Failure to File Forty-Eight Hour Notifications

The Feingold Senate Committee ("the Committee") has failed to file the required Forty-Eight (48) Hour Notifications ("48-Hour Notices") for 4 1 contributions totaling $54,726.73 received prior to the 1998 Genera1 Election.

The candidate was involved in the General Election held on November 3, 1998. Prior Notice was sent to the Committee on September 30, 1998 (Attachment 2). The Notice includes a section titled "48 Hour Notices on Contributions". This section reads "Notices are required if the committee receives contributions (including in-kind gifts or advanccs of goods or services; loans from the candidate or other non-bank sources; and guarantees or endorsements of loans to the candidate or committee) of $1,000 or more, during the period October 15 through October 31. The notices must reach the appropriate federal and state filing offices within 48 hours of the committee's receipt of the contributicn(s)."

On January 20, 1999, a Request for Additional lirfoimation ("RFAI") was sent to the Committee (Attachment 4). The RFAI notes on an informational basis that the Committee may have failed to file one or morc of the required 48-Hour Notices for "last minute" contributions of $1,000 or more. The notice requests the Committee to review their procedures for checking contributions received during the aforementioned time period. In addition, the notice states that although the Commission may take legal steps, any response would be taken into consideration.

' A 48 Hour Notice discloses a $2,000 contribution from Paul Sperry and Schedule A discloses a $1,000 contribution each from Paul and Aim Sperry.

Thc Committee’s response dated January 3 I , 1909 does not adequately address the failure to file 48-Hour Notices. The response dated March 15, 1090 docs address this issue. The Committee states that, “Although there is E possibility that some of these contributions were included in a 4X hour report which failed to reach the Commission, . . . all or most of these contributions were apparently omitted inadvertently from the 48 hour reporting process”. The Committee further cxplains that, “This oversight may have resulted from a lapse in communication between two of the Committee’s offices. In October of I W X , the contributions were processed in one office, while the 48 hour reports were gexrated in a different office at a separate location. Since that time, the fiindraising office of thc Committee has been consolidated to one office for all operations, lessening the chance of miscommunication. Accordingly, the Committee has talten actions to cnsure that the situation that caused this reporting problem cannot be repeated” (Attachment 5).

Obviously, it makes sense to do this only ifthe Commission would find such notification

helpful. We wodd appreciate your guidance as to whether the Commission would like

such notication. The Committee hopes that its response ofJanuary 31,1999 was

adequate in addressing the concern about contributions which were disclosed on 48 hour

reports, but not on schedule-A of the Post-General report.

As to the issue of appiuently excessive contributions, questions were asked about

contributions from Henry Lord, Ruth Lord and Mary Pennock. 9

The appearance of excessive contributions in the cases of Henry Lord and Ruth Lord was

created because tne Committee reported these two contributions incorrectly. The

contributions were made through a conduit, and although it may appear that contributions

were excessive, they simply needed to be reported accurately as appropriate conduit

contributions. The Committee mistakenly reported the same contributions twice on the

schedule-A portion of the 1998 Post-General report. (The only checks from the Lords

received by the Committee (attachment #3), the schedule-A form which vias previously

filed (arrachmer. +l), and an amendment explaining the Lord's contributions (aaachment

#5), which should have been sent previously, are attached. A h attached is a corrected

schedule-A form which correctly reports other conduit contributions as they should have

appeared on schedule-A of the 1998 Post-General Election Report (bttachment M).) The

Committee understands the need to report conduits accurately, and correctly reported

conduits on the 1998 Year End Report, which was due on, and filed by, January 3 1,1998.

The $250 contribution from Mary Pennock received by the Committee on October 27,

1998 put her $200 over the $1,000 limit on contributions for the 1998 General election.

At the time of her contribution, the Committee inadvertently M e d either to r e b d $200

to Ms. Pennock or to seek Ms. Pennock’s permission in redesignaiing the additional $200

for the 2004 Primary election. At th is time, the Committee has refunded $200 to Ms.

Pennock, and has taken ineasures to ensure this mistake wiU not occur in the hture. (A

copy of Ms. Pennock‘s contributions filed by the Committee (&chent #8), the $200

refund check and refund form is attached (attachment #9).) The Committee understands

the importance of federal limits on contributions.

The Committee is also carefully examinirlg all of our contributions to check for the

possibility of any additional excessive contributions. Because this process is time

consuming, the Committee will contact the Commission as soon as possible in a follow-up

correspondence to no@ the Commission ifany other mistakes are located. We have also

corrected our method of reporting conduits under the direction of the Commission; and

we are also carefully reviewing and consolidating the procedures for processing

contributions

ISSUE THREE

Finally, let me address the concern of certain 48 hour reports which were not and should

have been filed. While the Committee correctly reported all the contributions in question

on the schedule-A portion of the 1998 Post-General Election Report, a number of the

contributions were inadvertently not reported under the 48 hour report requirement for the

final weeks of October 1998. Although there is a possibllrty that some ofthese

contributions were included in a 48 hour report which f d e d to reach the Commission,

(The October 17, 1998 48 hour report is attached (attuchment #IO) .) all or most of these

contributions were apparently omitted inadvertently from the 48 hour reporting process.

(The 48 hour reports which should have been prepared and sent in a timely manner are

also attached, dated March 11, 1999 (uftuchment Cfll).) The Committee sincerely

apolo-eizes for these omissions, recognizing and respecting the i m p o m c e of the 48 hour

disclosure requirement. As you recommended, the Committee's procedures for filing the

48 hour notices have been reviewed and the Committee has taken action to e r w e that the

problem will not be repeated.

For your information, it appears that the problem largely resulted fiom an internal lapse in

communication in the context of the Committee's effort to abide by Senator Feingolds

voluntary pldges to limit the amount of out-of-state and PAC contributions which his

campaign received to certain maximum percentages of the campaign's total receipts As

you will note, most of the contributions in question were either PAC contributions or QUt-

of-state contributions. and therefore were not always immediately accepted by the

campaign in order to ensure Senator Feingolds pledges were never violated. In other

words. sometimes contributions were not deposited for a brief period o f h e , as permined

under federal law, given that they might have had to be returned ifthey would put the

Feingold Senate Committee out of compliance with Senator Feingold's fundraising

instructions

. The omissions apparently occurred when these checks were ultimately deposited and ?.he

relevant campaign staff simply failed to file the 48 hour notices that had been fied for

other contributions. This oversight may have resdted from a lapse in commuilication

between two of the Committee's offices. In October of 1998, the contributions were

processed in one oEce, while the 48 hour reports were generated in a differe:nt office at a

separate location. Since that time, the hdraising office of the Committee h r s been

consolidated to one office for all operations, lessening the chance ofmiscommunication.
