MEMORANDUM OF ASSOCIATION

ofIndian Council of Agricultural Research

1. The name of the Society is the Indian Council of Agricultural Research.

2. The objects for which the Indian Council of Agricultural Research is establishedare :

(a) To undertake, aid, promote, and co-ordinate agricultural and animalhusbandry education, research and its application in practice, developmentand marketing in India and its Protectorates and any other areas in or inrelation to which the Government of India has and exercises any jurisdictionby treaty, agreement, grant usage, sufferance or other lawful means by allmeans calculated to increase secure its adoption in every day practice.

(b) To act as a clearing house of information not only in regard to research butalso in regard to agricultural and veterinary matters generally.

(c) For the purposes of the Society to draw and accept and make and endorsediscount and negotiate Government of India and other promissory notes,bills of exchange, chequed or other negotiable instruments.

(d) To invest the funds of, or money entrusted to, the Society upon suchsecurities or in such manner as may from time to time be determined bythe Governing Body and from time to time to sell or transpose suchinvestments.

(e) To purchase, take on lease, accept as a gift or otherwise acquire, any landor building, wherever situate in India which may be necessary or convenientfor the Society.

(f) To construct or alter any buftding which may be necessary for the Society.

(g) To sell, lease, exchange and otherwise transfer all or any portion of theproperties of the Society.

(h) To establish and maintain a research and reference library in pursuance ofthe objects of the Society with reading and writing rooms and to furnish thesame with books, reviews, magazines, newspapers and other publications.

(i) To do all other such things as the Society may consider necessary, incidentalor conducive to the attainment of the above objects.

4. The income and property of the Society, however, derived shall be applied towardsthe promotion of the objects thereof as set forth in this Memorandum of Associationsubject nevertheless in respect of the expenditure of grants made by theGovernment of India to such limitations as the Government of India may fromtime to time impose. No portion of the income and property of the Society shallbe paid or transferred, directly or Indirectly by way of dividents, bonus or otherwisehowsoever by way of profit to the persons who at any time are or have beenmembers of the Society or to any of them or to any persons claiming throughthem or any of them, provided that nothing herein contained shall prevent thepayment in good faith of remuneration of any member thereof or other personsin return for any service rendered to the Society.

5. If, on the winding up or dissolution of the Society, there shall remain, after thesatisfaction of all its debts and liabilities, any property whatsoever the same shallnot be paid to, or distributed among the members of the Society or any of thembut shall be dealt with in such manner as the Government of India may determine.

RULES OF THE INDIAN COUNCIL OF AGRICULTURAL RESEARCH

Short title, extent,commencement andapplication

Definitions

(a) These rules may be called the Rules of theIndian Council of Agricultural Research.

(b) In their scope and application these Rulesextend to its Headquarters, all the Institutesand other units of the Indian Council ofAgricultural Research.

*(c) These Rules shall come into force afterapproval by the Government of India and witheffect from such date as may be specified bythe Government of India.

(a) "The Society" means the Indian Council ofAgricultural Research, a Society registeredunder the Societies' Registration Act, 1860.

(b) "The Council" means the Indian Council ofAgricultural Research.

(c) "The Governing Body" means the bodyconstituted under Rule 35 of these Rules asthe Governing Body of the Society.

(d) "The President" means the President of theIndian Council of Agricultural Research.

(e) "The Vice-President" means the Vice-Presidentof the Indian Council of AgriculturalResearch.

(f) The Director-General" means the personappointed by the Government of India to bethe Director-General of the Indian Council ofAgricultural Research.

(g) "The Member, Finance" means the Officernominated by the Government of India in theMinistry of Finance to act as Member of theGoverning Body.

(h) The Secretary" means the person appointedby the Government of India to be theSecretary of the Indian Council of AgriculturalResearch. Secretary includes AdditionalSecretary and/or Deputy Secretary soappointed in the Council, or any other personexercising the functions of the Secretary bywhatever name called.

(i) "Director" means a person appointed underthe provisions of these Rules and Bye-lawsof the Council to be the Director of anInstitute of the Indian Council of AgriculturalResearch.

(j) "The Chairman and other members" meansthe persons appointed by the President withthe approval of the Government of India tobe the Chairman and Members of theAgricultural Scientists' Recruitment Board.

(k) "The Constituent Units of the Society" meansthe Indian Council of Agricultural ResearchHeadquarters, its Research Institutions,regional and sub-stations, researchlaboratories etc. and Co-ordinated-Projectsmanaged and administered by the Society.

(1) "Year" means unless otherwise specified bythe Governing Body, the financial year of theGovernment of India.

(m) "The Agricultural Scientists' RecruitmentBoard" means the Board constituted underRule 25 of these Rules as the AgriculturalScientists' Recruitment Board.

I. SOCIETY

Headquarter* of the 3. The office of the Society shall be situated at theSociety Headquarters of the Government of India.

Member* of the Society 4. The Society shall have the following Members:-

(i) Minlster-in-charge of the portfolio ofAgriculture in the Union Cabinet—Presidentof the Society.

(ii) Minister of State in the Union Ministry ofAgriculture dealing with the Indian Councilof Agricultural Research - Vice-President.

(iii) Union Ministers holding charge of Finance,Planning, Science & Technology, Educationand Commerce (in case the Prime Ministeris holding any of these portfolios, the Ministerof State in the Ministry/Departmentconcerned).

(iv) Other Ministers In the Union Ministry ofAgriculture.

(xv) Five technical representatives, namely Agri-cultural Commissioner, Horticultural Commis-sioner, Animal Husbandry Commissioner,Fisheries Development Commissioner, fromthe Union Ministry of Agriculture and Inspec-tor-General of Forests, Government of India.

(xvi) Fifteen scientists from within and outside theCouncil including one from the IndianCouncil of Medical Research, nominated bythe President.

(xvii) Three representatives of commerce andindustry, nominated by the President.

(xviil) One farmer from each region of the countryas mentioned in Rule 60(a) and fourrepresentatives of rural interests, nominatedby the President.

The representation may be by name or bydesignations, as may be appropriate provided thatthe membership of the Society may be changed bythe Government of India from time to time.

As envisaged under Rule 83 of the Rules of the ICARSociety, concurrence of the Government of India to theamendment of Rule 4(xv) of the Rules of ICAR Society hasbeen obtained vide Ministry of Agriculture (Department ofAgricultural Research and Education) Letter No. l(l)/86-CDN-I dated 30th June, 88. The amended rule will comeinto force with effect from 30th June, 1988.

5. The Society shall maintain a roll of membersindicating their full names, addresses andoccupations and every member shall sign the same.If a Member of the Society changes his address, heshall notify his new address to the Secretary of theSociety, who shall have the entry in the roll ofmembers changed accordingly. Where, however, amember does not notify any change of address tothe Secretary of the Society, his address as givenin the roll of members, shall be deemed to be hiscorrect address.

6. Should any member of the Society be unable toattend a meeting of the Society, the President shallbe at liberty to appoint any person as a substituteto take his place at that meeting of the Society.Such substitutes shall have all the rights andprivileges of a member of the Society for thatmeeting only.

7. Where a person becomes a member of the Societyby virtue of his office or appointment which heholds, his membership of the Society shall terminatewhen he ceases to hold that office or appointment.

shall cease to be members of the Society onthe dissolution of the House or on the expiryof their term or on ceasing to be members ofthe House, which ever is earlier.

b) Membership of the Society shall bedetermined on the happening of any of thefollowing events :-

i) On the expiry of the period ofmembership for which nominated,

ii) Death, resignation, insolvancy, lunacy orconviction for a criminal offence,Involving moral turpitude,

ill) When a member himself declines toserve on the Society or his employerrefuses to grant him permission to serveon the Society, and

iv) When a member does not attend threeconsecutive meetings of the Societywithout proper leave of the President.

(c) The President may at any time terminate themembership of any one or more of the mem-bers or at one and the same time terminatethe membership of all members other thanthe ex-officio members. Upon such termina-tion, the vacancies shall be filled in accor-dance with the relevant provisions of theseRules. A member whose membership is soterminated shall be eligible for renomination.

Subject to the provisions of Rules 7 and 8, anominated member of the Society shall hold officefor a period of three years from the date of hisnomination.

If a casual vacancy arises during the three-yearperiod referred to in Rule 9 above, such vacancyshall be filled in like manner as the original vacancyand the person nominated/appointed to fill thevacancy shall, subject to the provisions of Rule 7and 8, hold office for the unexpired portion of thethree years' period.

When a member desires to resign his membershipof the Society, he shall forward his letter ofresignation to the Secretary who shall forthwithsubmit the same for the consideration of thePresident. The resignation shall take effect from thedate of its acceptance by the President.

The Society shall function notwithstanding any

vacancy in its body and no act, direction orproceeding of the Society shall be invalid merely byreason of such vacancy or any defect in theappointment of any of its members.

Mandate of ICAR 12-A. In order to fulfil the objects as contained in theMemorandum of Association of the Society, theCouncil is authorised :-

(i) To plan, undertake, aid, promote and co-ordinate education, research and itsapplication in agriculture, agro-forestry,animal husbandry, fisheries, home scienceand allied sciences.

(ii) To act as a clearing-house of research andgeneral information relating to agriculture,animal husbandry, home science and alliedsciences, and fisheries matters through itspublications and information system, andinstituting and promoting transfer oftechnology programme.

(iii) To provide, undertake and promoteconsultancy services in the field of education,research, training and dissemination ofinformation in agriculture, agro-forestry,animal husbandry, fisheries, home scienceand allied sciences.

(iv) To look into the problems relating to broaderareas of rural development concerningagriculture including post-harvest technology,by developing co-operative programmes withother organizations such as the IndianCouncil of Social Sciences Research, Councilof Scientific and Industrial Research, BhabhaAtomic Research Centre, Universities, etc.

(v) To do other things considered necessary toattain the objects of the Society.

14. The Director-General shall be the Principal ExecutiveOfficer of the Society.

15. They shall be appointed from time to time by theauthority competent under these rules to malte suchappointments, Directors of Research Institutes,Directors of Laboratories, Project Co-ordinators andsuch other officers as may be required to assistthe Director-General and/or officers subordinate tohim for carrying out the objects set forth in theMemorandum of Association of the Society.

16. The Society shall have, subject to such restrictionsas the Government of India may impose and subjectto such guidelines as the Government of India mayissue from time to time in this behalf, full authorityto perform all acts and issue such directions asmay be considered necessary, incidental orconductive to the attainment of the objectsenunciated in the Memorandum of Association ofthe Society.

17. The Society shall review in its meeting at least oncea year the progress and performance of theconstituent units of the Society and give such policydirections as it may deem fit, to the Governing Bodyand the constituent units of the Society.

18. (a) A notice or any other information may beserved upon a member of the Society eitherpersonally or by sending it through post inan envelope addressed to such member athis address as noted in the roll of members.

(b) Any notice or other communication issuedthrough post shall be deemed to have beenserved on the day following the day on whichthe letter, envelope or wrapper containing thesaid notice or communication is posted. Inproving such service it shall be sufficient toprove that the cover containing such materialwas properly addressed and put into the postbox or delivered to the postal authorities foronward transmission.

III. PRESIDENT

19. The President shall exercise such powers for the

conduct of the business of the Society as may bevested in him by the Society. In addition, thePresident shall have powers to :-

i) review periodically the work and progress ofthe Society,

ii) appoint Committees or Commissions toenquire into and report on the affairs of theSociety, and pass such orders thereon as heconsiders proper.

Delegation of Powers 20. The President may, in writing, delegate such of hispowers as he may consider necessary to the Vice-President/the Director-General, the Secretary, theDirectors of the Institutes, or to any other officer ofthe Council.

IV. VICE-PRESIDENT

Powers and functions 21. Besides the powers hereinafter enumerated In theseRules, the Vice-President shall exercise those powerswhich may specifically be delegated to him by thePresident.

V. DIRECTOR-GENERAL

Powers and functions 22. (a) Subject to any order that may be passed bythe Government of India, the President, theVice-President and decisions of the GoverningBody, the Director-General as the PrincipalExecutive Officer of the Society shall beresponsible for :-

i) the proper administration of the affairsand funds of the Society,

ii) prescribing the duties of all employeesof the Council,

iii) exercising supervision and disciplinarycontrol over the work and conduct ofall employees of the Council,

iv) co-ordinating and exercising generalsupervision over all research activitiesin agriculture and animal husbandryand other activities of the Council, and

v) advising the Government of India, StateGovernments and the Administrations ofthe Union Territories on all mattersconnected with agriculture and animalhusbandry referred to him.

(b) Subject to these Rules and Bye-laws, the

VI. SECRETARY

23. (a) The Secretary shall exercise all administrativeand financial powers as have been conferredon him under these Rules and such of thepowers as may be delegated to him from timeto time.

(b) The Secretary, shall or any member of theGoverning Body, if so authorised by aresolution passed in that behalf by theGoverning Body may execute all contracts,deeds and other instruments on behalf of theSociety or the Governing Body.

(c) For the purpose of Section 6 of the SocietiesRegistration Act (21 of 1860) the Secretaryshall be considered the Principal Secretaryof the Society and the Society may sue or besued in the name of the Secretary of theSociety. The Secretary may authorize anyother officer of the Society in writing to signand verify pleadings on his behalf.

(d) The Secretary may, in writing, delegate suchof his powers as he may consider necessaryto any officer subordinate to him.

24. (a) The Secretary shall function under thedirections of the Society, the Governing Body,the President, the Vice-President and theDirector-General.

(b) The Secretary shall keep or cause to be keptminutes of the proceedings of the Society andthe Governing Body and take necessaryaction in connection therewith.

(c) The Secretary shall keep or cause to be keptall records of the Society at its office or anyother place to be determined by theGoverning Body.

VII. AGRICULTURAL SCIENTISTSRECRUITMENT BOARD

25. There shall be an Agricultural Scientists'

Recruitment Board with a whole time Chairman andother members who shall be appointed by thePresident, with the approval of the Government ofIndia.

25(a) If the Office of the Chairman of the ASRB becomesvacant or if he is by reasons of absence or for anyother reasons unable to perform the duties of hisOffice, these duties shall until some other personis appointed under Rule 25 to the vacant office,has entered on the duties thereof or, as the casemay be until the Chairman has resumed his dutiesor a new Chairman has been appointed, beperformed by such of the other member of theASRB as the President, Indian Council ofAgricultural Research may appoint for the purpose.

25(b) The Chairman and other Members of the ASRB shallhold office for a term of 6 years from the date onwhich they enter upon their office or until theyattain the age of 65 years, whichever is earlier.

25 (c) (i) Subject to the provisions mentioned hereinbelow, the Chairman or any other Memberof the ASRB shall only be removed from hisoffice by order of President, ICAR on groundof misbehaviour after a high poweredCommittee of three members nominated bythe Governing Body on reference being madeto it by the President has on enquiry held inaccordance with the principle of naturaljustice reported that the Chairman or suchother Member, as the case may be, oughton any such grounds to be removed.

Notwithstanding anything mentioned above,the President may by order remove from officethe Chairman or any other member of theASRB, if the Chairman or such otherMember, as the case may be :-

(a) is adjudged as insolvent; or

(b) engages during his term of Office in anypaid employment outside the duties ofhis Office; or

(c) is in the opinion of the President, unfitto continue in office by reason ofinfirmity of mind or body.

25(c) (ii) The Chairman may in writing, delegate suchof his powers as he may consider necessaryto any other member of the ASRB.

Function* 26. (a) The Recruitment Board shall function as anIndependent recruiting agency and shall beresponsible for recruitment to posts In theAgricultural Research Service and to suchother posts and services as may be specifiedby the President from time to time.

(b) The Recruitment Board shall render suchother assistance to the Council in personnelmatters including promotion as may berequired by the President.

(c) The Recruitment Board shall advise theCouncil in disciplinary matters relating topersonnel recruited/appointed either by theCouncil itself or in consultation with theRecruitment Board.

(d) The Recruitment Board shall submit annuallyby the second week of May of the yearfollowing the financial year a report on itsactivities for each financial year to thePresident.

VIII. MEETINGS OF THE SOCIETY

Annual General Meeting 27. The Annual General Meeting of the Society shall beheld on such date, time and place as may bedetermined by the President.

Special General Meeting 28. (a) The President may convene a Special GeneralMeeting of the Society whenever he thinksfit.

(b) At all Special General Meetings, no subjectother than that stated in the notice orrequisition, as the case may be, shall bediscussed except when specially authorizedby the President.

(c) Any requisition so made by the members ofthe Society shall express the object of themeeting proposed to be called and shall beleft at the address of the Secretary.

(d) The President shall convene a Special GeneralMeeting of the Society on the writtenrequisition of not less than fifteen membersof the Society.

Calling of the meetings 29. All meetings of the Society shall be called by noticein writing by and under the hand of the Secretary.

Notice for meetings 30. Every notice calling a meeting of the Society shallstate the date, time and place of the meeting andshall be served upon every member of the Society

32. (a) The President shall preside over all meetingsof the Society. In his absence the Vice-Presldent shall preside over the meetings ofthe Society. In the absence of the Presidentand the Vice-President, the members presentshall choose one from amongst themselvesto be the Chairman of the meeting.

(b) No business shall be discussed at anymeeting of the Society except the election ofa Chairman, whilst the chair is vacant.

33. Fifteen members of the Society present in personshall form a quorum at any meeting of the Society.

34. (a) All disputed questions at meetings of theSociety shall be determined by vote of themembers present and voting.

(b) Each member of the Society shall have onevote.

(c) In case of equality of votes the Chairmanshall have a casting vote.

IX. GOVERNING BODY

35. The Governing Body shall have the following mem-bers from amongst the members of the Society :-

i) Director-General.... Chairman

iv) Secretary, Agriculture.

36. The Governing Body shall generally pursue andcarry out the objects of the Society as set forth inthe Memorandum of its Association and in doingso shall follow and implement the policy directionsand guidelines laid down by the Society.

37. The affairs and funds of the Society shall bemanaged, administered, directed and controlled,subject to Rules, Bye-laws and orders of the Society,by the Governing Body.

38. (a) The Governing Body shall exercise allexecutive and financial powers of the Societyincluding those vested in or conferred or tobe conferred on it by or under any statutesubject nevertheless in respect of expenditureof such limitations as the Government ofIndia from time to time may impose.

(b) In particular and without prejudice to thegenerality of the foregoing provisions, theGoverning Body shall have the power, subjectto the provisions of these Rules and Bye-lawsframed thereunder, to:

1) Consider the annual and supplementarybudgets placed before it by theSecretary, from time to time, and passthem with such modifications as maybe deemed necessary,

2) establish, maintain, amalgamate and/orclose institutions, laboratories, officesand/or hostels, etc..

3) encourage the pursuit of learningparticularly relating to agriculture andanimal sciences and for the purposefound scholarships, prizes, medals, etc.and certificates and other academictitles,

4) create posts, categorize posts andpersonnel in the Council,

5) determine the conditions of service ofthe employees of the Council, fix theirremuneration and define their duties,

6) prescribe the cadre strength of scientistsfor the Council as a whole with theappointment for individual or group ofdisciplines for each Institute for a periodof five years at a time,

7) prescribe the ratio of posts in differentgrades or groups of grades in scientificand technical posts,

8) constitute with the approval of thePresident and Agricultural ResearchService,

9) lay down the principles and procedureswhereby In the initial constitution of thecadre the existing scientists of theCouncil may be encadred having dueregard to the necessity for maintaininga high standard of efficiencycommensurate with better pay scalesand prospects of advancement,

10) enter into arrangements with theGovernment of India and through theGovernment with foreign andinternational agencies and organizations,the State Government and other publicor private bodies or organizations orindividuals for securing and or acceptinggrants-in-aid, endowments, donations orgifts to the Society on mutually agreedterms and conditions provided thatsuch terms and conditions shall not becontrary to or inconsistent with theobjects of the Society, or the policy ofthe Government of India,

11) take over, acquire (by purchase, gift,exchange, lease or hire or otherwisefrom Government of India and through

the Government from foreign and inter-national agencies and organizations, theState Governments and other public orprivate bodies or organizations, or indi-viduals, institutions, libraries, laborato-ries) museums, collections, immovableproperties, endowments or other fundstogether with any attendant obligationsso that neither the transaction nor theterms and conditions where-under it isconcluded, is inconsistent with the ob-jects of the Society or the policy of theGovernment of India,

12) appoint boards, Committees, Sub-com-mittees and Panels consisting of personswho may or may not be members ofthe Governing Body or employees of theCouncil, for such purposes and periodsand with such powers and on suchterms as it may deem fit,

13) dissolve and/or substitute all or anyBoard Committee, Sub-committee orpanel functioning or set up under Sub-Rule 12 above under the Society, andto issue such direction to them as itmay deem fit and necessary, and

14) delegate such administrative, financialand other powers to the Director Gen-eral, Secretary and any other Officer ofthe Council, as it may consider neces-sary and proper.

Delegation of powers of 39. (a) The Governing Body may delegate to theInstitutes Directors of the Institutes/Laboratories all

powers for their functioning.

(b) The Indian Agricultural Research Institute,which is a deemed University under theUniversity Grants Commission Act, 1956 andsuch other Institutes as may be declareddeemed Universities, may be delegatedenhanced powers beyond those contemplatedin Sub-Rule(a) above in view of their specialstatus.

Powers to frame, amend 40. Subject to the provisions of these Rules and withor repeal bye-laws on the approval of the Government of India, thecertain matters Governing Body shall have the power to frame-

amend or repeal bye-laws for the administration andmanagement of the affairs and funds of the Societyand in particular to provide for the following matters:

i) preparation and sanction of budget estimates,sanctioning expenditure, execution ofcontracts, investment of funds of the Society,purchase, sale or change of such investmentsand maintenance of accounts and their audit.

ii) procedure for recruitment and training,examination, assessment, clearance ofprobation, confirmation and promotion ofpersonnel to and in the service of the Council.

ill) terms and tenures of appointments andassignments, emoluments, allowances, rulesof discipline and other conditions of serviceof the employees of the Council.

iv) terms and conditions governing: -

a) the grant of scholarships, fellowshipsetc.,

b) deputations within the country andabroad,

c) grants-in-aid for research schemes andprojects, and

d) establishment of research centres.

v) such other matters as may be necessary orincidental to the administration of the affairsand funds of the Society.

Frequency of meetings 41. The Governing Body shall meet as often asnecessary, and in any event at least once in eachquarter of the year, the year for this purpose beingthe financial year commencing on the first day ofApril and ending on the thirty-first day of March ofthe following calender year.

Date, time and place of 42. The Governing Body meetings shall be held on suchmeetings date, time and place as may be determined by the

Director-General.

Notice for meetings and 43. (i) all meetings of the Governing Body shall beits service called by notice in writing by and under the

hand of the Secretary,

(ii) every notice calling a meeting of theGoverning Body shall state the date, time andplace of the meeting and shall be served uponevery member of the Governing Body not lessthan fifteen clear days before the dayappointed for the meeting.

Validation of proceedings 44. Any inadvertent ommission to give notice to or non-of meetings receipt or late receipt of notice by any member shall

not invalidate the proceedings of the meeting.

(2) In the event of disagreement be-tween the Member-Finance andthe Chairman of the GoverningBody on any financial matterbeyond the delegated powers ofthe Director-General as Secre-tary to the Government of In-dia, the matter may be referredto the Ministers of Agricultureand Finance for decision.

48. Any business, which it may be necessary for theGoverning Body to perform, except such as may beplaced before the annual meeting of the Society,may be performed by a resolution in writingcirculated among all its members, and, any suchresolution so circulated and approved by a majorityof the members shall be as effectual and bindingas if such resolution had been passed at a meetingof the Governing Body.

49. The proceedings of all Governing Body meetings andresolutions passed, referred to in. Rule 48 above,shall be submitted by the Secretary to the Chairmanof the Governing Body for approval.

X. ACCREDITATION BOARDAccreditation is a process of quality assurance whereby an approved institution or

programme is critically apprised, at intervals, by a group of external peers as to whether aninstitution or programme met the norms and standards prescribed by the Council from time totime. The Accreditation Board should be a fairly strong body under the ICAR umbrella and shouldhave powers to control implementation of the norms and standards agreed by the Board.Objectives of the Board 1. To assist the people, prospective students, educational

institutions, professional societies, potential employers,Govt. and other concerned agencies in identifying thoseinstitutions and their programmes which meet the minimumnorms and standards prescribed by the Council.

2. To provide guidance for the improvement of existingagricultural education institutions/programmes and alsoto develop new institutions/programmes.

standards for accreditation of institutions andprogrammes of Agricultural Education includingVeterinary Sciences and Agricultural Engineering.

2. To assist the Council for the matters pertaining toapproval, recognition, inspection and funding ofinstitutions of Agricultural Education.

3. Evaluate the academic programme and the Institutionalset up in which these programmes are conducted.

4. To periodically assess the curricula of various degreeprogrammes offered by the State AgriculturalUniversities and other approved institutions andsuggest modifications, if required.

5. To oecide the equivalence of qualifications.6. To lay down Norms and Standards of courses,

curricula, instructional facilities, teaching staffqualifications, requirements of admission etc. and ifwarranted de-recognise degree/institution.

7. To provide guidance on University governance,personnel and financial policies etc.

The Board will be supported by necessary scientific, technical and administrative staff.Secretariat of the Board

An independent Secretariat directly responsible to the Director-General, ICAR, with full-time Secretary of.the Board in the rank of ADG, with adequate staff, to execute the above responsibilityshould be established. The Board will be supported with necessary infrastructure including scientific,technical, financial and administrative staff.Notice of Meetings 53 All the meetings of the Accreditation Board shall be called

by notice in writing by and under the hand of the Member-Secretary of the Board.

Quorum 54 Seven members of the Accreditation Board shall constitutethe quorum for any meeting of the Board.

Frequency of Meetings 55 The proceedings of the Accreditation Board shall beregulated mutatis mutandis in accordance with theprovisions of Rules 42, 43 (ii) and 45. The meeting shall becalled at least once in six months.

Action on Proceedings 56 The proceedings of the Accreditation Board including itsviews and recommendations on various matters consideredby it, shall be placed before the next meeting of theGoverning Body for information and for issue of suchdirections as it may deem proper.

XI. SCIENTIFIC PANELSConstitution 57 The Governing Body shall constitute scientific panels for

various disciplines, as also inter-disciplinary panels for thepurpose of:-i) considering research schemes and projects,ii) advising the Governing Body on technical matters, andiii) drawing attention to gaps in the current research and

training efforts.Joint Panels 58 The Governing Body may constitute either on cost sharing

or cost-free basis Joint Panels with other scientific bodieslike the Council of Scientific and Industrial Research, IndianCouncil of Medical Research, Indian Council of SocialSciences Research, etc. for one or more of the followingpurposes:-i) collaboration in research,ii) inter-disciplinary examination of research schemes and

projects,iii) implementation of research schemes and project, andiv) co-ordination with various other scientific bodies and

the University Grants Commission to avoid duplicationand to bring about effective co-ordination in agriculturalresearch.

Action on the 59. The views, recommendations and reports of the scientificrecommendations and Panels and Joint Panels on the various matters consideredreports by them shall be placed before the Governing Body for

information and for issue of such directions as it may deemproper.

XH. REGIONAL COMMITTEESConstitution 60. (a) The Governing Body shall constitute Regional

Committees. The areas comprised in each re-

gion shall be determined by the GoverningBody after taking into account the agro-climaticand other relevant factors.

*(b) The Director-General shall be the Chairman ofthese Regional Committees. He shall nominatea member of each Committee as Secretary ofthat Committee.

(c) The membership of the Regional Committeeshall be as under:-

i) the members of the Society residing in thatregion.

ii) Chairman of the Development Council ofCouncils constituted by the Departmentof Agriculture, Government of India, lo-cated in the region.

iii) Directors of the Institutes of the Councilin the region.

iv) Scientific/technical representatives ofAgricultural Universities, State Depart-ments, Central Institutes and Departmentof Agriculture of the Union Ministry ofAgriculture, and

v) farmers nominated by the President.

**vi) Two members from non-governmentalorganisations engaged in rural develop-ment in the region nominated by the presi-dent,

(d) The membership of the Regional Committeeshall be regulated mutatis mutandis in accord-ance with the provisions of Rules 6 to 11.

Functions 61. The functions of the Regional Committee shall be to:-

i) review the status of agricultural research andeducation in the region, and

ii) analyse, discuss in depth and make recom-mendations on the location specific problemsof agriculture, animal husbandry, fisheries andforestry peculiar to the region.

Provided that the Governing Body may from time totime enlarge or curtail the scope, authority and func-tions of a Regional Committee.

XIII. MANAGEMENT COMMITTEES

Constitution 66. (a) Each Institute of the Council shall have a Man-agement Committee consisting of the followingmembers:-

(c) For the purpose of these rules, Institutes shallalso include National Research Centre, ProjectDirectorates, Bureaux or any other unit of theCouncil, as may be approved by the President.

Powers and functions 67. The powers and functions of the Management Com-mittee shall include:-

i) consideration of proposals for Five Year Planand Annual Plan,

ii) periodical review of progress of developmentschemes.

iii) consideration of proposal for the annual budget.

iv) consideration of items of expenditure which arebeyond the powers of the Director of the Insti-tute.

v) policy issues relating to the Institute, includingthe rights and obligations of staff,

vi) consideration of action taken on the recommen-dations of the Grievance Cell and Institute JointCouncil,

vii) any other items, as may be desired by the Direc-tor or other members of the Committee or asmay be required to be considered as per deleg-ation of powers as directions of the GoverningBody whether contained in any manual, ordersissued, resolution passed, or other instructionsapproved by the Governing Body, and

viii) such powers as may be delegated by the Govern-ing Body to enable the Management Commit-tees to administer the funds allocated and theprogrammes approved.

Notice of meetings 68. All meetings of the Management Committee shall becalled by notice in writing by and under the hand ofthe Member-Secretary of the Committee.

Quorum 69. Four members of the Management Committee shallconstitute the quorum.

Frequency of meetings *70. The Management Committee Meeting may be held 2-3times in a year depending upon the actual need of theInstitute. However, rule 42, 43(ii) and 44 shall con-tinue to apply mutatis mutandis.

Action on proceedings 71. (i) the proceedings of the Management Committeeshall be forwarded to the Director-General im-mediately and Directors should ensure that theproceedings should be delivered to the Secretary,ICAR, within a week of the meeting.

(ii) the Director-General shall have the power toreview/cause to be reviewed any decision of theManagement Committee where he considersthe same is not in consonance with the Rules,general policy, practice or the priorities of theCouncil provided that any order on the basis ofthe basis of such review shall be passed withina period of one month w.e.f. the date of receiptof the proceedings at the Headquarter. If theproceedings of the Management Committee arenot received at the Headquarter these may bereviewed by the Director-General any time suomoto.

(Hi) in case the Director of the Institute has reasonsto differ from the views of the Management Com-mittee, having regard to his accountability asthe Head of the Institute, he should after re-cording the reasons in writing forward the samewith the proceedings of the meeting of the Man-agement Committee to the Director-General forhis decision till such time a final decision onsuch matters is taken by the Director-General

**(c) For the purpose of these rules, the Institute shallinclude Project Directorate, Bureau, NationalResearch Centre or any other Unit of the Coun-cil as may be approved by the President. The cov-erage of the Research Advisory Committee willalso be extended to the National Research Cen-tres taking into account the size of the Centres,specifically with the approval of D.G., ICAR.

71C The powers and functions of the Research AdvisoryCommittee shall include:(i) to suggest research programmes based on na-

tional and global context of research in thethrust areas.

(iii) any other function that may be specifically as-signed by the Director-General, ICAR.

71D All meetings of the Research Advisory Committee shallbe called by notice in writing by and under the hand ofthe Member-Secretary of the Committee. An omissionto give notice or late receipt or non-receipt of notice byany member shall not invalidate the proceedings ofthe meeting.

*71F The Research Advisory Committee shall normally meetonce in a calendar year at the Headquarters of theInstitute, on a date and time as may be determined bythe Chairman of the Committee. Only in exceptionalcases, the RAC may be convened twice in a year. Theduration of the RAC meetings may be of 1 to 3 daysdepending upon the agenda of the meeting.

71G (i) the proceedings of the Research AdvisoryCommittee shall be forwarded to the Director-General, ICAR by the Member-Secretary, aftergetting the same approved from the Chairman,immediately and the Director of the Instituteshould ensure that the proceedings are deliv-ered to the Secretary, ICAR within a week of themeeting.

(ii) the Director-General shall have the power toreview/cause to be reviewed any decision of theResearch Advisory Committee where he consid-ers the same is not in consonance with theRules, general policy, practice or the prioritiesof the Council provided that any order on thebasis of such review shall be passed within aperiod of one month of the date of receipt of theproceedings at the ICAR Head-quarters. If theproceedings are not received at the Headquartersthese may be reviewed by the Director-Generalany time suo mofo.

(ill) in case the Director of the Institute has reasonsto differ from the views of the Research AdvisoryCommittee, having regard to his accountabilityas Head of the Institute, he should after record-ing the reasons, in writing, forward the samewith the proceedings of the meeting of the Re-search Advisory Committee to the Director-Gen-eral, for his decision. Till such time a final deci-sion on such matters is taken by the Director-General, the recommendations of the ResearchAdvisory Committee shall not be operative oracted upon.

Note: The outside experts and the Chairman of the Commit-tee shall be paid TA/DA as admissible to non-officialsunder the ICAR Rules. In addition, they should alsobe paid an honorarium of Rs 1,000/- (Rupees onethousand only) for attending the meeting.

STAFF RESEARCH COUNCILConstitution 71H (a) Each Institute of the Council shall have a Staff

Research Council consisting of the followingmembers :-1. Director of the Institute Chairman2. Joint Director (Research)/Incharge (Re-

search Co-ordination and ManagementUnit.) Member

3. Heads of Divisions/Sections Members*4. All Principal Investigators of the Projects.

This shall include the Leaders of the ma-jor programmes at the Institute, Heads ofDivisions (HDDs) and the Project Coordi-nators. The number of programme leadersis to be decided at the Institute level inconsultation with the Research AdvisoryCommittee by adopting the following cri-teria:(i) For NRC, all the Scientists working

in the NRC may be the member of theSRC.

(ii) For the National Institutes the mem-bership from this category may be lim-ited to 50. Members

(c) For the purpose of these Rules, the Instituteshall also include the Project Directorate, Bu-reau, National Research Centre, or any otherunit as may be approved by the President.

The powers and functions of the Staff ResearchCouncil shall include: -

(i) consideration and evaluation of the ResearchProjects (RPF 1). The Principal Investigatorwill make representation of the ResearchProject to the SRC. The SRC will reject/rec-ommend the Research Project along with itsduration,

(ii) consideration and evaluation of the on-goingProjects (RPF II Annual Research Progress Re-ports), after these have been assessed by anexpert. The SRC will make specific recom-mendations about the achievements andshort-comings of the projects,

(iii) Advise on the fostering of linkages betweenthe groups/Divisions/Institutes in respectof multi-disciplinary Projects/multi-locationalProjects,

(iv) monitor the follow up action on the recom-mendations of QRTS with respect to technicalprogrammes of the Institute, and

(v) any other function as may be assigned to itby the Director of the Institute or the Direc-tor-General, ICAR.

71J All meetings of the Staff Research Council shall becalled by notice in writing by and under the hand ofthe Member-Secretary. An omission to give notice orlate receipt or non-receipt of notice by any membershall not invalidate the proceedings of the meeting.

Note (i) An external expert, who is a member of theSRC will be invited to make critical evalua-tion of the on-going project before it isconsidered by the SRC. An honorarium of Rs200/- per day may be paid to the externalexpert for his evaluation.

(ii) Before the new Project is considered by theSRC, it will be examined by the Research Co-ordination and Management Section/Unit ofthe Institute in respect of its importance ofproblems, its design and final requirements.Each Institute should constitute such a Sec-tion/Unit by re-adjustment of the existingstaff. Such a Section/Unit will function un-der the charge of a Joint Director (Research)/Director of the Institute.

XIV. GENERAL

72. The Society shall establish and maintain its ownoffice, Research Institutes and Laboratories, Regionaland Sub-Stations etc.

73. Recruitment and appointment to the various postsin the Council shall be made in accordance withthe Recruitment Rules framed or to be framed forthe purpose in the Council in consultation with theChairman or any other member of the ASRB towhom the Chairman has delegated his powers un-der Rule 25(c)(ii) and duly approved by theGoverning Body and the President.

74. The funds of the Society shall consist of the follow-ing :-

1) Income from the Cess realised under the Ag-ricultural Produce Cess Act, 1940 (Act No.XXVII of 1940).

2) Lumpsum and recurring grants made by theGovernment of India.

3) Income from investments.

4) Income from other sources.

75. (i) the Bankers of the Society shall be the StateBank of India and its subsidiaries and/orScheduled/Nationalised Banks.

(ii) unless otherwise authorised by the Presidentor the Director-General or the Secretary, nonew account shall be opened.

(iii) no amount shall be withdrawn from the So-

76. The accounts of the Society shall be audited bysuch person or persons as may be nominated forthe purpose from time to time by the Governmentof India in consultation with the Comptroller andAuditor-General of India.

77. Matters having financial implications, which fall be-yond the powers of the Director-General shall bereferred to the Member-Finance for advice.

78. There shall be at the Council's Headquarters a Fi-nancial Adviser who will be a whole-time employeeof the Council. He shall be responsible for the bud-get of the Society, control of its finances, and inaddition may be required to be responsible for thebudget of the Society, control of its finarjces, andin addition may be required to be respohsible forthe proper maintenance of accounts and internalaudit. The Financial Adviser shall advise the Direc-tor-General on all financial matters. TheDirector-General shall have the power to over-rulehis advice by recording in writing reasons therefor.A report of all such cases shall be submitted to theGoverning Body for information.

79. There shall be at the Council's Headquarters a Le-gal Adviser who will be a whole-Ume employee ofthe Council. He shall be responsible for advisingthe Society in all legal matters and for arrangingcontest/defence of legal proceedings instituted byor against the Society in any Court and for thevetting and drafting of all deeds, agreements andother legal documents.

80. An annual Report of the proceedings of the Societyand all work undertaken during the year shall beprepared by the Governing body for the informa-tion of the members of the Society alongwith theAuditor's report thereon shall be placed before theSociety at its Annual General Meeting and also onthe table of the Houses of Parliament.

81. The Governing Body of the Society shall have a sealwhich shall be used only with its prior approval incases where under any law it is necessary for theSociety to affix it on a document or on an instru-ment or the Governing Body otherwise so decidessuch a document/instrument shall be signed by a

82. Subject to the approval of the Government of Indiapreviously obtained, the Society may alter or extendthe purpose for which it is established or be amal-gamated either wholly or partially with any otherSociety by following the undermentioned procedure:-

(a) The Governing Body shall convene a SpecialGeneral Meeting of the Members of the Soci-ety, according to these Rules for theconsideration of the said proposition,

(b) The Governing Body shall submit the propo-sition for such alteration, extension oramalgamation as aforesaid to the membersof the Society in a written or printed report,

(c) Such report shall be delivered or sent by postto every member of the Society fifteen cleardays previous to the said Special GeneralMeeting,

(d) Such proposition shall be deemed to havebeen agreed to if not less than three-fifths ofthe members of the Society cast their votesin its favour either in person or by proxy atthe said Special General Meeting, and

(e) Such proposition shall be confirmed by thevotes of three-fifths or members of the Soci-ety present at the Second Special GeneralMeeting convened by the Governing Body atan interval of one month after the formermeeting.

83. The Rules of the Society may, with the sanction ofthe Government of India, be altered at any time bya Resoultion passed by a majority of the membersof the Society at a meeting of the Society convenedfor the purpose.

84. The Society, may, with the approval of the Govern-ment of India, change its name by a resolution passedby a majority of the members of the Society at anymeeting of the Society convened for the purpose.

85. The membership of one body will not be a bar tothe membership of other bodies.

I. FINANCIAL

A. Budget and Finance

Preparation of Budget 1. (a) Not later than the first February of each yearEstimates the Secretary shall prepare detailed Budget

Estimates of receipts and expenditure (withthe anticipated opening and closing balancesof the Society) for the ensuing financial year.The budget shall be in the form prescribedin this behalf in the Regulations framedunder these bye-laws.

(b) The estimates shall show separately the sumsrequired to meet the expenditure from incomeout of the following:

i) Government of India grants,ii) Proceeds from the Agricultural Produce

Cess Act, and

ill) Other sources.(c) The estimates for expenditure to be met out

of the Government of India grant for eachyear shall further exhibit the expenditure onresearch under the following major heads:i) Agriculture and Soil Conservation,ii) Animal Husbandry,ill) Dairy Development,Iv) Fisheries,v) Education, andvl) Other heads.

(d) The expenditure on Plan and Non-PlanSchemes shall be shown separately.

(e) The estimates for expenditure fromAgricultural Produce Cess Fund shall beexhibited separately under the followingheads:i) Agriculture and Animal Husbandry

2. The Secretary shall, in the first instance, place theBudget Estimates before the Standing FinanceCommittee and then together with therecommendations of the Standing FinanceCommittee constituted under Section 7 of theAgricultural Produce Cess Act, 1940, to theGoverning Body for sanction.

3. After the estimates have been finally approved bythe Governing Body, the details of the allotmentsfor expenditure of the various constituent units shallbe communicated to them by the Financial Adviser.One copy of the sanctioned estimates shall also besent to the Auditor of the Council nominated bythe Comptroller and Auditor-General of India. Allvariations in the estimates sanctioned by thecompetent authority during the year shall besimilarly communicated.

4. Revised and/or supplementary estimates ofexpenditure shall similarly be submitted to theGoverning Body for sanction in such form and onsuch dates as may be directed by the GoverningBody.

5. For new schemes proposed to be financed from thereceipts/accumulations of the Agricultural ProduceCess Fund, prior approval of the Governing Bodyshall be necessary.

6. The Director-General may, subject to the availabilityof funds in the budget by reappropriation orotherwise, and provided that in his opinion thescheme is urgent and that its sanction cannot bedeferred to the next meeting of the Standing FinanceCommittee and the Governing Body, sanction for aperiod not exceeding one year an original grant notexceeding Rs 50,000.00 for a new scheme. No suchscheme shall, however, be constituted beyond thesaid period of one year without approval of theStanding Finance Committee and the GoverningBody.

7(1) The Director-General may sanction additional grantfor an approved scheme up to the following financiallimits subject to a maximum of 25% of the original

• grant sanction for the entire period of that scheme:-

a) Where cost of the approved Rs. 20,000/~scheme is Rs 1 lakh or less

In order to maintain continuity of work under anon-going scheme of urgent nature, the Director-General may sanction an extension of the schemefor not more than six months on existing basissubject to the ratification of such extension byStanding Finance Committee/Governing Body attheir subsequent meetings provided further that thetotal period of the scheme as a result of grant ofsuch extension does not exceed the overallprescribed period of five years.

(a) The Primary Units of appropriation willordinarily be :-

i) Headquarters Administration,

11) Research Institutes/Laboratories,

ill) Each Project falling under the All-IndiaCo-ordinated Project,

iv) Projects other than (111) above,

v) Education, and

vi) Fellowships and Scholarships,

b) The Secondary Units of appropriation will be:-

i) Pay of Officers,

ii) Pay of Establishment,

ill) Allowances and Honorarium excludingovertime and travelling allowances,

iv) Travelling Allowances,

v) Overtime Allowances,

vi) Grant-in-ald,

vii) Leave salary and pension contributions,

viii) Other charges, and

Ix) Any other Item or items, as may berequired.

(c) The Director-General shall have full power toappropriate sums provided in the sanctionedEstimates during the financial year to meetexpenditure, on each item up to the amount

provided for in the sanctioned estimate. Anyunspent balance shall lapse and shall not beavailable for utilization in the following year.

(d) The funds of the Society shall not beappropriated or re-appropriated to meetexpenditure, which has not been sanctionedby the authority competent to sanction itunder these bye-laws.

(e) No reappropriation shall be done from 'Plan'to 'Non-Plan' without the sanction of theGovernment of India.

(f) No reappropriation shall be done from onemajor head to another major head out of thegrant given by the Government of Indiawithout the approval of the Governing Body.

(g) The Governing Body shall have power toreappropriate from one approved scheme toanother on the Plan side provided that theoutlay of a scheme for a 5-year period doesnot exceed the approved outlay in the Five-Year Plan and subject further to suchguidelines and restrictions as the Governmentof India may prescribe.

(h) The Director-General shall have, in respect ofGovernment of India grants, full power toreappropriate funds at any time from one pri-mary unit of appropriation to another,provided that the total sanctioned BudgetEstimate within the major head is not there-by exceeded. No reappropriation shall be madeso as to augment the provisions under thehead 'Pay of Officers' and 'Pay of Establish-ment' taken together for the entire grant.

(i) In respect of Agricultural Produce CessFunds, the Director-General shall have fullpowers to reappropriate funds from one unitto another.

(j) The Secretary, The Directors of Institutes/Laboratories or any other Officers soempowered by the Governing Body, may re-appropriate funds from one secondary unitbefore the close of the financial year to whichthe appropriation relates.

(k) The funds allotted by the Governing Body fora scheme as grant-in-aid out of theAgricultural Produce Cess Fundaccumulations shall be resumed if the

Scheme is postponed or abandoned. In thatevent the Director-General shall be competentto allot to the extent required the funds thusresumed to any scheme/schemes approvedby the Governing Body. If after making suchallotment, any balance is left, it shall becredited to the funds of the Society.

Expenditure sanction— 9. (a) No expenditure from the funds of the SocietyDelegation shall be incurred without the sanction of the

authority competent under these bye-laws.

(b) A sanction to expenditure will not becomeoperative unless funds are made available tomeet the expenditure by valid appropriationor reappropriation.

(c) The powers regarding sanction of expenditureshall be exercised after strictly following theguidelines or restrictions which have been orwhich may be imposed by the Governmentof India from time to time.

(d) The Governing Body shall have full powersto sanction expenditure on any service up toany amount included in the sanctionedbudget. However, sanction of the Presidentshall be required for creation of any post ina scale of pay the maximum of which exceedsRs 2.750/-.

(e) In the application of the various Rules andRegulations of the Government of India, asamended or altered or modified from time totime and applicable to the Society, the powersvested in the President of India shall beexercised by the President of the Society.

(I) The Director-General shall exercise thepowers delegated to him under the rules andBye-laws of the Society as well as thosepowers which are exercisable by a Ministry/Department of the Government of Indiaincluding creation of any post in a scale ofpay the maximum of which does not exceedRs. 2.750/-.

(g) The Secretary in respect of the Indian Councilof Agricultural Research Headquarters andthe Institutes/Laboratories etc., and theDirector in respect of the concerned Instituteshall exercise all the powers of the "Head ofDepartment" for the purpose of various Rulesand Regulations of the Government of India,as amended from time to time and applicable

mutatis-mutandis to the Society till suchthe Council frames and enforces its ownRules and Regulations in this behalf.

In addition, the Secretary/Directorsshall exercise all the powers specificallydelegated under the Rules and these Bye-laws or which may hereinafter be delegatedto them by the Governing Body.

(h) In exceptional cases, the Director-Generalmay empower in writing a Director ofLaboratory/Institute to exercise, in additionto all the powers exercisable by him inrespect of the concerned Institute, all suchpowers in respect of any other Institute/Laboratory. In cases where powers are to beexercised by the Directors in consultationwith the Management Committee, no suchpowers shall be exercised without suchconsultation.

(i) The Director-General, the Secretary and theDirectors of the Institutes/Laboratories maydelegate the powers exercisable by them tosuch Officers as they may deem fit.

()) The Deputy Directors-General and other Of-ficers in and under the Council shall exercisesuch powers as have been delegated or whichmay be delegated to them under the Rulesand Bye-laws of the Council.

Powers to sanction 10. Expenditure in excess of the net appropriation forexcess expenditure the year shall require the sanction of the Governing

Body.

Powers to write-off losses 11. (a) The power to write-off looses in respect ofthe funds of the Society shall be exercisedby the Director-General to the extent it isbeing exercised by a Ministry/Department ofthe Government of India. A list of casesinvolving a write-off of Rs 5000/- or abovein each case in the previous year ending 31stDecember shall be placed before theGoverning Body at its meeting convened forthe purpose of passing the budget estimatesof the Society.

(b) The Director-General may subject to suchconditions and monetary limits as he mayconsider necessary to impose, delegate thepowers mentioned in (a) of this bye-law tothe Secretary/Deputy Directors-General/otherOfficers of and under the Council and the

grantee Institutions. A list of all such casesfor each year ending 31st December shall besubmitted annually to the Director-Generalby the 31st January of the next year for hisinformation.

Contracts 12. (a) The form of all contracts to be executed byany Authority of the Indian council ofAgricultural Research, as defined in Rule 13of the Rules of the Indian Council ofAgricultural Research Society in force from3rd April, 1975, or by any other Authoritydelegated with powers to execute contracts,deeds and other instruments on behalf of theSociety and Members of the Governing Body,shall be drawn up under legal advice.

The Secretary may delegate his powerto execute all contracts, deeds and other in-struments on behalf of the Society or theGoverning Body subject to such restrictionsas he may think fit to impose to any Officerof the Society or to any other Body, Institu-tion or Organization under the administrativecontrol of the Society.

(b) Property owned by the Society which is nolonger required by the Society may be dis-posed off by the Director-General providedthat disposal of immovable property, shall bemade with the prior approval of the Govern-ing Body keeping in view the instructions ofthe Government of India issued in this re-spect from time to time.

Legal proceedings, 13. The Secretary shall have the power to file andcompromise etc. defend suits or other proceedings by or against the

Society and to compromise, settle or refer toarbitration any dispute relating to the Society.

Investment of funds 14. (a) The funds of the Society may be invested insuch manner as may be prescribed by theGovernment of India. All investments of thefunds of the Society shall be made in thename of the Society.

(b) All purchases, sales or alterations of invest-ments shall be affected on the authority ofthe Director-General and all contracts, trans-fer deeds or other documents necessary forpurchasing, selling or altering the invest-ments of the Society's funds shall beexecuted by the Secretary or any other Of-ficer authorised by the Secretary.

(c) The scripts/securities shall remain inpersonal charge of the Secretary or any otherofficer so authorised by him for safe custodyand shall be verified once in six months withthe Register of Securities maintained. Acertificate of verification will be recorded inthe Register by the concerned officers of theSociety.

15. (a) Funds of the Society shall be kept withdrawnin the manner laid down in Rule 75. ChequeBooks shall remain in personal custody ofan officer of the Society authorised by theSecretary in this behalf.

(b) The Secretary and such other officers of theSociety, as may be authorised, shall beallowed to draw and keep at their disposalpermanent advances considered necessaryfrom time to time to meet petty expenses. Apermanent advance shall be recouped as andwhen required.

B. ACCOUNTS AND AUDIT

16. The accounts of the Society shall be maintained insuch form as may be prescribed in this respect inthe Regulations to be framed hereinafter under theseBye-laws.

17. (a) The Financial Adviser or any other Officerappointed for the purpose shall apply a checkof the nature of pre-audit to payments madefrom the funds of the Society. NecessaryAudit Registers and other Registers asrequired for the purpose of such audit, shallbe maintained in the forms prescribed in thisbehalf in the Regulations. The forms ofaccounts and their maintenance shall beapproved by the Government of India withthe concurrence of the Comptroller andAuditor-General of India.

(b) The Financial Adviser or any other Officerappointed for the purpose shall causeperiodical internal audit of the accounts ofthe various Institutes and of the Headquartersof the Society and take necessary action onthe checks so exercised.

18. In each Institute/Laboratory of the Society, the ChiefAccounts Officer or the Accounts Offlcer-in-chargeshall be responsible for scrutinising the budget andall proposals involving financial implications,

maintenance of accounts and its internal audit Theyshall advise the Director of the Institute/Laboratoryin all financial matters. The Director and/or theManagement Committee shall have the power toover-rule his advice after recording reasons therefor.The Accounts Officer concerned will send throughthe Director a six monthly report of such cases tothe Financial Adviser of the Society who shallexamine the same place it before the Director-General along with his comments thereon.

Substantive Audit 19. (a) Accounts of the Society shall be audited an-nually by such person or persons as may benominated by the Central Government un-der Rule 76. Any expenditure incurred on orby the Auditors so nominated in connectionwith such audit shall be borne by the Soci-ety. The audit will be conducted inaccordance with the principles and proce-dures as may, from time to time, be laiddown by the Government of India in consul-tation with the Comptroller and Auditor-General of India.

(b) The Auditors or any other Officer appointedby them in connection with the audit of theaccounts of the Society shall have the samerights, privileges and authority in connectionwith such audit as the Comptroller andAuditor-General of India has in relation tothe audit of the Government accounts andin particular shall have the right to demandthe production of books, accounts, connectedvouchers and other necessary documents andpapers.

(c) If an expenditure from the funds of theSociety consists of grants to any authorityor individual under the audit of any Auditor/Audit Officer of the Government or aChartered Accountant, the Auditor of theSociety will satisfy himself that the purposeof grant is within the scope of Article 4 ofthe Memorandum of Association. The auditorof the Society will accept a certificate of auditof that Officer or Chartered Accountant inrespect of the expenditure from the grants.The Secretary will arrange to obtain andproduce a certificate of audit.

(d) The accounts of the grantee institutions,associations etc., shall be open to check bythe Auditor of the Society.

Annual Accounts and 20. (a) The Secretary shall compile the AnnualResults of Substantive Accounts of the funds of the Society referredAudit to in Rule 76 within three months of the close

of the financial year in the form as may beprescribed in this behalf in the regulationsto be framed hereinafter under these bye-laws. The form of Annual Accounts shall beapproved by the Government of India withthe concurrence of the Comptroller andAuditor-General.

(b) The results of audit shall be communicatedby the Auditors to the Governing Body of theSociety as early as possible but not later than31st March of the year following the year towhich the Annual Accounts relate. TheGoverning Body shall furnish a copy of theAudit Report along with its observations tothe Department of Agricultural Research andEducation, Government of India and also tothe Society. The Auditors shall also forwarda copy of the Audit Report directly to theDepartment of Agricultural Research andEducation, Government of India.

(c) The Governing Body may deal with the auditobjections raised by the Auditors and takesuch action as may be deemed proper.

II. PERSONNEL

Categorisation of posts 21. The posts in the Council shall be categorised asScientific, Technical, Administrative (includingAccounts), Auxiliary and Supporting on the basisof the following criteria:-

(a) Scientific : Scientific personnel shall be thosewho are engaged in agricultural research andeducation (including extension education)whether in physical, statistical, biological,engineering, technological or social sciences.This category shall also include personsengaged in planning, programming andmanagement of scientific research.

(b) Technical: Technical personnel shall be thosewho perform technical service in support ofresearch and education whether in theLaboratory, Workshop or field, or in areas likeLibrary, Documentation, Publication andAgricultural Communication.

(c) Administrative : Administrative personnelshall be those who provide administrativesupport for the work of the Laboratory/Institute/Headquarters Organization.

(d) Auxiliary : Auxiliary personnel shall be thosewho are not directly connected with theresearch and education activities of theOrganization, and are not covered by theother categories defined In this bye-law.

(e) Supporting : Supporting personnel shall bethose who generally help and support theabove four categories of staff. They may beskilled, semi-skilled or unskilled.

The categorization of posts shall be done inthe Council with the approval of the Govern-ing Body. The Governing Body shall havepower to alter, amend or add to the abovecriteria for classification of posts with the ap-proval of the President.

22. There shall be an Agricultural Research Service forScientists and such other Services for other staffas the Governing Body with the approval of thePresident may decide to constitute for carrying onthe purposes of the Society.

23. The Governing Body with the approval of the Presi-dent shall prescribe the procedure for recruitment,training, examinations, assessment, clearance ofprobation, confirmation and promotion of person-nel to and in the service of the Council.

* 24. The Composition of Committees, Boards or othersuch bodies for promotion, selection, recruitmentand other matters incidental thereto or connectedtherewith for various posts under the Council shallbe as prescribed in consultation with the Chairman,Agricultural Scientists' Recruitment Board or anyother member authorised by him and duty^ipprovedby the President, ICAR.

25. The appointing authority for various categories ofposts will be as specified in the relevant ServiceRules, or in the Regulations to be framed in thisregard duty approved by the Governing Body andthe President.

28. Notwithstanding anything contained in these bye-laws, the provisions of the existing Bye-laws 38 to42 of the Indian Council of Agricultural ResearchBye-laws relating to recruitment and appointmentto various posts in and under the Council shallcontinue to be in force till such time as theRecruitment Rules for various categories of postsin the Council as provided in Rule 73 of the IndianCouncil of Agricultural Research Rules are framedand enforced.

in. SERVICE CONDITIONS

29. These Bye-laws shall apply to permanent andtemporary employees of the Society but shall notapply to any person employed on casual or daily-wage basis.

30. (a) Except in regard to matters for which specificprovision has been made in the Rules, Bye-laws, Regulations or Orders made or issuedby the Society, the service and financial Rulesframed by the Government of India and suchother Rules and Orders issued by theGovernment of India from time to time, shallapply mutatis mutandis to the employees ofthe Society in regard to matters concerningtheir service conditions.

(b) Notwithstanding anything contained in thisBye-law, the Governing Body shall have thepower to relax the requirement of any Rulementioned in (a) above of the Bye-law to suchextent and subject to such conditions as maybe considered necessary.

31. The Central Civil Services (Classification, Control andAppeal) Rules, and the Central Civil Services(Conduct) Rules, of the Government of India for the

ii) reference to 'Government' and 'GovernmentServant' in the Central Civl Services ConductRules shall be construed as references to the'Society' and 'Officers and employees of theSociety' respectively.

32. (a) Employees of the Council covered by thePension Scheme shall be required tosubscribe to ICAR Provident Fund.

(b) In the case of employees not covered by (a)above, they shall subscribe towards a Con-tributory Provident Fund which shall beregulated in accordance with the ICAR Con-tributory Provident Fund-cum-Gratuity Rules.

33. (a) The age of retirement of scientific and technicalpersonnel in the service of the Council shallbe 60 years. No extension of service shall begiven but where absolutely essential in theinterest of research, the Council may re-employoutstanding Scientists on suitable terms withthe prior approval of the President.

(b) Staff of other than those mentioned in (a)above, shall retire on attaining the age asprescribed by the Government of India forsimilar categories of staff from time to time.

34. The Governing Body may decide from time to timewhich posts in the ICAR shall be tenure posts. Theperiod of tenure will, in the first instance, be 5 yearswhich may be extended up to another 5 years.

IV. SCHOLARSHIPS, FELLOWSHIPS, GRANTS-IN-AID,SPECIAL PROGRAMMES, RECOGNISED INSTITUTIONS. ETC.

The terms and conditions governing such activitiesshall be laid down by the Governing Body. It shallbe within the power of the Governing Body to alter,amend or repeal any or all the terms and conditions.

Such Scholarships, Fellowships, Grants-in-aid shallordinarily be restricted to Indian Citizens normallyresident in India.

(a) All Institutions engaged in research andeducation work in the sphere or agriculture,animal husbandry, forestry, fisheries andallied subjects and maintained by the Centralor the State Governments or affiliated to anyof the recognised Indian Universities for post-graduate research and/or education shall be"Recognised Institutions" for the purposes ofthe Society.

(b) In addition to the "Recognised Institutions"mentioned in (a) of this Bye-law, theGoverning Body may, on application and inaccordance with the procedure to be laiddown in this matter by the Governing Body,accord recognition to any institution, body,association or organization engaged Inresearch in the spheres of agriculture, animalhusbandry, forestry, fisheries or other alliedsubject.

39. The Governing Body may give to the "RecognisedInstitutions" such technical and/or financialassistance from the Society as it may think properand on such conditions as it may impose.

V. GENERAL

40. The Governing Body, the President, the Director-General, the Secretary, and the Directors of theInstitutes/Laboratories may delagate such of theirpowers to other Officers of the Society as may beconsidered necessary in the exigencies of service.

41. 42. Orders made in the name of the President, Vice-President and the Director-General may beauthenticated under the hand of the Secretary orDeputy Secretary or an Officer designated for thepurpose by the Director-General.

43. The delegation of powers already made under theexisting Rules and the Bye-laws in force prior tothe enforcement of these Bye-laws to the variousauthorities and other officers of the Society, shallcontinue to be exercised by them till such timethese are either withdrawn or enhanced or reducedunder the Rules and Bye-laws, which may be inforce.

44. Agreements etc. which may create obligations of anynature on the Society and not covered under anyother bye-law shall be signed by the Director-General, or the Secretary or an Officer workingunder and authorised by the Secretary.

45. Words and expressions used in these bye-laws shallhave same meanings as defined in the Rules. Wordsimporting the singular number shall include theplural number, and words importing the malegender shall include the female gender. Theinterpretation of these bye-laws, as made by thePresident, shall be conclusive and final.

46. Any Bye-law, or part of a Bye-law, which may befound to be in conflict, wholly or in part with theRules, shall cease to be valid.

47. Notwithstanding anything contained in the Rulesand Bye-laws of the Society, any action initiated orpurported to have been initiated under the Rulesand Bye-laws then in force and further proceedings

APPOINTMENTS

38. The Officers and staff of the Society shall be grouped in the following categories :-

39. (1) Notwithstanding anything in these Bye-laws, the work relating to recruitmentto all or any category of posts in the Council's Headquarters and its Research Insti-tutes/Laboratories/Centres may be entrusted by the President/Vice-President, to theAgricultural Scientists' Recruitment Board set up by the Society with the approval ofthe Government of India, as an independent recruitment agency.

(2) The composition of the Selection Committees/Interview Boards for various sci-entific and technical posts in the Indian Council of Agricultural Research Headquartersand its Institutes shall be as under :-

I. Posts of Deputy Directors-General and Assistant Directors-General at IndianCouncil of Agricultural Research Headquarters, may be filled on transfer/dep-utation basis on the recommendations of a Departmental Selection Committeeto be constituted by the President of the Society.

The currently vacant posts of Deputy Directors-General and Assistant Direc-tors-General at the Headquarters, at the time of notification of these Bye-laws,shall be filled through transfer/deputation on the recommendations of a De-partmental Selection Committee to be constituted by the Society in consultationwith the Government of India (Department of Personnel).

la) In the Indian Council of Agricultural Research Headquarters :

Selection Committee

i) Chairman to be nominated by the Vice-President and Director-GeneralChairman

ii) Assistant Director-General Member

iii) One outside Expert to be nominated by the Vice-President and Director-General Member

(b) At the Institutes-Selection Committee

- i) Director or his representative Chairman

ii) Two Advisors to be nominated by the Director, at least one of whom willbe from outside the Indian Council of Agricultural Research Members

(3) (a) In the event of the Chairman, Agricultural Scientists' Recruitment Board,not being able to attend the Interview Boards, as mentioned in clauses IIand III (a) and (b) of this Bye-law, he will nominate an outside Expert asAdvisor to act on his behalf as Chairman of the Interview Board.

(b) (i) In the cases I, II & III above, the Advisers on the various InterviewBoards/Departmental Selection Committee will be nominated by theChairman, Agricultural Scientists' Recruitment Board.

(ii) In the case of IV above, the Directors will send a list of Advisors to theAgricultural Scientists' Recruitment Board out of whom the Chairman,Agricultural Scientists' Recruitment Board wil nominate a few Advisorsin order of preference for acting as the Chairman and Member of theSelection Committee and also on Screening Committee, wherevernecessary.

(4) The President, the Vice-President and Director-General, the Directors of theInstitutes, and the Secretary, Indian Council of Agricultural Research shall exercise

powers of Appointing Authority in regard to scientific and technical posts in the IndianCouncil of Agricultural Research as mentioned below :-

(a) President Post carrying a pay scale, the maximum of which is above Rs1600/- p.m.

(b) Vice-President Posts in Class-I, the maximum pay scale of which does notand Director- exceed Rs 1600/- p.m. except Junior Class I posts.General

: (c) Directors All posts up to Junior Class I in the Institute.

(d) Secretary All posts up to Junior Class I in the Indian Council of Agri-cultural Research Headquarters.

(5) In addition to the above work relating to recruitment entrusted to it, the Agri-cultural Scientists' Recruitment Board shall be consulted :

(a) On all matters relating to methods of recruitment to posts in and underthe Council;

(b) On the principles to be followed in making appointments and promotionsto posts and the suitability of candidates for such appointments and pro-motions;

(c) On such disciplinary matters affecting persons in the posts equivalent toClass II and above in the Central Government serving under the Counciland in its Research Institutes, as the President, in consultation with theAgricultural Scientists' Recruitment Board, may specify.

40. (1) The post included in categories (i) and (ii) in Bye-law 38 shall be filled byadvertisement on All-India basis in consultation with the Agricultural Sci-entists' Recruitment Board, save and except that :

(i) Posts in respect of which the procedure for appointment is laid downin these Bye-laws shall be filled in accordance with the said proce-dure; and

(ii) Posts in respect of which the procedure for filling the same on tenurebasis by transfer/deputation, as laid down in Bye-law 39(2) (I) shall befilled in accordance with the said procedure through the DepartmentalSelection Committees.

Provided that posts in Class III may be filled by inviting nominations from Employ-ment Exchanges and appointments may be made on recommendations of a SelectionCommittee to be constituted for the purpose as laid down in clause V (a) and (b) ofBye-law 39.

(2) Recruitments, appointments, promotions and transfers to posts included incategory (iii) of Bye-law 38 shall be made in accordance with such rules and orders asmay be made by the President, in consultation with the Agricultural Scientists'Recruitment Board, which will, as far as practicable, be similar to rules in force forcorresponding post under the Central Government provided that the President maydelegate his powers in this respect to the Director-General, the Secretary, and theDirectors, as he may deem necessary and expedient in the interests of the Council.

(3) Appointments to posts included in category (iv) in Bye-law 38 may be made by

inviting nominations from Employment Exchanges and on the recommendations of aSelection Committee to be constituted by the Appointing Authority.

41. Notwithstanding anything contained in these Bye-laws, the Director-Generaland Vice-President, Indian Council of Agricultural Research, may in exceptional cases,in consultation with the Agricultural Scientists' Recruitment Board invite a qualifiedIndian Scientist abroad or in India to accept an appointment to a Scientific or Techni-cal post of which he is the Appointing Authority, for a period not exceeding one year.

42. All appointments and promotions shall be made in accordance with the Re-cruitment Rules already framed or to be framed In consultation with the AgriculturalScientists' Recruitment Board, for each post or category of posts.

43. The Agricultural Scientists' Recuritment Board shall submit annually report onits activities for each financial year to the President by the second week of May of that

. year.
