Establishing a Public Safety Broadband Network

different spectrumchannel or geographiclocation following anincentive auction or stations that are

impacted by such anauction; or MVPD costincurred from carriageof relocated or sharedchannels

or equal to thedetermined value of compensation and allreverse auction bids arebinding on the licensee

FCC has the authority toreassign televisionbroadcast spectrumlicensees for thepurpose of conductingthe auction as long asthe costs reasonablyincurred by the licenseeare reimbursed

- However, reasonableefforts must be made to

preserve viewer access toover the air broadcastsignals and to ensure thatstation service andpopulation coverage aremaintained- FCC cannot reassign alicensee to move fromUHF to VHF channel broadcast TV license or 

MVPD have the option of 

requesting a waiver or modification of application of anyprovision of law or regulation administeredby the FCC or instead of reimbursement for relocation

May not require anyTV station licensee tocollocate its facilitieswith that of another television broadcast

station licensee inorder to transmit onthe same frequency.
