3. 6e e*&ourts 7ational portal also pro%ides trainin! material for 9udicial officersand staff" lin/s to #istrict &ourt we:sites and statistical reports t6at can :eused as a 9udicial mana!ement information system. 6is portal is epected toplay a /ey role in :rin!in! a:out 9udicial reforms. 6e etransactions ser%ices of t6e e&ourts portal as per etaal.!o%.in 6a%e crossed 2.2 &rore.

4. A lar!e num:er of #istrict &ourts 6a%e launc6ed t6eir we:sites for t6econ%enience of liti!ants and ot6ers 6a%e :een pro%ided wit6 a template for

easy launc6 of a we:site.5. &6an!e Mana!ement eercise 6as :een successfully implemented. All 9udicial

officers in t6e country 6a%e :een trained in t6e use of computers t6rou!6 21+ 9udicial officers w6o 6ad :een trained as Master rainers for continuin!trainin! pro!rammes. 21- &IS Master rainers ?#istrict System Administrators@6a%e :een trained from amon!st t6e court staff in t6e use of t6e &aseInformation Software. 6ese &IS Master rainers 6a%e trained more t6an 4000System Administrators in t6e effecti%e use of computers and &IS.

. All i!6 &ourts are in t6e process of pro%idin! uniue identification num:ers toall 9udicial officers. Many i!6 &ourts 6a%e already completed t6is eercise.

(. All i!6 &ourts 6a%e ta/en up Process 'e*en!ineerin! eercise" t6ere:y6a%in! a fres6 loo/ at processes" procedures" systems and &ourt 'ules.

+. <nified 7ational &ore %ersion 1.0 of t6e &ase Information Software 6as :eende%eloped. 6is is in use in almost all States. 6e process of mi!ration of olddata into t6e <nified 7ational &ore &IS %ersion 1.0 is in pro!ress.

10.6e process of implementation of t6e Pro9ect 6as s6own t6at many new courts6a%e come up in t6e last se%eral years and many more will come up. Pro%ision

needs to :e made for newly esta:lis6ed courts and courts t6at will come up in

&ourts 6a%e set up Process 'e*en!ineerin! committees to moderni$e t6e

processes" procedures and &i%il &ourt8&riminal &ourt 'ules. 6e Process

'e*en!ineerin! committees are epected to complete t6e eercise :y 31st

January" 2014.

assistance of 7I& Pune for use in all t6e #istrict and alu/a &ourts all o%er

t6e country. 6is 6as :een implemented in all t6e States and mi!ration of

Marc6 2013.

and Mo:ile Apps etc. are 9ust a few of t6e many important o:9ecti%es. In order to

ac6ie%e t6em" t6e &ourt I& ena:lement approac6 needs to :e so ta/en up t6at t6e

infrastructure for not 9ust t6e &ourt 'oom :ut also for t6e 'e!istry ?Sections@ of t6e&ourt &omple is pro%isioned. 6is is indispensa:le for ensurin! optimum automation

of 9udicial and administrati%e processes and also t6e ideal deli%ery for t6e liti!ant

centric ser%ices. Sufficiency of t6e infrastructure /eepin! in %iew t6is aspect is a

ma9or !oal to :e ac6ie%ed t6rou!6 net p6ase of t6e e&ourts Pro9ect.

6* M13es "et to 2o

Most of t6e deficiency in uploadin! of data onto 7J#D and t6erefore t6e lac/

of deli%ery of ser%ices online is attri:uted to issues relatin! to lac/ of effecti%e" sta:leand relia:le A7 connecti%ity for t6e &ourts. 6is aspect of A7 connecti%ity w6ic6

6as assumed almost as muc6 si!nificance as a%aila:ility of electricity for a system to

wor/G deser%es immediate and effecti%e attention. owsoe%er ro:ust and efficient

t6e 6ardware and t6e software pro%ided may :e" t6is 6indrance of connecti%ity

:ecomes a :ottlenec/ so serious t6at it c6o/es up t6e w6ole flow of information to

t6e :eneficiaries t6ere:y ma/in! t6e ac6ie%ements made so far immaterial for t6e

liti!ants and t6e society at lar!e.

6e on!oin! eercise of Process 'een!ineerin! in t6e e&ourts pro9ect as

initiated :y t6e e&ommittee" is epected to !enerate a 6u!e reuirement of

implementation in t6e area of o%er6auled processes :ein! followed in t6e day to day

functionin! of t6e &ourts. 6e c6an!e" a:andonment or new introduction of

processes" apart from :ein! :rou!6t in force t6rou!6 amendment in rules" will also

need meticulous implementation t6rou!6 a ma9or re%ampin! eercise of

customi$ation and redesi!n of t6e present &ase Information Software. 6is eercise

will need considera:le plannin! and desi!n efforts in addition to t6e efforts and time

for de%elopment as well as roll out of t6e reformed and reen!ineered &IS.

6e uantum of 6ardware pro%ided in t6e present p6ase :ein! too less" t6e

optimum computeri$ation of court processes 6as not :een possi:le. 6e uantum of

6ardware was calculated on per &ourt 'oom :asis wit6 9ust one slimline P& and

t6ree t6in clients per &ourt. perience 6as s6own t6at t6is num:er is too low as

sections8re!istry of t6e &ourt also need to :e considered for 6ardware for effecti%e

and optimum I& ena:lement. 6is lac/ or paucity of 6ardware 6as also :een a

ma9or reason for not w6olly s6iftin! to computeri$ed processes from t6e manual

processes. &onsiderin! t6is condition of t6e &ourts w6ic6 6a%e :een co%ered under

t6e Pro9ect" t6e &ourts not co%ered for computeri$ation or esta:lis6ed after its

commencement :ut durin! t6e continuation of t6e present p6ase cannot !et fullyinte!rated wit6 t6e 7J#D. Also !i%en t6at more 6ardware is reuired ?in t6e re!istry"

for instance@ and t6at many courts in dilapidated" tenanted and newly esta:lis6ed

:uildin!s 6a%e not yet :een co%ered for computeri$ation" full inte!ration of all district

and su:ordinate le%el courts in t6e country into t6e 7J#D and t6e conseuent

:enefits of 7J#D for performance and analysis is yet to 6appen.

7ew courts are :ein! added from time to time :ased on t6e decisions ta/en :y

respecti%e i!6 &ourts and State Do%ernments" decision of t6e Supreme &ourt in ,ri9Mo6al >al case on 1-.4.12 to create additional 10H positions in su:ordinate 9udiciary"

and t6e policy decision to dou:le t6e eistin! stren!t6 of 9ud!es in a period of fi%e

years. Some of t6e newly created courts are :ein! esta:lis6ed in eistin! court

complees already co%ered :y e&ourts pro9ect and t6ere is ine%ita:ly a time la!

:etween t6eir operationali$ation and computeri$ation. 6erefore" t6ere are always

courts t6at are not computeri$ed" w6et6er in eistin! or new court complees. 6is

results in difficulties for Jud!es to :ase t6eir analysis on all eistin! courts and for lawyers and liti!ants to :e sure w6et6er :enefits of computeri$ation 6a%e accrued in

courts t6ey are liti!atin! in. 6e une%en spread and a%aila:ility of I& resources

creates a more difficult and intri!uin! situation for t6e Jud!es" >awyers and liti!ants

ali/e" specially w6ere some &ourts in t6e same &ourt &omple are still on manual

processes e%en for :asic needs li/e cause list !eneration etc. w6ereas all ot6er

&ourts in t6e same comple are doin! most of t6eir day to day wor/ on computers.

As accretion of courts in a &ourt &omple may :e a continuous process and t6ere

may always :e a la! :etween esta:lis6ment of an additional court and its

computeri$ation" it is necessary to pro%ide for I& infrastructure reuirements well

:efore or at least at t6e time of notification of a new court.

7eedless to say t6at" mere creation of additional &ourts is not sufficient for

reducin! t6e :ac/lo! of cases. Enly tec6nolo!ical ena:lement of t6e &ourts will

effecti%ely address t6e situation and would e%entually fructify t6e real o:9ecti%e of t6e

creation of additional &ourts. It is 6i!6 time t6at t6e additional &ourts created durin!

or :efore t6is p6ase of t6e pro9ect are immediately ta/en up for computeri$ation wit6

an added pro%ision of also co%erin! t6e yet to :e created &ourts at least till a cut*off

date not earlier t6an two years of t6e t6ree year duration of t6e net p6ase of t6e

pro9ect.

it6 t6e ad%ent of new tec6nolo!ies in t6e area of 6ardware" networ/in! etc.

t6e model :ased upon cloud computin! concepts needs to :e implemented instead

of t6e present model of distri:uted and decentrali$ed ser%er infrastructure so as to

reap t6e fruits of scala:ility" flei:ility" economy" optimum use of resources offered :y

cloud computin! model etc.

In addition to t6e a:o%e measures" in order to fully sync t6e &ourt processes

wit6 t6e latest trends in e*!o%ernance" acti%ities li/e scannin!8di!iti$ation of case

record" document mana!ement system for di!ital arc6i%in!8stora!e8retrie%al"

:usiness intelli!ence tools ena:led mana!ement information systems" 9udicial and

administrati%e wor/flow automation etc" are reuired to :e ta/en up at t6e earliest

possi:le opportunity as t6eir implementation will reuire a considera:le uantum of

efforts" funds and time.

t6ere:y necessitatin! an immediate net p6ase of t6e e*&ourts pro9ect w6ic6

succeeds t6e current p6ase wit6out any !ap of time or efforts and also carries

forward all pendencies" arrears and remainder resources of t6is p6ase to t6e net

p6ase.

It is t6erefore necessary t6at t6e procurement and supply of computers and

indeed of all 6ardware" s6ould :e decentrali$ed. In principle" t6is 6as :een a!reed to

:y t6e i!6 &ourts and also appro%ed in t6e meetin!s of t6e e&ommittee. 6e

Pro9ect must :e decentrali$ed wit6 !reater responsi:ility :ein! placed on t6e i!6

&ourt to ensure t6at infrastructure" 6ardware and day*to*day issues are ta/en care of at t6eir end.

At t6e same time" e&ourts Inte!rated Mission Mode Pro9ect" :ein! a &entral

Pro9ect under t6e 7eDP Plan and for reasons of ensurin! uniformity of infrastructure

in &ourts across t6e country" it :ecomes necessary to decide t6e desi!n and

specifications of t6e infrastructure at a central le%el. 6is is also si!nificant from t6e

point of %iew of software to :e used and ser%ices to :e rendered :ein! more or less

unified and centrali$ed wit6 only some %ariations from State to State. ardware

Infrastructure to :e pro%isioned to t6e &ourts from t6e e&ourts Pro9ect" in order to :e

compliant and seamlessly inte!rated wit6 rest of t6e components of t6e Pro9ect" will

Note for extension of Phase I as transition to Phase II of the eCourts Projectonly if Phase II could not commence from 1/4/2013

The policy document for Phase II of the eCourts Project has been preparedand is under submission to the full meeting of the eCommittee to be chaired by

Hon'ble the Chief ustice of India! Coordinated efforts by the eCommittee"

#epartment of ustice and $IC ha%e been and &ill continue to be made for timely

appro%al and commencement of Phase II of the Project from st April" 2()!

Although the priority is to start Phase II of the Project as per the policy

document from st April" 2()" in the e%ent of any delay in appro%al*commencement

thereof" an extension of Phase I is proposed as a roll-o%er or intermediate Phase

preceding the commencement of Phase II! The objecti%e is to a%oid any gap" halt or

stand-still in the acti%ities of the Project as referred in paragraph ) of Chapter 2 of

the policy document!

The follo&ing components of Phase I are re+uired to be continued for

implementation in the inter%ening period" if any" bet&een Phase I and Phase II of the

Project!

for the Court as gi%en herreinabo%e &ill be omitted! In addition to the abo%e Court

Eoom hard&are" all other appro%ed components 7except the Court Eoom hard&are

of < , systems8 of Phase I of the Project for these Courts &ill also be pro%isioned!

2+a,. $dditional Courts that ha-e come up ithin the same Court Complex#

The Court Complexes already ta5en up in Phase I of the Project ha%e been

pro%ided &ith /er%er Infrastructure in the /er%er Eooms &hich can cater to more

systems in the additional Courts coming up in the same Court Complex! The

additional Courts in the country &hich ha%e come up &ithin the same Court Complex"

&hich can be co%ered using the already installed ser%er infrastructure in the Court

Complex" &ill be pro%ided &ith the 2<0 718 systems hard&are as referred abo%e in

the extended period of Phase I of the Project!

2+,. $dditional Courts comin up in ne Court Complexes#

As Phase II of the Project is to implement Cloud Computing architecture for

the eCourts Project" it is not ad%isable to in%est more resources on purchase of ser%er infrastructure for Courts at this stage! After assessing the additional courts

that ha%e come up in fresh*ne& Court Complexes" infrastructure for udicial /er%ice

Centre*Centrali9ed >iling Counter and $et&or5 Eooms &ill ha%e to be pro%isioned!

The hard&are for Court Eoom &ill be as gi%en abo%e and the hard&are for Court

Complex &ill be as per the specifications*+uantity of Phase I!

If the Court Complex is a single Court Complex" no ser%er infrastructure has

been pro%isioned in Phase I! >or other Court Complexes ha%ing multiple Courts"%arying +uantity of ser%ers from 2 to ( depending upon the number of Courts in the

Court Complex ha%e been pro%ided! In a large number of Court Complexes ha%ing

multiple ser%ers" not all the ser%ers are utili9ed! Therefore" any ne& Court Complex

that has come up" any such unutili9ed ser%er infrastructure may be used for the

purpose by &ay of reallocation and the related expenditure &ill ha%e to be

pro%isioned for the same! It is reiterated that in%estment on local ser%er infrastructure

is &orth a%oiding &hen the Project &ill be going in for cloud based computing soon

As the extension phase &ill target computerisation of additional 2((( Courts

o%er and abo%e )2)" an e+ual number of udicial 4fficers also &ill ha%e to be

pro%ided &ith aptop and Printer as gi%en to the udicial 4fficers during Phase I of

the Project!

3. ideo Conferencin eteen Courts ails#

Presently a pilot exercise for testing of soft&are based %ideo conferencing

solution is under&ay for fi%e Court Complexes and fi%e jails! 4n the basis of the

outcome of this pilot exercise" the soft&are based @C solution is intended to be

deployed for F(( Courts G ails as a part of Phase I of the Project! As the result of

the pilot is expected to be clear by the end of anuary" 2() and it may not be

possible to roll out the solution in )F Courts G ails across the country by , st

6arch" 2()! Therefore in the extended period of Phase I" all the #istrict Court

complexes and the Central" #istrict and omen ails of the country &ill ha%e to be

ta5en up for pro%iding the soft&are based @C solution" subject to the outcome of the

ongoing pilot exercise!

4. Implementation of the decisions ta5en in the 6mpoered Committee 7eetin

held on 28th ctoer! 2013#

+$, )eplacement of the IC& infrastructure of Capital City Court

A decision has been ta5en in the aforesaid ?mpo&ered Committee meeting

for the total replacement of the hard&are G A$ of F Courts and replacement of the

gap hard&are of ,30 Courts &hich &ere part of 2 Court Complexes of the Capital

City Courts Project! If for any reason the funds transfer * procurement for

implementing this decision is not complete by , st 6arch" 2()" it &ill ha%e to be

ta5en up in the extended duration of Phase I of the Project!

+%, $dditional 9ardare )e*uirements for the 9ih Courts

In the said ?mpo&ered Committee meeting" a decision &as ta5en appro%ing

the additional hard&are re+uirement of 0 High Courts! The implementation of this

decision is yet to start as the proposal is in the process of further appro%al by 6inistry

of >inance! The re+uirements recei%ed from High Courts of Allahabad" Dombay"

Punjab G Haryana and #elhi and those of the /upreme Court &ill be placed in

?mpo&ered Committee soon! Thus the additional hard&are re+uirement of 2( High

Courts and the /upreme Court" &hich is intended to be pro%isioned from Phase I of

the Project" &ill no& ha%e to be ta5en up in the extended duration of Phase I of the

Project" if not completed by 6arch" 2()!

+C, )e*uirement of technical and other s5illed manpoer for the office of

the eCommittee#

A decision &as ta5en in the said ?mpo&ered Committee meeting for

deployment of 2( personnel at the eCommittee for a period until ,st 6arch 2()"

and pro%ision of re+uisite hard&are infrastructure for the office of the eCommittee!

As the assessment of the resumes of personnel is under process for short listing the

manpo&er to be deployed and the hard&are as appro%ed has also not been procured

so far" the implementation of this decision" if it cannot be implemented by 6arch"

2()" &ill ha%e to be implemented in the extended duration of Phase I of the Project!

The manpo&er for the eCommittee &ill be re+uired till the extended duration of the

Project!

:. ;ite Preparation $N Implementation <ecentrali=ation#

In order to expedite the completion of tas5s in this extension period" the /ite

Preparation G A$ implementation acti%ity &hich ha%e been major contributors to

delays in the Project" &ill be decentrali9ed to High Courts for being completed &ithin

a preferred period of four months but not later than fi%e months! The acti%ities of

sites preparation and A$ implementation &ill ha%e to be ta5en up in fast trac5edmode and the process of hard&are P! 4! Issuance etc! &ill follo& simultaneously in

order a%oid any gap bet&een site-readiness" A$ implementation and hard&are

deli%ery*installation!

The procurement of hard&are &ill be from $IC empanelled %endors of the

eCourts Project or $IC/I empanelled %endors for the respecti%e items! There &ill

also be an option for the High Courts to procure the hard&are item as per the

procurement model gi%en in the Phase II Policy and Action Plan #ocument!

It is reiterated that" as gi%en in the policy and action plan document of Phase

II" all the soft&are solutions to be deployed as part of the eCourts Project &ill be

based on >ree G 4pen /ource /olutions 7>4//8 technolgoies" &hich do not ha%e

any licensing or subscription charges to be paid! This policy &ill be strictly adhered

to also in the extended duration of Phase I! This applies to the hard&are already

pro%ided during Phase I and also the hard&are that &ill be pro%ided in the extended

duration of Phase I! Hence" li5e Phase II proposal" no budgetary allocation for

purchase of any soft&are product &ill ha%e to be made during extended period of the

Phase I of the Project!

6xtension <uration of Phase I and its impact on other onoin/pendin tas5s

of Phase I#

There are clear three months before the end of the Project! Therefore" a

period of six months starting from April" 2() &ill be sufficient for ta5ing up the abo%e

referred pending tas5s in the extended duration of Phase I of the Project!

Conse+uently" the proposal for extension of Phase I" if at all necessary" is placed for

not more than six months duration immediately after the present deadline of Phase Ii!e! ,st 6arch" 2()! This is %ital for the reason that the implementation of the

litigant friendly and reformati%e components of Phase II of the Project can be ta5en

up as early as possible i!e! not later than st 4ctober" 2()!

The extension of the Phase I of the Project is intended to ha%e an extension

effect all on all other funding and ongoing acti%ities already in progress in the Project!

This is &ith reference to any funds still being utili9ed at High Court le%el for data

entry" technical manpo&er" contingency expenses etc!
