Jonathan Hughes (JH): Why should clients consider using planning specialist advisers?Michael Stein (MS): A wide range of residential and commercial clients have found our services to be of great value as it avoids them having to become personally embroiled in the planning process. This can be a very complex and frustrating experience and needs careful handling to produce the desired results.Claire Smith (CS): The new Jersey planning appeal system is particularly complex and we are able to help our clients navigate the pitfalls, hopefully to a fairer, more positive outcome.

JH: How and when can you appeal against a planning decision?MS: You have 28 days from the date a decision is made to appeal against it. You can fi nd the date of the decision on the decision notice.CS: You have to fi ll in the ‘Appeal of a Decision (Article 108 and 110 of Planning and Building (Jersey) Law 2002) Form’ which you can download from the planning pages of the States website or collect from the Judicial Gre� e at the Royal Court House, Royal Square. In the fi rst instance you just provide a brief outline of why you disagree with the decision.

JH: Who can appeal?MS: You can appeal against a decision if you have been refused planning or building permission or you disagree with a condition attached to a planning or building permission; or you own or occupy a building or land where a building, place or tree has been listed.CS: You can also appeal if you’ve made a written statement about your neighbours’ application where planning permission has been granted, and you live or have an interest in land within 50m of the application site.

JH: What are the costs of an appeal?MS: An appeal against the refusal to grant or to vary planning permission for major development is £300 and minor development is £100.CS: And an appeal against the grant of planning permission (known as a third party appeal) is £300.

JH: How should a typical appeal process work?MS: Once the appeal is accepted you have 28 days to submit full details of your reasons for appealing.

CS: If the appeal isn’t accepted the Judicial Gre� e will explain why, for example if it is submitted out of time. As Mike says, once the appeal is accepted, you have 28 days to submit your full arguments. After this deadline, everyone involved will receive each other’s cases, circulated simultaneously by the Gre� e and you have 14 days to comment on the other side’s arguments. You can’t raise any new issues at this point that weren’t raised in your initial statement. MS: Some appeals can be considered based on written statements but the majority will involve a hearing chaired by an independent inspector.CS: The inspector makes a recommendation to the Minister, but the Minster makes the fi nal decision and can choose to follow or depart from the inspector’s recommendation, giving reasons.

JH: How long will an appeal take?MS: The Gre� e state that decisions on appeals can be expected around 10 weeks from the date the appeal was accepted.CS: However I think there are many more appeals in the system than were expected (as evidenced by the brief increase in fees from £300 to £1200) so a time period of 4 to 6 months may be more realistic.

Shedding light on the new planning appeal system

MSPlanning Ltd is a one-stop shop planning and architectural service whose primary purpose is to secure permission for its wide range of clients, providing a professional service from the conception of a scheme to completion of the project. The team give professional advice on all planning matters, however large or small, advising clients on how best to secure planning permission or resolve planning disputes. Michael’s reputation, and that of the practice, is based on giving honest advice which, whilst sometimes disappointing, avoids the client entering into costly and abortive work.

Claire Smith is a very experienced planning, environment and construction law specialist, acting for individuals, local businesses in all sectors and government bodies. She joined Ogier in November 2015 as part of their recently launched Pan-Channel Island property, planning and construction law team, meaning that they now have a signifi cant presence across the Channel Islands underpinned by the strength and reputation of the long standing Jersey o� ering. Claire advises clients on planning law, heritage issues, viability, housing development, environmental law, lawful development and

enforcement. Claire also provides advocacy at planning appeals, negotiates planning agreements/covenants and advises on the legal robustness of planning applications (including environmental impact assessment).

Mike and Claire have worked on a number of appeals on behalf of both applicants and objectors together, and their clients have remarked that the new process seems very fair. They still await the outcome of the Minister’s decision on the recent appeals they have been involved with under the new system.

Jersey Lending Market How much further can mortgageproduct rates fall?More reductions have been introduced by Jersey lenders in the past few weeks, so making 2016 the year in which mortgage rates fell to the lowest that we have ever seen.

As the year progresses, we should see a slightly more relaxed attitude being shown by lenders and this means that mortgages could soon become available to more borrowers than at present.

LIVING SMALL: THE TINY HOME MOVEMENT

Welcome to a tiny world of converted horse-boxes and trailers, intimate spaces that have twice the utility and half the area. Who cares if you can’t stand up in the bedroom and there’s not enough storage space to swing a cat? This is about sustainable living and avoiding mortgages. 

With an average size of 100 - 400 square feet, tiny homes are roughly a quarter the size of a standard UK home and a fraction of the cost. You’ll save heaps on taxes and building, heating, maintenance, and repair costs. What’s more, you’ll discover a simple and uncluttered lifestyle with an environmental impact as tiny as your living room. 

It’s actually cheaper to build a tiny home than it is to rent a studio long term, but it does pay to think carefully about priority spaces and everyday needs. If you agree that less is more and want to build your

own tiny home, you fi rst need to fi gure out a fl oor plan. You must be ruthless and think only about the essentials - extra wardrobe space is a luxury when you’re vying for space with your tiny toilet. To get the most of your space, consulting an interior designer who can use that small space e� ectively.

Far from being the province of circus folk, the ‘tiny life’ is a bonafi de social and architectural movement. People are actively choosing to downsize the space they’re living in. If you’re interested in conserving the environment, saving cash or just want the luxury of more time and freedom, the tiny life is for you. 

It’s had worldwide media attention, and with good cause, since in the current climate the maxims of the ‘tiny life’ are eminently sensible - it encourages people to be frugal, and live simple and self

su� cient lives. And because of the low cost to build and relative ease of construction, they’ve been used to house refugees after Hurricane Katrina and to shelter the homeless after the fi nancial crisis. 

Still not convinced? Here’s some quick stats - 68% of tiny house owners have no mortgage in the US and 55% have more savings than the average American. 

Even better, it’s actually possible to go ‘on tour’ with your tiny home - if you build it with wheels it can be towed to the next town. If you do plan on taking your home on the open road it’s worth consulting the planning department and TTS.

With spring approaching and the bulbs coming up, what better time to put your property on the market and make it more saleable in the current competitive market?

A few simple rules followed can make all the di� erence to potential purchasers when choosing one property over another.  

Starting with the garden and front entrance, make sure these are pleasing to the eye so that anyone viewing is made to feel welcome and they don’t have to fi ght their way through overgrown shrubs, last autumn’s leaves, bicycles or dustbins.

Once you have potential purchasers inside, they can look at the property and visualise their own e� ects in situ and decide on any decoration or colour that they want to introduce themselves to put their own stamp on the property.

Make sure all rooms are de-cluttered as much as possible as nobody wants to see all surfaces covered with personal belongings. Try to fi nd a place for everything whether it is in a drawer, a cupboard, the loft or the garage. Apart from anything else, de-cluttering will make any room appear much bigger. In addition ensure that all curtains and blinds are fully open so that natural light can fl ood through the windows.

Choosing neutral décor will also make rooms appear much larger and brighter.  Although you may love bright colours, these may not be to others’ tastes and the thought of having to redecorate a house from top to bottom as soon as you have bought it may not be everyone’s cup of tea or coffee!

Talking of coffee… first impressions go a long way towards the final decision, and what better way than to have a pot of coffee brewing, or some bread baking for viewings, which would certainly be preferable to unwashed animal bedding or trainers lurking in the hallway!
