What is an RTA and when will the Law apply?

A residential tenancy agreement (or RTA) is an agreement that provides for the exclusive occupation of a self-contained residential unit (as prescribed under the Law) for a periodic term or a fixed term of 9 years or less.

The Law will apply to any RTA that is made after the Law comes into force, or those agreements entered into before the Law is in force but which are subsequently varied or amended.

While initially the Law will only apply to leases for qualified accommodation, it will apply to certain unqualified accommodation, such as lodging houses, following the implementation of the Control of Housing and Work (Jersey) Law 201- later this year.

What Now? Before the Law comes into force, the Minister for Housing is undertaking an extensive consultation process, which is due to close on 9th March 2012.

The aspects of the Law under consideration include whether a compulsory standard form of RTA should be introduced, and if so whether it should include a condition report and standard form of notice, to avoid uncertainty in relation to security deposits, breaches of conditions and the termination of the tenancy.

Islanders wishing to make a submission can do so either online by visiting the www.gov.je website or by contacting the Population Office.

What Next? Landlords and letting agents are encouraged to ensure that their letting documents are compliant with the requirements of the Law, and to seek

advice as to how the implementation of the Law may affect the management of their portfolio.

Tenants may wish to take advice in relation to their rights and responsibilities under the new Law. While not all residential leases will immediately fall within the scope of the Law, it is important to understand your legal obligations.

Nearly three years after being adopted by the States, the Residential Tenancy (Jersey) Law 2011 (the “Law”) is expected to come into force this summer.

The Law aims to provide a modern statutory framework to enable the development of fair, transparent and well-regulated agreements between landlords and tenants. In particular, the Law will establish:-

Insurance

Finance

Before you start house hunting, you need to find out how

much you can borrow and therefore what price (taking into

account surveyors and legal fees and disbursements) you can

afford to offer. Please note that stamp duty is payable on a

loan as well as a house purchase.

Ensure the information you provide in respect of any loan

application is accurate. If an offer of a loan is conditional on

certain insurance policies being in place, take steps to ensure

they are in place before completion. Carefully read any loan

offer and promptly return it duly signed to the lender. Check

that required funds will be available before completion. Little

will happen if the money is not available on the day!

Perhaps one of the most striking aspects of moving home is the sheer number of people you have to deal with and co-ordinate to ensure that your move actually happens. There are lawyers, mortgage brokers, banks and other lending institutions, estate

agents, valuers, surveyors, removal companies, insurance companies, utility companies, the post office, and possibly architects and tradesmen and the list can continue, but what do you need to do first?

The SurveyYou’ve found your dream house, but is it all it seems? valuation and structural surveys will give comfort that the house is worth what you are paying and is not going to require unscheduled works to keep it standing. Will the property re-sell? Do there seem to be any issues with neighbouring properties? If purchasing from a developer, what is included in the price and what guarantees are provided as to structure and workmanship?

Instruct Lawyer

It is probably never too early to instruct your lawyer in

respect of your proposed purchase. If possible, provide your

lawyer with clear, written instructions. Keep him advised,

not least if there are changes to the transaction. Ask your

lawyer to provide you with a written statement of all the

fees, disbursements and stamp duty you will be charged,

preferably in the form of a draft completion statement.

The value of striking up a good relationship with your lawyer

is of utmost importance. Given the sometimes obscure and

demanding nature of the Island’s conveyancing system,

competence and experience are essential for the smooth

running of your transaction.

Choose the right firm of lawyers! Choosing the right firm of

lawyers to act for you is also crucially important. Cheapest

is rarely best! The key to a successful move is planning so

that things are not left to the last minute and you are not

rushed into making hasty and ill-considered decisions. Treat

the selection of the correct firm of lawyers to act for you as

a critically important part of your purchase from the very

outset.

Which estate Agent Should You fall for?With romance in the air again this february Gill hunt of The Jersey estate Agents’ Association takes a loving look at how we could fall head over heels with…an estate agent.

Spring is round the corner and love is in the air. Yet spare a thought for poor estate agents. These, often undervalued, creatures are amongst the least likely to receive a great deal of affection from their clients on valentine’s Day - or any other day for that matter.

But right at the moment, in this dire economic climate, good estate agents can be a bit like perfect sweethearts. It is always best to have someone by your side who values you, who will fight for you, who won’t answer back - too much, who will only hang around your house when you want them to, and has all your best interests at heart. Such a person may not make such a bad partner.

Of course there are good partners and bad partners. Selling property well rests heavily on the partnership built up between seller and estate agent. A good agent will lovingly put your property on a pedestal and then negotiate fiercely to achieve the best deal for you. On the other hand, a lesser agent may just put your property on the internet with all their others and then haggle to find the easiest deal all round.

There is a great difference between the two – often many thousands of pounds. You could come to love the former but hate the latter. The trick is finding the right one at the outset. It’s a bit like finding the best boyfriend or girlfriend. They may look roughly the same but in practice they all act very differently.

So if you are searching for the type of estate agent you could come to love this spring invite a few around to give you some marketing advice and see how you get on. Then ask yourself which you would prefer, the flashy one who brags a lot and is cheap or the one who you feel most comfortable with to act in the most decent way: the one you can come to depend on.
