APOLOGIES None OFFICERS Nicky King (Council Secretary) 264/16/17 PUBLIC PARTICIPATION None. 265/16/17 DECLARATIONS OF INTEREST There were no declarations of interest made at this point. 266/16/17 MINUTES OF MEETING HELD ON 18TH JULY 2016 Members considered the minutes of the Committee meeting held on

18th July 2016. Councillor Hurst-Jones proposed that the minutes be approved as a

correct record and signed by the Chair. This was seconded by Councillor A Robinson and carried unanimously.

RESOLVED That the minutes of the meeting held on 18th July 2016 be accepted

as a correct record, and signed by the Chair. MATTERS ARISING 267/16/17 Burneside Neighbourhood Area/CIL Monies Councillor Hurst-Jones raised the matter of the Burneside

Neighbourhood Area and the issue of who would receive CIL monies. Councillor A Robinson expressed his concern regarding the situation, stating that KTC needed to decide what approach to adopt concerning developments on the edges of Kendal that were not actually within the Kendal Town Boundary. After a general discussion Members agreed that the matter should be added to the agenda of the next Management Committee meeting for further discussion.

RESOLVED That the matter of the Burneside Neighbourhood Area and the issue

of who would receive CIL monies be added to the agenda of the next Management Committee meeting for further discussion.

01/08/2016 Planning Appendix 1 KTC Planning Committee Meeting 23rd May 2016 Comments Relating to Item 13 on Planning Appendix 1 – Land Adjacent to Underbarrow Road, Kendal (Ref 0413)

Members of the Planning Committee discussed the application in depth following public participation.

Councillor Finch proposed that the application be rejected and that the Committee recommend to SLDC that it be refused. Principal reasons for this decision being as follows:

Particular concerns over:

• The shortage of affordable housing. • The relatively poor design (especially those properties on land fronting Underbarrow Road)

on this very functional development on a sensitive approach to Kendal.

Continued concerns over:

• Contamination. • Surface water clearance. • Potential loss of amenity to certain properties. • Travel and transport considerations.

Members also remained concerned about issues highlighted in Councillor J Robinson’s email of 18th April 2016 to Fiona Clark of SLDC.

The proposal was seconded by Councillor Oldham and carried unanimously.

RESOLVED

That application 13 on Appendix 1 for development of land adjacent to Underbarrow Road, Kendal be refused.
