    20 * Not applicable to the Porsche Sport Driving School.

    Participants do not have any entitlement toa specific Porsche car model.4.2 Participants renting a Porsche hirecar must produce a valid driving licenceand identity papers as well as a creditcard at the check-in on the day of theevent. The relevant details are enteredon the car hire contract issued byDr. Ing. h.c. F. Porsche Aktiengesellschaftand to be signed by the participant.4.3 Porsche hire cars are covered bythird-party as well as comprehensiveinsurance. The comprehensive insurance,depending on the relevant training level,is subject to the following damage excessamounts per claim: Warm-up: excess EUR 5,000 Precision/Women Only:

    excess EUR 5,000 Performance: excess EUR 10,000 Master/special courses: excess

    EUR 10,000When hiring turbocharged vehicles, thedamage excess is EUR 10,000 irrespectiveof the training level.4.4 In the event of a claim, the participantshall pay the excess to Porsche.4.5 Porsche does not offer any additionalinsurance cover.4.6 If the insurer is not liable due to grossnegligence or wilful intent on the part of theparticipant, or if the damage caused bythe participant is not covered by the fullycomprehensive insurance, the participantis liable for all damage the participant orthe person accompanying the participanthas caused.

    If such costs do arise, they shall be iseparately.6.11 The event fee/payment includesthe following services: Training fees Circuit hire incl. track safety measu Supervision by two instructors per g On-site project management Food and refreshments as specified

    in the respective programme Technical support for the vehicles Medical support Training contents as specified in

    the relevant programme Training information pack Travel cancellation insurance6.12 The participant pays the followincosts: Travel to and from the training venu Running costs for the participants o

    vehicle including fuel and lubricants Accommodation costs in the hotel a

    indicated as well as additional costsas drinks at the bar, parking, telephcharges, etc.

    6.13 First time participants driving aPorsche registered in their name thatbeen modified for disabled persons mtake part in their first Warm-up or Pretraining session free of charge.

    7 Event requirements

    7.1 There are no requirements for theWarm-up or Precision courses.7.2 To participate in the Performancetraining course the driver must havecompleted a Precision event at the PoSport Driving School.7.3 To participate in the Master trainicourse the driver must have complete

    3.2 The use of vehicles that have beenissued with transit or temporary numberplates is not permitted in these events.3.3 All parts or equipment fitted to thevehicle must be approved by the GermanTechnical Inspection Association (TV)and entered in the vehicle registrationpapers. To be observed for the exhaustsystem in particular: every circuit operatoris subject to noise restrictions set by thelegisla tor. These have to be continuallymeasured, documented and strictlycomplied with. If a vehicle is fitted with astandard exhaust system from the manu-facturer, there should be no unexpectedcomplaints from racetrack security.3.4 The Organiser reserves the right toexclude from the event any vehicle thatdoes not comply with these requirementsin accordance with subsections 3.13.3.There is no entitlement to the provisionof a replacement vehicle in such cases.3.5 Before taking part in an event werecommend that customers check withtheir car insurers to ensure the validity oftheir third-party vehicle insurance and, ifapplicable, their comprehensive insurancecover.

    4 Using a hire car from Porsche

    4.1 Porsche cars may be hired (subjectto availability; hire fee depends on traininglevel) for the duration of Porsche SportDriving School events (Porsche VehicleHire). In this case a separate car hireagreement has to be made withDr. Ing. h.c. F. Porsche Aktiengesellschaft.

In the case of shortnotice bookings made within 7 days of thedeparture date, how you receive yourtraining documents shall be agreed withthe Service Team of the Porsche SportDriving School. Participants are requestedin their own interest to carefully check thedocuments upon receipt.6.9 If payments that are due are not paidor not paid in full and the participant doesnot pay even after receiving a reminderwith a payment deadline, the Organisershall have the option to cancel the contractexcept in the case where it is already clearthat there are serious defects. In the eventof cancellation of the contract in the con-text of the sentence above, the Organisermay demand payment of cancellationcharges as compensation as set forth insection 15. If the participant does notmake any payment despite being inarrears, the Organiser reserves the rightto charge a fixed dunning cost fee ofEUR 20 for the second reminder. The rightof the participant to prove that substantiallylower or no costs have been incurredremains unaffected.6.10 Costs for additional services, suchas visa applications, etc., are not includedin the participation fee unless expresslyitemised in the description of services.

    1.2 By signing the registration form theparticipant accepts airtours GeneralTerms and Conditions.1.3 The contract for participating in anevent comes into effect as soon as thePorsche Sport Driving School issues aninvoice to the participant. The receiptof the invoice also serves as writtenconfirmation of the registration. Theconfirmation of participation is nottransferrable.1.4 The Organiser endeavours to provideparticipants with a detailed traininginformation pack at the latest 10 daysbefore the start of the relevant event.

    2 Driving licence

    2.1 All participants must produce a validdriving licence on the day of the event.Participants must also affirm that theyhave not been officially banned from driv-ing. This applies regardless of whether thecar used is a private car or a car hired outby Porsche in accordance with provisionsin section 4.2.2 Participants who are unable to pro-duce a valid driving licence or have beenofficially banned from driving shall notbe entitled to take part in Porsche SportDriving School events. In such cases thecourse fee shall not be refunded.

    3 Using private vehicles

    3.1 Only vehicles covered by statutorythird-party insurance and which complywith the German road traffic regulations(StVZO) may be used in the event.

    the date of the training (see subsections6.3 and 6.5.3).6.3 The balance becomes due once it hasbeen confirmed that the training shall takeplace as agreed.6.4 The amount of the deposit and thebalance and any applicable cancellationcharges in the event of a cancellation areshown on the confirmation/invoice.The charges in the event of cancellation(cf. section 12), processing and amendment fees (cf. section 13) as well as charges forcustomised arrangements of the event arepayable immediately.6.5 Paying the Organiser6.5.1 Payments to the account of thePorsche Sport Driving School may bemade in euros only. In the case of paymentby direct debit, the Organiser shall needdetails of the bank account and the addressof the participant or, where appropriate,the address to which the training docu-ments should be sent as well as writtenauthorisation to charge the bank account.6.5.2 The participant may also pay thetraining fees by credit card. In this case,the details of the credit card shall berequested separately when booking.The Organiser will also need the addressof the participant or, where appropriate,the address of the person who will bereceiving the documents, as well as author-

    isation to charge the bank account via thecredit card. Please note that the specialbenefits offered by the TUI Card/TUI CardGold do not apply when making bookingswith the Porsche Sport Driving School.6.5.3 As a rule, the deposit is debited

    from your bank account within a week ofconcluding the contract and the balance30 days before the start of training but

    Training objectives of the

    Porsche Sport Driving School

    The Porsche Sport Driving School eventsorganised by TUI Deutschland GmbH(hereinafter referred to as airtours)pursue the following objectives: To improve driving skills and driving

    safety, especially in everyday road trafficsituations

    The events are not aimed at achievingmaximum speeds nor are they intendedto encourage competitive behaviour

    To improve mastery of the vehicle andresponse time

    To identify hazardous situations wellin advance

    To promote correct responses inhazardous situations

    The events seek to make a positivecontribution towards reducing thenumber of accidents. To achieve theseobjectives participants are divided intogroups of up to approximately 12participants of a similar level. A maximumof 2 instructors supervise each group.

    Conditions of participation in thePorsche Sport Driving School, Germany

    1 Registration, confirmation

    1.1 Registration should be completedexclusively using the Porsche Sport DrivingSchool form, printed or online version(www.porsche.com/sportdrivingschool).

    5 Accompanying person and second

    driver

    5.1 Accompanying personEach participating driver may register anaccompanying person to join them in atraining event, but not take part actively.The accompanying person may travel asa passenger during section training. How-ever, unfortunately no passengers areallowed in the training vehicle while drivingfor assessment purposes or completinglaps. Children aged 12 or more mayaccompany the driver in the Warm-up andPrecision section training sessions. How-ever, another adult must be available onsite to oversee the child during lap drivingsessions. Employees of the Porsche SportDriving School cannot accept responsibilityfor supervising children. Both parentsmust sign a liability waiver for the minor.For Performance and Master training levelsas well as for special courses, the minimum age for accompanying persons is 18.5.2 Two drivers per vehicleIt is possible on request to register twodrivers for one vehicle in closed incentivegroups. In this case, two people share thetraining vehicle and both take part activelyin the event as full-paying participants.

    6 Payment

    6.1 To safeguard the monies paid bycustomers, the Organiser has taken out in-solvency insurance cover with the GermanReisepreis Sicherungsverein VVaG (DRS).An insolvency insurance certificate shall beenclosed with the confirmation/invoice.6.2 After conclusion of the contract, adeposit of 25 % of the total price becomesdue when the confirmation/invoice is issued.

    concluding the contract, airtours reservesthe right to alter the content of the event.

    12 Cancellation by the participant

    before training commences/cancellationfees

    12.1 The participant may withdraw froman event at any time before trainingcommences. The date on which notice ofcancellation is received by the Organisershall be decisive (for addresses see sec-tion 22). Participants are recommended toput the notice of cancellation in writing.12.2 In the event of cancellation by theparticipant or a no-show at the event, theOrganiser shall no longer be entitled to theevent fee. Instead, if the Organiser was notresponsible for the cancellation or theno-show at the event or in the absence offorce majeure, the Organiser shall beentitled to claim reasonable compensationdepending on the applicable event fee tocover the costs of the preparations madefor the event at the time of cancellation orno-show as well as for the administrativehandling costs of the cancellation. Theapplicable pro-rata based standard cancel-lation fees are set forth in subsection 12.5and take into account the time betweencancellation and the contractually agreedstart of the event. The typical savings andother possible usage of services providedat the event are taken into account.12.3 Cancellation fees are also payable ifthe participant does not show up at thetime specified in the information pack forthe relevant training circuit or if the no-

    show is due to a failure by the participantto provide the necessary travel documents,such as a passport or the relevant visa, forwhich the Organiser is not responsible.

    However, the Organiser must make dcost adjustment that takes into accouthe value of any expenditure saved, aas such benefits generated by the coponents not made use of by the partipant and put to other meaningful use any refunds received from service prov

    15.2 The Organiser may cancel the econtract up to 5 weeks (receipt by thparticipant) before the start of the evshould the minimum number of particpants specified in the relevant descriof services not be reached. The Orgashall of course notify the participant asoon as it becomes apparent that the imum number of participants will not reached. The notice of cancellation wbe delivered to the participant immedly. The participant shall be immediaterefunded the full amount paid for parpating in the event.

    16 Extraordinary circumstances

    force majeure

    16.1 We refer to article 651j BGB (GeCivil Code) in the case of termination the event contract due to force majeuThe wording is as follows:(1) If the event is substantially impaire

    jeopardised or adversel y affected as result of force majeure not foreseeabwhen the agreement was entered intothen the Organiser as well as the partpant may terminate the agreement siunder these provisions.(2) If the contract is cancelled in line witem (1) above, the provisions of artic 651e subsections 3 (1) and 2 (4) ap16.2 Participants may consult the traadvice issued by the German Ministry

    Similarly, it does not apply in the case ofasserting statutory compensation claimsfor default or impossibility for whichairtours or its legal representatives andvicarious agents are responsible. Nor doesit apply in the case of negligent violationof material contractual obligations. Con-tractual obligations are deemed to be suchobligations whose violation may endangerthe purpose of the contract and on compli-ance of which the contracting party mayusually rely. In the case of the breach ofsuch cardinal contractual obligationsthrough gross negligence, airtours liabilityis limited to compensation for the typicaldamages foreseeable at the time thecontract was concluded. Claims basedon the German product liability act remainunaffected.10.3 Participants driving their own vehicles at a Porsche Sport Driving School eventshall indemnify airtours and its legal repre-sentatives and vicarious agents from allclaims resulting from damage to thisvehicle made by an authorised third party(keeper, owner etc.), unless the damagewas caused through gross negligence ormalicious intent on the part of airtours orits legal representatives and vicariousagents.10.4 The liability disclaimer and localliability exclusions to be signed by theparticipant and any accompanying personremain unaffected.

    11 Changes by airtoursIn the case of force majeure, extremeweather conditions, orders issued byrelevant authorities for safety or othermaterial reasons or the result of circum-stances unforeseeable at the time of

    assigned their rights and duties in accord-ance with the contract to participate in theevent. In this case, the Organiser must benotified immediately. The Organiser mayobject to the third person substituting theparticipant, if the third person does not sat-isfy the necessary event requirements or ifstatutory or official regulations or direct ivespreclude their participation. If a third per-son replaces the booked participant, theOrganiser is entitled to charge a flat-ratehandling fee of EUR 50. The participantsright to show evidence that substantiallylower costs or no costs at all have been in-curred remains unaffected. The registeredparticipant and the substitute are jointlyand severally liable for paying the event feeand the extra cost incurred through inclusion

    of the replacement person.

    14 Travel insurance

    14.1 []*14.2 Events at the Porsche Sport DrivingSchool include an insurance packagethat covers travel cancellation fees andaccidents.

    15 Cancellation and terminationby the Organiser

    15.1 The Organiser may terminate theevent contract without notice if the parti-cipant disrupts the course of the eventdespite proper admonishment by the Or-ganiser. This also applies if the conduct ofthe participant grossly violates the termsof the contract to such an extent that theimmediate termination of the contract is

    justified. The Orga niser reserves the rig htto retain the price paid for the event. Thedisruptive participant shall also bear anyextra costs incurred for repatriation.

    section training sessions. airtours pro-vides a limited number of helmets onpayment of a deposit.9.4 The consumption of alcohol is strictlyprohibited (blood alcohol level: 0.0 per-cent) at all Porsche Sport Driving Schoolevents, as is the taking of drugs or intoxi-cating substances that may have a nega-tive effect on the participants ability todrive. All participants undertake to ensure,through their behaviour before and duringthe event, that they comply with these re-quirements. The event management shallbe entitled to exclude any participant rea-sonably suspected of consuming alcoholor taking drugs or any other intoxicatingsubstance from participating in the event.In such cases, there shall be no reimburse-ment of the event fee.9.5 In the event of gross breaches ofdriving discipline, the event managementshall be entitled to exclude the participantconcerned from further participation. Insuch cases, there shall be no reimburse-ment of the event fee.

    10 Liability, limitation of liability andexemption

    10.1 Participants take part in the PorscheSport Driving School events at their ownrisk.10.2 airtours and its legal representativesand vicarious agents shall only be liablefor damage to the participants or damagecaused to third parties by a participant ifthis damage was caused by gross negli-gence or malicious intent by airtours or itslegal representatives and vicarious agents.This exclusion of liability does not apply inthe case of fatal injury or injury to thebody or health of the participant.

Any remain-ing value shall not be paid out in cash.Vouchers and their redemption are subjectto the laws of the Federal Republic ofGermany. Vouchers shall be valid for aperiod of three years after their issue,starting from 31 December in the yearin which they were issued.

    13 Rebooking, change of person

    13.1 Up to the 31st day before the start ofthe event at the request of the participant,the Organiser shall, as far as is feasible,amend the booking for an amendment feeof EUR 50 per person. An amendment is,for instance, a change to the date of theevent, the destination, the place the travelcommences, the accommodation ortransport. In the case of scheduled flights,as soon as the ticket has been issued add-itional changes to the departure time aredeemed to be an amendment. Changes inline with the periods referred to above insubsection 12.5.2 (e.g. for flight-based/standard charges from 30th day beforestart of travel) as well as changes thattake effect outside the period of validityof the description in the brochure uponwhich the booking is made (subsection6.11) may only be made by cancelling thetravel contract under the provisions insection 12 and immediately rebooking.This also applies to flight-only travel onscheduled flights in the case of a changeof carrier performed at the participantsrequest.13.2 Until the start of the event, partici-pants may request that a third person be

The Organiser reserves the righton a case-by-case basis to allow direct entryto Porsche Sport Driving School events

    (Performance and higher levels) to driverswith documented experience gained at train-ing events offered by third-party organisersand subject to a successful check to ensurethat the course content is equivalent.

    8 Training venues

    8.1 The circuits are closed to other driversduring the events.8.2 All circuits are subject to the Germanroad traffic regulations (StVO) and roadtraffic licensing regulations (StVZO).

    9 Safety precautions

    9.1 Participants must follow the instructionsof the airtours employees for the entireduration of any event. Seat belts must beworn at all times.9.2 Accompanying persons named on theregistration form and second drivers maytravel in the participants car during sectiontraining sessions, except when drivers arebeing assessed or completing laps.While the participant is completing laps, theaccompanying person may travel with the in-structor (subject to available space).9.3 At all Porsche Sport Driving Schoolevents, helmets must be worn when com-pleting laps. This also applies to various

    from the 10th day before the start of theevent 80 %, after the 3rd day before thestart of the event until the day the eventstarts or in the case of a no-show, 90 % ofthe event fee.

    Vouchers

    A handling fee of 5 % of the value of thevoucher is due if a voucher issued for agiven value is returned. The right to showthat lower costs or no costs at all havebeen incurred remains unaffected.12.6 The right of the participant to find asubstitute (see subsection 13.2 below) re-mains unaffected by the above provisions.12.7 Redeeming vouchersVouchers may only be redeemed againstservices listed in the Porsche Sport DrivingSchool brochures. Vouchers cannot be re-deemed against additional services, suchas flights, or any rebooking or cancellationfees. Vouchers may only be redeemedthrough the Porsche Sport Driving School,

    of visa applications, etc., by the relevantauthorities.19.3 The participant alone is responsiblefor complying with all regulations neces-sary for participating in the event. Anynegative consequences, especially thepayment of cancellation fees arising fromnon-compliance with these regulations, arethe participants responsibility, with the ex-ception of consequences due to culpablyincorrect or deficient information providedby the Organiser.19.4 Participants may enquire at thePorsche Sport Driving School as towhether a passport is needed to travel tothe booked event or whether an ID card issufficient. Please ensure that your traveldocuments are valid for the requiredperiod. In some countries children may beregistered in the passport of an accom-panying parent, while in others childrenrequire their own passport.19.5 Some countries apply very strictcustoms and currency regulations. Makesure that you are well informed and abideby the regulations.19.6 Some countries demand that certainvaccination certificates are no less than8 days old and not more than 3 years(smallpox) or 10 years old (yellow fever).Proof of such vaccinations is required bythe German authorities after returningfrom certain countries (e.g. Africa, theMiddle East). Participants may consult thePorsche Sport Driving School directly formore information.

    20 Audio and video recordings

    Participants may only use recordingsthey have made themselves for privatepurposes, unless airtours, the

    18.5 Claims arising from unlawful actslapse after 3 years.18.6 If negotiations between the partici-pant and the Organiser regarding theclaim or the circumstances surroundingthe claim remain unresolved, then theperiod after which the claim lapses shallbe postponed until the participant or theOrganiser refuses to continue with nego-tiations. The period after which the claimlapses shall take effect at the earliest3 months after the end of the postpone-ment.18.7 The assignment of claims against theOrganiser to other parties is excluded.This does not apply to family memberstravelling together.

    19 Passport, visa, customs, foreigncurrency and health requirements

    19.1 The Organiser shall notify nationalsof the country in which the event is offeredof any requirements concerning passport,visa and health regulations as well as anychanges to such regulations before thestart of the training. Nationals of othercountries should contact the respectiveembassy/consulate. Basic information onformalities is provided in the eventdescription in the brochures (subsection6.11) and in the training documents.Participants are requested to take note ofthis information.19.2 If the Organiser was entrusted withthe visa application, the Organiser himselfis not responsible for ensuring that thevisas required are issued by the relevantconsular authorities in good time, unlessthe Organiser was ultimately responsiblefor the delay. The participant should allowapproximately 8 weeks for the processing

    18 Exclusion of claims, limitation andassignment

    18.1 All claims on account of the event notbeing provided in accordance with the con-tract (articles 651c to f of the BGB) mustbe lodged with the Organiser within onemonth (the relevant addresses can befound in section 22 below). It is recom-mended that all claims be made in writing.The participant may make a claim after theexpiry of one month only if he was prevent-ed from doing so earlier by circumstancesbeyond his control. The day the eventended is not included when calculating themonths deadline.18.2 Claims asserted by the participant inaccordance with articles 651c to f BGB forlosses resulting from fatal injury, bodilyharm or damage to health, if they arisefrom a deliberate or grossly negligentbreach of duty on the part of the Organ-iser, lapse according to the statute of limi-tations after 2 years. This also applies toclaims for compensation for other dam-ages that arise from a deliberate or grossly negligent breach of duty on the part of theOrganiser or one of his legal representa-tives or vicarious agents.18.3 All other claims asserted by theparticipant in accordance with articles651c to f BGB lapse after 1 year accordingto the statute of limitations.18.4 The date for determining the lapse ofclaims according to 18.2 and 18.3 aboveis based on the day that follows the daythe event finishes as per the contract.

This alsoapplies to the entire legal relationship.22.5 Insofar as legal action is taken by thecustomer against the Organiser abroadand German law is not applied to the liabil-ity of the Organiser then as regards thelegal consequences, in particular regard-ing the type, extent and amount of theclaims of the customer, German law shallapply exclusively.22.6 The customer may take legal actionagainst the Organiser only at the placewhere the Organiser is based.22.7 Any legal action taken by the Organ-iser against the customer must be made inthe customers usual place of residence.The venue for any legal action against acustomer or contract partner to a travelcontract who is a trader or merchant, anatural or legal person, whether public orprivate, who is domiciled or has his usualplace of residence abroad or his place ofdomicile or usual residence is not knownat the time the action is taken, is agreedas the place where the Organiser is based.22.8 The aforementioned conditionsrelating to the choice of law and the legalvenue do not apply:a) if and inasmuch as provisions existin favour of the customer based on con-tractually mandatory regulations frominternational agreements and which areapplicable to the contract between thecustomer and the Organiser, or b) if andinasmuch as mandatory regulations in themember state of the European Union towhich the customer belongs are applicable

    17 Redress/price reduction/termination

    17.1 If a service or component of theevent cannot be fulfilled or is not fulfilledin accordance with the contract, the par-ticipant is entitled to demand redress.The Organiser may offer redress by provid-ing an alternative service of an equal orhigher value. The Organiser may refuse tooffer redress if this would involve unrea-sonable expenditure.17.2 After returning from the event, theparticipant is entitled to claim a reductionin the participation fee if services andcomponents of the event were not provid-ed in accordance with the contract and theparticipant did not culpably omit to notifythe Organiser of the defects immediately(without undue delay).17.3 If a training session was substantiallyimpaired due to a defect or deficiencyand the Organiser did not provide redresswithin a reasonable period, the participantis entitled in accordance with statutoryprovisions to terminate the event contract.In the interests of the participant and to beable to document such action, the recom-mended form of notice of termination is inwriting. The same applies if the participantcannot be reasonably expected for goodcause to continue in the event due to de-fects acknowledged by the Organiser. It isnot necessary to give a reasonable periodfor providing redress if redress is impos-sible or the Organiser refuses to provideredress, or if the immediate termination ofthe contract is justified in the participantsbest interest. The participant only owes

    21 Data protection

    Personal data that participants makeavailable to us shall be processed elec-tronically and used as necessary in orderto perform the contract. The data shall bestored in a central database maintainedby Dr. Ing. h.c. F. Porsche AG. airtours a TUI Deutschland GmbH brand shall pro-cess and use the data solely in conjunctionwith the Porsche Sport Driving School.

    22 Place of jurisdiction/generalinformation

    22.1 The recipient of the participationdocuments is obliged to check thedocuments received immediately to ensurethey are correct (name, training details, etc.)and to notify the issuer immediately in theevent of an error.22.2 Participants are obliged to bring avalid driving licence and a valid passport/identity card to events. The followingdriving licences are accepted: EU driving licences National driving licences in German

    or English National driving licences from

    non-EU countries not issued in Englishare only acceptable if accompaniedby a German translation

    International driving licences only whenpresented together with a national drivinglicence

    22.3 The invalidity of individual provisionsof the event contract does not affect thevalidity of the overall contract. The same
