PART 1 - STATUTORY PLANNING SECTION As provided for under the provisions of the scheme, this part of the Structure Plan has the same force and effect as if it were a provision, standard or requirements of the scheme.

1.0 STRUCTURE PLAN AREA The Structure Plan applies to the land contained within the inner edge of the broken black line shown on the Structure Plan map.

Subject Area The Structure Plan area comprises approximately 10 hectares.

2.0 LOCAL STRUCTURE PLAN MAP Plan 1: The 'Structure Plan' illustrates the land use precinct proposed for the Structure Plan area. The map defines the following precinct:

The permissibility of uses and development shall be in accordance with the provisions of the General Industrial Zone. Notwithstanding the uses permitted under the Scheme, Industry - Hazardous shall be an 'X' use in this precinct.

PART 2 - EXPLANATORY REPORT

1.0 INTRODUCTION The purpose of this Structure Plan is to facilitate a significant industrial development proposal within the Neerabup Industrial Area.

The Neerabup Industrial Area, in total, comprises approximately 1,000 hectares of predominantly general industrial land, and is the subject of an overall draft structure plan (Structure Plan No. 17) generally known as the Neerabup Industrial Area Structure Plan, currently under consideration by the City of Wanneroo.

Structure Plan No 17 (SP 17) is at a relatively advanced stage in the assessment process, with the public consultation phase completed and the City having given conditional endorsement; however, the proposal is yet to be considered by the WAPC, and the scale and complexity of SP 17 is such that it will take considerable time for the Commission to properly assess and process the proposal.

In the meantime, the development time frame for the proposed industrial development, a Laminated Veneer Lumber (LVL) production plant, necessitates more immediate consideration.

Given that the broader planning structure for the area has been effectively addressed through SP 17, it is considered that the most appropriate method by which to expedite consideration of the LVL plant in the interim is to adopt a “limited” structure plan over the specific site.

The Pederick Road Structure Plan and report have been prepared to accord with the requirements of Part 9 of the City of Wanneroo District Planning Scheme No. 2 (DPS2).

2.0 SITE DESCRIPTION The site comprises a total area of 10 hectares and is located immediately to the west of the junction of Orchid Road and Pederick Road, within the eastern sector of the Neerabup Industrial Area.

As part of the proposal to create the LVL site (through the subdivision of Lot 10053 Mather Drive) it is intended to extend Pederick Road westwards to connect to Mather Drive. This road extension is consistent with the draft Neerabup Industrial Area Structure Plan.

3.0 RELATIONSHIP TO DRAFT NEERABUP INDUSTRIAL AREA STRUCTURE PLAN The draft Neerabup Industrial Area Structure Plan (SP 17)has been in the process of preparation and assessment for approximately three years. The draft Structure Plan was formally advertised in November 2002, in accordance with scheme requirements. Council has since considered submissions received during the advertising period and resolved that the Structure Plan is satisfactory subject to a number of modifications being made. Once those modifications are undertaken, the draft SP17 must then be submitted to the Western Australian Planning Commission (WAPC) for its consideration.

Figure 3.1 shows the site in the context of the draft Neerabup Industrial Area Structure Plan. Figure 3.2 shows the site in the context of the indicative development concept, which was included in the explanatory report for the draft SP17. Both of these plans formed part of the draft Structure Plan document that was considered by Council in January 2003.

These figures illustrate that the proposed identification of this site for General Industrial use, as well as the proposed extension of Pederick Road, are both consistent with the broader structure planning for the whole of the Neerabup Industrial Area.

Whilst the draft SP17 has yet to receive any formal consideration by the WAPC, it has been prepared in close consultation with both Council and the Commission, and it is generally considered, at technical officer level, that the proposed SP17, in so far as it relates to the land the subject of the Pederick Road Structure Plan, is acceptable.

3.1 The need for an interim Structure Plan

The LVL plant is a major industrial processing development of regional significance, which has been negotiated and supported by the state of Western Australia.

The State Government, as the owner of the land, has agreed to sell the land to the proponents to facilitate the development, and the necessary subdivision approvals to effect this have been obtained. In addition, the City of Wanneroo has granted conditional development approval for the development.

Whilst the development approval has been granted, Council is of the view that the provisions of DPS2 prohibit the commencement of development until an agreed Structure Plan has been adopted, in accordance with Part 9 of the Scheme. Whilst the Neerabup Industrial Area Structure Plan is at an advanced stage of consideration (having completed the public consultation phase and received formal council endorsement) it is unlikely that the completion of the formal adoption process will occur within a time frame necessary to meet the development commitments required to ensure that the project proceeds.

Through consultation with the City and officers of the WAPC, it was agreed that the overall Structure Planning for the Neerabup Industrial Area was sufficiently advanced to determine that the proposed development will be consistent with future planning and development in the area, and that the most appropriate mechanism to expedite the commencement of construction would be the preparation and adoption of an ”interim” Structure Plan for the LVL site, in order to overcome the technical barrier caused by the scheme provisions.
