Federation of Bosnia and Herzegovina
The Federation of Bosnia and Herzegovina is one of two entities in the State of Bosnia and
Herzegovina, comprising 51% of its territory. The Federation of Bosnia and Herzegovina is
a decentralized unit consisting of ten federal units (Cantons), named exclusively after the
cities where the seats of Cantonal authorities are located or after their regional and
geographical features.
The Cantons in the Federation of BiH are:
1. Una-Sana Canton – seat: Bihać
2. Posavina Canton – seat: Orašje
3. Tuzla Canton - seat: Tuzla
4. Zenica-Doboj Canton – seat: Zenica
5. Bosnian Podrinje Canton – seat: Goraţde
6. Central Bosnia Canton – seat: Travnik
7. Herzegovina-Neretva Canton – seat: Mostar
8. West Herzegovina Canton – seat:Široki Brijeg
9. Sarajevo Canton – seat: Sarajevo
10. Canton 10 – seat: Livno
The capital of the Federation of Bosnia and Herzegovina is Sarajevo. The official
languages in the Federation of BiH are: Bosnian, Croatian, and Serbian. Other languages
may be used as a means of communication and teaching.
The official scripts are Latin and Cyrillic.
The exclusive responsibilities of the Federation of BiH are:
organization and management of the defense of the Federation of BiH, protection of
its territory, including the establishment of a joint command for all military forces
in the Federation of BiH;
Federation citizenship;
development of economic policy;
passage of regulations on finances and financial institutions of the Federation of
BiH and the fiscal policy of the Federation of BiH;
combat against terrorism, inter-Cantonal crime, illicit drug trafficking and
organized crime;
allocation of electronic frequencies for radio, television and other purposes;
establishment of energy policy and provision and maintenance of the necessary
infrastructure;
financing of activities of the Federation authorities and institutions of the Federation
of BiH.
The Federation government and the Cantons are responsible for:
guarantees for and implementation of human rights;
health;
environmental policy;
communication and transport infrastructure;
social policy;
implementation of laws and other regulations on citizenship and travel documents
of BiH citizens from the territory of the Federation of BiH, and on the stay and
movement of foreign nationals;
tourism;
exploitation of natural resources.
The structure of the government of the Federation of BiH is as follows:
legislative branch (Parliament of the Federation of BiH);
executive branch (the President and Vice-Presidents of the Federation of BiH and
the Government of the Federation of BiH);
judicial branch (Constitutional Court of Federation of BiH and Supreme Court of
Federation of BiH).
Legislative branch of the Federation of Bosnia and Herzegovina
The legislative authority in the Federation of BiH is exercised by the Parliament of the
Federation of Bosnia and Herzegovina.
PARLIAMENT OF THE FEDERATION OF BOSNIA AND HERZEGOVINA
The Parliament of the Federation of BiH consists of:
1. the House of Representatives
2. the House of Peoples.
The Parliament of the Federation of BiH is responsible for:
election of President and Vice-Presidents of the Federation of BiH;
confirmation of the appointment of the Government of the Federation of
BiH by majority vote;
passage of laws on the performance of the functions of the Federation
government;
approval of agreements with states and international organizations;
financing of the FBiH Army and approval of officer appointments;
passage of the budget of the Federation of BiH and laws on taxation, and
provision of necessary funding in other ways.
The Parliament of the Federation BiH passes the following: the Constitution of Federation
BiH, laws, resolutions, recommendations, and decisions, provides authentic interpretation
of the laws and establishes clarified texts of laws and other documents.
HOUSE OF REPRESENTATIVES OF THE PARLIAMENT OF THE FEDERATION
OF BIH
The House of Representatives of the Parliament of the Federation of BiH consists of 98
Representatives.
The mandate of Representatives is for a period of four years, and they are elected
democratically by secret vote in direct elections in the entire territory of the Federation of
BiH.
The House of Representatives elects from amongst its members a Speaker and two Deputy
Speakers of the House, who may not be from the same constituent people or from amongst
the Others.
The work of the House of Representatives is transparent. This is ensured through the
timely, complete, and objective informing of public. The citizens, in accordance to the
Rules of Procedure and room capacity, are given 10 free access to attend the sessions of the
House of Representatives and working bodies in allocated room space for them.

HOUSE OF PEOPLES OF THE PARLIAMENT OF THE FEDERATION OF
BOSNIA AND HERZEGOVINA
The House of Peoples of the Parliament of the Federation of BiH consists of a total of 58
Delegate seats: 17 Bosniak, 17 Croat, 17 Serb and 7 from amongst Others.
Delegates are elected from amongst Delegates in Cantonal legislatures in proportion with
the ethnic structure of the population.
The mandate of Delegates is for a period of four years.
The House of Peoples will have at least one Bosniak, one Croat, and one Serb of each
Canton that has at least one of such representative in the legislative body. Bosniak, Croat,
and Serb Delegates of each Canton are elected by the Delegates representing the
correspondent constitutive people, in accordance with the election results, in the Canton's
legislative body, and the election of the Delegates from among the Others is defined by
law. A person who is a member of the House of Representatives or a councilor in
Municipal Assembly may not be a Delegate in the House of Peoples.
The House of Peoples elects from amongst its members, by majority vote, a Speaker and
two Deputy Speakers of the House, who may not be from the same constituent people or
from amongst the Others.
The work of the House of Peoples is transparent. This is insured through the timely,

Procedure and room capacity, are given free access to attend the sessions of the House of
Peoples.
Decisions concerning the vital interests of any of the constituent peoples require the
approval of majority of Delegates in the House of Peoples. The vital national interests of
constituent peoples are defined as follows:
the exercise of the right of constituent peoples to be adequately represented in
legislative, executive, and judicial authorities;
the identity of a constituent people;
constitutional amendments;
the organization of public government authorities;
equal rights of constituent peoples in the decision-making process;
education, religion, language; preservation of culture, tradition, and cultural
heritage;
territorial organization;
public information system;
and other issues to be treated as issues of vital national interest if so considered by
2/3 of one of the Caucuses of Delegates of constituent peoples in the House of
Peoples.
Working Bodies of the House of Peoples of the Parliament of the FBiH
The House of Peoples establishes permanent and temporary working bodies that are tasked
with discussing the issues under the competency of the House of Peoples, discussing the
draft and proposal version of the laws and other general documents of the House of
Peoples, and preparation and realization of other tasks.

Executive branch of the Federation of Bosnia and Herzegovina
The executive authority of the Federation of BiH is exercised by the President of the
Federation of BiH, and Vice-Presidents of the Federation of BiH and the Government of
the Federation of BiH.
PRESIDENT AND VICE-PRESIDENTS OF THE FEDERATION OF BIH
The President of the Federation of BiH represents and acts on behalf of the Federation of
BiH and is at the head of the Federation executive branch. The President of the Federation
BiH has two Vice-Presidents who are of different constitutive peoples.
The election for the President and two Vice-Presidents of the Federation Bosnia and
Herzegovina shall require a majority vote in the House of Representatives and then by a
majority vote in the House of Peoples, including the majority of each Caucus.
The President of the Federation of BiH is responsible for the following:
appointment of the Government, heads of diplomatic missions, Federation BiH
Army officers, and judges of Federation BiH Constitutional Court;
exercise the function of the supreme commander of the Federation BiH armed
forces, and in accordance with the civil command provisions of the Article V.5 (a)
of the BiH Constitution;
consultations regarding the appointments of ombudsmen and judge
signing of decisions of FBiH Parliament after their passage;
signing and ratification of international agreements on behalf of the Federation of
BiH;
granting of pardons for crimes stipulated in Federation laws, except for war crimes,
crimes against humanity, and genocide.
The Vice-Presidents of the Federation of BiH replace the President of the Federation of
BiH in circumstances stipulated by the Constitution.

GOVERNMENT OF THE FEDERATION OF BOSNIA AND HERZEGOVINA
The Government of the Federation of BiH is composed of 8 Bosniak, 5 Croat and 3 Serb
Ministers. One Minister from among the Others may be nominated by the Prime
Minister/President of the Government from the quota of the largest constituent people.
The Government has a Prime Minister/ President of the Government who has two Deputy
Prime Ministers from different constituent peoples.
According to provisions of the Annex 7, at least 15% of the Members of the Government
has to be of one constitutive people, and at least 35% of the Members of the Government
has to be of two constitutive peoples. One Member of the Government has to come from
among the Others.
The Government of Federation of BiH is elected after its appointment has been confirmed
by a majority vote of the House of Representatives of the Federation BiH.
The sessions of the Government are held in the seat of the Government, and every forth
session will be held in Mostar. The Government may have its session in some other city in
the Federation BiH territory, and the Prime Minister, in consultation with the Deputy Prime
Ministers, will decide on this matter.
The Government informs the public about its work, passed decisions, resolutions and
positions, important matters to be discussed or are the subject of discussion at the
Government sessions. The Government informs the public through the Press Office.

tourist industry; employment, market, and prices; finances, banking, customs, taxes, and

as the economic aspects of issues from the areas of pension and disability insurance, health,
education, science, culture, and sport, and other issues from the field of economic policy.
The Commission for Matters of Human Rights, National Minorities, Civil Society, Justice,
and Administration discusses issues pertaining to the following areas: exercise of human
rights and national minority rights; civil society; constitutionality and legality; election
system; political and territorial organization of the Federation of BiH; coat-of-arms, flag,
and seal of the Federation of BiH; associations of citizens, foundations, endowments,
political organizations; prosecutor's office; crime; economic misdemeanors and offences;
amnesty and pardon; judicial and administrative proceedings; attorney's office;
enforcement of criminal sanctions; administration, labor relations and salaries in the
administration; public notaries; statistics; archives; law practice; obligation and property
relations; office business; rule books on the internal organization of Federation
administrative bodies and other bodies of Federation administration; and other issues
pertaining to judicial authority and administrative authorities and other bodies of
administration.
The Commission for Social Activities discusses issues pertaining to the provision of the
highest standards of internationally recognized human rights and fundamental freedoms
and application of European standards in all areas of social life, and in particular in the
areas of: health, education, science, culture, and sport; labor relations in economic and
social activities; pension and disability insurance; protection of war veterans and disabled
war veterans; implementation of Annex VII of the General Framework Agreement for
Peace in Bosnia and Herzegovina; and social welfare policy.
The Commission for Development Strategy and Safety of Transport discusses issues
pertaining to the following areas: development of preventive measures, establishment of
co-ordination, and encouraging co-operation in improving safety of transport, and study of
particular issues from areas including road, railway, navigation, pipeline and air transport;
priority projects and programs of development of roads, railways, air transport, internal
inland and maritime transport; cost-effective and efficient transport infrastructure;
international communications with neighboring and European countries; market
competitive intermodal transport system; transport operations and regulations based on the
European norms for integration into the European Union as an integral part of the pan-
European network.
For discussion of particular legal or economic matters falling under the jurisdiction of the
Government and Federation administrative authorities, there exist as advisory and
professional bodies of the Government: the Legal Council of the Government of the
Federation of Bosnia and Herzegovina and the Economic Council of the Government of the
Federation of Bosnia and Herzegovina. As members of the Councils are appointed legal,
economic, and other experts from the University and other academic institutions.

The Federation Ministry of Internal Affairs performs administrative and other professional
tasks related to exercising competencies of the Federation of BiH in the area of internal
affairs, as follows:
protection of constitutional order and prevention of violent threats to that order and
security of the Federation of BiH;
protection of life and personal security of citizens;
prevention and detection of criminal acts;
tracking down and capturing perpetrators of criminal acts;
maintaining public peace and order;
protecting certain persons (and VIPs) and facilities;
criminological and technical forensic expertise;
traffic security on the roads;
ID cards and travel documents;
residence and movement of foreign nationals;
fire protection;
traffic, transport and storing of hazardous substances;
organizing, arming, equipping, training and improving the skills of police in active
service and in reserve;
establishing and organizing functional communication systems of this Ministry;
registration of motor vehicles and driving licenses;
acquisition, keeping and carrying weapons and ammunition;
holding public gatherings;
education, vocation training and upgrading skills for the needs of law enforcement
agencies;
scientific and research work from within the scope of the police;
providing assistance aimed at eliminating consequences in case of general danger
caused by natural disasters and epidemics.

FEDERATION MINISTRY OF JUSTICE
Federation Ministry of Justice performs administrative, professional and other tasks
stipulated by law that refer to:
exercising the competencies of the Federation of BiH in area of justice, and in
particular those of judicial institutions and administration;
administrative supervision over the work of judicial administration and
administrative bodies of the Federation of BiH;
assisting in education of judges and prosecutors;
associating in political organizations and citizens' associations;
office administration;
administrative supervision and execution of criminal sanctions.
Within the Federation Ministry of Justice there exists the Institute for Public
Administration.
The Institute for Public Administration performs professional and other tasks from within
the competencies of the Federation of BiH, related to:
establishing internal organization of the Federation ministries and other authorities
of the Federation administration aimed at improving their work and organizing and
ensuring management efficiency;
introducing modern professional methods and means of work in the administration
(information and documentation system);
regulating the exercise of rights and duties of employees and officials, salaries and
other allowances in the bylaws of the ministries and other administrative bodies of
the Federation of BiH, and co-operation with the competent workers' union in
dealing with those issues;
organization of vocational training and upgrading for employees;
building systems of local self-government, election system, political and territorial
organizations of the Federation of BiH and drafting relevant regulations on those
issues;
issuing publications of law related materials;
developing co-operation with appropriate international organizations, as well as
local authorities and their associations.

FFEDERATION MINISTRY OF FINANCE
The Federation Ministry of Finance carries out administrative, professional and other tasks
stipulated by law related to the competencies of the Federation of BiH in the area of
finances, as follows:
tax system and tax policy,
monitoring implementation of policy and measures in the area of foreign currency
system, customs, import duties, credit and banking system;

public debt and its servicing;
control of revenue collection within the Federation Budget.

FEDERATION MINISTRY OF ENERGY, MINING AND INDUSTRY
The Federation Ministry of Energy, Mining and Industry performs administrative,
professional and other tasks related to:
exercise of competencies of the Federation of BiH in the areas of energy, mining,
geological research and industry;
monitoring economic operation and economic position of economic agents, and co-
ordination and implementation of projects which are of importance for the
Federation of BiH;
creating policy on energy and geological research;
inspection of facilities and plants for electricity generation and pressure facilities;
inspection in the course of research and exploitation of mineral raw material
Within the Federation Ministry of Energy, Mining and Industry there are the Institute of
Metrology and Institute of Geology.
The Institute of Metrology:
performs professional and organizational tasks in the area of metrology in the
Federation of BiH;
passes professional regulations on the verification of technical criteria;
conducts testing and verification of technical criteria;
establishes relevant centers for verification and supervision of technical criteria;
participates in implementing, keeping, maintaining and use of standards and
reference materials;
performs standardization and application of standards and reference materials;
keeps relevant registers in the territory of the Federation of BiH;
performs measurements and supervision over the use of criteria and marking of pre-
packed products;
performs direct control of objects made of precious metals and their branding;
co-operate with the relevant institutions in Bosnia and Herzegovina.
The Institute of Geology:

The peace-time invalids are military invalids who acquired that status during obligatory

FBiH Privatization Agency
The Agency performs technical and other duties pertaining to the privatization process.
The Agency also performs advisory, promotional, educational, and other duties in
accordance with the law. Within the framework of its activities, the Agency in particular:
initiates and participates in the preparations for passage of laws and other
regulations in the field of privatization;
co-operates with responsible ministries, Cantons, agencies, and other bodies and
organizations dealing with restructuring and privatization;

FBiH Budget Audit Office
Public sector audit is a new activity in FBiH aimed at enhancing transparency and
accountability in spending public funds.
The FBiH Budget Audit Office is responsible for establishing, through audit of financial
reports and budgetary financial transactions in the Federation of BiH:
that all measures have been taken to ensure collection and keeping of public
revenue and that the relevant authorities are in compliance with the applicable laws
and instructions;
that payments of public liabilities or use of public income, including extra-
budgetary funds, are made with appropriate authorization and for the purposes for
which the authorization was granted;
that all measures have been taken to ensure the acceptance, keeping, issuance, and
proper use of public reserves and that the relevant instructions are complied with.

Civil Service Agency of the Federation of BiH
The Civil Service Agency of the Federation of BiH is established by the Government of the
Federation of BiH.
The Agency will perform the following tasks:

The judicial function in the Federation of BiH are carried out through the courts of the
Federation of BiH, Cantonal courts, and Municipal courts. The courts of the Federation of
BiH are:

The judicial authority in the Federation of BiH is exercised independently and freely.
Federation BiH High Judicial and Prosecutorial Council is an independent constitutional
body of judicial authority whose task is to ensure an independent, impartial and
professional judiciary and to establish a professional and effective judicial system and
prosecutorial function in the Federation of BiH. Among other duties, the Council is also
responsible for appointments, realization of disciplinary proceedings and dismissals of
judges, prosecutors and their deputies, except the judges of the Federation BiH
Constitutional Court.
CONSTITUTIONAL COURT OF THE FEDERATION OF BOSNIA AND
HERZEGOVINA
The Constitutional Court is composed of nine judges, of whom at least two come from each
of the three constituent peoples and one from among the Others. The main function of the
Constitutional Court is resolving disputes:
between Cantons;
between Cantons and the Federation government;
between the city and its Canton or Federation government;
between the city and Municipality;
between Municipalities and their Cantons or Federation government; and
between the Federation government institutions or within single institutions of the
Federation government.
The Constitutional Court will:
at the request of the Federation President, Federation Vice-Presidents, Prime
Minister, Prime Minister Deputies or at the request of one third of any of the
Houses of the Federation Parliament, determine whether a proposal law adopted by
one of the Houses, or a law adopted by both Houses, is in conformity with the
Federation Constitution;
at the request of the Prime Minister, Prime Minister Deputies, President of Canton
or one third of the delegates in Cantonal legislative body, determine whether the
Cantonal constitution or amendment to the constitution, proposal law or law
adopted by that legislative body is in conformity with the Federation Constitution;
at the request of the Federation President, Federation Vice-Presidents, Prime
Minister or Prime Minister Deputies, determine whether a proposed or adopted
regulation passed by a Federation government body is in conformity with the
Federation Constitution;
at the request of the Prime Minister, Prime Minister Deputies or President of
Canton, determine whether any of the proposed or adopted regulations which have
been passed by a body of Cantonal, city or Municipal authority are in conformity
with the Federation Constitution.
The Constitutional Court also decides on: constitutional issues referred to it by the Supreme
Court or Cantonal Court and put into the procedure before that court; issues stipulated by
the law in the matter of immunity in the Federation of BiH; existence of interests vital to
constitutive people of importance for decision-making in the House of Peoples of the
Federation Parliament; appeals against decisions of the highest court of Cantons with
special regime; removal of the Federation President and Vice-Presidents.
The President of the Federation of BiH in compliance with the Vice-Presidents proposes
the judges of the Constitutional Court. Appointment of the judges is done by the majority
Delegates in the House of Peoples present and voting. Judges of the Constitutional Court
will serve until the age of 70, unless they do resign or are relieved with reason by the
consensus of other judges of that court.

SUPREME COURT OF THE FEDERATION OF BOSNIA AND HERZEGOVINA
VThe Supreme Court is the highest appeals court in the Federation of BiH, whose
responsibilities include decisions on appeals against decisions by Cantonal courts regarding
issues related to the Constitution, laws, and other Federation regulations, as well as other
issues determined by the Federation legislation, except for those falling under the
jurisdiction of the Constitutional Court.
The decisions of the Supreme Court are final and binding.
The number of Supreme Court judges is defined by the Federation law according to needs,
provided that the number of judges may not be less than nine.
Supreme Court judges, including the President of the Court, are elected, appointed,
disciplinary proceeded and dismissed by the High Judicial and Prosecutorial Council in
accordance with the law. Supreme Court judges, except reserve judges, are appointed for
life time, unless in the case of resigning, retiring or removed with reason, by the High
Judicial and Prosecutorial Council, in accordance with the law.
The President of the Supreme Court is responsible for the work of the FBiH Supreme
Court, as well as for the management of the court police. The President of the Supreme
Court passes regulations under which the court police operates. The court police assists
Courts, the Prosecutor's Office and Ombudsmen, at their request, in performing their
duties.
The Supreme Court also has primary jurisdictions determined by Federation laws.

Federation Prosecuto's Office
The Federation Prosecutor's Office is an independent state body that, within the framework
of the rights and responsibilities of the Federation of BiH, undertakes measures defined in
law with regard to the prosecution of perpetrators of criminal acts and economic offences,
uses legal means to protect legality, and performs other duties as defined in the Federation
law.
The Federation Prosecutor's Office has first-instance jurisdiction over investigating
activities and prosecution of potential perpetrators of criminal acts of terrorism, inter-
Cantonal crime, illegal drug trafficking and organized crime in criminal matter at the first
instance level, which the Law on the Supreme Court of the Federation of BiH has placed
under the jurisdiction of this court.
The Federation Prosecutor's Office discharges its function in accordance with the
Federation Constitution, and on the basis of Bosnia and Herzegovina and Federation BiH
laws. In discharging its functions, the Federation Prosecutor's Office protects the exercise
of human rights and citizens' freedoms that are guaranteed by the Constitutions of Bosnia
and Herzegovina and the Federation of BiH, as well as rights and interests of legal entities
in accordance with the law. Federation Prosecutor's Office will ensure constitutionality and
lawfulness. In discharging its functions, the Federation Prosecutor's Office has the right and
duty to, on its own initiative and at request, inform the Federation President, Federation
Vice-Presidents, Federation Parliament and the Federation Government about the
implementation of Criminal Code in the Federation of BiH, and its own work.
Through the media and in other ways, the Federation Prosecutor's Office informs the public
about the crime situations, and within its competencies as stipulated by law and in
accordance with the interest of the proceeding, it may also inform public on specific cases,
if these information are categorized as information of public interest.
The Federation Prosecutor's Office follows and examines problems encountered in its
practice in the Federation of BiH, that are of interest for the implementation of Criminal
Code in the Federation of BiH.
The Chief Prosecutor and his/her Deputies, and Federation Prosecutors perform the
function of the Federation Prosecutor's Office. They are elected and appointed by the High
Juridical and Prosecutorial Council of the Federation of BiH. The Chief Prosecutor and
his/her Deputies are appointed for a period of six (6) years, with a possibility of re-
appointment. After the expiration of the mandate, the Chief Prosecutor and his/her
Deputies continue with performing their duties as Federation Prosecutors. The Federation
Prosecutors are appointed to the office without a restricted mandate.
The Chief Prosecutor, in discharging its function in the prosecution of criminal acts,
proceeds before the Federation Supreme Court and other courts of the Federation of BiH.
The Chief Prosecutor acts as an arbitrator in the matter of competency conflict between two
Prosecutor's Offices at cantonal level.
The Chief Prosecutor, when ever he/she has a reason to doubt that the Cantonal
Prosecutor's Offices failed to apply the Federation Criminal Code or that the prosecution of
criminal acts can not be efficiently conducted within the competency of Cantonal
Prosecutor's Office, may give circular or individual binding instructions to Cantonal
Prosecutor's Offices, conduct criminal investigations and prosecutions before Cantonal and
Municipal courts. The Chief Prosecutor may take particular cases or activities from one
Cantonal Prosecutor's Office and entrust them to other Cantonal Prosecutor's Office.

Federation Attorney's Office
The Federation Attorney's Office is a state body that undertakes measures and uses legal
tools for legal protection of the property and property interests of the Federation of BiH,
except for the property and property interests of the Federation Ministry of Defense and
Army of the Federation of BiH, whose legal protection is provided by the Ministry of
Defense through its relevant organizational unit. The Federation Public Attorney's Office
also conducts other activities defined by law.
Governmental bodies, enterprises and other legal entities are required to submit to the
Federation Attorney's Office data and information regarding the jeopardizing, infringement
or denial of rights and assets that are the property of the Federation of BiH, for the purpose
of taking legal action and using instruments for which the Federation Attorney's Office is
authorized.
At the request of the Federation Attorney's Office, governmental bodies and legal parties
are obliged to submit data, information and files which it needs for undertaking actions
within its jurisdiction.
The Federation Attorney's Office performs duties of legal protection of the property and
property interests of the Federation of BiH, its bodies, other governmental bodies and funds
that have the status of a legal entity are financed from the Federation budget or the
Federation has founding rights over them.
The Federation Attorney's Office performs duties of legal protection of the property and
property interests of public enterprises and other legal entities established by the Federation
of BiH, if so foreseen by the establishment acts. If not decided otherwise by the Federation
Government, the Federation Attorney's Office, in addition to performing the duties defined
by the Federation law, represents the Federation of BiH at international courts, arbitration
courts and other international governmental bodies and organizations.
The Federation Attorney's Office may represent a Cantonal or Municipal Attorney's Office
at international courts, arbitration courts and other international governmental bodies and
organizations if they request this representation and if it is foreseen in Cantonal law. If
under the regulations of a foreign country the Federation Attorney's Office may not engage
in direct representation at its courts, arbitration courts and other governmental bodies and
organizations, the Government will authorize another person that under the regulations of
the foreign country may replace it in the representation.
If authorized by them, the Federation Attorney's Office may represent governmental bodies
against which a lawsuit has been filed in an administrative dispute when the property and
property interests of the Federation of BiH are violated.
In the process of passing general acts regulating the property relations, rights and
obligations towards the assets that are the property of the Federation BiH, it is obligatory to
obtain an opinion from the Federation Attorney.
The Federation Attorney's Office provides professional support to bodies, funds,
enterprises, and other legal entities in solving property issues and provides opinion with
regard to conclusion of property agreements.
Bodies and legal entities are required to obtain a legal opinion from the Federation
Attorney's Office before concluding a contract of sale, trade, lease, transfer for temporary
or permanent property use, with or without a fee, concession agreement, contract on
construction and pooling of resources for construction, contract on status and contractual
forms of linking enterprises, as well as other contracts through which assets or material
rights are purchased or disposed of. When the subject of contract is a movable property or a
property right whose value does not exceed 1,000 KM, it is not obligatory to obtain a legal
opinion from the Federation Attorney's Office.
At the request from Cantonal and Municipal Attorney's Offices, the Federation Attorney's
Office provides them with legal opinion on property contracts that they intend to conclude
with foreign legal entities and individuals, as well as on other property relations with those
persons.
The Federation Attorney's Office provides Cantonal and Municipal Attorney's Offices with
obligatory instructions regarding the application of Federation laws.
With the consent form the Prime Minister Deputies and confirmation from the Federation
Parliament, the Prime Minister appoints and removes the Federation Attorney and his/her
Deputies. The Minister of Justice proposes the appointment of the Federation Attorney and
his/her Deputies. The Federation Attorney is appointed for a period of four (4) years and
may be re-appointed. The Deputy Federation Attorneys are appointed to the office for an
unlimited period of time.
