Civil Litigation - A Step By Step Look At The Process

Speaker: Dorothe J. Howell, ACP

Civil litigation is a term used to describe the legal process applied to non-criminal matters.This session will discuss in depth each step in the process of a civil lawsuit:1. Initial steps in a civil lawsuit, complaint and answer;2. Motions practice;3. Discovery and pre-trial;4. Trial and judgment;5. Appeals;6. Enforcement.

Each step in the process will be discussed in detail, using examples, forms, practice tips, and most importantly, real life examples as they apply to the role of the paralegal.

Advanced Contracts - Commercial Leases

Course Level: Advanced

This presentation will provide a quick overview of a commercial lease agreement and will focus on the operative portions of the contract. In particular, the presentation will concentrate on drafting skills as they relate to particular provisions of the lease agreement. Prior to the presentation, participants will be asked to draft two provisions of a commercial lease agreement that will be the main focus of the presentation. Participants will be encouraged to share their experiences regarding the drafting process.

An Introduction to Estate Planning

Many people believe that estate planning is only for the rich and famous. Estate planning is not limited to millionaires. Everything that you work hard for over your lifetime deserves attention. The focus of estate planning is not always about the money! You must consider what is appropriate for your family. My favorite phrase is, “Equal and fair are not always the same thing.” My goal is to acquaint you with the basic tools of estate planning, including a will, revocable trust agreement, power of attorney and advance medical directive. I will discuss when tax planning needs to take place for the wealthier estates and how best to accomplish those goals. Bottom line, estate planning is relevant for everyone no matter what you have or who your family members are. Each of these requires proper planning.

This session will cover the most commonly utilized nonimmigrant category that authorizes employment for professional foreign nationals in the United States, the H-1B Petition. This session will also encompass topics such as common obstacles of legal teams, prevailing wage issues, the H-1B cap, and the implications of non-compliance with the U.S. Department of Labor’s H-1B Labor Condition Application.

Not Your Typical Newsletter

This presentation focuses on the key components to putting out a quality newsletter/e-zine that contains relevant and timely information. The goal is to provide attendees with the materials they need to get started on their own newsletter/e-zine or to revamp their current one to increase readership, participation and get rave reviews. Amber Roberts, ACP and Kim Brown, ACP will discuss strategies the Nebraska Paralegal Association (“NePA”) uses to plan its newsletter/e-zine each quarter. Some key factors that will be discussed are the importance of a publications committee, using templates and checklists, getting quality articles and information, relevant and interesting topics, planning the details, and following through on publication. This presentation targets all members of NALA affiliated associations who will benefit from the review and get great tips and tricks to use to publish a newsletter/e-zine that contains relevant information and actually gets read. Examples of NePA’s e-zine can be found at http://nebraskaparalegal.org/membership/ under the In Brief Newsletter heading. We’ll also touch on other types of communication like Facebook, email, etc.

Practicing the Paralegal’s Professional Responsibilities

This session will examine the rules of professional responsibility about candor, confidentially, loyalty, and fairness through hypothetical situations and give participants a chance to apply the critical ethical rules all paralegals need to know and practice.

Questioning Techniques for Depositions

Taking a Deposition is both a science and an art. While so few know how to take great depositions, even fewer receive the kind of training that is needed to ask the right questions. In this session, you will learn the most sophisticated of techniques in how to draft questions that will make any deposer a true star. You will learn innovative information techniques, what documents (in a prioritized fashion) are most useful in crafting questions, how to make a complete battle plan to goal-directed questioning, how to word questions, how to utilize pleadings, discovery responses, exhibits, documents, video/audio, etc. in depositions, anticipating and overcoming objections, among many other techniques. You will learn about questioning techniques, including such things as open-ended, close-ended, exhaustion techniques, warm and cold questions, conversational and other styles/forms. We will also discuss fact v. expert witness depositions and differences and strategies attendant to each of them. We will also address how to prepare your own witnesses, and what mistake lawyers always make, should never make and what always works in depositions.

Raising Capital and Crowdfunding

This presentation will provide an overview of a variety of methods a business may use to raise capital through a private offering. In particular, the presentation will address three specific methods of capital raising: crowdfunding, Regulation D, and Regulation A+. The presentation will introduce attendees to the main features of crowdfunding, Regulation D, and Regulation A+, including the governing regulations and requirements for each type of private offering. It will also compare and contrast the benefits and drawbacks of these types of offerings as a mechanism for raising capital.

The Basics of Trusts

Speaker: Ted H. Miller, Esq.

Course Level: Basic

This session is comprised of three sections. First, the speaker will discuss the basics of trusts. Who makes a good trustee? How do trusts work in everyday life? When do trusts fail? Secondly, the implementation of trusts will be reviewed. Common funding challenges will be analyzed. Fiduciary accounting, trust litigation, and strategies for trust dispute scenarios will be discussed. Thirdly, the speaker will outline drafting challenges and errors which arise in drafting trusts. This session will provide a strong refresher on trusts, but will have substantive intermediate content on the challenges and opportunities that trusts create for clients.

While many lawyers are quite talented, far less have a full understanding of all objections or how to best assert or respond to them. Here, you will acquire the latest understanding of the best (and worst) objections, whether in response to discovery or in depositions or in court. Trap Doors - Real Estate Transfers

Real estate, whether commercial or residential, is full of challenges that are often hard to predict.
