Do you have some insurance customers getting a divorce?

by Curtis M. Pearsall, CPCU, AIAF, CPIA President – Pearsall Associates, Inc., and Special Consultant to the Utica National E&O Pro-gram

With the divorce rate over 40% for 1st marriages and over 60% for second marriages, it seems like it will only be a matter of time before your agency has a customer going thru a divorce. Are you ready for when that happens? These situations can obviously be very emotional. For the most part, the various personal lines coverages are based on the named insured and the residence. As a result, any change in the living arrangements can reduce / potentially eliminate coverage for one of the couple. There are two common scenarios: The couple is getting divorced and the agency knows about it or the cou-ple is getting divorced and the agency is not aware of it. Certainly both require very strong focus and tremen-dous attention to detail, and the necessity of accurate documentation. If the agency is aware of the divorce, this definitely makes resolving the various issues somewhat easier as you can ask questions to ensure that the coverages are being arranged properly. The key is to duplicate the coverage as much as possible unless one of the parties chooses not to do so. Attempt to meet with each party to get the necessary details. Determine any key issues that could impact how coverage applies. When dealing with the Homeowners coverage, do not look to make any changes to the named insured until the divorce is final. If you were to delete one of the parties before the divorce was final and there was a loss, the settlement would only be made payable to the resulting named insured (this happened not too long ago). You may need to place coverage for one of the parties if they are residing at a different location. This could be a renters policy or even a full HO policy. The current insurance program could include other coverages such as inland marine for jewelry, guns, paint-ings, etc.), wet marine or coverage for motorcycles, ATVs, etc. If the couple had an umbrella, once again, the goal is to ensure that the coverage is duplicated as best possible. This requires tremendous attention to detail and solid communication. There is certainly the chance that you won’t know about the divorce. Some things to be on the lookout for: There may be requests from one of the parties to modify the coverage. Typically it would be a reduction of some type. The request could also be to modify the named insured, delete coverage, cancel a policy, etc. Be careful. Most agencies require that the customer speak to an agency representative in this situation. This would give you the opportunity to maybe ask some questions. One question that you may want to ask: Is there any information that you have that would be benefi-cial for me to know? This hopefully would flush out some critical information. Then document what they tell you. A word of caution: make sure that you are taking direction from the named insured. If the spouse wants to cancel the husband’s gun collection, can you legally take direction from her? Be certain to check the policies in question to see who the named insured is. To ensure that each party receives the proper communication, the key is to treat each of the Named Insureds as a separate client. Letters should be sent to both informing them of the action taken and inviting questions or further changes that may be needed. Continued on next page

There is a chance that the agency staff will know the couple – it is important to detach yourself from the situation. If the applicable person does not believe that they can handle it without getting emotionally in-volved, ask another member of the staff to do so. Due to the frequency that divorces are occurring, take the time to plan now for when it happens

because it appears that it is only a matter of time before it does.

Life Lessons from Special Olympics Athletes by Chris Paradiso, President – Paradiso Presents, LLC

At this Three weeks ago, I attended my sister Rachel’s Special Olympics competition. My father and I arrived at the venue early in order to visit with my sister and many of the other athletes. What I witnessed that day was truly powerful and has had a lasting effect on me. I saw the dedication and support of many volunteers that day, but what had a lasting impression on me was seeing fraternities from the local college supporting and being involved in every part of the event. Many of these college students were actually in the pool work-ing with and assisting the Special Olympics athletes. While in attendance, I realized that over the past eight to ten years, I had not seen college students be so actively involved in an event such as this. These fraternity brothers had assembled cooking booths for all the athletes and attendees, along with dedicating their time and talent to work with the special needs of the athletes. During the hour and twenty minute ride home from the event, my father and I discussed how incredible it was to see a younger generation of students be so ea-ger and willing to help out and get involved with special needs athletes. We talked about how Southern Con-necticut State University and the committee of the Special Olympics had done such a wonderful job energiz-ing the younger generation to become involved with an event such as Special Olympics. Additionally, we dis-cussed how great leadership was shown on that Saturday morning and how it could affect my insurance agency. Growing up with a sister who has special needs was not difficult task, like many assume. It was simply what we knew. However, witnessing how special needs children were treated as I grew up was a very difficult task. Three weeks ago, I realized just how far society has come with the treatment of special needs athletes, and it brought a tear to my eye. During that Special Olympics event, many of the volunteers were handing out bracelets to be worn everyday with a saying on it that said “we need to remove the R word from our soci-ety”. The ‘R word’ has brought a lot of pain to many families in the past fifty years. I think it’s amazing that people from all walks of life have come together to put an end to the use of the ‘R word.’ Continued on next page

Life Lessons continued

There is a very good reason why the Special Olympics is called special- these young men and women can teach you more about life than you could have possibly realized. During my time at the event there three weeks ago, I learned three very valuable lessons about being an insurance agent from the special needs athletes. Number one- these athletes were extremely focused on accomplishing a goal. Number two- they had the most amazing attitude you could ever ask for in a person. Number three- not one of them ever complained, whether they came in first place they came in last place. Every one of those athletes had a smile on their faces from ear to ear, and we all knew that they had given their best effort. I hope you take these three very valuable lessons and include them into your daily life. I know I certainly will.

Grilled Shrimp Salad with Lemon Lime Vinaigrette For the vinaigrette: 1 tablespoon fresh squeezed lemon juice. Salt & fresh ground black pepper to taste (sea salt or kosher salt). For the salad: 8-12 ounces fresh Carolina shrimp, peeled and deveined. Tis the season for fresh caught Carolina shrimp! 2 tablespoons olive oil. Garlic salt to taste. ½ head romaine lettuce or regular lettuce torn into bite size pieces. 2 large enoki or button mushrooms, sliced. 2 medium slices of red or Vidalia onion, chopped. 1/3 cup grated carrot. 1/3 cup torn radicchio or red cabbage.
