Federal Regulatory Update

• New Certification Rules went into effect in March of 2018.

• Changes requiring Private, Certified and Registered Applicators to be 18 years of age.

• Changes requiring annual training for Registered Applicators applying Restricted Use Pesticides

Upcoming Regulation Changes

• Regulations requiring all private applicators to be a minimum of 18 years old (immediate family excluded). This coincides with the new federal C & T Regulations introduced by EPA.

• Restricting the use of RUP’s to certified applicators only or requiring annual training of non-certified individuals, using RUP’s, to comply with C & T Regulations.

• Regulations requiring notification to Pesticide Sensitive Individuals for all Category 8 (Public Health) Applications.

• Took effect 11/18/19. Lists for Cat 8 being populated now.

Pollinator Protection Act• Effective January 1, 2018

• Neonicotinoid pesticides can be sold only by licensed dealers

• Can be used only by certified applicators or those under their direct supervision

• Indoor, agricultural and veterinary use exempt

• Putting your Certification number on your attendance sheets makes it easier for staff to enter your credits, and makes it less likely to make a mistake because they couldn’t decipher your name on the sheet.

• Please try to write LEGIBLY!

• Your Certification number be found on your MDA ID card.

• Also note! If you are a commercial applicator and inspected or stopped in the field and cannot provide that card, it IS A VIOLATION and you can be issued a Cease and Desist Order on the spot!

Reminder…

• Regulation COMAR 15.05.01.03.5 states that a licensee must Immediately notify the department by telephone of any pesticide accident, incident, fire, flood or spill and report the full details of the event, including any remediation taken;

• 410-841-5710

• This is something that everyone should know. There have been 3 “incident’s” reported this year that the department was notified of prior to a consumer complaint.

2019 Business Inspection Violations

• Inspection Year is 1/2 over. Runs July 1 to June 30.

• As of 7/1/19 there have been 146 inspections this year. • This number is lower than normal because we are short

2 inspectors.

• Out of 146 inspections there were 75 that had one or more violations!

• 49% of all inspections had 1 or more violations! THAT IS HALF!

• 38% of violations were for RECORDS!

The Regulations require the following information to be recorded for each

pesticide application:

1) Name of applicator

2) Date of application

3) The plant, animal or site to which the pesticide was

applied and the pest to be controlled

4) Acreage, square footage, cubic footage or number of plants

or animals or a description of the area or structure treated

5) Address of treated property

6) Common name and EPA registration number of pesticide

7) Rate and concentration of pesticide used

8) Total amount of pesticide used

9) Type of equipment used to apply the pesticide

10) Time of day of application

11) The direction and estimated velocity of the wind at the site when the pesticide

was applied (this does not apply if the application consists of baits or is made

in or within 3 feet of a structure)

Unlicensed Business Initiative

- MDA has continued to investigate unlicensed

companies providing or advertising pest

control services.

- MDA staff continues to monitor,

newspapers, yellow page directories, flyers,

various internet sites and investigate tips and

conduct field inspections.

- 18 complaints involved unlicensed

businesses and 18 notices were issued.
