1. PRE-QUALIFICATIONINSTRUCTIONS1.1 Introduction

Kenya Association of Manufacturers would like to invite interested candidateswhomust qualify bymeeting the set criteria as provided, to supply and delivergoodsorprovideservicestotheorganization.

1.2 Pre-qualificationObjective

The main objective is to have a database of approved suppliers to supply anddeliverassorteditemsandprovidesservicesunderrelevanttenders/quotationstoKenya Association of Manufacturers as and when required during the periodending30thDecember2020.

1.3 InvitationofPre-qualification

Suppliers registered with Registrar of Companies under the Laws of Kenya inrespective merchandise or services are invited to submit theirPREQUALIFICATION documents to our internal auditor at AAM Resources,PurshotamHouse,ChiromoLaneso that theymaybepre-qualified/registeredfor submission of tenders. Bids will be submitted in complete lots singly or incombination. The prospective Suppliers are required to supply mandatoryinformationforpre-qualification/registration.

1.4 Experience

Prospectivesuppliersandcontractorsmusthavecarriedoutsuccessfulsupplyanddelivery of similar items/services to Corporate Organization of similar size andcomplexity.Potentialsuppliers/contractorsmustdemonstratethewillingnessandcommitmenttomeetthepre-qualificationcriteria.

1.5 Pre-qualificationDocumentThis document includes questionnaire forms and documents required fromprospectivesuppliers.

1.6 Inordertobeconsideredforpre-qualification/registration,prospectivesuppliers

mustsubmitalltheinformationhereinrequested.1.7 DistributionofPre-qualificationDocuments

2. BRIEFCONTRACTREGULATIONS/GUIDELINES2.1 TaxesonImportedMaterials TheSupplierwillhavetopayalltaxespayableasapplicableforallmaterialstobe

supplied.2.2 CustomsClearance

Thesuppliers shallbe responsible for customclearanceof their importedgoodsandmaterials.

2.3 ContractPrice Thecontractshallbeofunitpricetypeorcumulativeofcomputedunitpriceand

quantitiesrequired.Pricesquotedshouldbeinclusiveofalldeliverychargesandtaxes.

2.4 Payments

Alllocalpurchaseordersshallbeoncreditofaminimumofthirty(30)days3. PRE-QUALIFICATION/REGISTRATIONDATAINSTRUCTIONS3.1 Pre-qualificationdataforms TheattachedquestionnaireformsPQ-1,PQ-2,PQ-,PQ-3,PQ-4,PQ-5,PQ-6,areto

be completed by prospective suppliers/contractorswhowish to be prequalifiedforsubmissionoftenderforthespecificcategory.

3.1.1 Thepre-qualified/registeredapplicationforms,whicharenotfilledoutcompletely

andsubmittedintheprescribedmannerwillnotbeconsidered.AllthedocumentsthatformpartoftheproposalmustbewritteninEnglishandinink.

3.2 Qualification

It is understood and agreed that the pre-qualification/registration data onprospectivebiddersistobeusedbyKenyaAssociationofManufacturersindetermining, according to its sole judgment and discretion, thequalifications of prospective bidders to perform in respect to the TenderCategoryasdescribedbytheclient.

3.2.2 Prospective bidders will not be considered qualified unless in the judgment of

KAM they possess capability, experience, qualified personnel available andsuitability of equipment and net current assets or working capital sufficient tosatisfactorilyexecutethecontractforgoods/services.

3.3 EssentialCriteriaForPre-Qualification/RegisteredExperience: Prospective bidders shall have experience in the supply of goods,services and allied items. The potential supplier/contractor should showcompetence,willingnessandcapacitytoservicethecontractatshortnotice.

3.3.2Personnel ThenamesandpertinentinformationandCVofthekeypersonnelforindividualor

grouptoexecutethecontractmustbeindicated.3.3.3FinancialPosition TheSupplier’s financial conditionwillbedeterminedby latest financial statement

submittedwiththeprequalificationdocumentsaswellas lettersofreferencefromtheir bankers regarding suppliers/contractors credit position. Potentialsuppliers/contractorswillbepre-qualifiedonthesatisfactoryinformationgiven.

3.3.5PastPerformance Pastperformancewillbegivendueconsiderationinpre-qualifyingbidders.Letterof

referenceandorcopiesoforder/contractsfrompastcustomersshouldbeincludedinFormPQ-5.

3.4 Statement

Applicationmust includea swornstatementFormPQ-6by theTendererensuringtheaccuracyoftheinformationgiven.

3.5 WithdrawalofPrequalification

Shouldaconditionarisebetweenthetimethefirmispre-qualifiedtobidandthebidopeningdatewhichintheopinionoftheclient/KAMcouldsubstantiallychangetheperformanceandqualificationofthebidderorhisabilitytoperformsuchasbutnotlimitedtobankruptcy,changeinownershipornewcommitments,KAMreservestheright to reject the tender from such a bidder even though he was initially pre-qualified.

3.6 FixedBusinessPremises

ThefirmmusthaveafixedBusinessPremiseandmustberegisteredinKenya,withCertificate of Registration Incorporation/Memorandum andArticle of Association,copiesofwhichmustbeattached.

3.6.1The firmmust show proof that it has paid all its statutory obligations and have

currentTaxComplianceCertificate,whichismandatory.3.6.1 Successful firms will be required to sign supplier code of conduct before being
