Access to the Pechanga Indian Reservation by Non-Members is not a right, but a privilege which may be granted or denied to an individual upon proper authority of the Pechanga Band (Article l(b), Non-Member Reservation Access and Rental Ordinance, May 1, 1996); 1 Whereas, Federal law recognizes the Pechanga Band's inherent, retained sovereignty and jurisdiction over both its members and its territory; Whereas, the Pechanga Band, as a sovereign Indian nation, has the power to enact and enforce laws to safeguard the general welfare and safety of its Membership and its Reservation; Whereas, the tribal lands' of tlhe Pechanga Indian Reservation are private property, and non) members have no property interest in uninvited entry onto said lands. Now, therefore, the Tribal Council of the Pechanga Band, having been duly granted the authority by action of the General Council of the Pechanga Band on May 1, 1996, hereby makes the following findings: 1. John Gomez, Jr. (hereinafter "Gomez") is a Non-Member of the Pechanga Band of Luiseno Indians; I 2. 3. Gomez has made a veiled threat of violence against the Pechanga people by stating that,"Maybe Congress and the courts really won't do anything until someone gets hurt ...Thatmight be what triggers a review of this."

4. The Tribal Council has determined that Gomez' presence on the Pechanga IndianReservation causes a significant threat to public safety and constitutes a public nuisance.

Therefore, pursuant to the "Non-Member Reservation Access and Rental Ordinance," principlesof Federal Indian law, and Tribal Custom and Tradition, john Gomez,jr. is hereby permanentlyexcluded from the Pechanga Indian Reservation;

Be it Further Resolved, that the Tribal Council is denying Gomez the privilege of access to theReservation and all exterior properties under the authority of the Pechanga Band.

Be it Further Resolved, that violation of this exclusion order is pursuant to Tribal law andFederal law, and the Band reserves the right to prosecute any violations to the fullest extent ofthe law. VIOLATIONS OF THIS ORDER SHALL BE PUNISHED BYA FINE OF UP TO FIVETHOUSAND DOLLARS ($5,000).

Persons being excluded from the Pechanga Indian Reservation may request an appeal hearing.All appeal requests shall be made in writing and delivered to the Pechanga Tribal Governmentwithin seven (7) days of delivery of this Notice. Appeal notices must state why a hearing isnecessary and why the proposed action should not be ordered.
