Along the main stretch of road passed St Ouen’s Village toward Vinchelez, you’ll recognize the road, which bends off to the right to Greve de Lecq where the old Leoville Hotel used to stand… Well, just after that on Route de Vinchelez, on the left there is an opening to a soon to be, very elegant driveway to Bay Tree Cottage: A lovingly restored traditional barn, overlooking farmland and meadows, set within the charming country lanes in the heart of the West.

Cynthia was there at Bay Tree Cottage to tell me all about her biggest endeavor

yet and to show me the uniqueness of each property, “We make homes, not houses,” she said. So true, a woman’s touch is perfectly sprinkled throughout the site as Cynthia treats each home as though it were to be her own. Still, just the right balance is managed, leaving in her property path a sense of style rather than ownership. A canvas primed to perfection. The drive is, at the moment still under some construction, Bay Tree Cottage, however is ready to move right in to. The large parking bay is surrounded by raised flower-beds and the forecourt is lit up in the evening, showing off the granite restoration. As with many barn conversions and restorations, treasure can be found – an old water pump was one of the discoveries at Bay Tree Cottage and the old relic now sits proudly atop the opening to the parking bay.

The entrance in the front garden leads directly into the living room, handy indeed for little ones who like to venture outdoors - the garden has a secure gate and wall surrounding it. The front door is

situated just at the side of the property, with a wide walkway belonging to Bay Tree Cottage. The front door leads into a spacious reception, with a large storage cupboard directly in front, for wellies, coats and brollies, vacuum etc. Stepping into the living room, the large front window and garden door fill the room with light. A westerly orientation ensures that the warmth remains right up until sundown.

The cottage has been dressed, which makes for more of a fun viewing - immediately starting to visualize living there. Sitting on the sofa in front of the log-burning stove in the fireplace, I imagined Christmas Day, which, aptly is when the rest of the development is set to be ready: ‘Juniper Cottage’ and it’s little neighbour, ‘Thyme Cottage’ as well as the main house where developers, Cynthia and Mervin intend to live. Back to the fireplace… it is one of the highlights of the living room. A Jersey Oak mantle piece with a white cement chimney, rugged texture and coziness: A real appreciation of the building. *I was so glad they didn’t paint

it. Under-floor heating warms the whole of downstairs leaving the walls free from radiators. The carpeted Living room leading onto the porcelain tiled floor throughout the hallway, cloakroom and kitchen.

The downstairs cloakroom is an impressive size, with carefully considered features and décor. The grandly sized second mirror, flush with the wall (excuse the toilet pun), is a fabulous extra for last minute hair adjustments and a quick twirl. The fixtures and fittings are stunning, a perfect finish and there is a vast storage cupboard in there too.

Into the kitchen, the huge, homely country kitchen… *Gasp. Its size is magnificent and with a pretty table lay out and a few finishing touches, I picture breakfast overlooking the vast lush garden. This house is wooing me. All the usual necessities are integrated in the kitchen, high quality Rangemaster oven, Villeroy & Boch Belfast sink, plus a few added extras like the über cool electric sockets set in the

corners, no crumb or grime pick up… clean and efficient. The taps of boiling hot and freezing cold filter water is a coveted feature for sure and the beautiful oak continues through into the heart of the home.

The kitchen leads out onto a large patio area and up onto the garden. With fledgling bushes separating next-door’s plot, the expanse of the space outside is fantastic. With a stable fence at one end, the garden has space for a vegetable patch, kid’s play area or a hot tub if you’d rather. Plenty of room for a BBQ area, Bay Tree Cottage’s garden is an undoubtedly ideal host place for outdoor entertaining. Up the stairs and onto the split landing, up again to the right is the en suite master bedroom and smaller double bedroom (this room would be an ideal kids room, playroom or a decadent dressing room if kids don’t apply). Fitted cupboards have been installed on the landing where wasted space would have left a ledge for dust-gathering objects… The cupboards provide a lot of space, for hanging clothes,

and suitcases, toys or boxes etc. The master bedroom overlooks the West with a sea view across farms and fields from a Juliet balcony - this bedroom is brimming with rural charm. Sunset from here will be quite the picture.

The second largest bedroom and house bathroom are across the split landing. Beautifully decorated and finished, high ceilings are a feature, with exposed beams and woodwork throughout upstairs. The bathroom contains a feature shelf with modern lighting and porcelain tiles on the floor. The colour scheme and wood finishes have been chosen with care and compliment the décor of the rest of the house perfectly, as with every detail in every room.

Insurance

If you are buying a freehold property, you will become the owner of the property as soon as your contract is passed before the Royal Court. You should insure the property in your name (and possibly that of your lender) for its full replacement value from the moment of completion. Share transfer and flying freehold properties will usually already have buildings insurance, but you should insure the contents and your personal possessions.

You should also consider taking out life, critical illness and disability cover, especially if you are borrowing money.

Finance

Before you start house hunting, you need to find out how

much you can borrow and therefore what price (taking into

account surveyors and legal fees and disbursements) you can

afford to offer. Please note that stamp duty is payable on a

loan as well as a house purchase.

Ensure the information you provide in respect of any loan

application is accurate. If an offer of a loan is conditional on

certain insurance policies being in place, take steps to ensure

lawyer to provide you with a written statement of all the

fees, disbursements and stamp duty you will be charged,

preferably in the form of a draft completion statement.

The value of striking up a good relationship with your lawyer

is of utmost importance. Given the sometimes obscure and

demanding nature of the Island’s conveyancing system,

competence and experience are essential for the smooth

running of your transaction.

Choose the right firm of lawyers! Choosing the right firm of

lawyers to act for you is also crucially important. Cheapest

is rarely best! The key to a successful move is planning so

that things are not left to the last minute and you are not

rushed into making hasty and ill-considered decisions. Treat

IF YOU’VE DECIDED TO DEVELOP YOUR PROPERTY, ONE OF THE FIRST HURDLES YOU WILL FACE WILL BE OBTAINING THE NECESSARY PLANNING PERMISSIONS. THIS PROCESS CAN SEEM DAUNTING, LENGTHY AND EXPENSIVE BUT IT DOESN’T NEED TO BE. HERE, MICHAEL STEIN OF MSPLANNING PROVIDES A USEFUL CHECKLIST OF THINGS TO CONSIDER BEFORE YOU START TURNING YOUR DREAM INTO REALITY.

1. WHAT PLANNING ZONE IS THE SITE IN?Most of the Island’s land is in the Green Zone, which provides protection and a general presumption against new development but there are still certain types of development that might be permissible. Other zones may be more restrictive (coastal national park), or less restrictive (built up areas). Find out what zone your site is in to determine what development is acceptable.

2. WHAT ARE THE RELEVANT PLANNING POLICIES?The Island Plan contains many other planning policies relating to the economy, housing, transport and so on. All the relevant policies for your land will, generally, need to be complied with so knowledge and understanding of these policies is necessary.

3. ARE THERE ANY OTHER STANDARDS OR GUIDELINES RELEVANT TO THE PROPOSAL?In addition to the Island Plan, be aware of Supplementary Planning Guidance documents. These provide guidance on various tasks which need to be carried out to accompany planning applications, and identifies various standards to be met.

4. ARE ANY OF THE BUILDINGS LISTED?Around 4000 buildings in the Island are included on the register of buildings for their architectural or historical importance. The register is currently being reviewed. These buildings are heavily protected against demolition, partial demolition or external alteration and some have their internal fabric protected too. It is sensible to obtain professional advice as you cannot make any external alterations without planning permission.

5. WHAT SERVICES ARE THE SITE CONNECTED TO?Developments which involve a large increase in site use will, normally, require the site to be connected to the foul sewer. If connection is proven to be too costly (a formula exists for working it out), then connection onto a tight tank may be allowed. Connection to the mains water supply is not a prerequisite so a proposal can rely on a borehole (but note these are now licensed).

6. IS THE ACCESS SATISFACTORY FOR HIGHWAY SAFETY?Increased site use may also require improvements to be made to sub-standard existing accesses, for highway safety. We recommend professional guidance be sought in advance of any approach to the highway authorities to see how access can be improved.

7. WHAT DESIGN APPROACH SHOULD BE FOLLOWED?A new building needs to fit comfortably in its context in terms of size, scale and design. Is a modern design appropriate or would a traditional form be more in keeping? More often than not a building will need to be under-stated rather than iconic.

8. DOES THE SITE HAVE A PLANNING HISTORY?It is worthwhile researching the planning history for your site to see if previous similar proposals have been approved or refused. If a previous application has been refused, it is possible the reasons for refusal could be addressed to reach a successful outcome.

9. IS THERE ‘PLANNING GAIN’ FROM THE PROPOSAL?A proposal that brings physical or environmental improvements for the community, such as improving highway safety for a number of properties outside of the application site, can be used to support a proposal, especially if the planning considerations are finely balanced.

10. ARE THERE ANY RESTRICTIVE COVENANTS WHICH PROHIBIT DEVELOPMENT?It is not uncommon for applicants to have paid for expensive plans and obtained planning consent only to find that the title deeds to their property prohibit them from carrying out the development as planned. Private property rights override planning consents.

In the world of plants, gardens and flowers, the idea of ‘vintage’ relates to our own fondest memories of those plants, scents, places and the people who we associate with them. We all have a trigger plant in our memory or mind somewhere, but you may just not be able to name it. Here are some of the most classic plants and flowers, that when brought together in one garden will truly make your patch the most memorable piece of vintage gardening going!

ROSES I love classic English roses with big dopey flowers and a subtle scent of myrrh.

LAVENDER Has greatest scent, it is easy to grow and adored by every generation; this one is the ultimate classics.

FORGET ME NOT A wonderful little plant that adores the slightly damper shadier gardens.

HONESTY This is a personal favourite, not only do they have beautiful flowers, the seedpods form gorgeous moon like plates that glow when the light hits them.

SWEET WILLIAM A Stunning sweet smelling biennial with pretty heads of glowing pinks, reds and crystal whites.

JASMINE Again loved for its scent which it releases in delicate waves in the early evening.

HONEYSUCKLE This is so easy to grow, it has flowers that look like pale sea anemones.

BUDDLEJA This has always been popular due to its huge attraction to butterflies and bees. It is a stunning plant, easy to grow, loves the sun and can make a stunning hedge.

HYDRANGEA Some love these plants, some don’t, but this is quite simply vintage Jersey, huge rounded heads of the purest shabby chic. I love them, no pests or disease and easy to grow!

A BULTHAUP WOW-FACTOR TRANSFORMATIONCharlie and Angela had been working on their house, rebuilding their four bathrooms, and improving windows in other rooms. Their kitchen was the next big project.

The brief they gave Stewart Carr at bulthaup Winchester was to create a light, airy, highly contemporary and cutting edge kitchen in line with the bathrooms they had already completed.

Stewart worked with Interior Designer Lynne Skelton to get the maximum potential out of the space. The utility room used to be next to the kitchen, separated by a small patio, and it was decided to extend the kitchen out across the patio to meet the utility. This provided the necessary width to enable a fabulous long central island - something that Angela had always wanted.

Lynne was keen for the new space to stand out structurally from the rest of the house and created a huge glass corner giving clear views of the garden. A large electric glass roof light in the ceiling further enhanced the feeling of light and space.

Charlie and Angela decided to finish the central island in applewood with a slim and practical 10mm stainless steel worktop. This is their main preparation, storage and cooking area; it includes an Atag induction hob and a seamlessly integrated bulthaup sink.

A tall run in Alpine white laminate with laser welded edges was created to discretely hold a Gaggenau fridge freezers, ovens, a wine chiller and a crockery cabinet, with internal drawers for easy access right to the back. The opposite wall IS the designated washing up area with a wide bulthaup stainless steel sink and draining area, Miele dishwasher, and further storage.

“The finished result really is incredible” Charlie enthused “Angela and I are bowled over with just how fantastic it looks.”

The following is a brief synopsis of what you might expect to see in your purchase contract.

FORMAL GREETINGS

All hereditary contracts open with general greetings of the Court by the Bailiff acting under the Sovereign authority. Whilst the passing of contracts takes place in a formal Court sitting it is not a judicial procedure and the Court is acting as a place of record for a transaction in property agreed between the parties.

INTRODUCTION OF THE PARTIES

The names of the transacting parties are set out at the beginning of the contract. To pass contract a party must either appear personally or by attorney, their legal guardian (tuteur), or in the case of interdiction, by their curator. A person of legal age and capacity can appoint anyone as their attorney, whereas the appointment of a guardian or curator is overseen by the Court.

DESCRIPTION

The contract will describe the property and its appurtenances (e.g. a house and garage, with dependant garden and land) and will set out the property’s Unique Property Reference Number together with a plan indicating the location and extent of the property.

The boundaries of the property will be described in the contract, by reference to where and how the property joins neighbouring lands. The plan attached to the contract is for identification purposes only, and cannot be relied on to assess a property’s boundaries.

SERVITUDES

The contract recites the rights and restrictions applicable to the property. These vary significantly depending on the type, location and history of a property.

Positive rights may include rights of way and access over neighbouring land, and the right to bring mains and other services to the property. The clauses will set out how such rights may be exercised and any associated conditions or limitations. Building restrictions may limit future development of the property and there may also be restrictions that limit its use, e.g. commercial uses or keeping animals.

BUYER BEWARE

Most purchase contracts will contain a standard “vices cachés” or “hidden defects” clause, meaning that the purchaser accepts the property in the condition that it is at the time of passing contract, without any warranty from the seller.

PROVENANCE

Towards the end of the contract you will find a clause that transfers all charges, conditions and restrictions to the purchaser. It sets out the title to the property for at least the past 40 years so that it is possible to trace the history of ownership of the property.

CONSIDERATION

The purchaser undertakes to pay the purchase price to the seller, and the consideration clause will include any

specific agreements between the parties – such as deductions of a deposit paid in advance. As contracts are passed on a Friday the practice is that monies are not transferred until the following week (usually on the following Tuesday).

POSSESSION

Most contracts provide for immediate vacant possession of the property to be given upon passing contract however, in practice, this rarely occurs because most house moves take place during the course of the weekend.

It is possible to delay taking possession for an agreed period or to acquire the property subject to the continuance of an existing lease.

THE OATH

The contract will conclude with an oath that the parties will not act nor cause anyone to act against the contract on pain of perjury. This oath is affirmed when the contract is passed before the Royal Court, and the Bailiff (or other judge sitting in place of the Bailiff) will ask the parties to raise their right hand and swear the oath before the contract is considered to be passed.

CONVEYANCING: AN OVERVIEW OF A CONTRACT

A conveyance is a hereditary contract which conveys property from one person to another, such as a sale, gift or an exchange of properties. The transfer of ownership or “title” takes place before the Royal Court of Jersey. The contract is then registered in the Public Registry and is open to public inspection.

Buying a property is one of the most stressful events to occur during your lifetime and in these difficult economic times it can be even more so. Coupled with uncertainty at work and fear of redundancy, getting a foot on the property ladder can seem an almost unattainable goal for many first time buyers.

However if you consider sharing the deposit and mortgage repayments with a friend or a member of your family, this results in an achievable monthly repayment and part ownership of an asset, by way of the property.

As with any financial arrangement, there are risks to be considered and anyone proceeding along this path should take independent legal and financial advice.

Here are some of the benefits and risks:

Benefits Joint Deposit – Sharing the deposit means each party is paying less than they would if purchasing alone and are therefore able to save quicker;

Joint Costs – All legal, surveyor and other fees would be shared and thus cheaper;

Larger Property – It may be that a more expensive property could be considered as a result of the shared expenses;

Shorter term – With shared mortgage repayments the term may be shortened and interest costs possibly reduced;

Cheaper Maintenance – with shared ownership of a property, all maintenance costs would be shared and thus reduced individually.

Risks Added legal costs – associated with setting up a formal agreement for co-purchasers;

Disagreements – these may arise if one party wishes to sell their share of the property before the other;

Financial implications – if one party contributes more of the deposit than the other.

In conclusion then… to quote the well known Beatles song “With a little help from your friends….” many more purchasers have the opportunity of taking that all important first step onto the property ladder.
