CHANGE IN CONDITIONS APPLICANT'S RESPONSE STANDARDS GOVERNING THE EXERCISE OF THE ZONING POWER
PURSUANT TO REQUIREMENTS OF THE UNIFIED DEVELOPMENT ORDINANCE, THE BOARD OF COMMISSIONERS FINDS THAT THE FOLLOWING STANDARDS ARE RELEVANT IN BALANCING THE INTEREST IN PROMOTING THE PUBLIC HEALTH, SAFETY, MORALITY OR GENERAL WELFARE AGAINST THE RIGHT TO THE UNRESTRICTED USE OF PROPERTY AND SHALL GOVERN THE EXERCISE OF THE ZONING POWER.

Change in Conditions Applicants Response Standards Governing the Exercise of the Zoning Power
A) The use is a permitted under M-1 district. The proposed change in conditions will permit a use that is suitable in view of the use and development of adjacent and nearby properties.
B) The proposed change in condition will not adversely affect the existing use or usability of any of nearby property. The property has existing industrial uses on 3 sides. The property to the north is zoned residential but is currently undeveloped.
C) The property is currently zoned M-1 and is being utilized as a manufacturing facility. Because of the lack of parking, they currently have to double park cars on-site. In addition, they are renting space next door that will expire that accommodates about 88 cars. Without a buffer reduction to add parking, the property may not work long term for this operation.
D) The change in condition will not result in an excessive or burdensome use of the infrastructure systems.
E) Yes. The change in condition is in conformity with the policy and intent of the Land Use Plan.

Letter of Intent for Change in Conditions
Buckel Design Group, LLC ("BDG)" submits this Change in Conditions Applications on behalf of Price Industries, Inc. ("Owner"), for the purpose of revising general zoning condition 2 (J) of the Gwinnett County Zoning Case Number RZ-4-87, concerning an approximate 8.357 acre tract (hereinafter, the "Property") located at 2975 Shawnee Ridge Court, NW; said Property being rezoned to M-1 Light Industry on February 24, 1987.
Condition 2(1) currently states as follows:
"A minimum 50 foot wide buffer, undisturbed except for utility crossings, access points and revegetation to provide a visual screen, is to be established where the property abuts residential uses as long as the property remains residentially zoned."
We respectfully request that the Condition 2 (J) be revised as follows:
The 50 foot wide undisturbed buffer be reduced to zero and replaced with a 10' wide planted landscape buffer. Where retaining walls are located, planting at the top of walls will be limited to evergreen type trees or shrubs with spacing to provide a visual screen. The landscape plan to be approved by the Director of Planning.
BDG has included 2 concept site plan options for consideration. Option P-1 assumes that an off-site grading easement would be required from the adjacent property owner. Option P-2 assumes that no off-site grading easeme nt could be obtained a nd all work would be contained on the subject property.
