SECTION A:

SHIP GENERATED WASTE

1. INTRODUCTION

The International Convention for the Prevention of Pollution from Ships (MARPOL) is the main

international convention covering prevention of pollution of the marine environment by ships and was

adopted on 2nd

November 1973 at IMO.

The Convention includes regulations aimed at preventing and minimizing pollution from ships and

currently includes six technical Annexes:

Annex I Regulations for the Prevention of Pollution by Oil

Annex II Regulations for the Control of Pollution by Noxious Liquid Substances in Bulk

Annex III Prevention of Pollution by Harmful Substances Carried by Sea in Packaged Form

Annex IV Prevention of Pollution by Sewage from Ships

Annex V Prevention of Pollution by Garbage from Ships

Annex VI Prevention of Air Pollution by Ships

The Merchant Shipping (Port Waste Reception Facilities) Regulations 1997 (as amended) place a

duty on every harbour authority to provide adequate facilities for the reception of prescribed wastes

from ships using the harbour.

This document is Section A of the Port of Felixstowe’s Waste Management Plan, setting out the

measures in place for the reception and control of ship-generated waste.

It is complementary to Section B, which deals with the landside waste.

Revision of Port Waste Management Plan

In order to comply with the Regulations in July 2016 the Company carried out the following review

procedures and submitted its Waste Management Plan for approval as required by the Regulations.

Consultation with interested parties

Analysis of the type and capacity of facilities

Consideration of the location and ease of use of facilities

Review of the type and capacity of facilities

Consideration as to whether cost of facilities provides a disincentive to use

Review of the publicity given to the facilities

Details of the methods/results of the above procedures are as follows:

1.1 Consultation

Consultation with potential users was carried out via the Felixstowe Port Users Association (FPUA),

a body whose aims include liaising with the Port Authority to represent, protect and promote the

common interests of its members, and to resolve problems of a localised nature quickly and

efficiently.

FPUA represents Shipping Lines, Freight Forwarders, Hauliers and Port Related Services.

Consultation involved issuing a questionnaire regarding the quality and extent of waste reception

facilities on the Port. Responses were shared with the Company and, where appropriate, acted

upon.

All ship waste declarations are electronically received via Destin8, which is passed monthly to the

local MCA office. Any vessel not pre-entering the information into the system is contacted and

warned, and details of any vessel/company persistently not pre-declaring are passed to the MCA.

Annex I - Oily Waste

Oily waste is the generic term used for dirty ballast water, tank washings, scale and sludge, oily bilge

water, and sludge from the purification of fuel oil.

Annex V - Garbage

The quantity of waste for vessels calling at the port has been obtained from the Waste Disposal

Notification System on Destin8.

This information is stored for at least 3 years.

Annex IV - Sewage

Following the Merchant Shipping and Fishing Vessels (Port Waste Reception Facilities)

(Amendment) Regulations 2009 sewage is now considered part of a vessel’s generated waste.

To date no requests have been made to discharge sewage at the port.

1.3 Type and Capacity of Waste Facilities

(a) Having taken into consideration the actual figures for Annex V Waste, it was determined that

sufficient capacity was available for this waste, and that suitable and sufficient capacity is

available until the next review date.

These facilities are available at the vessel’s side by calling the Dock Tower on VHF Ch 74 or

direct dialling the Quayside Shift Manager on 5440. The skips are mounted on roll trailers.

(b) With regard to Annex II Waste, none has been received into the port for the last 5 years.

Should reception facilities be required, they can be made available by contacting the local

contractor.

(c) Annex I Waste is collected by an authorised contractor. Annex 1 Waste is recycled by the

contractor. Any fees incurred to be allocated as necessary.

1.4 Providing Information to Users

Information on garbage disposal is provided to all vessels as Section II of the Port of Felixstowe

Shipmaster’s Information Booklet.

This booklet is issued to all vessels on their first visit, by the Marine Department, and annually

thereafter.

The booklet is regularly updated (latest edition September 2012) with vessels supplied with the latest

copy on their next arrival; this is recorded in the Port’s Marine System.

Also notices are displayed on Maritime Cargo Processing (MCP) Destin8 screen informing agents of

any updates or changes.

An information poster is placed on board each vessel advising the crew of the correct procedure for

disposal of food waste (as per Appendix III).

Information is also available via radio/telephone from the Dock Tower.

2. PROCEDURE TO COMPLY WITH THE WASTE (ENGLAND AND WALES) REGULATIONS 2011 (AS AMENDED)

This section applies to vessels’ garbage (Annex V Wastes) only.

The nature of the waste must be ascertained before disposal and the correct code from the List of

Wastes allocated.

A Waste Transfer Note is completed and signed by representatives of the Company and the vessel.

Copies of this WTN are left with the vessel and sent to the vessel’s agent and the Procurement

Department.

A monthly summary of waste transferred is prepared and kept available for inspection by any waste

regulation authority who may serve a notice for its production.

3. PROCEDURE TO COMPLY WITH THE HAZARDOUS WASTE REGULATIONS 2005 (AS AMENDED)

This section applies to international catering waste and any other hazardous waste a vessel may

wish to land, with the exception of oily wastes (Annex I) which are collected by separate

arrangement between the vessel and local contractors and are not the responsibility of the port or

the Company insofar as documentation of the waste transfer.

Wastes defined as hazardous by means of their entry in the List of Wastes shall be subject to a

Consignment Note prepared by the master of the vessel in accordance with Regulation 39 of the

Hazardous Waste (England and Wales) Regulations 2005.

A Consignment Note must accompany each transfer of waste, since no facility exists for ‘standing’

Consignment Notes. Each consignment Note must be coded as follows:

SHPFEL/YYYZZZ

Where SHP denotes a collection of waste from a vessel

YYY denotes the trading name of the shipping line

ZZZ is the collection number

Collections of waste from the port will be subject to a further Consignment Note, usually prepared by

the waste carrier, as part of the standard procedure set out in Regulation 36.

Copies of the Consignment Notes must be kept by the Procurement Department for at least 3 years

following the transfer of the waste to which it refers. A monthly summary of waste transferred (both

from vessel to port and port to disposal point) will be prepared and will be kept available for

inspection by any waste regulation authority who may serve a notice for its production.

4. RESPONSIBLE PERSONS

Waste collections from vessels are co-ordinated by the Operations Department through the Quay

Equipment Controllers. Onward disposal through the port’s waste contractor is the responsibility of

the Waste Manager, Procurement Department, who also maintains all waste records.

5. MARINE WASTE (PORT RECEPTION FACILITIES)

5.1 Legislative Background

(a) EU Directive 2000/59/EC on port reception facilities for ship-generated waste and cargo

residues as amended by Directive 2007/71/EC which are incorporated into English law by

the Merchant Shipping and Fishing Vessels (Port Waste Reception Facilities) Regulations

2003 (SI 2003/No: 1809) as amended by the Merchant Shipping and Fishing Vessels (Port

Waste Reception Facilities) (Amendment) Regulations 2009 (together the Regulations).

Under the Regulations harbour authorities are required to provide reception facilities for ship

landed waste including oily residues, noxious liquid substances and ship generated waste

(including sewage) without causing undue delay to vessels. This duty may be contracted

out. Harbour authorities are required to have a pre-notification system and a mandatory

charging system in place.

(b) The International Convention for the Prevention of Pollution from Ships, 1973, as modified

by the Protocol of 1978 (MARPOL 73/78), Annex V requires harbour authorities to provide

adequate reception facilities for garbage. See also MCA Guidance Note 387.

(c) Under the Regulations vessels are required to:

1. Provide notification before entry into a port or terminal of waste they wish to

discharge, including information on the type and quantity. This information is

entered on Destin8 prior to arrival of the vessel.

2. Deliver their waste to port reception facilities before leaving the port or terminal,

unless they have sufficient dedicated storage capacity to store the waste until the

next port of call and have followed the required notification procedure. This

information is recorded on the Waste Declaration via Destin8.

3. Pay the port a mandatory charge to significantly contribute to the cost of port

reception facilities for ship-generated waste whether they use them or not.

Exemptions may be granted and exempt vessels are recorded on the Port Marine

System once an exemption certificate is received from the MCA. See example in

Appendix II.

(d) Harbour authorities are exempted from holding waste management licences so long as the

total quantity of waste discharged from each vessel does not exceed 20m³ and is not stored

for more than 7 days.

(e) The Secretary of State may grant an exemption from all three of the following requirements:-

to notify the harbour authority or terminal operator before entry;

to deliver all ship generated wastes; and

to pay a mandatory charge at each harbour/terminal regardless of use, provided

that:

the ship is engaged in scheduled traffic with frequent and regular ports of call; and

there is sufficient evidence of an arrangement ensuring the delivery of ship-

generated waste and payment of charges in a port along the ships route.

Companies wishing to apply for an exemption should refer to MGN 387. An example of the

exemption request form is in Appendix V.

5.2 Procedures for the Removal of Oily Residues from Vessels

a) Any shipping line or its agent requesting reception facilities for oily residues should apply to

the Marine Department (Dock Tower) giving at least 24 hours’ notice. (Tel: 01394 604724).

b) Dock Tower personnel will advise the use of Hydrodec (or other appointed contractor from

time to time) as contractor to remove such residues.

c) The appointed contractor has provided the Company with a full method statement and

details of its facilities, its arrangements with HM Customs & Revenue and details of its

insurance arrangements. Costs for the provision of services by the appointed contractor will

be by arrangement between the appointed contractor and its customer.

d) The appointed contractor will remove the oily residues in compliance with the Company’s

General Bye-Laws and with the Port of Felixstowe Code of Practice for Tankers Operating

on Quays, contained within its permit to operate, as issued annually by Head of Health and

Safety (see 5.3 below).

e) The appointed contractor will remove oily residues for re-processing and re-cycling.

f) The appointed contractor is licensed for the transfer and disposal of waste and also for the

handling of transfrontier shipments of waste.

5.3 Code of Practice for Tankers Operating on Quays

(a) High visibility clothing and safety helmets must be worn.

(b) Permission must be sought from appropriate Terminal Management/Supervision prior to

carrying out any operation. A permit to work system is operated via the Terminal Quay

offices.

(c) Road tankers must have fully enclosed tankage and fitted with gate or ball valves in good

working order.

(d) All collection and/or discharge pipes (i.e. flexible hoses) to be empty of any product, with

drip caps fitted to the ends.

(e) All flexible hoses, pipes, lines, couplings and connectors to be of sound approved

construction and free from leaks and defects.

(f) On completion of collection, all lines to be emptied, caps fitted and tank valves shut prior to

vehicle moving off.

(g) All vehicles to be fitted/supplied with spillage cleaning materials i.e. granules, detergents,

mops, shovels and brushes.

(h) On instruction from any authorised Company personnel or the responsible Ship's Master,

pumping shall cease.

(i) Adequate public liability and third party insurance to be in place.

(j) The failing of a company to comply with the above conditions may result in that company

being refused access to quays within the port.

(k) IN THE EVENT OF A SPILLAGE the driver/agent to inform immediately Terminal

Management, the vessel's Duty Officer and Marine Supervisors - Dock Tower.

In addition to the above, in the event of a spillage the driver is to immediately cease pumping and

attempt to contain the spillage with materials on board his vehicle.

Under no circumstances should the driver continue pumping after the spillage has been cleaned up,

until Company personnel have given approval.

5.4 Reception Facilities for Garbage from Vessels

The port provides reception facilities for garbage as follows:

Segregated and labelled wheelie bins for recyclable waste

Covered skips for Category 1 international catering waste

REL bins for non-recyclable or otherwise contaminated waste

These receptacles are placed on roll trailers for ease of movement to vessels.

When a vessel requires waste removal, the vessel’s agent will contact the Quay Equipment

Controller (QEC) and an agreed time for delivery and collection of waste shall be arranged. The

QEC will arrange for the roll trailer to be delivered to the vessel and then returned to its designated

bay.

Vessels are advised that these skips are provided for small-bagged quantities of the following:

Food wastes and other materials contaminated by such wastes generated on board vessel, principally in the galley and dining areas.

Refuse generated in living spaces of crew and passengers, principally paper products, glass, rags, bottles and plastics etc.

Waste from ship's stores generated on board vessel.

Vessels are prohibited from dumping, discharging, or allowing to fall into the water any solid waste

matter.

For large quantities of waste and for cargo associated wastes, vessel maintenance wastes and

cargo residues not defined or listed in the MARPOL Convention, the vessel's agent must be

contacted to make arrangements for appropriate facilities with a collecting agency.

For the purposes of compliance with the transfer of waste legislation, waste must be itemised on a

waste transfer note, which must be copied to the vessel, the Company’s Procurement Department

and the vessel’s agent.

It is the responsibility of the Waste Manager to ensure that a licensed waste disposal contractor

empties skips once full.

5.5 Reception Facilities for Sewage from Vessels

This requirement contained within Annex IV of MARPOL 73/78, has been incorporated into English

law by the Merchant Shipping and Fishing Vessels (Port Waste Reception Facilities) (Amendment)

Regulations 2009. Collection is to be arranged through vessels’ agents.

5.6 Reception Facilities for Cargo Residues from Vessels

The master of a ship shall ensure that cargo residues are delivered to a port reception facility in

accordance with the provisions of Marpol 73/78. Any fee for delivering cargo residues shall be paid

by the user of the reception facility. As the Port of Felixstowe does not handle tanker traffic there are

no reception facilities for cargo residues in the port, other than those used for disposal of waste oil

from vessels the port normally handles.

5.7 Reception Facilities for Residues from Exhaust Gas Cleaning Systems

To date, no requests have been made regarding providing reception facilities for exhaust gas

cleaning system residues.

6. DREDGING WASTES

6.1 Legislative Background The Marine Management Organisation (MMO) is responsible for issuing licences to enable harbour

dredging to take place. Permission is also required to dump dredged spoil.

Such licences are issued under the Marine and Coastal Access Act 2009 (Part 4).

The MMO maintains a copy of all marine licenses pursuant to the Marine Licensing (Register of

Licensing Information) Regulations 2011.

6.2 Pollution of Dredging Spoil

Pollution of dredging spoil may be caused by a number of sources:

The effluent of the port and its associated sites (licensed and illegal).

Accidental spillages of polluting substances.

'Imported' water pollution from upstream industrial or agricultural activities.

It is the port's aim to prevent such pollution through the following means:

Evaluating the technical possibilities for making effluent cleaner through assessment in

liaison with Anglian Water Services and the Environment Agency.

The use of checklists for bulk liquid cargo transfer operations.

Safe handling of 'packaged' pollutant liquids (including tank containers).

Training of personnel, good housekeeping, effective emergency response and strict

enforcement of codes of practice.

6.3 Dredging Policies and Procedures

Maintenance dredging takes place at 12 week intervals under MMO licence and in consultation with

Harwich Haven Authority.

Capital dredging works involving port expansion and channel deepening are only undertaken after

environmental impact studies have been made, and are also subject to the MMO licensing

requirements.

7. PROVISION OF INFORMATION TO VESSELS

All ships' masters visiting the port receive full information concerning all the reception facilities for

waste available at the port. This is promulgated through Section II of the Port of Felixstowe

'Shipmasters Information Booklet'.

An information poster is placed onboard each vessel bringing to the attention of the crew the need to

place food waste in a separate marked skip at the port. See Appendix III.

8. RECORD KEEPING

It is the responsibility of the Company’s Procurement Department to maintain records of waste

accepted into the port's reception facilities from a vessel and to supply such information as required

to the Maritime and Coastguard Agency.

Records are obtained from the Destin8 computer database passed to the Portmaster on a ship-by-

ship basis.

Such records will be supplied to the Portmaster by Hydrodec, Destin8 and by the Procurement

Department for their various areas of responsibility.

These records are stored for at least 5 years.

9. PLAN REVIEW This Waste Management Plan will be reviewed on a three yearly basis by the Portmaster and the

Head of Health and Safety, Hutchison Ports (UK) Limited. The next review date will be July 2019. The first review was carried out in January 2001.

10. COMPLAINTS PROCEDURE

If the Port of Felixstowe’s waste reception facilities are not satisfactory, the details should in the first

instance be brought to the attention of the Dock Tower on 01394 604724. The Dock Tower will then

inform operations staff to take corrective action.

If the complaint is not dealt with satisfactorily, a complaint form in Annex D of the MCA Marine

Guidance Note (MGN) 387, should be completed and sent to the MCA at:

10.2 Reporting of Vessels that do not comply with the Merchant Shipping (Port Waste Reception Facilities) Regulations 2003 (as amended)

Non-compliance is automatically recorded through the Destin8 Waste Disposal Notification system.

This is monitored regularly, and in instances of non-compliance the vessel's agent will be informed.

If the issue is not resolved, the vessel will then be reported to the MCA for non-compliance.

11. CHARGES FOR DISPOSAL

11.1 Annex V Waste (Garbage)

Facilities for the collection and disposal of Annex V waste from vessels calling at the port are

provided as per a list of charges published in the Port Tariff.

Unless exempted, all vessels calling at the Port of Felixstowe will be required to pay a charge

towards the cost of waste reception facilities:

Vessel up to 175m £39.56 per call

Vessels over 175m £77.85 per call

(Correct at 1st July 2016 - these rates may be subject to change).

11.2 Other Waste (including Hazardous Waste)

The collection and disposal of any other waste, including cargo associated waste, vessel

maintenance waste (Annex I and II of MARPOL) and hazardous wastes are subject to a charge.

This charge will vary according to the type and quantity of waste to be disposed of.

Special arrangements and contract terms should be negotiated directly between the vessel’s agent

and the collecting agency.

Information on the costs of disposal is commercially sensitive and may be obtained from the

contractor concerned.

Appendix VII Port User Questionnaire Under the Merchant Shipping and Fishing Vessels (Port Waste Reception Facilities) Regulations 2003 (as

amended) and MGN 387 guidance, every harbour authority is required to provide waste reception facilities

adequate to meet the needs of ships using the harbour and without causing undue delay to ships.

The Authority should prepare a Waste Management Plan, submitted to, and approved by, the Secretary of

State. The views of port users should be consulted prior to the plan being approved. The Plan should be

reviewed at three-yearly intervals.

As part of the review process, I would be grateful if you could respond to the questions below:

1. “Vessels should notify the Authority of the waste they plan to discharge, including information on

types and quantities, at least 24 hours before arrival”.

This process is currently undertaken within the Destin8 reporting requirements.

SECTION B:

SHORE GENERATED WASTE

1. INTRODUCTION

This document is Section B of the Port of Felixstowe’s Waste Management Plan, setting out the measures in place for the storage and handling of waste generated by the port’s landside operations. It is complementary to Section A, which deals with vessel generated waste.

2. GENERAL REQUIREMENTS 2.1 Legislation

The port’s waste management and disposal is governed by several key pieces of legislation:

The Environmental Permitting Regulations (England and Wales) 2010 allow certain activities which may have an impact on the environment and human health. Activities that can cause pollution are prohibited unless authorised by a permit. The Environment Agency or a local authority issues a permit, giving instructions on how the environment must be protected from the activity in question.

Hazardous Waste (England and Wales) Regulations 2005 defines requirements for the storage and disposal of hazardous waste.

Environmental Protection (Duty of Care) Regulations 1991 requires waste transfer notes for all transfers of waste, and records to be kept.

Controlled Waste (Registration of Carriers and Seizure of Vehicles) Regulations 1991 requires all waste to be transferred using licensed carriers.

These regulations have been extensively amended over time and there are many other pieces of relevant legislation.

3. DOCUMENTS AND RECORDS 3.1 Waste Carriers

All waste carriers must be appropriately licensed. A copy of the current licence for each waste carrier used by the port shall be kept by the Procurement Department.

3.2 Waste Broker As landlord, where the port provides waste management services to its tenants it is acting as a waste broker within the terms of the Environmental Permitting Regulations 2010. Accordingly the Company is registered as a broker.

3.3 Premises Notification

The port is required to notify to the Environment Agency every year as a producer of hazardous waste. The Environmental Manager shall undertake this task every year (anniversary date is July 15

th).

3.4 Records Process

All WTNs and Consignment Notes shall be returned to the Procurement Department, where they will be entered into the waste register. The register shall be in the form of a manual database, which records all waste movements (whether hazardous or not). This allows reporting of waste quantities across all waste streams.

The hardcopy WTN/Consignment Note shall be kept for at least the minimum period (2 or 3 years respectively) after which it may be destroyed.

4. GENERAL WASTE

General waste is collected port-wide in a range of containers appropriate to the size of the operations in the area.

All waste vehicles are required to pass over the weighbridge on entering and leaving the port and obtain a ticket, which forms the basis of the charge for the waste disposal as well as the gates pass for departure from the port.

5. MANAGEMENT OF SPECIFIC WASTES 5.1 Paper and Cardboard

Collection bins are provided in offices on request, which are lined with clear plastic bags provided by the cleaning contractor. When full, the cleaning contractor removes the bag and places it, tied up, into one of several blue 1100 litre wheelie bins placed around the port. There are over 70 recycling bins at 26 locations throughout the port estate which are emptied at regular intervals. Emptying frequencies vary between bi-weekly to 3 times a week where demand is greatest.
