IMPORTANT INFORMATION ONCITY OF YORBA LINDA SPECIAL RECALL ELECTION

VOTES CAST BY THE VOTER:

There are two questions on the City of Yorba Linda Special Recall Election ballot for each recall. Refer to the ballotimages below.

FIRST QUESTION:

Whether or not the incumbent City Council Member shall be recalled:

Shall Thomas H. Lindsey be recalled (removed) fromthe office of City Council Member?

Yes

Shall Craig Young be recalled (removed) from theoffice of City Council Member?

A “Yes” vote means the voter wants the incumbent City Council Member recalled (removed) from office.

A “No” vote means that the voter wants the incumbent City Council Member to remain in office.

SECOND QUESTION:

The second question on the ballot considers those candidates who are campaigning to replace the incumbent CityCouncil Member if he is recalled. A voter may vote for one of those candidates who are listed on the ballot or may write-in the name of a qualified write-in candidate.

A voter may lawfully cast votes on both questions or cast a vote only on either of the two questions. A voterDOES NOT need to cast a vote for both questions to ensure that the vote he/she did cast on only one questionwill be counted.

RESULTS OF THE ELECTION:

If more voters mark “Yes” than “No” on the first question, the incumbent City Council Member will be recalled (removed)from office.

If more voters mark “No” than “Yes” on the first question, the incumbent City Council Member will remain in office.

If the incumbent City Council Member is recalled (removed), the candidate who receives the most votes in the secondquestion will be elected as the new City Council Member for the duration of the term. That person can be sworn-in asthe City Council Member once the results of the election are certified.

STATEMENTS OF CANDIDATESSEEKING NONPARTISAN OFFICE

STATEMENT OF REASONSFOR THE PROPOSED RECALL OF THOMAS H. LINDSEY

The grounds for recall of Councilmember Thomas H. Lindsey are:Broke his campaign pledge of low-density development.

a. Voted against an urgency ordinance, which would haveplaced a moratorium on high density development andthat would help further a ballot measure to eliminate orreduce high-density housing sites that include 4-storybuildings with heights up to 50 feet.

b. Refused to listen to concerned residents and deal harshlywith the County regarding development of over 500 homes infire sensitive land near the northeast corridor of the City.

c. Lindsey's vote to kill the high-density moratorium is anabandonment of his signed statement in his 2010 Contractwith Yorba Linda, which pledged to voters that all infilldevelopment projects would be consistent with their existingand surrounding neighborhoods.

Is fiscally irresponsible and unethical.a. Put the City at risk for $19 million breach of contract

lawsuit with the County and the Sheriffs Department in anill-fated attempt to renegotiate Yorba Linda's police servicescontract with the Brea Police Department, after the policecontract was signed and approved by both the City andCounty.

b. Participated in a public smear campaign of three fellowcouncilmembers, voting to publicly disclose confidentialclosed-session information used during the November 2012election.

Fellow Yorba Lindans, please vote “No” in this unprecedentedrecall election. Recall of an elected official is for illegal acts.Opponents initiated this recall over a vote I made to uphold housingdensity laws that Yorba Linda voters approved just two yearsago, affirming decisions from our Planning Commission. BecauseI upheld the will of residents and avoided costly, unwinnablelawsuits, I am facing recall. With the City almost entirely built out,our fundamental character is set and reasonable developmenthelps keep our city financially strong. I do not advocate “HighDensity!”

Over the past four years I have worked tirelessly to protect our City.Public safety will always be my first priority. Other priorities includea vibrant Town Center with businesses and restaurants, Costcogas, well maintained streets and parks, city landscaping, and greatschools. Our beautiful city demands fiscal conservatism to keep itthat way.

The normal General Election in November allows you to vote foryour City Council properly. Don’t let the disregard for your taxdollars be rewarded. Don’t fall victim to the deception and bullyingtactics employed by recall supporters. Vote “No” on recall andchoose your Council in November.

ANSWER OF THOMAS H. LINDSEY TO STATEMENTOF REASONS FOR THE PROPOSED RECALL

PLEASE, DO NOT SIGN THE RECALLIt will cost Yorba Linda taxpayers tens of thousands of dollars infiling fees alone. This recall is a misguided attempt by a narrowspecial interest to bully council into adopting extreme policies thatwill hurt our economy, kill jobs and also cost residents hundreds ofthousands in attorneys' fees.A city-wide moratorium on new construction in response to thisspecial interest group's opposition is a disproportionate reaction wecannot afford. It's the same kind of reactionary policy-making thattakes place in Sacramento which is driving so many businessesfrom California.This recall is a reckless erosion of council's independence frombullying special interests. It's an intimidation tactic that sets aprecedent on future councils' willingness to do what is right for ALLresidents, not bend to the will of special interests.I'm a low-density housing advocate who carefully negotiates asopposed to recklessly abandons the fiduciary responsibility owedtaxpayers and I'm fully supportive of the diligent efforts by ourSheriffs. I've worked hard to help get our finances in order, alreadysaving us millions in interest, and am disappointed this group wouldwaste tens of thousands of taxpayer dollars on this unnecessaryeffort.

From community service projects to LittleLeague, I have enjoyed the privilege of associating with the bestfriends and neighbors a man could ask for.

Unfortunately, our city is in the midst of a manufactured crisis:holding an expensive recall of a councilmember mere weeks beforehe is up for re-election anyway is not an act befitting the land ofgracious living. Vote no on the recall to denounce this bad behaviorand the policies of those who support it.

If you want Yorba Linda to continue to thrive, vote no on the recall,then check my name—as an insurance policy. Our grandchildrendeserve to grow up in the vibrant city our children did. Together wecan preserve our city’s future.

I need your vote to stop the out-of-control, high-densitydevelopment that threatens to destroy Yorba Linda’s semi-ruralcharacter and special quality of life. Elect me and I will join the long-term members of council who are also committed to this cause.

I am currently a professor and co-chair of Business Administrationat Whittier College, where I have worked for the past twenty years.Previously, I had a successful business career as President andChief Operating Officer of two California-based businesses, andbefore that, I served as Vice President/Senior Regional Managerof Progressive Insurance. While teaching, I also consulted withsenior managers in many organizations. I have taught for Biola,Pepperdine, and Claremont Graduate Universities.

STATEMENT OF REASONSFOR THE PROPOSED RECALL OF CRAIG YOUNG

The grounds for recall of Councilmember Craig Young are:Broke his campaign pledge of low-density development.

a. Voted against an urgency ordinance, which would haveplaced a moratorium on high-density development and thatwould help further a ballot measure to eliminate or reducehigh-density housing sites that include 4-story buildings withheights up to 50 feet.

b. Refused to listen to concerned residents and deal harshlywith the County regarding development of over 500 homes infire sensitive land near the northeast corridor of the City.

Is fiscally irresponsible and unethical.a. Put the City at risk for a $19 million breach of contract

lawsuit with the County and the Sheriffs Department in anill-fated attempt to renegotiate Yorba Linda's police servicescontract with the Brea Police Department, after the policecontract was signed and approved by both the City andCounty.

Betrayed the trust of Yorba Linda voters and his 4-yearcommitment to the community to serve on the city council.

a. Declared his candidacy for State Assembly in August 2013within just 8 months of being sworn in for his first term as acity councilman. Ironically, his November 2012 campaignstatement specifically stated he had no hidden agenda andno axe to grind.

Special interests were unhappy with how Yorba Linda residentsvoted and launched a recall for a do over. They spread vicious liesabout my record in an attempt to make their political cronies lookbetter.

The truth is: I’m opposed to dense overdevelopment, workingdiligently to maintain Yorba Linda’s character and quality of life.

They pursued political aspirations at Your expense. Theirmudslinging included filing multiple allegations of ethical violationswith the District Attorney. After six months of thorough independentinvestigation and over $50,000 of taxpayer expense, attorneyscalled the allegations “Unfounded” (in bold letters)!

Additionally, the Orange County Registrar was paid $62,152, plusanother cost to taxpayers estimated at $187,603-$210,050. Whilethey waste your money, I’m solving Yorba Linda’s $4,000,000annual structural deficit. In two years, I’ve approved:

Debt payoff, saving $9,000,000 in interestTown Center, bringing new dining, shopping, and revenueLa Palma repairCostco Gas, adding convenience and revenue

PLEASE, DO NOT SIGN THE RECALLIt will cost Yorba Linda taxpayers tens of thousands of dollars infiling fees alone. This recall is a misguided attempt by a narrowspecial interest to bully council into adopting extreme policies thatwill hurt our economy, kill jobs and also cost residents hundreds ofthousands in attorneys' fees.A city-wide moratorium on new construction in response to thisspecial interest group's opposition is a disproportionate reaction wecannot afford. It's the same kind of reactionary policy-making thattakes place in Sacramento which is driving so many businessesfrom California.This recall is a reckless erosion of council's independence frombullying special interests. It's an intimidation tactic that sets aprecedent on future councils' willingness to do what is right for ALLresidents, not bend to the will of special interests.I'm a low-density housing advocate who carefully negotiates asopposed to recklessly abandons the fiduciary responsibility owedtaxpayers and I'm fully supportive of the diligent efforts by ourSheriffs. I've worked hard to help get our finances in order, alreadysaving us millions in interest, and am disappointed this group wouldwaste tens of thousands of taxpayer dollars on this unnecessaryeffort.

We must stop the special interest-controlled City Council fromradically transforming our city to high-density housing. I will supporta moratorium on 3 and 4-story development and a ballot initiative toreduce densities. During my tenure on the City Council and as Mayor in 2011, Iworked to competitively bid our police services. I am an architect ofthe contract with the Orange County Sheriff, which saved taxpayers$10 million over five years with 40% more coverage. I stronglybelieve in public safety and Yorba Linda must demand that theNortheast County properties deal directly with our city in this fire-prone area. We must also find equitable solutions for the shortfallsin the Landscape Maintenance Assessment District.

I am a proponent of Measure Y, the Ethics Policy. I supportedMeasure BB that ended Eminent Domain and Measure B, the Rightto Vote on Land Use Amendment.

Yorba Linda is a wonderful place to live, work, and play. My wifeand I raised our four children here and it’s been our home for thepast 30 years. In all that time, I have never seen anything likethis recall effort. I don’t want “high density.” My wife enjoys ridingher horse in the lakebed and I would not want development toimpact that. I did my homework and found out that Yorba Lindavoters approved the local laws that allow these developments inour city. Despite what the recall supporters have said, Mayor Youngand Councilman Lindsey don’t support “high density.” They are,however, following our laws and state housing mandates. Therecall supporters have manipulated the facts and mischaracterizedour council members’ positions to discredit them and legitimize thiscostly recall election so that they could try reclaiming the Councilmajority.

Many residents had the wool pulled over their eyes when theysigned two petitions against “high density” development that wereactually recall petitions. This was dishonest.

I am voting “No” on the recall but I am running for council as analternative choice for Yorba Linda if the recall succeeds.
