grading of the officers. The ACR/APAR grading of 5 years may be seen and
the appraisal of the ACR may be done as PeI guidelines mentioned in the
Chairman, CBEC's aforementioned letter i.e. "Outstanding/Excellent" will be
grven 5 marks for each YPaf', "very Good" will be given 4 marks for each YPt'
"Good" will be given 3 marks for each year and for lower grading' 2 marks will
be given for each year. Since, ACR system has been replaced by APAR system'

the appraisal of APARs unLler the cxisting instruction of the government shall
be done as Per details given below:

(") The officers with maximum m f the panel and the

descending order i.e. the officer with on top of the panel
and the officer with least marks witl be at the bottom of the panel. In case of
two officers having same marks, the one having more seniority wiil be
considered for posting to LCS, Raxaul'
(d) The officer being posted must also be enjoying a good reputation regarding his
integrity, efficiency, discipline and devotion to duty'
(") officer's tenure at LCS Raxaul will be for a period of trvo years from the date of
posting.
(0 The screening Committee will accordingly submit its recommendation to the
Chief Commissioner of Customs (Preventive) Patna Zotte, Patna for his
considerations, who would order for posting for Raxaul on the basis of
recommendations of the Committee'
(iir) The posting of officers of Group 'B' Executive Gazetted & Non-Gazetted
officers at LCS, Jogbani shall be done by the Chief Commissioner' Customs
(Preventive) Patna Zone, Patna on the basis of recommendation of the
screening Committee comprising of Commissioner, Customs (Preventive) '
Patna, Commissioner of Central Excise & Service Tax, Patna and Commissioner
(Appeal) patna, on the basis of same selection criteria which has been adopted
, for posting officers of these cadre at LCS, Raxaul'
(iv) The posting of officers of Group 'B' Executive Gazetted & Non-Gazetted
officers at LCS Sonauli, LCS Barhni and LCS Nepalganj Road shall be done by
the Chief Commissioner, Customs (Preventive) Patna zone, Patna on the basis
of recommend,ation of the screening Committee comprising of Commissioner
of Central Excise, Lucknow and Commissioner of Customs (Preventive)'
Lucknow on the basis of same selection criteria which has been adopted for
posting of officers of these cadre at LCS, Raxaul'

(r) The officers once postecl to Most sensitive Places in Patna Customs(P)'
Commissionerate and Lucknow Customs (P) Commissionerate shall not be
againposted,totheMostSensitivePlacesinthesamegrade.

The posting to the Sersitive and Non-Sensitive places/chalges shall be done
by the jurisdictional Commissioner following the Transfer Policy'
Any mid-term transfer on the administrative or compassionate ground shall
be affected. by the jurisdictional Commissicner and they shall furnish a report
to this effect to the Chief Comrnissioner, Customs (P) Zone' Patna
immediately outlining the ground.s which necessitated such mid-term
transfer and iustifying the administrative reasons for the postings done'
6. Classification of Charges:
Different Charges in the commissionerates are classified as Most sensitive'
sensitive or Non-sensitive as pel enclosed Annexure-I. This classification is
applicable to all Cadres.
(i) There shall be strict rotation and adherence to tenure of postings in case of all
posts-sensitive as well as non sensitive to ensure all round exposure and
efficiency. Flowever, in case where sufficient number of officers are not
available due to administrative/vigilance reasons for posting to sensitive
charges, officers can be rotated from one charge to another sensitive charge'
(ii) As far as possible, eu:I officer in the subsequent cycle of posting in the same
. grade should not be posted in the same most sensitive/sensitive charge'
(iii) on reversion from a sensitive Directorate, as fat as possible, officers should be
posted to a non-sensitive charge for a minimum period of one year'
(iv) Posting to a sensitive charge should normally not exceed two years for each
posting.
(u) The officers promoted to the grade of Superintendent/ Inspector and posted to
Customs shall not be given Most Sensitive/sensitive charge for at least one
year.

Minimum tenure in charge:
Minimum tenure in a non-sensitive charge shall normally be one year.
Flowever, maximum tenurc' for posting in Airport/ Air-Cargo shall normally
be one year but may be extended to two years for willing officers having
unblemished records and administrative exigencies.
Period of stalr at one station:
The total period of stay at one station of an officer, except difficult areas and
Airport/Air Cargo should not be less than two years.
Period of stay in Commissionerate:
The total tenure of posting in Customs Commissionerate shall be five years,
However, in case of Patna Commissionerate, if an officer in the grade of
Superintendent opts for repatriation on completion of four years in Customs
Commissionerate, the same shall be considered.
Posting to Difficult Areas (Hard postings):
(i) The posting to difficult areas would be done by the jurisdictional
Commissioners following the principles of this Transfer Policy.
(ii) Tenure of posting to Difficult Areas (Hard Postings) shall be one year. As far
as possible, all officers should be rotated to such postings on the basis of roster,
which should be circulated in advance of transfers every year. List of Difficult
Areas (Hard Postings) are as per enclosed Annexure-Il.
The officer shall not be shifted frequently from one station to another without
tenure of the posting being completed, same on administrative ground.
Last posting before superannuation:
Officers who are due for superannuation within two years should be, as far as
feasible, posted to the station of his/her choice or two the nearest station.
Posting of spouse at the same station:
If the spouse of an officer is also working in a Central/State Government office,
he/she should be posted to the station where spouse is working or a nearby
station as far as administratively possible, in terms of the DOP&T's extant
guidelines in this regard.

15. Record management and tlansparency regarding history of Posting:
History of posting of all Gloup 'B' Gazetted and Non-Gazetted Executive
Officers should be maintainecl by the concerned Cadre Controlling Authorities
i.e. Chief Commissioner, Central Excise & Service Tax Ranchi Zone, Patna and
Chief Commissioner Central Excise & Service Tax, Lucknow. Further, the
Cadre Controlling Authorities should ensure that the same is put up on the
website, maintained by it, within a period of one year of the issue of the
Board's guidelines to ensure transparency in administratioru as stipulated in
the Board' guideline.
16. Training:-
It shall be the responsibility of the jurisdictional Commissioners to ensure that
mandatory training of adequate duration in Customs work is given to the
officers coming from Central Excise before their first posting to Customs charge
in order to acclimatize them with the nature of the work in Customs
formations. Further, all the officers posted to EDI based work environment
(including RMS) shall invariably be given a familiarizattonf refresher courses
on regular basis.
17.
(i) The tenure of posting in Customs formation shall be f.or 6 (six) years. During
this tenure, they shall be posted to border areas (LCS) for 2years from the date
of posting, 2 years in Divisions and for remaining period they may be posted
for one year at hard posting and for remaining one year at
Headquarters/ Circles.
(ii) For deputation of Havildars/Head Havildars to DRI, they should be posted on
the basis of their willingness only.
(iii) Their representations for posting to any station should be considered
sympathetically, subject to administrative requirements.
18. Transfer/?osting guidelines in respect of the officers of Ministerial Cadre:
(i) The tenure of posting in Customs formation shall be for 6 (Six) years.
(ii) The officers of Ministerial Cadre shall be posted to Most Sensitive Places on the
basis of their APAR grading in the manner prescribed for Raxaul at Para 3

above, of this Transfer Policy by the jurisdictional Commissioner. The duration
of their posting to Most sensitive place shall be for 2 years.
(iir) Their representations for posting to any station .should be considered
sympathetically, subject to administrative requirements.
(i") The officers shall be posted to Most Sensitive Places for only one time in each
grade.
Any officer can be transferred from a station on administrative grounds by the
jurisdictional Commissioners,. The Commissipners shall furnish a report to this
effect to the Chief tommissioner/ Custosrs P) Patna Zorrc, Patna immediately
thereafter, outlining the grounds which necessitated such mid-term transfer and
justifying the administrative reasons for the postings done.
Any grievance arising out of AGT or other transfer and posting order should to
subrnitted to the Chief Commissioner, Customs (Preventive) Patna Zone, Patna
for redressal of the same.
27. These transfer/placement guidelines would immediately come into effect from
the date of its issue.
